Application of THE QUIET MAN INN for a Variance to the Zoning
Ordinance, Article VII, Section 100-71, Bulk Schedule, for permission
to construct addition in this "B-l" General Business Zoning District
with an insufficient frontyard setback from the westerly property
line along Hobart Avenue. Property Location: Corner of Main Road
and Hobart Avenue, Southold, NY; County Tax Map Parcel No. 1000-
62-3-7.
WHEREAS, public hearings were held on April 23, 1987, May 21,
1987, September 10, 1987, and October 8, 1987, in the Matter of the
Application of QUIET MAN INN under Appl. No. 3593, and
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded; and
WHEREAS, the Board has carefully considered all testimony
and documentation submitted concerning this application; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the Board made the following findings of fact:
1. The premises in question is located in the B-1 General
Business Zoning District more particularly identified on the
Suffolk County Tax Maps as District 1000, Section 62, Block 3,
Lot 7, containing a total area of 4,008 sq. ft.
2. The subject premises is a corner lot as defined by
Section 100-13 of the Zoning Code with frontage of 63.50
feet along the south side of the Main Road and 97.99 feet
along the east side of Hobart Avenue.
3. The subject premises is improved with one two-story
framed building as shown by survey mapped February 13, 1987
by Roderick VanTuyl, P.C. with setbacks: (a) from the front

property line along the Main Road at 1.2 feet; (b) from the
west (front) property line at 24± feet; (c) from the south
[rear] property line at 21± feet; (d) from the east [side]
property line at 2.3 feet, all at the closest points.
4. By this application, appellant requests a Variance
from the Provisions of Article VII, Section 100-71, Bulk
Schedule, for permission to construct one-story addition to
the existing building in line with the northerly (front)
property line, extending 10 feet wide into the westerly
(front) yard area, extending 57.5± feet in length the full
10-ft. width, and thence extending 12 feet in length along
an angle parallel with the westerly property line [see
Sketch A-3 prepared by V. Regi Weile, Architect, submitted
under this application].
5. Article VII, Section lO0-71, Bulk Schedule, of the
Zoning Code requires a minimum: (a) frontyard setback at
35 feet; (b) sideyard at 25 feet~ (c) rearyard at 35
feet.
6. The setback requested under this variance is a reduction
from 14½± feet at the southwest corner to 4½± feet from its clos-
est point from the westerly front property line [see Sketch A-3
prepared by V. Regi Weile, Architect].
7. The addition is proposed to extend the kitchen floor
area and seating floor area as more particularly shown on Sketch
A-7 prepared by V. Regi Weile Architect, for the placement of
six two-seat tables.
8. Several parking plans have been considered for a total
of four parking spaces and a variance for the insufficient
parking is being considered separately under Appl. No. 3659
and rendered same date hereof.
9. The total seating capacity claimed by the appellant
is 26 at tables and 12 at the bar. Section lO0-112(A) of the
Zoning Code provides at least 1 for each 5 seats in an eating-
and-drinking establishment. The Southold Town Planning Board
has determined that a total of nine parking spaces are required
to satisfy the Site-Plan requirements under Article XIII. The
premises as exists without the addition provides for five
parking spaces, for this established business and second-story
single-family apartment use.
10. The present square footage of the first-floor area
is shown to be 1292 sq. ft. of which approximately 750 sq. ft.
has been utilized for the bar and table seating. The remaining
square footage has been utilized as kitchen area, lavatories
and stair wells [see Sketch A-6].
ll. Also noted for the record are the following documents:
(a) Certificate of Occupancy of Nonconforming Premises #Z16245
issued October 2, 1987, (b) copy of letter dated September 25,
1987 from Roderick VanTuyl, P.C., Surveyor, concluding that
no more than two vehicles could be accommodated in any arrange-
ment of diagonal parking allowing the normal 10' by 20' for
each space; (c) letter dated July 21, 1987 from the Building
Inspector indicating the occupancy load at 57 persons (both
standing and seating).
12. It is the opinion of this Board as follows:

(a) the amount of relief requested is substantial in
relation to the requirements, at 87+ percent of the
requirement and at 70± percent reduction of that established
[at the closest point];
(b) the difficulties created have been existing for
many years and the owners/operators purchased the existing
business and premises during the period of time these
zoning requirements have been in effect;
(c) an extension of the subject building would add to
an existing dangerous intersection and would create serious traffic
hazards with the reduction of on-site parking spaces and backing
out onto Hobart Avenue;
(d) the circumstances of the property are unique;
(e) the relief requested is not the minimal necessary;
(f) the test as to "significant economic injury" and
"practical difficulties" has not been satisfied as required
law,
by
(g) in view of the manner in which the difficulties arose
and in view of all the above factors, the interests of justice
would not be served by granting the variance as applied.
Accordingly, on motion by Mr. Sawicki, seconded by
Mr. Douglass, it was
RESOLVED, to DENY the relief as applied under Appl.
No. 3593 in the Matter of QUIET MAN INN for a 10-foot wide
extension to existing building with reduction of frontyard
setback off Hobart Avenue.
Vote of the Board: Ayes: Messrs. Goehringer, Gri§onis,
Douglass and Sawicki. (Member Doyen of Fishers Island was
absent.) This resolution was duly adopted.

