WHEREAS, a public hearing was held and concluded on February 6,
1986, in the Matter of the Application for ANNA PACIFICO under Appeal
No. 3383 filed July 18, 1985; and
WHEREAS, the board has considered all testimony and documentation
entered into the record concerning this application; and it is noted
that public opposition has been received as noted in the verbatim
transcript of the hearing and record concerning this matter; and

1. The property in question is identified on the Suffolk County
Tax Maps as District 1000, Section 53, Block 05, Lot 034, consisting
of a total lot area of ]9,062 sq. ft. with 110 ft. frontage along the
south side of Blue Marlin Drive at Arshamomaque, Greenport, NY, and
is known as Lot #13 on "Map of Southold Shores" filed August 29, 1985,
File No. 3853~
2. By this application, appellant requests Variances for the
construction of an addition to the rear of the house consisting of
a wooden deck, fence enclosure,~pool, and gazebo: (a) with
minimum total s~deyards at 14.8 feet [which is established at the

west side, and the east side, a zero setback [and 1.8' building
eaves encroachment onto the neighboring property]; (b) with a
total lot coverage of 24% for a total of 4610 sq. ft. in area;
(c) with a setback of not closer than 43 feet from the wood bulk-
head and 49 feet to the high water mark [52± feet from the pool
wall to highwater mark].
3. Article III~ Section ]00-31, Bulk Schedule of the Zoning
Code requires a minimum sideyard setback at the easterly side at
15 feet (and minimum at the west side at l0 feet), a minimum total
sideyard area at 25 feet, and a maximum of 20% lot coverage for all
structures.
4. Article XI, Section ]00-119.2 of the Zoning Code requires
"...all buildings located on lot~ adjacent to tidal water bodies...shall
be set back not less than sevenTy-five (75~) feet from the ordinary
highwater mark of such tidal water body or not less than seventy-five
(75') feet from the landward edge of the tidal wetland, whichever is
greater ..... '~
5. It is the opinion of this board that the practical
difficulties demonstrated are not sufficient to warrant a grant-
ing of all the variances requested; however~ a reduction of the
square footage to 500 sq. ft. over the 20% maximum-permitted of
the zoning code (or 43122 9q- ft. total), and a reduction of the
east sideyard setback to ]6' 8" at the northeast corner of the
existing deck (allowing a 3' d'eck) and 7x at the southeas~t
corner of the existing deck (as exists), and a straight line
drawn on an angle connecting these two points (to allow a walk-
way fro~ the east side of the dwelling to the pool ~and deck
area in questioh)~ would not be unreasonable under the circum-
stances.
In considering this appeal, the board finds and determines:
(a) that the relief as requested i.s substantial in relation to
the zoning requirements~ being a variance of 20% over the
requirement for total lot coverage~ being ~ore than 35% of a
variance from the sideyard requi~rementsl and being a variance
of more than 40% of the wetland-setback requirements; (b)
that a reduction as decided herein is not unreasonable under
the circumstances; (c) that there is no other method feas~ible
for appellant to pursue other than a variance; (d) that the public
health, welfare~ safety, order and convenience of the town will
best be served by allowing the variances as amended by this board;
(e) that by allowing the variances as amended by this board, a
substantial change would not be created in the c~aracter ofthis
neighborhood; (f) that the spirit of the zoning ordinance and
the interests of justice will best be served by granting the
variances as amended and noted below.

I. That the northeast corner of the deck be reduced to
a minimum setback of 16'8" from the property line to allow for
a walkway/deck of three feet in width, and that a straight angle
be cut (connecting the northeast corner to the southeast corner
of the deck) to a minimum of 7' from the property tine at the
southeast corner (to allow for a walkway to the pool and rear
deck areas from a side entrance of the dwelling)~
2. That the total lot area ~ver the maximum-permitted
20% (3812 sq. ftc) shall not exceed BOO sq. ftr, for a total

is requested for the reason that we would like toobtain permission for construc-
tion of an addition to rear of house consisting of wooden deck,
and fence around a pool and a gazebo that lack the necessary
side yard setback and distance from the house due to the fact
that DEC required me 5o install pool 65 feet landward of tidal
wetlands.

