WHEREAS, a public hearing was held and concluded on May 22,
1986 in the Matter of the Application of GREENPORT HOUSING ALLIANCE
under Appeal No. 3504; and
WHEREAS, the board members have
familiar with the premises in question,
the surrounding areas; and
personally viewed and are
its present zoning, and
WHEREAS, at said hearing all those who desired to be heard
were heard, and their testimony was recorded; and
wHEREAS, the board has carefully considered all testimony
and documentation submitted concerning this application; and
WHEREAS, the board made the following findings of fact:
1. The premises in question is located along the west side
of Seventh Street, Greenport, more particularly known and referred
to as Lot No, 34, "Map of Greenport Driving Park," filed in the
Suffolk County Clerk's Office as Map No. 369, December l, 1909,
and is identified .Qn the Suffolk~CQunt3 Tax.Maps~as District 1000,
Section 48, Block 3, Lot 16.
2. The subject pr~mises consists of a total area of 4,506
sq. ft~ with 45.07' frontage (lot width) along Seventh Street, and
is presently improved with a delapidated structure set back ll± feet
from its front property line, Kearyard setback of 46± feet, and
sideyards of tO and 20. The structure as exists is unhabitabte

and will be removed and replaced.
3. Proposed to replace the existing structure is a new
single-family dwelling to be set back a minimum of 20 feet from
the front property line, at least 35 feet from the rear property
line, eight feet from the northerly side property line, and ten
feet from the southerly side property line, all as shown by survey
revised May 1, 1986, prepared by Roderick VanTuyl, P.C.
4. The variances requested are: (a) total insufficient
sideyards at t8 feet rather than the required 25 feet, and (b)
insufficient northerly sideyard at eight feet rather than the
required 15 feet. It is the opinion of the board that this
proposal is unique and is not unreasonable~ particularly in
light of the established setbacks of the existing structure.
In considering this appeal~ the board also finds and
determines: (a) the practical-difficulties ct. aimed'are unique
and sufficient to warrant the granting of this variance; (b)
the circumstances are not shared by other properties generally
existing in the neighborhood; (c) the difficulty cannot be
obviated by some method feasible for appellant to pursue other
than ~ variance, particularly due to the narrowness of the lot;
(d) there will be no substantial change in the character of ~he
neighborhood, or detriment to adjoining properties; (e)~hat in
view of the manner in which the difficul'ty arose and in considera-
tion of all the above factors, the interests of justice will best
be served by allowing the variance, as noted below.
Accordingly, on motion by Mr. Sawicki: seconded by
Mr. Douglass, it was
RESOLVED, that the relief requested under Appeal No. 3B04
in the Matter of the Application of the GREENPORT HOUSING ALLIANCE
for reduced total sideyards of 18 feet (~-r--~nd 10') and an ins.lffi-

is requested forthe reasonthat the Greenport Housing Alliance and the Town
of Southold's Community Development Program would ~llke to construct
a new home on this lot for'a middle income family,i The home that
is on the lot is not able to be renovated. (see Photo)

REASON FOR APPEAL Continued
1 STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary HARDSHIP because
of placing a home on this lot due ~o its width (45.07). Many of
the the lots in the Greenport Driving Park Subdivision are small
and it is difficult ~o place an 850 sq. ft. home on these lots
without a variance.
The house will have Greenporc Water and Sewer.
This home will be sold, at cost~ to a Southold Town resident.
2. The hardship created is UNIQUE and is not shared oy aJJ properties alike in the immediate
vicinity of this property and in this use district because
Some of the homes on the Greenpor5 Driving Park map are built on
2 lots (90 x 100). We are not able to obtain additional property.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because
over 50% of the homes in this area
are built on lots that are 45 to 50 feet in width.

