BARGAIN AND SALE DEED WITH COVENANT AGAINST GRANTOR'S ACTS
THIS INDENTURE, made as of the 26th day of March, two thousand and sixteen

party of the first part, and
HENRY KAMINER and RICK! FIER, as Trustees of FIER/KAMINER 2016 TRUST,
each having an address of 95 Charles Street, Unit #5,New York,New York 10014,
party of the second part,
WITNESSETH, that the party of the first part, in consideration of ten($10)dollars lawful
money of the United States paid by the party of the second part, does hereby grant and release
unto the party of the second part, the heirs or successors and assigns of the party of the second
part forever,
ALL that certain plot,piece or parcel of land with the buildings and improvements thereon
erected, situate, lying and being at Cedar Beach, near Southold,in the Town of Southold, County

December 20, 1927 as map number 90,being more particularly bounded and described as
follows:
BEGINNING at a point on the northwesterly side of Midway Road, where the same is
intersected by the division line between lots 139 and 140 on the above mentioned map;
said point being distant 60.39 feet southwesterly as measured along the northwesterly
side of Midway Road from the southwesterly end of the curve connecting the
northwesterly side of Midway Road with the southerly side of Cedar Point Drive West;
RUNNING THENCE from said point or place of beginning along the northwesterly side
of Midway Road the following two courses and distances:
1. South 28 degrees 20 minutes 40 seconds West 6.81 feet;
2. Southwesterly along the arc of a curve bearing to the left having a radius of 250.00
feet a distance of 93.87 feet to the division line between lots 140 and 141;
RUNNING THENCE along said division line North 70 degrees 43 minutes 50 seconds

SAID PREMISES being known as 130 Midway Road, Southold, New York, and designated as
District 1000, Section 090.00, Block 01.00, Lot 008.000.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed from Henry Kaminer and Ricki Fier dated March 25,2016 and intended to be recorded
immediately prior to the recording of this instrument.
TOGETHER with all right, title and interest,if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof;
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in
and to said premises;
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part,the
heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law,hereby covenants
that the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read"parties"whenever the sense of this indenture
so requires.
