This application must be filled in by typewriter or ink and submitted to the Building Department with the following:

1. Final survey of property with accurate location of all buildings, property lines, streets, and unusual natural or
topographic features.
2. Final Approval from Health Dept. of water supply and sewerage-disposal (S-9 form).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Sworn statement from plumber certifying that the solder used in system contains less than 2/I0 of 1% lead.
5. Commercial building, industrial building, multiple residences and similar buildings and installations, a certificate
of Code Compliance from architect or engineer responsible for the building.
6. Submit Planning Board Approval of completed site plan requirements.
For existing buildings (prior to April 9, 1957) non-conforming uses, or buildings and "pre-existing" land uses:
1. Accurate survey of property showing all property lines, streets, building and unusual natural or topographic
features.
2. A properly completed application and consent to inspect signed by the applicant. If a Certificate of Occupancy is
denied, the Building Inspector shall state the reasons therefor in writing to the applicant.

Work has been completed at the south east comer floor area of the cottage. New 2" x 8"
floor joists have been installed at 16" o.c. and the flush connections have metal joist
hangers installed. The new 3/4" plywood subfloor will be installed over to complete the
repair of the water damaged area.

To Whom It May Concern:
I have observed the existing conditions at the Cottage and have enclosed a sketch
depicting the area damaged by previous water infiltration.
The work to be completed in this area shall be to sister new 2" x 8" floor joists beside the
existing joists and ins~ll a new ~/d' plywood subfloor. The remainder of the floor area is
in good condition and will have new Y2" CDX plywood installed over the existing
subfloor as an underlayment for new carpet or vinyl flooring.

To expedite the Pre-Existing Certificate of Occupancy application, the owner must
submit records prior to 1957 to show that
the use has continued and not lost its non-conformity, since it was always assessed for
single family use. Please provide records prior to 1957 such as rent receipts and gas or
electric receipts for occupants.
Also provide records for the past three years (to show building has not lost its non-
conformity). These records should be rent receipts, gas and electric bills, or copies of IRS
Schedule E supplementing income for the past three years.

3. That I received title to the subject premises in 1988 from my mother, Edith
Barra. We resided at the premises since 1935.
4. That I know personally that in the late 1940~, my uncle resided in the guest
cottage and we resided in the main house. The use of that guest cottage continued
uninterrupted from the point in time my memory starts in the 1940s to date.
5. That I submit as evidence of the use of the guest cottage certain bills, which are
annexed hereto and made a part hereof.

cottage was in an unsafe and non-habitable condition. A N.Y. State Certified Architect or Engineer
must verify the continued use of this unsafe and non-conforming building.
Please forward this Certification to the Southold Town Building Department so this matter can be
resolved.

Dear Mr. Boufos:
I have had a conversation today with Gary Fish, which was apparently at your instigation.
He has informed me that it is the Building Department's position that the guest cottage at 475
Orchard Street, Orient, New York, is a non-complying building and a non-confirming use.
I am enclosing a copy of your Inspection Report, dated March 11, 2002, which states:
"Small Cottage - Floor System unsafe for habitation use at present. Must be repaired." Mr.
Fish has told me that it is the Building Department's interpretation, today, that such a repair
would violate Section 100-241(a), because it would be an alteration or reconstruction. Then if
the floor is repaired, it would be, in your view, suitable for habitation, but it could not be used
because it would lose its non-conforming status. Mr. Fish also told me that if I obtained an
architect's or engineer's statement stating that the floor was, in fact, safe, I might not get the
Certificate of Occupancy.
Mr. Fish also told me that the Building Department would not reply to me in writing.
I must be missing something. You say that the floor must be repaired, but if it is
repaired, it cannot be used. You also say that if it is not repaired, it cannot be used. This just
doesn't make sense.

Dear Mr. Price:
Regarding your letter dated May 6, 2002 to John Boufis, I find a number of inaccurate statements.
First, the building is a non-conforming building with a non-conforming use, and not a non-complying
building with a non-confirming use as you state in your letter.
Second, I informed you that if the Engineer recommended a replacement of the floor framing (structure)
that a disapproval may be issued according to Section 100-24 (A) as it may be deemed a reconstruction.
As far as your statement that I allegedly said you might not get the Certificate of Occupancy even if the
engineer stated the floor was safe, I have no idea as to any other outstanding issue on this property there
may be.
As far as your statement that the Building Department would not reply in writing is simply not true. I never
said that to you.
I have no idea why you sent such a letter, and am really surprised that you sent copies to the Supervisor,
The Town Board members, the Town Attorney and more.
