As we discussed, enclosed is a building permit application and "as built" drawings for the bathrooms and kitchens which were constructed after 1957 and prior to 1971. Pursuant to my letter to you on February 24, 2016, I provided three original affidavits of older but very clear minded Southold residents who were personally familiar with the property and could attest to the use of the dwelling as a two family house: • An affidavit of 72 year old Tom Grattan, residing at 2750 Young's Ave, • An affidavit of 88 year old James Rich residing at Wells Avenue, and • An affidavit of 85 year old Raymond Terry residing at 610 Jockey Creek Drive. All these Southold residents believe that the two family use was established prior to zoning, nevertheless, according to the Town of Southold Zoning Ordinance the two family use was permitted after zoning was adopted until 1971, when thereafter the use was permitted by Special Exception. In my letter to you dated March 29, 2015 I attached a copy of the applicable zoning ordinances. The first zoning ordinance adopted April 9, 1957 included 2-family as a permitted use. The two family use continued as a permitted use throughout adopted amendments. In 1965 through 1966 the B zone permitted "dwellings designed for and occupied by not more than four(4) families". Therefore, a two family dwelling continued to be a permitted use under the broader definition until November 1971. Michael Verity Building Inspector April 8, 2016 Page 2 The enclosed "as built" floor plans and your inspection of the condition of the property shows the separate living spaces. The basement shows that the kitchen was constructed with a brick foundation and thereafter the bathrooms were added with a block foundation. The assessment card identifies two significant increased assessment, on 9/7/67 and 3/29/71. The dimensions of the structure on the assessment card are correct. These re-assessments could be the affect of the reconstructed kitchens in 1967 and bathrooms in 1971. Also attached is a 1968 survey prepared by Van Tuyl & Son which shows the house with the kitchens before the bathrooms were added on the north side of the kitchen. In conclusion, the property assessment card, the memory of long time distinguished Southold residents, the Southold Town Zoning Ordinance, a 1968 survey, and architectural drawings support the conclusion that this structure is a two family dwelling established sometime before 1971. The definition of"Multiple Dwelling" in the New York State Multiple Residence Law is three or more units, in addition to hotels and boarding houses. 7.