1. STRICT APPLICATION OF THE ORDINANCE would produce practical dlfficultiesor unneces-

a]Expansion and upgrading of Kitchen is required to meet Code and Insurance
.Laws necessary in order to re-activate Restaurant aspect pf The Quiet Man Inn
as a Tavern and Restaurant.

table space to insure investment of Ki:tchen installation expense. Interior
clear width is presently 18'. Addition is proposed for an additional lO'width.

Dear Mr. Goehringer:
Pursuant to the requirements of Sections A 14-14 to 23 of the Suffolk
County Administrative Code, the Suffolk County Planning Con~nission on
3anuary 13, 1988, reviewed the above captioned applications and after due study
and deliberation Resolved to disapprove them because of the following reasons:
1. It constitutes the unwarranted overintensification of use/development
of premises;

It would tend to necessitate use of the adjoining roadways for parking
purposes adversely affecting the safety and traffic carrying capacity of
said roadways; and,
It would tend to establish a precedent for similar land development
patterns in the locale along N.Y.S. Rte. 25.

Dear Mr. Gilbert:
Thank you for the cooperation during the fire inspection of
Quiet Man Inn on July 13, 1987. The occupancy load of your
establishment is 57. This figure is shown on the occupancy
certificate which is to be posted in a conspicuous location
in the public area of your tap room.
During the inspection the following were noted and should be
corrected as soon as possible.
There are combustible materials stored too close to the
heater in the basement. They shall be moved a minimum of
three feet away from the burner.
The rear exit through what used to be the kitchen is a usable
exit as long as the kitchen is unused. The exit path must be
kept clear at all times. This door shall be open any time
that you are open to the public.
A exit sign shall be installed by the front door.

The lock on the front door must be proper. A lock that
allows any body to lock the door with out the manager knowing
is not proper. The turn bolt shall be replaced by a keyed
lock or be removed. The lock in the handle shall be rendered
so that it will not lock the inside handle or be removed.
There shall be no hardware that will impede egress at any
time.
Extension cords shall not be used to replace fixed wiring.
There shall be a minimum of one (1) set of emergency exit
lighting positioned so a~ to illuminate the exit paths in
case of power interruption. All emergency Iiqhts must be
proper operating condition at ali times.

In the event that you do not have a building peri, it for
renovations within the next thirty (30) days the following
changes will be necessary.
There shall be an illuminated exit sign over the back door.
The door shall be equipped with emergency egress hardware
that will not impede exit at any time. Solid bars, bolts,
locks, or any hardware that stops egress through the door at
any time is illegal and not permitted.
The unused kitchen appliances shall be removed.
The kitchen space will be thoroughly cleaned, including
patching holes in the walls and ceilings. Storage in this
area shall be limited to those supplies necessary for day to
day operation, but in no case shall storage materials
decrease the exit path below a minimum of four feet. A
barrier shall be placed so that exiting patrons cannot go
down stairs by accident.
There shall be an illuminated exit sign over the front door.

Dear Mr. Farrell:
Thank you for the cooperation during the fire inspection of
the Quiet Man Inn on July 9, 1985.
The occupancy load of the Quiet Man Inn is 49. The
certificate must be posted and protected so it is visable at all
times by the general public and any inspecting agency.
Copies of the following certificates will be required for
full approval of the premises.
A. Underwriters Certificate (from your electrican)
B. Certificate of Occupancy (from the Building Department)
C. Certificate to serve and sell food (from the Board of
Health)
During the inspection the following were noted and should be
corrected as soon as possible.
I. The hood over the stove and fryer shall have a
self contained automatic fire extinguishing system.
This system shall be positioned so as to protect the
range, the oven, the broiler, the fryer, and the
exhaust ducts.
2. An ABC type of fire extinguisher, a minimum of
(10) pounds, should be mounted so as to be readily
accessable in case of emergency.

be operated from lamp type extension cords. Approved
outlets shall be provided.
6. All fire extinguishers shall be maintained in a
fully charged state and shall be inspected annually
with appropiate tags attatched.
7. The kitchen door to the public area shall be a 3/4
hour fire rated door and shall be closed at all times.
8. There shall be a NO EXIT sign over the kitchen
door.
9. There shall be a set of emergency lights located
as to illuminate egress paths in case of an emergency.
10. There shall be an illuminated exit sign over the
front door. This light shall be lighted at all times
when the establishment is occupied.
11. The lock in the front door must be keyed from both
sides. The lock in the handle must be removed. There
shall be no provision for the public to accidently lock
this only exit while the building is occupied.
12. Existing wiring in the kitchen, the tap room, and
the basement must be in accordance with the electrical
codes in effect at the present time.
When planning an addition, be sure to plan on adding a
second approved exit. This will allow you to make use of the
total occupancy load.

read the notice of hearing and application for the record.
CHAIRMAN GOEHRINGER: The next ~ppeal is again, a recessed appeal
from the las~'regularly scheduI~<~ meeting on behalf of the Quiet
Man. There's two of them. And we'll ask Mr. Moore if he'd like
to approach us. Is this a husband and wife team?
MR. MOORE: No. A separate operation. You needed some informa-
tion from me and we provided it to you very quickly. One thing
was a copy of an affidavit from Mr. Gilbert about the ..... He's
submitted one before and I think you asked for another copy. While
I'm up here, I'm not a sketch plan artist, but I tried to draw di-
agonal parking. I wasn't sure whether you meant diagonal facing
what direction?
CHAIRMAN GOEHRINGER: Can we grade this or what?
MR. MOORE: ~qell, if I had known we were going to grade, I would
have been more careful. Sure you can grade it.
CHAIRMAN GOEHRINGER: I'm sorry. I was a teacher for 10 years and
that's the reason.
MR. MOORE: This is diagonal slinging the pieces to the north. I
didn't put the scale on it. It's one to ten. And then I turned
around and drew it the other way which is probably what you were
thinking of. I really didn't think about it so I went this way.
It doesn't change anything unfortunately. We still have... I did
ask someone el~e who has got more experience with surveying and
that was Mr. VanTuyl and I sent a copy of the letter that he sent
back to me dated September 25th to your office. I'm not quite sure
if it had been received and put in the file. But he does agree that
you can only put two cars in diagonally either way. So I'm glad to
see that my drawings were pretty close. He didn't mention the third