REASON FOR APPEAL
Continued
I. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary HARDSHIP because the property is located on Peconic Bay and subject to the
regulations of the Department of Environmental Conservation. I was required to
install my pool measuring 15X36 feet a minimum of 65 feet landward of tidal
wetlands as shown on the attached survey. A permit was obtained from DEC
and the pool installed. Because of the DEC requJrements the pool is located only
15 feet from the rear of my house. The area was subsequently completely landscaped
and a ground level wooden deck was constructed for access to the pool A gazebo
was also built as part of the deck and ls one foot ever the property line on the
East which property is owned by Southotd Shores Associatiom The work is completed
at a cost of approximately St:hO00.
The hardsmo created is UNIQUE and is nat snarea Dy all properties alike in the immediate
vicini~ of this property and in this use district because
the property is a corner iot surrounded
by Blue Water Drive on the North, Peconic bay on the South and vacanz land
on the East which is owned by Southold Shores Association. The entire deck including
the gazebo and pool is approximately 2#00 sq. ft. which Together with the dwelling
(3812.6 sq. ft.) amounts to approximately 5~00.'sq. ft. which is iust about 29%
of the lot coverage. There is empty land on 2 sides of the house which will always
remain empty.
3 The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because of the waterfront nature of the area. There
are marinas and inlets throughout Southold Shores and the coverage of the lot
area does not affect anyones property or change the character of the district.
You can not build either to the South or the East of the house and the pool area
and deck can not be seen from the street. To the best of my knowledge there
is no objection from anyone as to the continued use of my pool and deck. I believe
the house and deck are tastefully built and adds to the improvement of the neighborhood.

In reference to the above and in furtherance of conversation had with your secretary
yesterday, I forward to you an amended Notice of Disapproval from the Office of
the Building Inspector.
Please note that we would like to amend our application to include a variance for
wetland set-back, Article XI, Section 100-119-2B concerning the location of the
swimming pool. Approval for construction of the swimming pool was granted by
the DEC as noted in my application.
Mr. Hindermann also makes reference to the Wetlands Ordinance~ Chapter 97~ Article
II~ Section 97-20. I am presently requesting a determination from the Trustees whethe
we require their approval. The area is bulkheaded and we are optimistic nothing further
will be .required by them.
If you require additional information or have any questions concerning this application,

Supplementing my letter to you of the 19th, please be advised we
have complied with the required notice to neighbors and adjacent
property owners and proof service has been filed with your
office.
At this time I am submitting three (3) copies of the survey dated
August 26, 1985 from ?econic Surveyors & Engineers, P.C. setting
forth all the requirements you requested in your letter of July 19,
1985 in items (a), (b) and (d).
In reference to item (c) of the same letter, please be advised
that I spoke to Mr. Hindermann and he indicated that he considered
the gazebo as part of the deck and not a separate addition. He
indicated that he would discuss this matter with your office so
that item (c) could be eliminated from the requirements.
I am waiting for a response from his office concerning the balance
of your letter referring to Article XI, Section 100-119.2 of the
Zoning Code.

On August 8, 1983, the Building Inspector of the Town of
Sc,,thold ialuld Building Permit No. 1246Z to Gaetano Rague& to
"construct a one family dwelling" at defendant's premises located
at 1250 Blue Marlin Drive, 8outhold, New York (Suffolk County Tax
Map ~esignationl District 1000~ Section 05?, Block 01, Lot 34).
On or about Septe~ber 13, 19B4, CURTIS W. HORTON, a Building
Inspector of the Town of So~thold caused an ir~lpection to be
performed on the premiles owned by Anna Pacifico and f~andl th~
defundent was using and occupying the one family dwelling on the
aforesaid premisel without first obtaining a Ce=t.~ficate of
Occupancy from the ~uilding Department of the Town of 8outhol~.
On September 13, 1984~ CURTIS W. HORTON, else found the defen-
dant had constructed an above ground porch (wood duck) a building
{enclosed bar), an outdoor fireplace, and an in ground sw~m~_/.ng
pool w~thout first obtaining a Building Permit f=om the Bull~/J~g
Department of the Town of Southold. Portions of ~he above g~ound
porch (wood dlck) and building (enclosed bar) are located in the
easterly side yard area of the defendant,s property an~ are les~
than three (3) fee~ from the easterly lot line of defendant,s
property~ allc=ontrary to the prov~sions of the Code of the Town
of Southo~d in such case made and provid~d.
FACTS

