Application of JOHN AND JEANNE BREDEMEYER for a Variance to the
Zoning Ordinance, Article XI, Section 100-119.2 for permission to
locate single-family dwelling structure within 75 feet of ordinary
highwater mark along Orient Harbor. Location of Property: West Side
of Bay Avenue, Orient, NY; County Tax Map Parcel No. 1000-26-1q8.
WHEREAS, publid]hearings were held on August 14, 1986, and
September 11, 1986 in the M~tter of the Application of JOHN AND
JEAN BREDEMEYER under Appeal No. 3533; and
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded; and
WHEREAS, the board has carefully considered all testimony and
documentation submitted concerning this application; and
WHEREAS, the board members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the board made the following findings of fact:
1. The premises in question is a described parcel containing
a total area of 6,300 sq. ft., frontage (lot width) along the
west side of Bay Avenue of 111.67 feet, lot depth along the south-
erly property line 52 feet and along the northerly property line
74 feet.
2. The subject premises is vacant and is more particularly
shown and identified on the Suffolk County Tax Maps as District
1000, Section 26, Block 1, Lot 18.
3. Article XI, Section 100-119.2, sub-paragraph B, requires
all buildings proposed on lots adjacent to tidal water bodies
other than the Long Island Sound to be set back not less than
seventy-five (75) feet from the ordinary highwater mark of such

4. By this application, appellants propose to locate a
22' by 57' single-family dwelling structure with setbacks as
follow: (a) from the front property line along Bay Avenue at
15 feet, (b) from the existing concrete bulkhead at the rear
of the premises at 13 feet, and six feet at its closest point,
(c) from the northerly side at 20 feet and southerly side
at 27 feet. The setback of the garage section of the proposed
structure will be 14 feet from the ordinary highwater mark (rear
property line) at ~ts closest point and 27 feet from the
northwesterly corner of the proposed dwelling.
5. It is noted for the record that: (a) by action taken
May 29, 1986, the Southold Town Trustees approved this project
under Wetland Application #358; (b) letter from the N.Y.S.
Department of Environmental Conservation, TW #15276-0287,
indicates that no permit under Article 25 is required; (c)
the elevation of the lowest floor with utilities, or first
floor, will be not less than nine feet above mean sea level
all as required by Chapter 46 of the Floodplain Law; (d)
Certificate of Occupancy #Z14922 was issued September 30, 1986
by the Southold Town Building Department.
6. It is also noted for the record that relief for
the frontyard setback is not necessary inasmuch as the
setback proposed is the same as the established dwelling
to the south and will meet the requirements of Section 100-33.
7. T~e relief requested is the minimal necessary in view
of the character and dimensions of this lot.
In considering this appeal, the board finds and determines:
(a) that the relief requested is not substantian in relation
t6 those, setbacks generally established in this vicinity; (b)
the practical difficulties claimed are sufficient to warrant
a granting of the relief requested; (c) there will be no
substantial change in the character of the district; (d)
the circumstances are unique; (e) there is no other method
feasible for appellant to pursue other than variances; (f)
that in view of the manner in which the difficulties arose and
in consideration of all the above factors, the interests of
justice will be served by allowing the relief, as conditionally
noted below.
Accordingly, on motion by Mr. Sawicki, seconded by
Mr. Grigonis, it was
RESOLVED, to approve the relief requested under Appeal
No. 3533 in the Matter of JOHN AND JEANNE BREDEMEYER as
applied and depicted by survey revised May 12, 1986 prepared
by Roderick VanTuyl, P.C., SUBJECT TO THE FOLLOWING CONDITIONS:
1. Compliance with the lowest-floor elevation requirement
of the Floodplain Management Law;
2. No fill to be placed in rearyard area which would
extend over the height (at the top) 6f the e~istin~ ~e~ent
bulkhead;
3. No further setback reductions into the westerly rear yard,
the northerly side yard, and east6r]y front yard areas.
4. Total lot coverage for all structures not to exceed 20%
as provided by the Bulk Schedule of the Zoning Code.
Vote of the Board: Ayes: Messrs. Goehringer, Grigonis,

Enclosed is a sketch for a proposed house on Bay Avenue
in Orient. We would appreciate your sending us a notice of
disapproval for any items which do not comply with the Zoning
Code. Although the house is set back only 15 feet from the
street, it is no closer to the street than the houses on the
surrounding properties.