spot which is back behind the buildings but his real question was
solely, how many diagonal spots could be obtained if we tried it
that way. Those are the two drawings I've done and his letter to
confirm, or my drawings to confirm his letter is the best way to
put that.
CHAIRMAN GOEHRINGER: I notied that you didn't get to stake the
property. Is that true?
MR. MOORE: I went by today and I didn't see the stakes. I had
put the request in and he acknowledges that request and apparent-
ly it hasn't been done as of this afternoon. I will call him in
the morning and ask him. Ibelieve one corner is marked with a
monument. That may help.
CHAIRMAN GOEHRINGER: I didn't see that one.
MR. MOORE: I think I did see on Mr. VanTuyl's site plan survey
a monument there assuming it's still there. I will hunt for it
but I will ask him to get out and put the ribbons out so we can
find it.
CHAIRMAN GOEHRINGER: What else would you like to say?
MR. MOORE: One other request I would like to make is at this time,
we don't really know which if any of the sketches we've submitted
to the Planning Board would be ruled upon and approved or denied.
We originally submitted a proposed sketch plan/site plan that would
keep four parking spaces on the property or provide four off-street
parking spaces. And the question came up, how many spaces are needed
for this variance. I think the Planning Board's memorandum that we
got back in September, indicates a total of 9 spaces. If you count
8 for the seating capacity and one for the accessory apartment, you
need as many as 9. Under the proposal that we submitted, the re-
quest for the variance would then be a variance of 5 spaces that we
can not physically provide on the site were you to grant the vari-
ances from the frontyard setback to permit the construction of this
porch. If however, the Planning Board goes with this sketch of which
you also have, together with curb, sidewalks and plantings, we can't
physically put any parking spaces off-street. In which case, the
variance goes from 5 lots or 5 spaces variance to a none space vari-
ance and that's the problem that I have her~ in asking the Board to
consider as an alternative request. Not to know at this stage which
plan would be preferred by the Planning Board. We have their input
memorandum from last month and it's just their position that we
shouldn't get a parking variance for the reasons set forth. One
other comment about that and I think you've already mentioned it.
The seating capacity, the human being capacity and I think there!s
57. I believe we cited that number at the last hearing and that
is the number from the Building Department. I don't believe 49 is

the proper figure from that memorandum. The seating capacity is
38 and that figure came from the seating capacity, the number of
seats that were physically in the building when it was bought by
Mr. and Mrs. Gilbert. As far as I know, those are the seats that
Mr. Farrell had and we really can't go back any further not to
really know. I'm trying to dig up and see if I can't get any in-
formation from the State Liquor Authority to confirm this. I'm
not sure I'm allowed to get into those prior applicants' files to
find that out.
CHAIRMAN GOEHRINGER: Your figure of 57 is ....
MR. MOORE: That's the capacity of human beings. The Building De-
partment ....
CHAIRMAN GOEHRINGER: That is the maximum capacity.
MR. MOORE: Maximum capacity, right. The capacity that we state
as far as seating goes, is 38 and that's the present capacity and
the Building Department has our pre-existing certificate of occu-
pancy which was mailed to me yesterday and I believe they've got
it sitting in the office there. You have it now but I haven't seen
it. I believe they do their capacity based on square footage and
that's where the 57 comes from. We would ask, and readily accept
a condition 6f a variance that we retain a seating capacity of 38
and that's been the premise all along. Then we can continue on
our merry way with 38 seats in there, not change a thing and the
parking is as it is and forget this variance, depending upon the
way the Planning Board elects to lay the parking out. It will not
c%ange the parking situation at all.
CHAIRMAN GOEHRINGER: How did you arrive at the five parking spaces?
MR. MOORE: As a requested variance applies, I believe it was re-
quested by this Board, of the Planning Board, how many spaces were
needed. With 38 seats, you use one parking space for five seats.
Seven parking spaces would be thirty-five and a fraction. So you
take 8 right there. I dispute whether the accessory apartment in
a bu~ness zone should be included for a parking space. But for
argument sake, I'll accept that and then there's nine. If we keep
with our proposal for the Planning Board, the parking the way we
suggested it, we can provide four off-street spaces. Keeping your
number of 9, our ability to provide four which leaves us with a
need for 5. This is all within the context and framework of the
parking across the street at Thompsons', the parking at Wayside
and the parking on the street. Agreements with which we have with
Thompsons' (orally) anyway to allow us to park there which I think
is significant in light of the fact that he operates under different
business hours than we do. That's where we're at. The two variances,
the frontyard variance which is because the corner lot and Hobart
is one way, I think is less of a concern than it would otherwise be

if Hobart had been a two-way street and the request for the park-
ing variance which depending on the way the Planning Board would
see that, those parking spaces layed out, will depend on actually
how many spaces we really need.
CHAIRMAN GOEHRINGER: And the approximate width or depth of the ad-
dition again, is ten feet?
MR. MOORE: Ten feet, right. And I think
ly on those drawings there based upon the
plans that were done by the architect.