enclosed with any fence or gate all contrary to the prov~liOnl Of
the Code of the Town of Southold in such case made and provided.
The above allegations of fact are made by the Complalltant
herein on direct knowledge and upon information and belief with
the sources of the Complainantes information and th~ gounds for
his belief being facts contained in the files of the Building
Inspector of the Town of Southold.

This letter is being directed to you with the assumption
that you are the attorney for the applicant, Anna Pacifico.
In reviewing the application which was filed late
yesterday afternoon, the board requested the following
information which is necessary at this time before site
inspections by the board:

new construction under consideration at its nearest
and farthest points to the side line and the setback
of the fence to the rear property line and wood
bulkhead at its nearest point;
copy of Notice of Disapproval concerning the gazebo
and any other construction which was not disapproved
under the July 12, 1985 Notice of Disapproval by
Building Inspector Hindermann, if these structures
are to be considered in this appeal;
please indicate on survey the exact setback of
both side yards, and indicating the total sideyards
[code requires l0 and 15, for a minimal total of 25
principal buildings].

It has also been noted that the setback of the fence and pool
from the high water mark is less than 50-75 feet from the highwater
mark (and bulkhead), and additional appl.ications may be necessary
pursuant to Article XI, Section 100-119.2 of the Zoning Code.

as to their position under 100-119.2, and please let us know
whether or not you wish to amend your application accordingly.

REASON FOR APPEAL
A Variance to Section 280A Subsection 3
A Variance to the Zoning Ordinance
is requested for the reasonthat we would like to obtain permission for construc-
tion of an additon to rear of house consisting of wooden deck, and fence
around a pool and a gazebo that lack the necessary side yard setback
and distance from the house due to the fact that DEC required me to
install pool 65 feet landward of tidal wetlands.

REASON FOR APPEAL Continued
1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary HARDSHIP because the property is located on Peconic Bay and subject to the
regulations of the Department of Environmental Conservation. I was required to
install my pool measuring l$X36 feet a minimum of 65 feet landward of tidal
wetlands as shown on the attached survey. A permit was obtained from DEC
and the pool installed. Because of the DEC requirements the pool is located only
15 feet from the rear of my house. The area was subsequently completely landscaped
and a ground level wooden deck was constructed for access to the pool. A gazebo
was also built as part of the deck and is one foot over the property line on the
East which property is owned by Southo]d Shores Association. The work is completed
at a cost of approximately $13,000.
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because
the property is a corner lot surrounded
by Blue Water Drive on the North, Peconic bay on the South and vacant land
on the East which is owned by Southold Shores Association. The entire deck including
the gazebo and pool is approximately 2400 sq. ft. which together with the dwelling
(3812.6 sq. ft.) amounts to approximately 5500 sq. ft. which is just about 29%
of the lot coverage. There is empty ]and on 2 sides of the house which wi]] always
remain empty.
3 The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
C~tARACTER OF THE DISTRICT because of the waterfront nature of the area. There
are marinas and inlets throughout Southold Shores and the coverage of the lot
area does not affect anyones property or change the character of the district.
You can not build either to the South or the East of the house and the pool area
and deck can not be seen from the street. To the best of my knowledge there
is no objection from anyone as to the continued use of my pool and deck. I believe
the house and deck are tastefully built and adds to the improvement of the neighborhood.