CHAIRMAN GOEHRINGER: On behalf of John and Jeanne Bredemeyer
I have a copy of survey indicating a parcel dated most recent-
ly May 12, 1986, of somewhat rectangular size. It appears it
is approximately 74 feet to the ordinary high water mark on the
north side 102.44 feet on Bay Avenue, 52 feet on the south side
and 110 feet along the bulkhead which faces somewhat due west.
And I have a copy of the Suffolk County Tax Map indicating this
and surrounding properties in the area. Is there somebody that
would like to be heard?
MS. WICKHAM: My name is Gail Wickham and I represent the
Bredemeyers. They have owned this property for many years. This
is the first opportunity they've had to build on it. And unfor-
tunately there have been probably everyi<regutato~yc~hange'<~that
could have been made has been made in the interim that they have
owned the property. The lot is just very small but it appears to
be the last buildable in the area. My client did sketch out and
I'd like to give you a copy of a rough diagram that he's made of
the surrounding properties along the waterfront showing that most
of the houses are located in this type of a position relative to
the Bay. In fact, the Health Department was, in making their ap-
proval, did note that the wells and cesspool for this property
were further from the Bay than any other property with the possi-
ble exception of this farm's next door. Their well is also right
on the front edge of the property. If you have any questions, I'll
try to answer them for you.
CHAIRMAN GEOHRINGER: What is the width of the proposed dwelling?
MS. WICKHAM: The depth is...
CHAIRMAN GEOHRINGER: I'm sorry. I keep referring to it as width.
I know that it really is depth.
MS. WICKHAM: The depth is 22 feet.
CHAIRMAN GEOHRINGER: Ok. And the length.
MS. WICKHAM: 57. That includes the garage.

CHAIRMAN GOEHRINGER: That includes the garage.
MS. WICKHAM: Right. Which is approximately 22 by 22.and that is
a building of 1254 square feet.
CHAIRMAN GOEHRINGER: Right. And that's a two-story structure?
MS. WICKHAM: A salt box.
CHAIRMAN GOEHRINGER: A salt box.
MS.. WICKHAM: Yes. It's a modest size lot. They've designed it
because the lot is small and they didn't want it to stick up like
a sore thumb. I've.seen a rendition of it in this... It's a New
England salt box. I think it will look very nice in the neighbor-
hood.
CHAIRMAN GOEHRINGER: I have a problem with closing this hearing
Ms. Wickham. And I have it because we don't ordinarily deal with
applications in this particular manner; this size configuration.
And we have only recently granted (within the last year and a
half) a building (I won't even call it a dwelling) on a piece of
property similar to this. And it took us a tremendous amount of
time looking at the specific piece of property and understanding
the bulkheading situation, the elevation situation and the over-
all way that a house can and most feasibly will be constructed on
a piece of proporty of this nature. With your client's indulgence,
I'm going to ask the Board tonight not to close this hearing. We
want to look at the one that we did grant and we want to go back
at the same time and look at this specific piece and possibly have
the continuation of the hearing at the next regular scheduled meet-
ing.
MS. WICKHAM: Was that other parcel on the water?
CHAIRMAN GOEHRINGER: Yes.
MS. WICKHAM: Unfortunately they just don't have anywhere to go
as far as the back yard. I can tell you (and you may remember
from your inspection) that that is an old concrete bulkhead. It
has been there for many many years. Mr. Bredemeyer tells me that
when we had these most recent terrential rains, there was no prob-
lem on that lot. There were on in fact, his property which is to
the east of that on the other side of Bay Avenue and many of the
other areas. It's probably actually higher than some of the Orient
property. I have house plans if that would help you.
CHAIRMAN GOEHRINGER: Yes, definitely.
MS. WICKHAM: What they are planning to do around the cesspool area
is to put up shallow, not shallow but low retaining walls to help
bring them up a little bit and retain their fill. And also around

the the foundation area (as we told the trustees who granted a
permit) the slopes would not exceed one foot and three feet.
So that the runoff (any runoff) would not take soil with it.
If there is anything else you want to see, we can certainly help
you.
CHAIRMAN GOEHRINGER: We'll take a copy (definitely) of the plans
with us and within the next couple of weeks we'll go over there
and take a look at this again, together.
MS. WICKHAM: The trustees did not suggest or not suggest, they ~
required that the driveway and parking area be porous construction
so that there would not be a runoff problem and that we take such
matters to prevent runoff.
CHAIRMAN GOEHRINGER: There are no open decks extending out toward
the water or toward the road on this second story?
MS. WICKHAM: No.
CHAIRMAN GOEHRINGER: Ok. We thank you and if you'll supply us
with plans, we'll recess this until...
MS. WICKHAM: We haven't done a grading elevation yet I can see.
Take a look at that. And after your next inspection, Mr. Brede-
meyer is generally down there and maybe he can go over these a
little bit better.
CHAIRMAN GOEHRINGER: Ok. Thank you. Is there anybody else who
would like to speak in favor of the application? Anybody like to
speak against the application? Questions from the Board members?