MR. MOORE: Yes, my drawings. I think that addition is on there.
I have shown it in the hatched area. That shows the addition on
the property with an attempt to provide as much parking as possible.
CHAIRMAN GOEHRINGER: I'm in a little bit of a quandry and I don't
really know what to do at this point because I have not seen the
stakes to do the measurements that I propose to do. So I really
don't know what to do at this particular point. I would like to
close the hearing and readily, I guess that's what we'll do. But
I'm sincere in ....
MR. MOORE: I'll get the ribbons out so you can take a look. I
think the measurements will bear out, if the architects used proper
numbers and the surveyor used correct numbers,... The architect
took Mr. VanTuyl's survey and I took the architect'~ site plan and
the numbers would bear out the distances they are. So I would be
glad to get Mr. VanTuyl to point them out for you.
CHAIRMAN GOEHRINGER: Ok. I thank you. I'll see if there's any-
body else who would like to speak in favor or against this hearing.

CUAIRMAN GOEHRINGER: This is a recessed hearing from, it wasn't the
last meeting, a while ago. We'll leave it at that particular point.
1 guess we'll open both of them at the same time. The next one is
also for the Quiet Man Inn and we'll read the legal notice of that
one and that's 3659° The legal notice reads as follows; upon appli-
cution, the applicant (Quiet Man Inn). variances zoning, Article XI,
Section 100-112 and Article III Section 100-31 for improvements for
sufficient number of parking spaces in this pre-existing business use
location of the propery on the corner of Main Road and Hobart Avenue,
Southold. And I have a copy of the Suffolk County Tax Map indicatinq
this and surrounding properties in the area. Would you like to be
hearing Mr. Moore?
MR. MOORE: I'm here on behalf of the G~lbcrt's, the owners and opera-
tors of the Quiet Man Inn. As you know, we were here some
with respect to the variance having to do with the corner lot status
and an equal frontyard variance because the property is on a corner
lot. And I think at that time, I went through and explained that we
could. There's an adequate justification for that variance, in par-
ticular, the unique entrance being a one-way road. The concern for
which the corner lot, two frontyard setbacks are established doesn't
really apply in this case.. The~traffic is not a problem there Jn ter~n~
of visibility. The problem of traffic does not head north on Hobart
Avenue. It heads south. So that concern there is not faced w~t%~ this
particular piece of property. I think it's rather unique in the town,
being a one-way street. The difficult situation where we're here for
a parking variance tonight,, comes from the Planning Board. Zn tkat,
alterations, remodelling, extensions, additions, changes of use and
things of that nature all require site plan approval and the Board
has taken the position to try to get as many property owners in com-
pliance with the present Town Code, to require them that you meet up
with today's parking requirements, setback requirements or an!? other

requirements that are set forth in the Town Code. And that's an
applaudable goal. In practice, it's an impossible goal for many
if not most of the existing businesses. Particularly, if the
Board takes the role that even a change of use would require a
site plan approval, you're going to have lots of applicants in
that are going to want to do any kind of remodelling, extensions,
additions, amendments, change of use or whatever else coming to
the Planning Board for the necessary site plan approval. And if
the Board is consistent in this application and interpretation,
would then say but you folks must now go to the Zoning Board and
get what ever variances that are necessary. Such as that why their
goal is reaching ultimate conformity to a Town Code, this Board is
here for the very purpose of granting the relief and providing the
mechanism by which the strict applications of these rules, while well
intended, can create the hardship. }{ere we are tonight. One of the
things that the applicant had been willing to do all alofg and would
hope that would be sufficient to justify the
site plan approval with its willingness to limit its seating capacity
as it presently exists. I guess it's very very important. When I'm
talking about expanding the business to create more business and big-
ger business, the seating capacity would not be changed. I am not
sure and I may have to request an adjournment tonigl~t, but I agree
with the comments set forth in the memorandum received this evening
as comments from the Chairman of the Planning Board, a copy of which
the Chairman of this Board provided me just a few moments ago. And
that is, that the expansion as proposed or this addition of the en-
closed porch will eliminate the four to five parking) spaces. I think
a site plan was presented to them originally. A copy of which I be-
lieve is in your file but I will certainly give to you, showing how
even with the existing or proposed additlon of this enclosed ~>orch,
four off-street parking spaces will be retained and I'll glve you
that as (in the second hearing) exhibit "A"o I think you might have
that already. That was given to the Planning Board at one point.
?kere are three along here and the fourth there. It's my understand-
ing that for planning purposes and majestics, it was suggested that
parallel parking be done along the street and that was a
done by the Planning Board. As I understand it, that was
revised site plan by the architect dated March 11 and I would ~ive
it to you as exhibit "B" and it shows parallel parking places ~rovid-
lng plantings and the proposed extension. This was a ~uggestion by
the Planning Board as a means to provide parking and perhaps a better
layout, in that with that one-way street, you would not have cars back-
ing out as they presently do on to Hobart. But by parallel parking,
they could pull down and continue in a southerly direction wit?~ the
flow of traffic and I give that to you as exhiblt "B". I believe
you have that also. But to see that distinction there. I belieYe
that was a recommendation by the Planning Board..
CHAIRFLAN: At what point, Mr. Moore, did they discuss diagonal
or when was it discussed?
MR. MOORE: As opposed to the parallel there? I'm not familiar with
any discussion on diagonal parking. Certainly we'd be willing to en-
tertain that as well.

