Ordinance, Article III, Section 100-31, Bulk Schedule, for approval of
insufficient area, depth and width of three parcels referred to as Lots
No. 1, 9 and 1u, Map of Bayside Terrace, Southold, NY; Lot No. 1 located
along t~e south side of North Sayview Road, and Lots No. 9 and 1u located
along the east side of Summer Lane; County Tax Map District 1000,
Section 78, Block 9, Lots 1 and 16.
WHEREAS, a public hearing was held and concluded on May 22,
1986 in the Matter of the Application of JOSEPH AND ANN PAUELLI under
Appeal No. 3485; and
WHEREAS, the board members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, at said hearing all those who desired to be heard
were heard, and their testimony was recorded; and
WHEREAS, the board has carefully considered all testimony
and documentation submitted concerning this application; and
WHEREAS, the board made the following findings of tact:
1. The premises in question is shown on the Filed Map of
"Bayside Terrace, tiled March 11, 1953, No. 2034, as Lots #1, 9
and 10; and is more particularly identified on the Suffolk County
Tax Maps as District lO00, Section 78, Block 9, Lots I and 16.
County Tax Map Lot #1 comprises only one subdivision lot, #1,
containing an area of 17,119 sq. rt. and improved with a single-
family dwelling. County Tax Map Lot #16 comprises two subdivision
Lots, ~9 and 10, presently vacant and containing an area of
2z,058 sq. ft.
2. The total lOt area of the entire premises is 39,17! sq.
ft. and fronts along three streets: (a) 132.08 feet along the
east side of Cedar Lane; (b) 243.70 feet along the south side of
North Bayview Road; (c) 194.40 feet along the west side of
Summer Lane.

3. ~y this application, appellants request approva~ of
The insufficient lot area, depth and width of three parcels as
existed during 1953 and shown by the Subdivision Map of Bayside
Terrace, as follows: (a) Lot #1 bt 17,11~ sq. ft. in area,
1~2.08' along Cedar Lane, and ~21.85 teet along North Bayview
Road [a corner ~ot]; (b) Lot #2 of ~2,~58 sq. Tt. in area,
12~.85 feet a~ong North Bayview Road and 114.~0 feet along
Summer Lane La corner lot]; and (c) Lot #3 of 9,600 sq. ft.
in area, 80 feet along Summer Lane, and ~20 Teet deep.
4. Submitted for the record are: (a) copies of the
County Tax Map highlighting similar circumstances of at least
two other properties on this block, although identified on
the Suffolk County Tax Maps as one merged lot; (b) copy of
Health Department accepting three parcels as existed on the
Bayside terrace Subdivision Map; (c) response from the
Southold Town Planning Board.
5. Article III, Section lO0-31, Column A-80 requires a
minimum lot area of 80,000 sq. ft.; Column A-40 requires a
minimum lot area of 40,000 sq. ft. The parcel as a whole
containing 39,177 sq. ft. meets 50% of the ~ot area require-
ment. The parcels as proposed herein vary meeting between
12% and 22% of the lot area requirement~ which ~s in the
board's opinion requires a substantial variance (of 88% to
78%).
6. It is the board's determination that the relief
for three parcels is denied; however, as an alternative,
the board approves two tots with insufficient area as shown
on the Suffolk County Tax Maps: (a) 100u-78-9-1, or Lot
#~ of ~7,119 sq. Tr. in area, 12~.85 feet of lot depth,
132.08 feet oz lot width~ and (b) 1000-78-9-16, or Lot #2,
of ~1,998 sq. ~t. in area, 120± feet lot depth, ~94.40 teet
in width.
In considering this appeal, the board finds and
determines that in reducing the number of lots requested
from three to two: (a) the relief requested will be the
minimum necessary; (b) the circumstances are unique;
(c) there are practical difficulties sufficient to warrant
the granting of this relier; (d) there will be no substan-
tial change ~n the character bt the neighborhood or
detriment to adjoining properties; (e) the ditficulty
cannot be obviated by some method ~easible for appellant
to pursue other than a variance; (f) the variance will
not in turn cause a substantia~ effect of increased
population density or be adverse to the safety, health,
welfare, comfort, convenience and order of the town; (g)
that in view of the manner in which the difficulty arose
and ~n consideration of all the above factors, the inter-
ests of justice will best be served by allowing the variance,
as conditionally noted below.

AND HEREBY IS APPROVED SUBJECT TO THE FOLLOWING CONDITIONS:
1. This variance is not to be considered an approval of
the three lots requested;
2. This variance is limited to not more than two lots
as more particularly shown and identified on the Suffolk County
Tax Maps as District 1000, Section 78, Block 9, Lots #1 and #lb.

New construction must conform with the requirements
"A" of the Bulk and Parking Schedule of the Zoning

Dear Mr. Goehringer:
In reference to the above appeal and in furtherance of your request at the hearing, my
office conducted an examination of the area in question and the current tax maps to
determine if any homes have been constructed on any lot other than single lots.
It appears that all homes built in this area have been constructed on only single build-
ing lots. Enclosed is the following documentation:
l. Current tax map showing tax lots I thru 25 on Cedar Drive
and Summer Lane, a total of 23 lots.
2. Property owners list extracted from tax records.
3. Plat map of Bayside Terrace reflecting filed map lot numbers
and Tax map numbers.
Lots 4 and 5 owned by Robert & 3eannie Gazzola were merge and now reflected on
the tax map as lot 5.1 and remains vacant.
Lots Il and 12, owned by 3oanne Doering, were merged and now reflected on the tax map
as lot 13.1 and is also vacant.
Lots 9 and 10, owned by the applicants, were merged and now reflected on the tax map
as lot 16. Apparently, lot No. I (where house is) remained as a separate tas lot as
evidenced by the attached separate tax bills.
All of the merged lots, namely lots 5.1, 15.1 and 16 are vacant.
Lots 6 and 15 on the plat may (tax lots 6 and Il) owned by Delmar & Constance Nuhfer~
did not merge and apparently lots 13 and 14 on the plat may (tax lots 12 and 13) also
did not merge as they are listed separately on the tax map, although , in fact, they might
be considered to be merged if they applied for a building permit. In any event, lots 15
(tax lot 11) and lot 14 (tax lot 12) remain vacant.
All the remaining lots have single familyresidences on them. All the lots on the east
side of Summer Lane (lots 17 thru 26 on the tax map) are single lots and are either
vacant or contain single family residences.

I would like to point out that lot 17 (tax lot 9) is owned by 3ack and Karin Thilberg~
while the adjacent lot 16 (tax lot [0) is owned only by Mrs. Karin Thi]berg and yet
these lots are considered separate and distinct. There is a houseon lot 17 and lot 16
is vacant and lot 16 can be legally sold and a one family house can be constructed on
it. The same would appear to be true for the Gadomski property (lots 13 and ]4)
and the Nuh:[er property (lots 6 and 15).
I trust that this is the information that you requested, It would appear that the
granting of the relief requested would be in keeping with the character of the neigh-
borhood and within the spirit of the law.