GENERAL
t. The permittee shall file in the office of the appropriate Regional
Permit Administrator, a notice of intention ID commence work at leasl 4a
hours in advance of the time of commencement and shall also notify him
promptly in writing of the completion of the work.
2. The permitted work shall be subject to inspection by an authorized
represenlalive of the Department of Environmental Conservation who may
order the work suspended if the public interest so requires.
3. As a condition of the issuance of this permit, the applicant has ac-
cepted expressly, by Ihe execution of the application, the full legal respon-
sibility for all damages, direct or indirect, of whatever nalure, and by whom.
ever suffered, arising out DJ the Ixoject described herein and has agreed to
indemnify and save harmless the State from suits, actions, damages and
costs DJ every name and description resulting from the said project.
4. Any material dredged in the prosecution of the work herein permitted
shall be removed evenly, without leaving large refuse piles, ridges across the
bed of the waterway or flood plain or deep holes that may have a tendency to
cause injury to navigable channels or to the banks of the waterway.
5. Any material to be deposited or dumped under this permit, either in
the waterway or on shore above high-water mark, shall be deposited or dumped
at the locality shown on the drawing hereto attached, and, if so Ixescribed
thereon, within or behind a good and substantial bulkhead or bulkheads, such
as will prevent escape of the material into the waterway.
6. There shall be no unreasonable interference with navigation by the
work herein authorized.
7'. That if future operations by the State of New York require an alteralion
in the position of the structure or work herein authorized, or if, in the opinion
of the Department of Environmental Conservation it shall cause unreasonable
obstruction to the Jree navigation DJ said waters or flood fl~w~.or endanger
the health, safety or welfare DJ the people of the State, or loss or destruction
of the natural resources of the State, the owner may be ordered by the Deparl-
ment to remove or alter the structural work, obslructions, or hazards caused
thereby without expense to the State; and if, upon the expiration or revocation
of this permit, the structure, fill, excavation, or other modification of the
watercourse hereby aulhorized shall not be compleled, the owners shall,
without expense to the State, and to such extent and in such time and manner
as the Department of Envlronment,~l Conservation may require, remove all or
any portion of the uncompleted ~lructure or fill and restore to its former
condition the navigable and flood capacity of the watercourse. No claim shall
be made against the State of New York on account of any such removal or
alteration.

CONDITIONS
8. That the State of New York shall in no case be liable for any damage
or Iniury Io the structure or work herein aulhorized which may he caused by or
result from future operations undertaken by the State for the conservalion or
improvement of navigation, or for other purposes, and no claim or right to
compensation shall accrue from any such damaBe.
9. That if the display of lights and signals on any work hereby authorize~
is not otherwise provided for by law, such lights and signals as may be pre-
scribed by the United States Coast Guard shall be inslalled and maintained
by and at the expense of the owner.
10. All work carried our under this permil shall be performed in accor-
dance with established engineering practice and in a workmanlike manner.
11. If Rranted under Arlicles 24 or 25, the Department reserves Ihe right
to reconsider this approval at any time and after due notice and hearing to
continue, rescind or modify Ihis permit in such a manner as may be found ID
be just and equitable. If upon the expiration or revocation Of this permit, Ihe
modification of the wetland hereby authorized has not been completed, the
applicant shall, without expense to the State, and to such extent and in such
time and manner as the Department of Environmental Conservation may ~equire,
remove all or any portion of the uncompleted structure or fill and restore the
site to ils former condition. No claim shall be made against the Slate of New
York on account of aoy such removal or alteration.
12. This permil shall not be construed as conveying to the applicant any
right to trespass upon the lands or interfere with the riparian rights of others
to perform Ihe permitted work or as authorizing the impairment of any rights,
title or interest in real or personal property held or vested in a person not a
party to the permit.
13. The permittee is responsible for obtaining any other permits, ap-
provals, [ands, easements and rights-of-way which may be required for this
project.
14. If granted under Article 36, this permit is granted solely on the basis
of the requirements of Article 36 of Ihe Environmental Conservalion Law and
Part 500 of 6 NYCRR (Construction in Flood Plain Areas huvlog Special Flood
Hazards - Building Permits) and in fiD way signifies that the project will be
free from floo~ing.
15. By acceptance of this permit the permtttee aRrees that the permit
is contingent upon strict compliance with the special conditions on the
reverse side.
