WHEREAS, a public hearing was held and concluded on May 22, 1986
in the Matter of the Application of MARJORIE D. PETRAS under Appeal
No. 3497; and
WHEREAS, the board members have personally viewed and are
familiar with the premises in question~ its present zoning, and
the surrounding areas; and
WHEREAS, at said hearing all those who desired to be heard
were heard, and their testimony was recorded; and
WHEREAS, the board has carefully considered all testimony
and documentation submitted concerning this application; and
WHEREAS, the board made the following findings of fact:
I. By this application, appellant requests permission to
construct addition to an existing dwelling which will exceed the
maximum lot coverage as provided by Article III, Section 100-31,
Bulk and Parking Schedule of the Zoning Ordinance, from 20% to
26.7% as shown on survey prepared by Howard W. Young revised
May l, 1986.
2. The addition proposed, without the proposed deck
area, has an area of 882 sq. ft. The proposed deck would have
an area of 141 sq. ft. The total percentage of lot coverage
as exists is 17%, or 1469 sq. ft. The percentage of relief
requested over the maximum 20%, or 1728.2 feet, is approximately
30% of a variance from the requirements, or 578.95 feet (over).

southerly side of a private right-of-way referred to as "Koke
Drive" containing an area of 8,641 sq. ft. [exclusive of
the "Koke Drive" right-of-way] and frontage (lot width) of
100 feet as depicted on the May 1, 1986 survey of Howard Young
and deed at Liber 6605 cp 104 dated August 8, 1969. The
subject premises is improved with a single-family one-story
frame house set back 28.6 feet from the front property line
(along the south side of the right-of-way), set back 27.6 feet
from the bulkhead along Corey Creek, and having sideyards of
8.4 feet on the west side and 19.8 feet on the east side.
Also existing is an 8.2' by 10.2' framed accessory shed,
which applicant has not included as part of the relief re-
quested since the shed will be permanently removed.
4. Submitted in support of the application additionally
is a revised survey of May 19, 1986 by Howard W. Young which
includes one-half of the 30' right-of-way. Appellants claim
that an additional 1,050 sq. ft., (10' by 105') should be
included in the total lot area for a total of 11,231 sq. ft.,
based on the subdivision map of the "Koke Estate" prepared
by Otto VanTuyl, L.S. which shows a 50-foot wide right-of-way.
However, in further reviewing these documents, it appears
the parcel in question as shown on the "Koke Estate~ subdivision
map is of a size 100' by 100' (exclusive of a 50' right-of-way).
This would give a total depth of 125 feet, rather than a total
depth of 137 feet (127 + l0 feet) in applicant's claim~
Although the ownership of this right-of-way appears undisputed,
this board must view the total lot area as that described in.
the applicant's deed and title documents, exclusive of the area
within the 50' right-of-way, which is unbuildable.
5. For the record it is noted there is a conditional
variance rendered under Appeal No. 2090 November 6, 1975,
concerning the location of an accessory building in the front-
yard area 25 feet from the front property line, which
applicant has agreed to void and which structure has been
eliminated from the relief requested by this application.
In considering this appeal, the board also finds and
determines: (a) that the relief requested is not unreason-
able and is not substantial in relation to the zoning require-
ments; (b) there will be no substantial change in the
character of the area; (c) the circumstances of this parcel
are unique; (d) the practical difficulties are sufficient
to warrant the granting of the relief requested; (e) there
is no other method feasible for appellant to pursue other
than a variance; (f) in view of the manner in which the
difficulties arose and in considering all the above factors,
the interests of justice will best be served by allowing
the variance, as noted below.
Accordingly, on motion by Mr. Goehringer, seconded by
Mr. Sawicki, it was
RESOLVED, that a variance for permission to construct
addition for a maximum of 26.7% lot coverage, or 2307 square
feet, in the Matter of the Application of MARJORIE D. PETRAS
under Appeal No. 3497, BE AND HEREBY IS APPROVED SUBJECT TO
THE FOLLOWING CONDITIONS:

1. Permanent removal of the existing accessory shed in
the frontyard area and automatic termination of the variance
rendered November 6, 1975 under Appeal No. 2090;
2. Total lot coverage, including all structures, shall

A Variance to Section 280A Subsection 3
A Variance to the Zoning Ordinance
is requested for the reason that
Appellant would be unable to construct the proposed addition to
dwelling as it creates a total lot coverage which exceeds that
permitted under the zoning ordinance, and creates total side yard
set-backs of .3 feet less than required.