CHAIRMAN GOEHRINGER: Ms. Wickham is there anything else you
wanted to say? Yes.
MS. WICKHAM: I can always think of two or three. Really very
briefly. I looked at the yard decision which your office gave
to us that you mentioned last time and I just want to make a
couple of comments. Because although that property was in a
C zone, I'd just like to go through it and analyze it briefly
for similiarities. And perhaps we should incorporate that de-
cision number 3118 and survey into the record and I ask that
you do that. That was only a 3,800 square foot lot we're deal-
ing with. We're dealing with a much larger lot. The setbacks
in that case were probably comparable for the lot size of what
we're asking for. There were 4 foot 6 inches on the first floor
and only 2 feet on the deck on the second floor. And it looks
to me that the reasons I would argue, that the appeal was granted
in that case, due appear to apply to the decision. Specifically,
there's really no feasible way for the Bredemeyers to obviate the
need for a substantial variances because the way the property is
conformed. And also, as far as the second reason in that case,
there are similiar circumstances to the adjoining properties.
and in this case, most of the neighborhood. The other reasons
I think are also comparable and they're governmental facilities
not adversely effecting the suggestions and what not. But I
think the reasoning in that case would apply and I ask if you
do have any questions, Mr. Bredemeyer is here and we'll try and
answer them for you.
CHAIRMAN GOEHRINGER: My only question is a cliff hanger. And
that is; how far can you actually reduce the width of the build-
ing and still make it a house?
MS. WICKHAM: Beyond what's proposed now?
CHAIRMAN GOEHRINGER: That's correct.
MS. WICKHAM: Oh Boy. They've really scaled it down. To make it
livable, I think it would be difficult going lower. If you had
any foresight, we would like to hear them. But just for adequate
room size, you have the plans there and that is the type of house
(a small salt box) that they would be planning on building.

MS. WICKHAM: We could go close to the road which is the case
of some of the other properties specifically to the north that
have a house right on the road but I don't think he wants to
do that. He'd rather maintain the setback in the front.
CHAIRMAN GOEHRINGER: Did they apply for a vacant land c.o. also?
MS. WICKHAM: Yes. I think we have one.
CHAIRMAN GOEHRINGER: I didn't see it in the file. It's just
that I would like to have it for part of the record, if you
don't mind.
MS. WICKHAM: I think I have one. If not, Ii'll~get you one.
CHAIRMAN GOEHRINGER: You don't have to give it to me now. You
can send it to me. No I don't think so. Let's see if anybody
else have any comment or discussion. Is there anybody else who
would like to speak in favor of this application? Second time
around. Anybody like to speak against the application? Ques-
tions from Board members? You have anything to say Mr. Douglass?
You've been down there again looking at it. No. Alright. I
guess we'll close the hearing now Ms. Wickham and we thank you

MS. WICKHAM: Mr. Bredemeyer's only comment was he just can't
narrow the house. It's already smaller than...
MR. BREDEMEYER: It's smaller than the other houses in the area.
CHAIRMAN GOEHRINGER: I'm aware of that.
MS. WICKHAM: And the lot is about comparable to thQse. No
that's all.
CHAIRMAN GOEHRINGER: Ok. Thank you. Hearing no further comment,

on the front edge of the property. If you have any questions, I'll
try to answer them for you.
CHAIRMAN GEOHRINGER: What is the width of the proposed dwelling?
MS. WICKHAM: The depth is...

I know that it really is depth.
I keep referring to it as width.
MS. WICKHAM: The depth is 22 feet.

