'- WHEREAS, a public hearing was held and concluded on March 28, 1985, in the Matter of Appeal No. 3324, for LYNN SCIORA: and WHEREAS, the board bas considered all testimony and documenta- tion entered into the record during the public hearing and since the filing of this application; and WHEREAS, the board members have personally viewed and are familiar with the premises in question, as well as its surrounding area; and WHEREAS, the board made the following findings of fact: l. The property in question is zoned "C-Light Industrial" and contains an area of 12,500 sq. ft., with lO0' frontage along the south side of the Main Road and 125' frontage along the west side of Kerwin Boulevard, Greenport, as shown on site plan dated 12/18/84 prepared by the office of Garrett A. Strang, architect; 2. Existing on the subject premises is a 2,950± sq. ft. building set back approximately three feet from the Main Road and from the westerly property line, and set back approximately 38 feet from the most southerly (rear) property line; 3. Applicant is proposing by this application to construct a bathroom addition of a size 10' by 21', leaving a frontyard setback from Kerwin Boulevard at 51± feet, which appears to be compliance with all other zoning requirements for this zoning district; (CONTINUED ON PAGE TWO) DATED: April 8, 1985. Article VIII, Section lO0-80(B)[13] permits eating and drinking establishments by special exception by the Board of Appeals, as provided by the Bulk Schedule, and subject to site plan approval by the Planning Board; 5. It is noted that the existing building had previously been used as a delicatessen, however, that us6 was discontinued for at least eight years; 6. tt is also noted for the record that a previous appeal was granted under Appeal No. 2679 to Raymond and Anna Ciacia for insufficient area and width of this parcel set off from the parcel identifiied as 1000-53-3-23 and to relocate the one-family dwelling from one onto the other; tn considering this application for a Special Exception use, the board determines: (1) that the use will not prevent the orderly and reasonable use of adjacent properties or of properties in adjacent use districts; (2) that the safety, health, welfare~ comfort, convenience and order of the town.will not be adversely affected by the property use and its location; (3) that the use is in harmony with and will promote the general purposes and intent of zoning since it is a permitted use° In passing upon this application, the considered items (a) through (l) of Article XII~ of the Zoning Code. board has also Section lO0-121(C)[2] Accordingly, on motion by Mr. Grigonis, seconded by Mr. Sawicki, it Was RESOLVED, that a Special Exception for permission to reinstat6 business as a delicatessen to include on-site eating and drinking services in this "C-Light Industrial" Zoning District, BE AND HEREBY IS GRANTED, SUBJECT TO THE FOLLOWING: 1. Planning Board approvals as reqKired by Sections 100'134 and 100-112 of the Code of the Town of Southold; 2. Referral to the Suffolk County Planning Commission p~rsuan~ to Sections 1323, et seq. of the Suffolk County Charter. The former business was that of a delicatessen. The proposed use will include a Coffee/Lunch Counter and several booths as an accessory to the Deli use. This proposed use falls under the catagory of an eating and drinking establishment per the zoning code. This use is only permitted in the C- Liqht Industrial District by a special exception of the Zoning Board of Appeals which is herewith requested.
