Any other activity within 100' of the wetland boundary requires a permit from this office. This is not an approval from any other agency. There are elements of our May 9, 2017 field inspection with Melissa Silverman present that must be acknowledged as a pre-condition to continued work on this project. They are as follows: 1. The present 13' wide pathway to the dock will be allowed to re-vegetate so that it will be no wider than 4 feet as per previous plans. 2. The cleared area presently used to launch and store kayaks will remain under the strict condition that there will be no further clearing or expansion of the area. 3. The pathway to the bay that exists to the East of the dock presently under construction will be abandoned and allowed to re-vegetate. 4. All necessary inspections for the buried water and electric services to the dock will be completed by appropriate licensed inspectors and copies of same will be provided to the Board of Trustees. 5. All lands seaward of the Board of Trustees designated wetlands boundary will be designated as a non-disturbance area with the understanding that the two fallen tees can h be removed, but no further t her work can h be done in this area without additional Trustee wetland permits. 6. I've attached a very rough sketch of the measurements that I took to accompany, and hopefully clarify,the pictures. Some things that I noticed: 7 of the 20 pilings exceed 8 inch in diameter. There's water and electric at the dock, as well as further north along the path closer to the house. Path is at least 9 feet wide. 16 foot clearing along the leading landward edge of the dock. "Extra" path for kayaks/sailboats through wetlands and spartina is at least 12 feet wide. Clearing has occurred seaward of the flags installed by the Trustees depicting the edge of the wetlands. This site inspection revealed that there has been cutting of vegetation in excess of the 4' width restriction which is as per Administrative Permit#8595A. , Failure to cease all cutting of vegetation on your property may result in a referral to the Bay Constable for legal action. Due to the environmental sensitivity of this site, the Board of Trustees may place additional permit restrictions on this property in order to protect the existing wetlands in question. A number of deficiencies and inaccuracies have become apparent during the review of your application. Accordingly, as noted below your application is deemed incomplete. Upon addressing the following and re-submission of the required information, this office will make a determination of completeness to start the environmental review of your application. • Project plans noted incomplete and/or inaccurate: Sheet #1: Two scales on sheet, neither the V-30' or 1"=50' accurately depicts proposed dock of 105' as it is approximately 1" long on plan reflecting only 30' or 50' of length. Sheet #2: Scale is not accurately reflecting 1"=5'. Sheet #3: Sheet#3 was not submitted with application. Sheet#4: With scale 1"=5', dock scales to 4.5' in contrast to stated width. • The project plans must be by a licensed design professional or marine surveyor. • Project plans must be to a scale of i"=20' or V=30', not smaller. • Project plans must cover the mean high water and mean low low water from said property to the mean high water and mean low low water all the way across Deep Hole creek. • Project plans must incorporate the vessel length, width, and depth (draft) at a minimum of 20'-25' set off from the Suffolk County Department of Public Works maintained channel for Deep Hole creek and Willis creek. • For your information and for the use,of your design professional, we have enclosed the Latitude and Longitude boundaries for the Deep Hole creek and Willis creek dredging projects of the Suffolk County Department of Public Works; along with the associated permits. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions The applicant fails to prove that the action meets the following requirements § 275-11 Construction and operation standards C. 2 (d) of the Southold Town Code: (d) Review and approval of dock applications. Before issuing a permit for a dock structure, the Trustees shall consider whether the dock will have any of the following harmful effects: (1] Whether the dock will impair navigation or be located in areas of high vessel traffic or vessel congestion; A f 1. The proposed dock expansion in relation to opposite shoreline structures is not discussed or shown and therefore an assessment of navigation impairments cannot be made. 2. In addition, Chapter 275 requires that the determination of the length of the dock must include the dimensions of the vessel. The dimensions of a vessel are not specified. 3. An assessment to whether the expansion is consistent with the existing dock line cannot be made. [2] Whether the dock will unduly interfere with the public use of waterways for swimming, boating, fishing, shellfishing, waterskiing and other water-dependant activities, 1. An assessment to whether the expansion would interfere with the use of waterways cannot be made. The endpoint of the dock is not provided on an aerial to assess the seaward prosection. The LWRP does not support the construction of private, dock structures over/in public trust lands and waters. The dock structure will result in the loss of public use of public waters and underwater lands. The LWRP states that "alternatives to long piers or docks include use of dinghies to reach moored boats and mooring in nearby marinas." Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