CHAIRMAN: First of all~ have we reduced? I've heard 9, 6, 4, 3, ~
1; the number of spaces. IIow many, from your recollection, at the
last Planning Board meeting, were they talking about?
MR. MOORE: My understanding based upon the code, is that it's one
space for five seats. And to use 38 as a number to which the Gi].-
bert's and sworn to in affidavit, that's the seating capacity, you
get 7 and a fraction. Obviously, 40 seats would be' 8 parking spaces.
Thirty-eight is 7 and change. So call it 8 parking spaces. It was
unclear from the letter that came out of the Planning Board, just the
number of spaces that were being applied. In fact, I have not had the
opportunity to appear before the Planning Board on this matter. That
was being held by the architect.before me. In any event, I believe
that the number we're talking about is 8. I take acception with the
statement, therefore, that we are eliminating those 4 to 5 parking
spaces that presently exists. Giving us the benefit of the doubt,
even 5 and we're using 4 and saying we need 4 additional ~ff-street
parking spaces. The property, as the Planning Board points out in
its memorandum, is physically incapable of providing additional park-
lng. If the situation can stay in its status quo and no one could do
anything about it, we'd have a pre-existing use there. We've got 38
seats and the parking is what it is, where it is, how it is and when
it is. I think the application is an attempt to enhance that piece
of property. I don't know if you've had the opportunity to go in and
see the property since the Gilbert's have taken it over in the last
year but they have done a very nice job with the inside. And I think
their goal is to enhance that piece of property which has had a w~ried
reputation throughout its history.
CHAIRMAN: Now, just let me ask a question here so that we get down
to a little bit more practical situation. The new addition, is it
planned to be made out of wood or cement? I had heard it was ~oing
to be a greenhouse effect. Is there some sketch?
MRS. GILBERT: What the plan was, was to build ~he po~ch wood frame
in exactly the same period as the front window which would be kee£~-
ing in character. As a matter of fact, Bill, if you showed that
sketch. This is existing and proposed.
CHAIRMAN: So it would be wood construction.
MRS. GILBERT: Exactly the same as what's up there now.
CHAIRMAN: Thank you.
MR. MOORE: So I just repeated myself to get myself rolling and get
myself back on track. The Planning Board's goal of getting everyone
to conformity is great but it doesn't always work. So you're chief
for that° We want to enhance the property and improving it. And
again, being more than willing to condition a variance if you should
be amiable to granting it to condition it on retaining the existing
seating capacity. So we're not talking about an additional traffic
congestion problem, a seating capacity problem that we're just ig-
noring and saying forget about it. We're going up to 60 seats and
we know we can't accomodate that. I think you've got a problem if
you maintain that position throughout the entire Town of Southold.

It's not really appropriate to say; hey, there's business zoned
property on the North Road and making those guys comply with it.
That is in fact, the case. I think that's fine but we've got to
recognize that if you take a type reading of the code and if you
want to change your use, you've got to come in. You, as a Board,
will be seeing more of these applications. We did try to obtain
formal and informal agreements for parking. We didn't succeed at
the former. We did succeed at later. Wayside gave us a written
affidavit saying that they would be willing to have up to six ad-
~itional cars parking on their lot as an off-street use. They're
closed during the primary business hours of this operation in busi-
ness. And the Planning Board felt that that particular, and I think
they reiterated it in this memorandum, that that was not the best
kind of parking available. The offer was made and we don~t have the
best parking available but it certainly was there and thqy did not
accept that or like that alternative. As far as I know, the offer
still stands. I met and spoke with the owner of Thompson's Empori-
um. A very nice gentleman who bent over backwords to say by all
means, please park here. He even told me to put up a sign on the
building of the Quiet Man that said additional parking at Thompsons.
but he didn't want me to go into a formal written agreement for ob-
vious reasons. He's got his own plans for his own property. He
didn't want to be tieing up members there. But the important tl/ing
of concept is his hours of operation.of closing at 6:00 or 6:30 at
the latest on a Friday night. And this business operates at night
primarily.so that we had overlapping uses of the same parking spaces
offered willingly by the owner of Thompsons. Not in writing but he
certainly was willing to do that. So we're not talking about cars
pouring all over the street. We have informal parking available to
us. There's also an owner, people who became friends with the Gil-
berts who own the property just to the west of Wayside in a little
red house there and the adjoining piecc as well. It's not prevalent
to develop. It doesn't have parking on it at this time but an individual
had let us know (that hey) if and when he can get parking on his p~ece .
of property, again, we will have an informal [31ace. He doesn't want
to tie it up for the same reasons. Parking is at a premimum. ~ think
that's a given. But you can not draw blood from a ~tone o~t c~ ~
of property. And the thing that I can offer to you as the stron~fe~;t
r{~ason for your willingness to grant a variance that we are not

signed by Charles Gilbert. And I believe that he broke it down to
26 seats at the table and 12 at the bar for a total of 38. So that
was the total seating capacity and I have a photocopy of that here
somewhere.
CHAIRMAN: Can you give us a copy sometime? The third thing is that
I had gone down there last Saturday afternoon. And among.st the cars
that were parked in the existing parking area, I had started... I
had trouble finding the west monuments to be perfectly honest with
you. And possibly you could either reconstruct them or take a siting
from one side so that I could at least go down there and start making
some other measurements. But what I would like to see is the possi-
bility of a plan for diagonal parking regardless of what other Boards
have said and so on and so forth. Because I think that's probably the
only way you can maximize the existing parking .....