DEFINITION OF MARKET V~iiUE: The highest price in terms of money whic~lll~property will bring in a competitive and

assuming the price is not affected by undue stimulus. Implicit in this definition is the consummation of a sale as of a specified
date and the passing of title from seller to buyer under conditions whereby: (1) buyer and seller are typically motivated; (2) both
parties am well informed or well advised, and each acting in what he considers his own best interest; (3) a reasonable time is
· allowed for exposure in the open market; (4) payment is made in cash or its equivalent; (5) financing, if any, is on terms generally
available in the community at the specified date and typical for the property type in its locale; (6) the price represents a normal
consideration for the property sold unaffected by special financing amounts and/or terms, services, fees, costs, or credits
incurred in the transaction. ("Real Estate Appraisal Terminology," published 1975.)
CERTIFICATION AND STATEMENT OF LIMITING CONDITIONS
CERTIFICATION: The Appraiser certifies and agrees that:
I. The Appraiser has no present or contemplated futura interest in the property appraised; and neither the employment to
make the appraisal, nor the compensation for it, is contingent upon the appraised value of the property.
2..The Appraiser has no personal interest in or bias with respect to the subject matter of the appraisal report or the participants
to the sale. The "Estimate of Market Value" in the appraisal report is not based in whole or in part upon the race, color, or
national origin of the prospective owners or occupants of the property appraised, or upon the race, color or national origin of the
present owners or occupants of the properties in the vicinity of the property appraised.
3. The Appraiser has personally inspected the property, both inside and out, and has made an exterior inspection of all
comparable sales listed in the report. To the best of the Appraiser's knowledge and belief, all statements and information in this
report are tree and correct, and the Appraiser has not knowingly withheld any significant information.
4. All confingent and limiting conditions are contained herein (imposed by the terms of the assignment or by the undersigned
affecting the analyses, opinions, and conclusions contained in the report).
5. This appraisal report has been made in conformity with and is subject to the requirements of the Code of Professional
Ethics and Standards of Professional Conduct of the appraisal organizations with which the Appraiser is affiliated.
6. All conclusions and opinions concerning the real estate that are set forth in the appraisal report were prepared by the
Appraiser whose signature appears on the appraisal report, unless indicated as "Review Appraiser." No change of any item in
the appraisal report shall be made by anyone other than the Appraiser, and the Appraiser shall have no responsibility for any such
unauthorized change.
CONTINGENT AND LIMITING CONDITIONS: The certification of the Appraiser appearing in the appraisal report is
subject to the following conditions and to such other specific and limiting conditions as are set forth by the Appraiser in the
report.
1. The Appraiser assumes no responsibility for matters of a Iegal nature affecting the property appraised or the title thereto,
nor does the Appraiser render any opinion as to the title, which is assumed to be good and marketable. The property is appraised
as though under responsible ownership.
2. Any sketch in the report may show approximate dimensions and is included to assist the reader in visualizing the property.
The Appraiser has made no survey of the property.
3. The Appraiser is not required to give testimony or appear in court because of having made the appraisal with reference to
the property in question, unless arrangements have been previously made therefor.
4. Any distribution of the valuation in the report between land and improvements applies only under the existing program of
utilization. The separate valuations for land and building must not be used in conjunction with any other appraisal and are invalid
if so used.
5. The Appraiser assumes that there are no hidden or unapparent conditions of the property, subsoil, or structures, which
would render it mom or less valuable. The Appraiser assumes no responsibility for such conditions, or for engineering which
might be required to discover such factors.
6. Information, estimates, and opinions furnished to the Appraiser, and contained in the report, were obtained from sources
considered reliable and believed to be true and correct. However, no responsibility for accuracy of such items furnished the
Appraiser can be assumed by the Appraiser.
7. Disclosure of the contents of the appraisal report is governed by the Bylaws and Regulations of the professional appraisal
organizations with which the Appraiser is affiliated.

is requested forthe reosonthat the Greenport Housing Alliance and the Town
of Southold's Community Development Program would like to construct
a new home on this lot for a middle income family. The home that
is on the lot is not able to be renovated. (see Photo)

REASON FOR APPEAL Continued
1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary HARDSHIP because
of placing a home on this lot due to its width (45.07). Many of
the the lots in the Greenport Driving Park Subdivision are small
and it is difficult to place an 850 sq. ft. home on these lots
without a variance.
The house will have Greenport Water and Sewer.
This home will be sold, at cost, to a Southold Town resident.
2. The hardship created is UNIQUE and is not shared by oil properties alike in the immediate
vicinity of this property and in this use district because
Some of the homes on the Greenport Driving Park map are built on
2 lots (90 x 100). We are not able to obtain additional property.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE
CHARACTER OF THE DISTRICT because
over 50% of the homes in this area
are built on lots that are 45 to 50 feet in width.
