Application of JOHN AND JOYCE HOLZAPFEL for a Variance from the
Conditions rendered under Appeal No. 2784 dated 10/15/81 (and 688
dated 7/9/64) and/or to waive the improvements required under Appeal
No. 2784 concerning Private Road #10 known as "Old Woods Road"
located at the east side of South Harbor Road, Southold, NY~ iden-
tified on the Suffolk County Tax Maps as District 1000, Section 87,
Block 1, Lot 23.1, and approving access pursuant to New York Town
Law, Section 280-a, from the east side of South Harbor Road to the
premises in question, identified on the Suffolk County Tax Maps as
District 1000, Section 87, Block 1, Lot 23.8.
WHEREAS, public hearings were held on January 9, 1986, February 6,
1986 and March 13, 1986, at which time the hearing was concluded, in
the Matter of the Application of JOHN AND JOYCE HOLZAPFEL under Appeal
No. 3432; and
WHEREAS, the board members have personally viewed and are
familiar with the premises in question and the surrounding area; and
WHEREAS, the board has considered all testimony and documentation
submitted concerning this application; and it is noted for the record
that there has been submitted for the record a petition in
support of the application by seven property owners in the
immediate area; and that there has been no public opposition
entered into the record concerning this application~ and
WHEREAS, the board made the following findings of fact:
1. The property to which appellant is requesting approval of
access to is located in an "A-80" Residential and Agricultural Zoning
District known and identified on the Suffolk County Tax Maps as
District 1000, Section 87, Block 1, Lot 23.8, containing a total
area of 2.709 acres, and located along the north side of the
private right-of-way in question, known and referred to as "Old
Woods Road," or Private Road #10.

2. The right-of-way in question exten
of South Harbor Road, Southold, in an easterl direc£-
tion a distance of 600± feet to the premises of the applicants.
The width of the traveled portions of the right-of-way is eight
feet for the first 170 feet; the southerly side is heavily wooded
with trees close to the southerly edge, allowing an upper clear-
ance of ll feet; and along the northerly side are old logs used
as a curb to protect the existing fence (along property presently
of Olenick, 1000-87-01-001). The remaining width widens out to
a minimum of 12 feet and is compacted dirt.
3. Although the traveled portion of the right-of-way is
better condition than as existed in 1981, when a conditional
variance was granted on October 15, 1981 under Appeal No. 2784
(Robert T. Bayley), it is the opinion of this board that some
improvements are necessary to provide suitable access required
by New York Town Law, Section 280-a, for emergency and other
vehicles (as noted below).

4. For the record, it is also noted that there is a prior
variance of record under Appeal No. 688 granted July 9, 1964.
5. It is also noted for the record that this 280-a variance
with conditions is not to be recognized as approval of access for
any other lots which may subject to 280-a updated approval in the
future, or any future set-off divisions or subdivisions, unless
so recommended in writing by the Building Inspector and filed
with the Office of the Board of Appeals.
In considering this appeal, the board determines: (a)
the relief requested is not substantial in relation to the
requirements; (b) there will be"no substantial change in the
character of this district; (c) the relief as conditionally
granted will not cause a substantial effect or detriment to
adjoining properties; (d) the circumstances of this appeal are
unique and there is no other method feasible for appellants to
pursue other than a variance; (e) in view of the manner in
which the difficulty arose, and the new circumstances, justice
will best be served by allowing the variance, as conditionally
noted below.
Accordingly, on motion by Mr. Douglass, seconded by
Mr. Goehringer, it was
RESOLVED, that relief be and hereby is granted in the Matter
of the Application of JOHN AND JOYCE HOLZAPFEL for approval of
access as required by New York Town Law, Section 280-a, SUBJECT
TO THE FOLLOWING CONDITIONS:
1. That there be a minimum open and unobstructed access
width of 10 feet to be paved with two inches [2"] of compacted
stone blend, and potholes filled, for the first 170± feet; and
2. That there be a minimum open and unobstructed access
width of 12 feet to be paved with two inches [2"] of compacted
stone blend, and potholes filled, for the remaining length, to
the premises of the applicants herein.
3. That a written request to the Office of the Board of
Appeals be furnished upon completion of the above conditions
as to acceptance of the improvements in accordance herewith.
Vote of the Board: Ayes: Messrs. Goehringer, Douglass,
Doyen, Grigonis and Sawicki. This resolution was duly adopted.

wooded and has trees very close to the road, allowing

Department and Superintendent Raymond Jaeobs of the Southold

This section does not allow safe l~ssa~e of the large water
truek of the Fire De~artaent nor the snow plow trueks of
the Southold Town Highway Department.
It is recommended that a field servey of the initial 170'
be made by a lielenoed land surveyor to determine the exact
loca%ion of the 18' right-of-way in this eeetlon. It is
also reoo~eended that a 1~' wide road be built in this area
in accordanee with the previoes speeifieations ~oted for this
road ~oted in the A~Deal No. 2?85 of of Robert T. Bayley.