CHAIRMAN: However, you may be able to bury one down in the other end
down toward the rear of the building by taking the curb out. And I
don't know again, to what extent the property goes to that curb. So
possibly on the southwest side and on the northwest side, you could
at least give me some idea by driving a stake in where exactly that
property line is. And possibly by the next meeting you could come
up with a diagonal parking plan with some plantings in it, a barrier
so to speak, between that and the building so nobody drives right in
and something of that nature. That's the reason I asked if the build-
ing was a cement construction or wood construction. Because as you
know, cement will withstand a little more impact than wood. Thank

Matter of QUIET MAN INN. (Recessed as requested from April
23). Addition with an insufficient frontyard setback from
Hobart Avenue, Southold, B-1 Zone. Main Road and Hobart Ave-
nue, Southold.
CHAIRMAN GOEHRINGER: The next hearing is a recessed hearing.
And therefore, I don't have to read the information and we'll
go on to Mr. Moore.
MR. MOORE: Good evening. Bill Moore. Offices of Cross Commons
in Mattituck. I'm hear on behalf of the Quiet Man. Mr. and Mrs.
Charles Gilbert are here with me. When I saw the schedule and I
say my wife was on for 4 or 5 hearings, I hustled back to the of-
fice and prepared my comments in writing. I've got a couple of
things for you. I believe the architect provides a packet. I
don't know if it's duplicated for all of you. Maybe it has been
but I think the most important information I've got is the tax
map, it's the existing site plan, it's the proposed site plan of
the inside and then one of the outside. The third item was writ-
ten comments in the form of a memorandum. I'll summarize real
fast because the clients were good enough to appear and I want
to do justice to the public hearing, if you do have any questions.
Very quickly, what we're here to talk about is the proposed exten-
sion to the Quiet Man Inn which is (I'm sure everyone knows) located
on the corner of Hobart and Main Road. The applicants purchased the
property last summer. A family member is a chef. And it's the hope
and the desire that they can expand the existing kitchen facility
which is a fire trap and for which they can not get insurance.
And to expand the existing seating, not by terms of capacity, but
only in terms of space. If you had the pleasure of being there
since they've done some interior work and fixed it up and tried to
sit at the present tables, you'd find that you were sitting elbow
to elbow with your neighbors. The proposal is merely to stretch
out and spread out the existing tables. In fact, they'd be willing
to condition any permit, variance or Planning Board approval with
that in mind. I think that's an important thing to keep in mind
when contemplating this. We're here for a frontyard setback be-
cause of a corner lot on the corner of Main Road and Hobart. The
unique thing about the property is that Hobart is a one way street.
The corner lot section of the code is concerned with putting build-
ings at intersections that will impede or create dangerous traffic
situations. Hence, the need to keep those buildings back off the
street corners. But in this case, you've got a one way street going
down or in a southerly (more or less) direction on Hobart. I don't
think the concern is quite as great in this case. Another observa-
tion and it's made in the memorandum, is that business property of
the existing businesses in town, are regulated before this Board
for variances because most, if not all of the existing businesses
in town, can not comply with the code as it's been adopted. Most
of them pre-exist. I came in last summer representing Metro Rental.

To try and bring out that trend or that fact. I'm sure you sit
night after night hearing these type of variances. We're here
again, tonight for that purpose. As it currently stands, we
can't use the kitchen. We can't get insurance. There is no fire
safety systems in it. I have a letter from Henry Hahn, who is
their insurance agent, attached to that and I think you had been
given that earlier. Another item is that drinking holes are going
by the by. The public is changing their habits. They do no go
in in large numbers. Drinking and driving is a primary concern.
And bar owners are being told and persuaded to provide food on
the premises. That's their goal here. These are young people who
moved to the Town of Southold. Mr. and Mrs. Gilbert live above
the Quiet Man and they really want to make a go of it. They do
not believe that the bar business in itself, just serving drinks,
can make it. They'd like to expand that kitchen so they can pro-
vide a pub-like setting for those of us who are out late at night
to get a bite to eat and like something to drink. That's the goal
of the piece of property. I'm working with Mrs. Scopez trying to
come up with something that's agreeable for the parking. The ad-
dition doesn't eliminate the floor we've got. We may reconfigure
them. The Planning Board suggested parallel parking. The appli-
cants are more than willing to do that. We've been working with
Mr. Thompson over at the Emporium and with Wayside and we have
all kinds of informal agreements. Wayside has even given us writ-
ten agreement. It's a separate problem and I'd like to get that
squared away with the Planning Board if I can. If necessary, if
you should grant the variance requested here tonight, that it
could be contingent upon a satisfactory resolution of this off-
street parking. With its recognition .... This is a unique cir-
cumstance here. We technically must meet before the Planning
Board for site plan approval as we are doing an alteration. So
we are willing, however, to convenant and we would not increase
existing seating capacity. Somewhere in there I think the park-
ing problem can get worked out. I just haven't quite figured out
where it's going to get worked out yet.
CHAIrmAN GOEHRINGER: ~ere are the cesspools on this building?
MR. MOORE: I apologize. I think you asked me that question be-
fore and I didn't get to the answer.
MR. GILBERT: Do you have a large scale map?
CHAIRMAN GOEHRINGER: Well, here's the largest survey I have.
MR. GILBERT: I can generally point out. In general, now this
is the proposed extension here. There is one here, one approxi-
mately here and one approximately here. This is very general.
CHAI~4AN GOEHRINGER: So you would be having to move them anyway,
I assume.