Appellant would be unable to make the desired improvements to
residence~ which are designed to enhance her property and to
compliment the surrounding neighborhood°
2. The hardship created is UNIQUE and is not shared by oH properties af[ke in the immediate
vicinity of this property and in this use district because
The survey submitted herewith indicates a lot area of 8~641 sq~ fto~
which is an unusually small lot in the Town of Southold. The zoning
ordinance permits 20% lot coverage~ which computes to 1~728.20 sqo
ft. The total proposed building area is 2~307 square feet~ creating
excess coverage of 578.8 sq. ft~ or 6.7%. 388.85 sq. ftc of this
construction will be decking, reducing the actual lot coverage by
vertical structures to 22.2%. The zoning ordinance permits a total
side yard set-back of 25 feet° This property is irregularly shaped
(slightly pie-shaped), because of this the southerly portion of the
proposed building area creates side yard set-backs which total 24°7
feet, .3 feet less than required.
3. The Variance wouJd observe the spirit ofthe Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because
The 6.7% lot coverage variance and the ~3 foot side yard set-back
variance requested are both minimal and will not create a substantial
visual change in the character of the district~ keeping in mind that
4.5% of the excess coverage is decking. It observes the spirit of the
ordinance in that the lot coverage proposal of 26.7% and the side yard
set-back proposal of 2~o7 feet are by no means grossly excessive~

Dear Ms. Moore:
As per your letter of 4/29/86, please be advised that we have
performed a special search of the records of the County Clerk
regarding premises shown on the Suffolk County tax map as
1000-87-5-6 as shown on the survey of Young & Young, dated 4/1/86.
Specifically we examined the southerly one-half of the Right of
Way adjacent to said premises. Title to said Right of Way was
owned by Adelheid Koke and Alexander Koke by deed in Liber
4175 cp 319. There is a chain of title from Koke to your
client Marjorie Petras f/n/a Marjorie Craig in Liber 6605 cp
104. In said deeds the actual description only covered the
premises as shown on said map. However, each deed contained
the standard one half street clause. Based upon said
language we are of the opinion that Marjorie Petras, f/n/a
Marjorie Craig is the fee owner of one half of the Right of
Way adjacent to her premises subject to the easement rights
of others. I trust this is satisfactory for your purposed.
Our bill is enclosed.

hereinbelow providing you with a recomputation of the proposed lot
coverage.
Survey of Young & Young dated May 19, 1986, (computed using ownership
to center line of 30 ft. right of way) shows a total lot area of
10,181 sq. ft.
The actual total lot area (computed using ownership to center line of
the actual 50 ft. right of way) is 10,181 sq. ft. plus an additional
1,050 sq. ft. for a Total Lot Area of 11~231 sq. ft. 20% of this lot
area is 2,246 sq. ft.
The proposed lot coverage breaks down as follows:
Proposed addition 882 sq. ft.
Existing deck 246 sq. ft.
Proposed deck 141 sq. ft.
Existing house 1,044 sq. ft.
Total proposed coverage: 2,313 sq. ft.
Less permitted 20%: 2,246 sq. ft.

1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sory HARDSHIP because
Appellant would be unable to make the desired improvements to her
residence, which are designed to enhance her property and to
compliment the surrounding neighborhood.
2. The hardship created is UNIQUE and is not shored by oil properties alike in the immediate
vicinity of this property and in this use district because
The survey submitted herewith indicates a lot area of 8,641 sq. ft.,
which is an unusually small lot in the Town of Southold. The zoning
ordinance permits 20% lot coverage, which computes to 1,728.20 sq.
ft. The total proposed building area is 2,307 square feet, creating
excess coverage of 578.8 sq. ft. or 6.7%. 388.85 sq. ft. of this
construction will be decking, reducing the actual lot coverage by
vertical structures to 22.2%.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because
The 6.7% variance requested is minimal and will not create a ~
substantial visual change in the character of the district, k~eping in
mind that 4.5% of this excess coverage is decking. It observes the
spirit of the ordinance in that the lot coverage proposal of 26.7% is
by no means grossly excessive.

part of the consideration for the issuance of .the Permit does understand and prescribe to the fol-
lowing:
1. That the said Board of Trustees and the Town of Southold are released from any and
all damages, or rialtos for damages, of suits arising directly or indirectly as a result of any opec-
ation performed pursuant to this permit, and the said Permittee will, at his or her own expense,
defend any and all such suits initiated by third parties, and the said Pecmittee assumes fur liability
with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold
2. That this Permit is valid for a period of 12 mos. which is considered to be the
estimated time required to complete the work involved, but should drcomstances warrant, request
for an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permit;tee wishes
to maintain the structure or project involved, to provide evidence to anyone concerned that auth-
orization was originally obtained.
4. That .the work involved will be subject to the inspection and approval of the Board or
its agents, and non-compliance with the provisions of the originating application, may be cause for
revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repess along
the beach between high and low water marks.
7. That if future operations of the Town of Soufl~old require the removal and/or alterations
in the location of the work herein authorized, or if, in the opinion of the Board of Trustee% the
work shall cause unreasonable obstruction to free navigation, the said Permlttee will be required,
upon due notice, to remove or alter this work or project herein stated without expenses to the Town
of Southold.
· 8. That the said Board will be notified by the Permittee of the completion of the work auth-
orized. - -
9. That the Permittee will obtain all other pennits and consents .that may be required sup.
plemental to this permit which may be subject to revoke upon failure to obtain same.
