Dated ...................................................................... ) x) ) REASON FOR APPEAL A Variance to Section 280A Subsection 3 A Variance to the Zoning Ordinance ~s reque~ed for the mason that Appellant desires to set off a portion of the subject property, creating two (2) lots, one of which would have insufficient lot width under the Zoning Ordinance. Form z]~l (Continue on other side) REASON FOR APPEAL Continued 1 STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary HARDSHIP because Appellant would be unable to divide the subject two-acre parcel of land. 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because a) This is the only "C"-Zoned property in the ir~mediate vicinity, and b) Although the property meets the area requirements of Article VIII~ Section 100-81 of the Zoning Ordinance, the property is unique by virtue of its shape, to wit: the southwesterly half of the property is narrow, and that portion (Lot 1 on survey sub- mitted with this appeal) does not meet lot width requirements~ as the property dimensions were established prior to zoning. 3,, The Variance would obse~e the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because the subject property contains sufficient area to permit the desired set off in this zoning district, and would be in keeping with the spirit of the ordinance and the character of the district in that the lots created would not be undersized, and there would be no change in the ultimate use of the property.
