WHEREAS, a public hearing was held on October 24, 1985 in the Matter of the Application of FRED SCHOENBAECHLER under Appeal No. 3414, and WHEREAS, the board members have personally viewed and are familiar with the premises in question and the surrounding area; and WHEREAS, the board has considered all testimony and documentation submitted concerning this application, including opposition from property owners in the area and the circumstances of this application~ and WHEREAS, the board made the following findings of fact: 1. The property in question is a corner lot as defined by Article I, Section 100-13 of the Zoning Code, having frontage along Gagen's Landing Road of 120.59 feet and along Clearview Avenue of 178.45 feet, consists of an area of 18,809 sq. ft. and is identified on the Suffolk County Tax Maps as District 1000, Section 70, Block 10, Lot 24. 2. By this application~ appellant requests a Variance to Article III, Section 100-31, Bulk Schedule of the Zoning Code which requires minimum frontyard setbacks to be not less than 35 feet, in order to allow a minimum setback of 26'6" and 31'9" from the easterly front property line, of this principal building. 3. Existing upon the premises is a single-family, two-story structure under construction and situated as shown by survey amended October 23, 1985 prepared by Roderick VanTuyl, P.C. and set back (CONTINUED ON PAGE TWO) DATED: December 4, ]985. Fo~ ZB4 (rev. 12/81) CHAIRMAN, SOUTHOLD TOWN ZONING BOARD OF APPEALS Page 2 - Appeal No. 3414 Matter of FRED SCHOENBAECHLER Decision Rendered November 26, 1985 26'6"at its nearest point to the east front property line (from the garage area), 31'9" from the southeasterly corner of the garage area to the east front property line, 40'2" from the south front property line, 56'10" from the west property line, and 40'9" from the northerly property line. 4. For the record, it is noted that Building Permit #14033Z was issued June 10, 1985 for the construction of a single-family dwelling with setbacks of 40 feet from the east and south front property lines. 5. It is also noted for the record that the following stages of construction have been completed or partially installed: (a) foundation; (b) framing; (c) plumbing; (d) electrical, and reference is made to the verbatim transcript of the October 24, 1985 hearing. In considering this appeal, the board finds that the relief be conditionally granted as noted below: (a) since it is not substantial in relation to the requirements of zoning, being a variance of three feet three inches [3'3"] or 10%; (b) there will not be a substantial change in the character of this district since there appear to be structures within this district with setbacks at 33 feet, more or less, from the front property line; (c) the relief granted will not cause a substantial effect or detriment to adjoining properties; (d) there is no other method economically feasible for appellant to pursue other than a variance; (e) in view of the manner in which the difficulty arose and the percentile stage of construction. Accordingly, on motion by Mr. Douglass, seconded by Mr. Grigonis, it was RESOLVED, that the following relief be and hereby is granted under Appeal No. 3414 in the Matter of the Application of FRED SCHOENBAECHLER: There be a minimum setback from the east front property line at not less than 31'9". Vote of the Board: Ayes: Messrs. Goehringer, Grigonis, Douglass and Sawicki. (Member Doyen of Fishers Island was absent due to weather conditions.) Goehringer Chairman Southold Town Board of Appeals Town Hall Main Road Southold, New York l1971 Re: Appeal No. 3414 - Fred Schoenbaechler Dear Mr. Goehringer: I am in the process of constructing two homes diagonally across from each other at the corners of Gagens Landing Road and Clearview Ave. in Southold. Stakes for the placement of the foundation and elevation of the house opposite Mr. Schoenbaechler's were tampered with. They were removed and replaced in areas a few feet away. These stakes were corrected before the foundation was poured. How- ever, a stake placed by Van Tuyl showing the elevation for the foundation was tampered with and not corrected in time. This resulted in additional blocks added to the foundation at con- siderable cost tobring it up to the proper elevation. When I staked out Mr. Schoenbaechler's house I checked all measurements the evening before the masons set their forms and poured the foundation. They were all at the correct Town setbacEs, i.e., from the corner of the house in question to Gagens Landing Road my measurements were 35'. I was unaware of the problem until a complaint was made to the building dep- artment by someone in the area. When I had the foundation plotted on the survey by Van Tuyl I was amazed thst the house was 8-9 feet closer to Gagens than the original. Since in the 8 years I have been staking out foundations I have never made an error li~e this before and owing to the fact that the sta~es across the street were tampered with I can only cor~clude the same for Mr. Schoenbaech- let's house. There is no way to move this particular home without creat- ing a financial hardship for the Schoenbaechler's. Thank you.