We are writing this letter to apply for a variance of
Town Law 280-a which requires us to make major improvements
to the road to our house. This road is known as Dirt Road
~10 or 01d woods Path.
The road is used by eleven homes, five of which are
occupied by summer residents.
The road has been used for over fifty years and has been
regularly maintained by all the residents. We own
absolutely none of the rosd and the residents who own the
rosd wish it remain as it is . Large garbage trucks and
large cement trucks have used it frequently and we believe
that the road bed and drainage is good, and will allow
emergency vehicles to travel along it. ~
Since we received our building permit with a 280-a
notation,three building permits have been issued without the
280-a notation and two certificates of occupancy have been
issued.
Again , we are asking a variance so that we do not
have to improve the road.

8:40 p.m.
PUBLIC HEARING: 8:40 p.m. Appeal No. 3432. Public Hearing was
held in the Matter of JOHN AND JOYCE HOLZAPFEL. Variance for relief-
waiver from conditions of Appeal No. 2784 rendered 10/15/81 concerning
improvements to right-of-way known as "Old Woods Road," Southold, to
their premises identified as 1000-87-1-23.8.
The Chairman read the legal notice of hearing and appeal applica-
tion for the record.
MR. CHAIRMAN: I have a copy of a survey dated September 23, 1984
from Robert A. Kart, surveyors in Riverhead, indicating a 2.7096 acre
parcel, and we are talking about the egress and ingress to this
particular parcel. And I have a copy of the Suffolk County Tax Map
indicating this and surrounding properties in the area. Are the
Holzapfels present?
JOHN HOLZAPFEL: Yes. My wife as at the dentist today and she's
at home. The basic problem and just to explain it to you is that we
built the new house, when we built the new house, we found about the
280-a. We went to the neighbors and what actually happened, we came
to the board, and we were put under an old variance, And that old
variance was supposedly not to be. We weren't allowed to use the old
variance, so we're reapplying for a variance not to have to improve
the road in terms of 280-a. The road as it exists has been there for
at least 50 years from the neighbors who lived there. There are
four fulltime residents on the road. There are four summer residents
on the road. We owned absolutely none of the right-of-way. The
people who do own the right-of-way are not interested in putting
gravel down on the road, because they don't want people going very
fast on the road. It's a small private road, and they don't want
to bring more people in, and they don't wa~t to bring people in
going faster. So we had asked them about 6 months ago. Sent
letters out to everybody, and buy and large it was an unanimous
decision that they didn't want to put gr.avel down. We offered it
as a suggestion. Since then yearly what happens is that the owners
of the properties get together, and once a year they have to place--
grade it--and that has been sufficient for everybody as far as I
could tell for a number of years. That's the basic. It's used
by big trucks regularly, and you can get in and out. The Huricane
happened to open the sides of the road a little bit more, and the
brush has been cleaned back so that it's even more opened than it
.was before.
MR. CHAIRMAN: To answer your question, or --not to answer, but
to make a statement I should say, concerning this--we are primarily
concerned since we are all firemen also on this board, about emergency
access. I will admit to you for the record that in my present view of

the particular road, and I just refer to the picture again because
had taken that picture about two weeks ago. The road is in much
better condition than the original application of way back in 1981.
The potholes had been filled. The road is fairly smooth, and the
next question is will the town engineer certify the road to meet
those specific qualities. In other words, will the road sustain
emergency vehicles 12 months of the year. We've had a fairly dry
winter so far--meaning no --why I am trying to say basically is,
there have been no snow plows running up and down digging up the
right-of-way. The other issue is the thaw in the Springtime area,
and that's primarily the most serious time when a right-of-way is
affected. We have a little bit of a problem at this particular
moment that we don't have our usual town engineer, who has been
ill for the winter months, and recently had an operation. So we
are going to, Mr. Holzapfel, have to reschedule this hearing after
an evaluation by him. I don't think there will be any timeliness
involved. We'll probably recess it until the next regularly
schedule meeting and hopefully in the interim he will be able to
go out and tell us if he feels that this right-of-way meets the
minimum specifications. As you know the right-of-way, all right--
I'll mention it again for the record--the right-of-way was in
much worse condition when the town engineer had looked at it
back to the 1981 application. That might have been the reason he
asked for or recommended the improvements that we therefore
couched in our decision. At this particular time, I havwe also
asked the chief of the Southold Fire Department to take a truck
up your road and make sure that he is happy with the width, size
and so on and so forth of the road; and he is, I assume, going
to answer me by letter or by telephone call some time in the very
near future. I had called him last weekend. So at this particular
time, I will ask if anybody else has any comments just so you know
what the situation is. It'll be about a two-week delay before we
get a chance. We have an environmental period in here anyway, so
we couldn't make a decision for 15 days. So we haven't shceduled
the next meeting in February, but it will be some time in the early
part of February or late part of this month, and we will attempt
to get either the regular typical engineer that we have or another
gentleman from Greenport to give us an evaluation on the road, and
hopefully we'll have that in our record at that Lime. Ok?
MR. HOLZAPFEL: Will I be notified then in terms of coming to
the meeting et cetera?
MR. CHAIRMAN: Yes, either that or you can give us a call
within the next couple of weeks.

