Post Permit Sign The permit sign enclosed with this permit shall be posted in a conspicuous location on the worksite and adequately protected from the weather. Page 2 of 6 S. Concrete Leachate During construction, no wet or fresh concrete or leachate shall be allowed to escape into any wetlands or waters of New York State, nor shall washings from ready-mixed cone r-Ile trucks, mixers, or other devices be allowed to enter any wetland or waters. Only watertight or waterproof forms shall be used. Wet concrete shall not be poured to displace water within the forms. 6. No Construction Debris in Wetland or Adjacent Area Any debris or excess material from construction of this project shall be completely removed from the adjacent area (upland) and removed to an approved upland area for disposal.,No debris is pernntted in wetlands and/or protected buffer areas. 7. Storage of Equiprnent,Materials The storage of construction equip ule ht,apd materials shall be confined to the upland area landward of the bulkhead or on a barge. 8. Relationship of this Permit to Other Department Orders and Determinations Unless expressly provided for by the Department, issuance of this permit does not modify, supersede or rescind any order or determination previously issued by the Department or any of the terms, conditions or requirements contained in such order or determination. 3. Applications For Permit Renewals, Modifications or Transfers The pennittee must submit a separate written application to the Department for permit renewal, modification or transfer of this permit. Such application must include any forms or supplemental information the Department requires. Any renewal,modification or transfer granted by the Departinent must be in writing. Storage of Equipment, Materials The storage of construction equipment and materials shall be confined to the upland area landward of the bulkhead or on a barge. 8. As you are aware, it was later determined that the site plan presented the ZBA application, last revised August 1 , 2015, incorrectly depicted the proposed lot coverage of 14.6%. The error was discovered when the applicant's design professional submitted a copy of the amended plan(approved by the NYSDEC on 3/7/2016), to the Building Department, last revised January 2 , 2016, showing the lot coverage as 21.07%. FIND rNGS OF FACT/ REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on August 6,2015, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(J.2)(I). The grant of the amended relief will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed front yard setback on MacDonald Road is more than the existing home footprint. Due to the flood zone this is the only place the new home can be placed to mitigate damage from possible future flooding. This section of MacDonald Road is a dead end and there is only one other home on this road. Several homes have non-conforming setbacks similar to this request. 2. Town Law §267-b(3)(b)t2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant topursue, other than an area variance. However, the home can be moved further from the bulkhead. The applicant's amended survey created more conformity with the code required bulkhead setback of 75 feet. 3. To�wn Law §267-bQ)(b)(3). The variance granted herein for the front yard is mathematically substantial, representing 43% relief from the code for the front yard setback. However, the property is a comer lot with two front yards and the existing home has a lesser setback from MacDonald Road id than the new proposal. The bulkhead setback represents a 50% relief from the code for the bulkhead setback. However, the applicant is moving the dwelling further from the bulkhead to reduce the amount of relief while still maintaining a conforming front yard setback from MacDonald Crossing. 4. TownLaw§267-bL3)(b)(4)—No substantial evidence has been submitted to suggest that the variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 'Me applicant must comply with Chapter 236 of the Town's to Water Management Code. 5. Town Law 267-b(3)(b)(5) The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of constructing a new home while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