MS. WICKHAM: Right. Which is approximately 22 by 22 and that is
a building of 1254 square feet.
CHAIRMAN GOEHRINGER: Right. And that's a two-story structure?
MS. WICKHAM: A salt box.
CHAIRMAN GOEHRINGER: A salt box.
MS.~ WICKHAM: Yes. It's a modest size lot. They've designed it
because the lot is small and they didn't want it to stick up like
a sore thumb. I've seen a rendition of it in this... It's a New
England salt box. I think it will look very nice in the neighbor-
hood.
CHAIRMAN GOEHRINGER: I have a problem with closing this hearing
Ms. Wickham. And I have it because we don't ordinarily deal with
applications in this particular manner; this size configuration.
And we have only recently granted (within the last year and a
half) a building (I won't even call it a dwelling) on a piece of
property similar to this. And it took us a tremendous amount of
time looking at the specific piece of property and understanding
the bulkheading situation, the elevation situation and the over-
all way that a house can and most feasibly will be constructed on
a piece of property of this nature. With your client's indulgence,
I'm going to ask the Board tonight not to close this hearing. We
want to look at the one that we did grant and we want to go back
at the same time and look at this specific piece and possibly have
the continuation of the hearing at the next regular scheduled meet-
ing.
MS. WICKHAM: Was that other parcel on the water?
CHAIRMAN GOEHRINGER: Yes.
MS. WICKHAM: Unfortunately they just don't have anywhere to go
as far as the back yard. I can tell you (and you may remember
from your inspection) that that is an old concrete bulkhead. It
has been there for many many years. Mr. Bredemeyer tells me that
when we had these most recent terrential rains, there was no prob-
lem on that lot. There were on in fact, his property which is to
the east of that on the other side of Bay Avenue and many of the
other areas. It's probably actually higher than some of the Orient
property. I have house plans if that would help you.
CHAIRMAN GOEHRINGER: Yes, definitely.
MS. WICKHAM: What they are planning to do around the cesspool area
is to put up shallow, not shallow but low retaining walls to help
bring them up a little bit and retain their fill. And also around

the the foundation area (as we told the trustees who granted a
permit) the slopes would not exceed one foot and three feet.
So that the runoff (any runoff) would not take soil with it.
If there is anything else you want to see, we can certainly help
you.
CHAIRMAN GOEHRINGER: We'll take a copy (definitely) of the plans
with us and within the next couple of weeks we'll go over there
and take a look at this.again, together.
MS. WICKHAM: The trustees did not suggest or not suggest, they ~
required that the driveway and parking area be porous construction
so that there would not be a runoff problem and that we take such
matters to prevent runoff.
CHAIRMAN GOEHRINGER: There are no open decks extending out toward
the water or toward the road on this second story?
MS. WICKHAM: No.
CHAIRMAN GOEHRINGER: Ok. We thank you and if you'll supply us
with plans, we'll recess this until...
MS. WICKHAM: We haven't done a grading elevation yet I can see.
Take a look at that. And after your next inspection, Mr. Brede-
meyer is generally down there and maybe he can go over these a
little bit better.
CHAIRM3LN GOEHRINGER: Ok. Thank you. Is there anybody else who

under the provisions of the Wetland Ordinance of the Town of Southold
application dated February 5, 1986, and
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations,

WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on May 29, 1986 at which time all interested
persons were given an opportunity to be heard, and
WHEREAS, the Board members have personally viewed and are familiar
with the premises in question and ti~e surrounding area; and
~HEREAS, the Board considered all testimony and documentation submitted
concerning this application, and
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety, and general welfare of the people of

NOW, THEREFORE, BE IT
RESOLVED, that ~ickham, Wickham & Bressler, P.C. on behalf of John M.
Bredemeyer, Jr. be granted permission under the provisions of the
Wetland Ordinance of the Town of Southold, New York all in accordance
with the application submitted. This permit will expire on May 29,
1987 if work has not commenced by same. The Trustees are to be
notified upon completion of the work.

During construction the following measures could be taken:
1. Driveways and parking areas within 75 ft. of the
Wetlands shall be of porous construction. Blacktop
shall not be used on this site.
2. Care should be taken so as to preclude the entry of any
material resulting during construction from entering
into adjacent waters.
3. Immediately following construction, all areas of exposed
soil shall be properly protected with suitable erosion
control devices and/or'vegetated to stabilize soil,and
prevent the entry of eroded soil into the nearby waters.
A $5.00 ~etland Inspection fee is now due and payable. Upon
remittance your permit will be forwarded by mail.

1. STRICT APPLICATION OF THE ORDINANCE would produce procticaldifficultiesorunneces-

the lot is small and narrow, and it would be
impossible to construct a residence meeting setback
requirements. The lot is the last of its kind in the
neighborhood, which is fully developed with homes having
setbacks and elevations comparable to, and in some cases
even less than, the proposed residence. As to the flood
plain, applicants have lived in the neighborhood for many
years and do not anticipate any flooding difficulty at the
proposed elevation.
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because it is the only lot 1.eft
in this area.
3 The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because the house will be constructed
at an elevation and location comparable to the other
residences along the waterfront.
