Lot 46 is subject to several Covenants and Restrictions. The department has analyzed the building plan to the Covenants and Restrictions (C&R's) and the following findings were made: 1. The approved plat and the C&R's establish a 50 foot setback from the road for Lot 46. a. The proposed building footprint meets the 50 foot setback requirement. The side yards meet the required 15 foot setback. 2. The C&R's and the approved plat identify a conservation easement on Lot 46. No disturbance is permitted within the conservation easement. a. The building footprint, as proposed, will not impact the conservation easement. b. The Town Trustees have mandated erosion control measures to further protect the conservation easement. 3. The C&R's state that clearing of Lot 46 will be limited to 57 percent. a. Calculations indicate that as proposed, approximately 47 percent of the lot area will be cleared. Based upon the above findings, the Planning Board approves the proposed building plan for Angel Shores Lot 46. Box 361 Wading River, NY 11792 RE: 1250 Esplanade, Southold SCTM#88-6-13.48 Dear Mr. Zouman: The Board of Town Trustees took the following action during its regular meeting held on Wednesday,February 20, 2002 regarding the above matter: WHEREAS,JOHN ZOUMAS applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated January 31, 2002, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on February 20, 2002, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS,the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 97 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, 2 NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees approve the application of JOHN ZOUMAS to construct a single-family dwelling with attached two-car garage, deck and driveway, with the condition that gutters and drywells are installed to contain the roof run-off, a snow fence and a staked line of hay bales are installed at the 75' clearing and ground disturbance limit and inspected prior to construction, all as depicted on approved survey last revised September 14, 2001.