As recent owners of County Tax Map Parcel number
1,000-87-1-23.8, we are seeking relief on Town Law 280 a as
discussed in appeal # 2784 rendered Oct. 15, 1981. We are
requesting to improve private road # 10 which extends from
South Harbor Road to our property - a distance of
approximately 600 feet. We would find it a hardship to
widen the present road due to the fact it would require the
removal and relocation of a number of neighbor's fences.
We would find it very uncomfortable to move into a
neighborhood where we would have to ask neighbors to move
their fences that have existed for many years. If the
relief is granted the improvements on the road made by us
would be a benefit for our neighbors and the Town.
We are high school science teachers and also adjunct
professors at Suffolk County Community College and we intend
to make our permanent and only residence on this property.
We plan to build a single family residence that would
produce no substantial change in the character of the
neighborhood if this relief is granted.
We would like to give you an outline of what we have
done in acquiring the land.
We had been searching for a historic home in the
Southold area for the past two years. When we were unable
to find a suitable home, we then decided to buy land and
reproduce a"new" historic home, modeled after a 1700-
Southold home that we had seen but was unavailable for
purchase. We then began looking for property to build.
After spending several months, we decided on the
Stewart parcel. It took another 6-8 weeks of investigating
covenants, getting surveys and obtaining Lilco estimates
while also contacting several builders for bids. We decided
on Mr. Robert Tacke who has great experience in building
colonial home reproductions. We took much time with him
planing and adapting "new" house plans to the original
authentic colonial we saw in Southold. We hope to maintain
the historic flavor of our home by using authentic
materials.
We found a purchaser for our present home in Wading
River in September. These people were willing to wait
until April to move in thus providing us with the time to
build our home.
During the end of November, our builder submitted our
plans to the Health Department for approval. He received a
letter indicating a D.E.C. permit would be required to
proceed any further. We contacted and met with the D.E.C.
and a permit was granted after gathering the additional
surveys,pictures, house plans and sending a covering letter.
This required another 3-4 weeks. Immediately after receiving
the D.E.C. permit in January we closed on the property and
our builder reapplied to the Health Department. Last week,
the Health Department okayed the plans and our builder went
to the Building Department.
After the closing on the land we were given a folder of
information by the real estate broker which we looked at
over the weekend and saw something that referred to Town Law
280 a We called the Town and on Tuesday Jan. 17 went to
the Planning Department for further information. At this
time, John meet our builder submitting our plans. We
eventually found out that the Zoning Board Of Appeals has
jurisdiction over this matter. After meeting with Linda on
Thursday, she explained that we should write a letter
detailing our hardship and seeking relief from Town Law 280
a.
We have worked very hard in obtaining as much
information as possible. We are not developers and only wish
to make our permanent residence in Southold on this 2.8 acre
piece of property. If we cannot build our home , it seems
that no one will be able to do anything with the property.
We have invested our savings in the purchase of this
property as well as sold our present home, which we must
move out of by April. We want very much to build our home
in the area but would find it a great hardship for two
people to have to carry out the task of resurfacing and
widening the road as indicated in appeal #2784. We fully
understand the necessity of having good road access for
emergency vehicles and are willing to do something to
improve the conditions of the present road.
We are people of limited means but are willing and
anxious to do whatever we can to meet the needs of the
community.
After speaking with Linda on Thursday January 19, we
went to private road number 10 and found to the best of our
ability considering the snowfall a width of 9-11 feet at the
narrowest points of the road. It is questionable in our
minds, if it is possible to even widen the road beyond its
present width without causing severe hardship and
inconvenience on the present property owners adjacent to the
road. We personally do not want to cause any problems for
these people. We understand you are aware of the present
road condition.
Immediately on Friday January 20 , we contacted our
builder and asked him about possible solutions to the road
improvement. Over the weekend,he was able to get an
estimate and was told that a 10 foot wide road of 600 feet
to a depth of 3 inches of 3/4 inch stone blend would cost
approximately two thousand dollars. It was also suggested
to us that the possibility of smoothing the road with a
grader and filling in any low areas might suffice and meet
the needs of the Town requirements. We would be willing
take on such an improvement at our expense.

If the above is acceptable, we would like to ask for a
conditional variance . Considering the winter months and
the influx of construction vehicles, we would like to
perform the work on the road during the last phases of house
construction. If authorized to do this we would like our
builder to start right away. The granting of a certificate
of occupancy could be held up until the road improvements
are made.
We appreciate your time and consideration in this
matter. We are sure you can understand our great need for
this relief and would appreciate any consideration that you
can give at this time. We certainly hope you can help us in
some way resolve our great difficulty.