MR. GILBERT: In fact, when we took over the property, we were
told that there was a three year extension for the complete re-
building of them. I think we have, or less than one year left
to do that. We have already approached the Health Department
people in Hauppauge regarding that and so forth and so on and
much larger capacity ones could be contained in this landscaped
area. We have gotten people who do this type of work to come
out and scope out the area and so forth. They said it can be
done and so forth. In terms of Health Department regulations
and so forth, it would require only normal type and leeching
sort of thing.
CHAIR~N GOEHRINGER: Alright. Now, the purpose of the reces-
sing of this hearing was for what purpose?
MR. MOORE: It had been my hope that we would have resolved the
parking in that time.
CHAIR~IAN GOEHRINGER: And you have not.
MR. MOORE: And we have not been able to resolve it. I want to
go ahead and ask then, if you're inclined to grant the variance,
please make it contingent upon some satisfactory resolution of
the parking. I didn't know if I could get the answer for you by
tonight. If I have to make an application ....
CHAIRMAN GOEHRINGER: I'd just rather continue the hearing until
such time that you get some type of parking.
MOORE: If that's how you prefer, fine.
CHAIRMAN GOEHRI~GER: I can't see any reason why I should close
it and if you can find parking somplace, let's recess it without
a date. Do you have any ideal how long they need?
~. MOORE: I don't know. I have the benefit of the transcript
of their last hearing. I've been meeting with Valerie and I'm
hoping to get back together with her on some resolution.
CHAI~4AN GOEHRINGER: Can I just ask you this question? Is there
any specific reason why you haven't attempted to add on to the
rear of this building as opposed to .... ? I'm talking about for
kitchen facilities as opposed to attempting to... The other part
of it for the elongation or the width of the building is a dif-
ferent situation. But is there any reason why you haven't chose
to...?
MR. MOORE: My understanding is that we are as far back to the
property line. Although it is commercially zoned, there is a
residential property behind us. We are as far back as we are
permitted to go. On top of that too, if you observed the proposed
floor plan of the cafe area as I might call it, it allows us to
wrap that kitchen around some traffic space for waitresses leading
from the kitchen directly into the cafe line rather than into the
pub area.

CHAI~4AN GOEHRINGER: Ok. Well that answered that question.
Let's recess without a date and come back to us when you're
ready. Yes, Mr. Gilbert.
MR. GILBERT: I know earlier this evening the Chairman made it
quite clear that it's important to keep comments germaine to the
issue at hand.~ And from my understanding (of course) Bill is
handling the legal issues which I guess are the germaine issues
and I think it's parking. Nancy and I felt that it was important
just as one citizen to another, not as a legal expert or as a
businessman, to emphasize the spirit of this project which I feel
is germaine. A social gathering place is very important to a
community. The Quite Man is one of the few establishments which
remains open all year around that are here for all the people of
this community. It's also a way of life. It's not so much a busi-
ness persay, as thought we were running a retail store operation
and so forth. It's a way of life. It's something that~ou have
to love to do. It is our purpose and although this is not a formal
hearing, may I be considered sworn in on this. It is our purpose
to provide a better establishment, not a bigger one. One that can
be run responsibly as it should under law and by community standards
or Southold community standards in general. Since the time we have
taken over the Quiet Man last July, I think we've demonstrated our
interest in improving the property itself, interior at first, ex-
terior we hope, and providing responsible management. The history
of the operation sincd July 2nd, brings that out. I merely ask you
to take that into consideration. It's our heartfelt wish that you
would please consider that. I thank you.
CHAI~4AN GOEHRINGER: Thank you. We have to, I have to come down
anyway and look at the interior, the later part of the building
anyway within the next month. I'll either stop down on some Satur-
day. What time do you open?
MR. GILBERT: We're open at 11 except on Sundays we're open at 12.
CHAIRMAN GOEHRINGER: Ok. I'll stop down some Saturday morning
just after 11 and maybe alone or with a couple of the fellows. I
really get out of the house on Saturday nights so I don't get tele-
phone calls from people that come out on Saturday and Sunday and
are looking for variances. So we thank you sir and we'll recess it

CHAIRMAN GOE~RINGER: I have a copy of a survey with the most re-
cent date of February 13, 1987 by Roderick VanTuyl, P.C. indicat-
ing a building in its present existance. The property is approxi-
matewly 63.5 by 90. 63~ is on the Main Road. The other 90 is on
the east property side. 25 feet approximately in the rear and
97.99 feet on Hobart Avenue. And I have a copy of the Suffolk
County Tax Map indicating this and surrounding properties in the
area. Is there somebody who would like to be heard on behalf of
this application?
MR. MOORE: Good evening. William Moore with offices in Mattituck.
I'll make your evening real short. We'd like to recess that hear-
ing if we can. There's been some confusion on my part and I think
between the Planning Board and Zoning Board as far as how we can
go about getting the parking which is a problem right now. Also,
the Planning Board just wrote a letter in the last couple of weeks
saying they can not waive the parking requirements and the ques-
tionsd start to arise. Are them able to waive teh parking require-
ments or do we have make that a separate application of the Zoning
Board to reduce parking and where we're going with that. If I can
make a separate applicaton or tie it in somehow with this one with
some guidance, I'll do that. At the same time, I'd like to do a
variance that way. I will try and get a parking agreement for off-
side parking for it. I'll try and work on that but I can't be sure
that we can pull that off. The Planning Board's comment is a lit.-
tle unclear and I spoke with Diane Schultz this morning. And she
understands teh Board's position that they can't waive parking re-
quirements. I guess the question comes to the Zoning Board and
they sit there and give a variance to parking space requirements.
We'll work on that.
CHAIRMAN GOEHRINGER: we probably would not.

