They determined that any vegetation (including trees) located landward of the established line of silt fencing and staked hay bales may be removed without applying for a permit. From the line of staked hay bales&silt fencing towards the water(seaward)will require a permit from this office to do any type of landscaping/tree removal/vegetation removal/sod installation/sprinkler installation. We must advise you to also contact the NYSDEC regarding any landscaping modifications to this area as permits may be required from them as well. I hope this answers your question regarding the construction of your new dwelling. Attached are the following documents in order: • Board of Southold Town Trustees Permit 8805 and Related Amendment • Page 3 of the DEC Permit#1-4738-04463 • Approved Site Survey Dated March 28, 2017 1 We need clarification regarding-removing trees which will impede on us buflding the two-story dwelling approved by the Board of Trustees per permit 8805 and the related Amendment. Furthermore, the attached DEC permit requires us to construct the row of stalked straw bales at the edge of the 30ft. buffer or at most 50ft from the tidal wetland boundary. We understand that the Southold Building Department will require the same. As such,to comply with protecting the wetlands we will need to remove trees which are in the path of the stalked straw protection barrier. Please speak to the Trustee to ascertain that permit 8805 provides the inherent authority to remove trees that impede the construction of the dwelling and the wetlands protection barrier. As I have indicated, we have come up against "issues" with the DEC and so have decided to revise our amendment request in a manner that alleviates any "issues" with the DEC. I am sending you as an attachment to this email a new amendment request letter and the Exhibits A, B and C which are referred to in the letter. We are having four originals of an updated survey prepared by Peconic Surveyors, P.C. (referred to as Exhibit D in the letter). Those will be hand delivered to you this week (I am told that they should be delivered on Thursday). As an aside, we are having Peconic Surveyors also address certain questions which the health department raised last week regarding the required distance between the galleys and ST, drains and 1,200 gallon tank. To avoid confusion, I suggest that you simply discard the previous amendment request letter (and everything else that was previously submitted). Please acknowledge receipt of this email and call me on my cell phone (203-253-9890) or email me if there is anything else that needs to be submitted.
