WHEREAS, a public hearing was held and concluded in the Matter
of the Application for GUY SOBERING on May 2, 1985; and
WHEREAS, the board members have personally viewed and are
familiar with the premises in question as well as its surrounding
area; and
WHEREAS, the board has considered all testimony and documentation
entered into the record in this matter; and
WHEREAS, the board made the following findings of fact:
1. The property in question is located in an "A-80" Residen-
tial and Agricultural Zoning District and is located on the North Side
of Sound Avenue, Mattituck, approximately 1474 feet east of Bergen
Avenue, and is identified on the Suffolk County Tax Maps as District
1000, Section 121, Block 01, Lot 3.1;
2. The subject premises contains a total acreage of 2.911
acres as certified by Howard W. Young, L.S. by survey most recently
dated January 14, 1985;
3. By this application, appellant requests approval: (a)
of proposed Lot #1 of an area of 63,404 sq. ft. with 357.96' frontage
along Sound Avenue and which is improved with a single-family, two-
story house set back at its nearest point from the front property
line 41.6 feet, and (b) of proposed Lot #2 of an area of 63,405
sq. ft. with 198.84' road frontage and which is improved with a
wood-frame structure and concrete foundation, set back 38.6 feet
at its nearest point from the front (south) property line.

4. For the record, it is noted that the premises in question
was the subject of a prior decision rendered by the Board of Appeals
on February 27, 1975 under Appeal No. 2003 restricting the premises
to contain not less than 40,000 sq. ft. in area (which was the
minimum lot area at that time for each lot in a land division).
5. It is also noted for the record that the parcel to the
east of proposed Lot #2 identified as District 1000, Section 121,
Block 01, Lot 3.2, contains 40,000± sq. ft. in area with an
existing dwelling structure (Building Permit #8083Z dated 7/18/75).
In considering this application, the board has determined
that the relief as requested be granted since: (1) the relief
requested is not substantial in relation to the zoning requirements;
(2) the variance will not adversely affect adjoining properties
and will not change the character of the district since the
premises have been used for single-family purposes and no addi-
tional dwelling units would be permitted [except by legislative
action of the Town Board to amend the present zoning regulations],
(3) the circumstances are unique; (4) practical difficulties
are sufficient concerning the circumstances of this and the
prior appeal applications; (5) in view of the manner in which
the difficulties arose, the interests of justice will be served.
Accordingly, on motion by Mr. Goehringer, seconed by
Mr. Grigonis, it was
RESOLVED, that the relief requested under Appeal No. 3339
in the Matter of the Application of GUY SOBERING for approval of
Lot #1 of 63,404 sq. ft. and Lot #2 of 63,405 sq. ft., BE AND
HEREBY IS APPROVED as shown on survey dated January 14, 1985 and
subject to there being no further front or side yard setback
reductions (except as established or permitted by the zoning
ordinance).

RESOLVED that the Southold Town Planning Board offers the
Zoning Board of Appeals the following comments regarding the

The lots proposed are less than the current two-acre
zoning, and there appears to be a house and a foundation already
existing on the property.

The Planning Board reviewed the above mentioned application
at~ the regular meeting of ~anuary 21, 1985.
It was the consensus of the Board that prior to any action
a field inspection will be made.
It was also noted that the lots are under the two-acre requirement,
therefore, an application will have to be made to the Zoning Board
of Appeals. Please see the Building Inspector first for the procedure
for applying to the Board of Appeals.

is requested forthe reasonthat we would like to obtain permission to subdivide into
t~o parcels, each havin~ 63,400+ square feet as per subdivision plan
attached.

REASON FOR APPEAL Continued
1. STRICT APPLICATION OF THE ORDINANCE would produce practicaldifficultiesorunneces-
sary HARDSHIP because the approximately 3 acre parcel in question had been
divided pursuant to a written marital separation agreement between
the applicants Guy and Ruth Sobering entered into on Sept. 16, 1951, and
with a~Memorandum of Agreement filed with the County of Suffolk on the
same date. At that time the zoning in the area was one acre. It was
contemplated that the spouses would each enjoy one half of the property
and exclusive use-and ownership of the dwellings thereon, which had been
before that date and continues to be the pattern of use. Unfortunately,
formal subdivision applicatlon was not made until 1984 whereupon it was
learned that a two acre requirement was in effect.

vicinity of this property and in this use district because
The hardship created by strict application of present zoning require-
ments is unique to this parcel and these individuals and is not shared by
neighboring parcels since the unique utilization of the existing parcel
and dwellings thereon is an outgrowth of the applicants' ubique and
particular personal marital circumstances and, is and has been based upon
the zoning requirements in existence at the time of their marital
separation which would in fact have permitted the utilization herein
requested.
3 The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because the lots created, if the variance were
granted, would be of substantial size (63,400+ Square feet each).
Substantial structures already stand on each of the proposed lot areas
and the utilization of these pre-exlstin~ structures would be in complete
conformity with the existing character of the neighborhood and district.
