THIS IS TO CERTIFY THAT THE FOLLOWING RESOLUTION NO. 2016-632 WAS
SCHEDULED AT THE REGULAR MEETING OF THE SOUTHOLD TOWN BOARD
ON JUNE 14,2016:
RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs
Supervisor Scott A. Russell to execute a retainer agreement with the law firm Sinnreich,
Kosakoff&Messina, LLP to commence a civil action in Supreme Court, Suffolk County,
against Petros Kougentakis regarding Town Code violations, subject to the approval of the Town
Attorney.

Re: Supreme Court Injunction Action (Kougentakis, Petros)
Dear Supervisor Russell:
This will confirm that the Town of"Southold (the "Town") has retained the law firm of
Sinnreich Kosakoff& Messina LLP (the "Firm") to represent the Town in the above-referenced
matter.
The Firm agrees to use its best professional efforts in connection with same, and will
provide your office with copies of all significant correspondence, legal notices, briefs or papers
concerning this matter.
The Firm's legal services will be billed at the rate_of$250.00 per hour for partners and
$200.00 per hour for Associates and "Of Counsel" attorneys. The Town will also reimburse the
Firm fOr all necessary and reasonable disbursements and expenses, without mark-up, including,-
but not limited to, certified mailing expenses and overnight mailing expenses. The Firni will
request..advance:.-.authority from the Town before it incurs any unusual expenses,-such as the
retention of a litigation-consultant or expert witness. - -- . = - -- - - -
. The Firm will bill the Town on a monthly basis and will provide-the Town with a detailed
_description of the services provided and expenses incurred, as well as providing the Town with
an executed claim voucher in the form required by the Town. - } -
Should a dispute arise concerning the fees billed by the Firm for services hereunder, the
Town shall, at its sole option, have the right to dispute any such fees by arbitration pursuant to
the Fee Arbitration Program established by the Chief Administrator of the Courts.

During the pendency of our representation of the Town, the Firm agrees not to bring any
new actions or proceedings against the Town, the Town Board, the Board of Zoning Appeals or
Planning Board.