tertain an application for a variance. We will try and get a park-
ing agreement. I can't be sure that we can pull that off. With

Dear Chairman Gerard Goehringer,
As per your letter of 15 December 1986 relating to the above Appeal, I respect-
fully submit the following clarifications:
1. Additional Seating: There is no additional seating.
As per attached Drawings A-6-E×isting Plan with Furnishings and A-7-Pro-
posed Plan with Furnishings please notethat no tables are being added to
the premises.
Due to the insufficient space between the bar and the first row of tables
AND the insufficient space between the two rows of tables,service is
difficult and can be hazardous when hot foods and drinks are served. The
proposed extension will allow half the tables to be relocated, thereby
allowing ample space for the staff to move about in the service of cust-
omers who are seated at the tables without interfering with Patron space
at the Bar Area.
As per enclosed photographs please note that at peak business evenings the
first row of tables has to be removed to allow ample space for Patron Ser-
vice. This reduction of tables is detrimental to the Quiet Man Inns' bus-
iness and investment and is a definite hardship.
Parking: Since there is no increase in tables, additional Parking is not
required.
With the addition of the extension please note that the n~mber of exist-
ing Parking spaces remains the same. As per Drawing A-1 and A-3 Spaces
No. I and 2 remain, No. 3 becomesparallel to the street and No.4 moves
to the rear of the building.
If you
Sidewalks: There is no sidewalk on the Hobart Avenue side of this property.
As per Drawings A-1 and A-3 please note that there is no sidewalk or curb
on the Hobart Avenue side of this property. Sidewalk at Main Street has
been indicated.

Dear Mr. Orlowski and Members of the Board:
A site plan has been presented by the owners of the Quiet Man Inn
to permit the alteration of the existing building to enlarge the
seating and kitchen area.
The Board has advised the applicants that they must comply with
the off-street parking requirements of the Town Code and provide
five (5) spaces in addition to the four existing off-street
spaces because the proposed addition requires site plan approval.
The proposed addition will not expand the seating capacity of
this preexisting use. The applicants are prepared to execute a
covenant agreeing to limit the seating to the existing 38 seats.
The Board has the authority to determine reasonable and
appropriate off-street parking regulations. In light of the
applicant's willingness to limit seating to its present capacity,
the Board should accept the existing parking and seating and
approve the proposed addition.
Moreover, the applicants have made a diligent effort to obtain
the additional off-street parking. The owners of the Wayside
Market granted permission to use their parking facilities as did
the owner of Thompson's Emporium. The spaces at Wayside were not
deemed acceptable to the Board because parking at that location
is not delineated clearly. The owner of Thompson's Emporium has
agreed to allow the use of his parking area for patrons of the
Quiet Man. In fact, he advised the owners of the Quiet Man that
they could put a sign on their property advising patrons of the
additional parking at Thompson's Emporium. He does not, however,
wish to enter into a formal written agreement with respect to the
parking.
Section 100-112(G) of the Town Code permits the Planning Board to
combine space requirements for two or more uses. The Board can
reduce the total parking spaces required for a particular use
when it can be conclusively demonstrated that the use will be
generating a demand for parking spaces primarily during periods

closes for the day by 6:30 p.m. The Quiet Man operates primarily

a variance from section 100-31 of the Southold Town Code by The
Quiet Man Inn. Specifically, the Quiet Man Inn is located on the

Practical Difficulties Exist
For the Applicant
VARIANCES ARE NECESSARY FOR MANY OF THE
ESTABLISHED BUSINESSES IN THE TOWN BECAUSE
THE BUSINESSES PRE-DATE THE ENACTMENT OF THE
ZONING ORDINANCE
Many, if not most, of the business establishments in the
town predate the enactment of the zoning ordinance. The building
in which the Quiet Man Inn is located is no exception. These
existing businesses are located on small lots in the established
business districts in the Town which creates a regular need for
variances from the zoning ordinance.
For example, the Mattituck business district has many
establishments that have required all manner of area variances to
cope with the requirements of the code and the practical
realities of the small sized business zoned lots.
In an application on behalf of Metro Rental in Mattituck
the Zoning Board was provided a list of some of the variances
obtained by the businesses located in the Mattituck business
district because the businesses could not comply with the
ordinance when renovations and alterations were being made to the
existing buildings. A similar list could be prepared for every
other hamlet area with business property in the Town of Southold.
If variance applications become computerized in the records of
the Town these trends could readily be established for the
Board's information.
VARIANCE WILL NOT AFFECT THE PUBLIC SAFETY OR
WELFARE AND WILL NOT ADVERSELY AFFECT THE
SURROUNDING PROPERTIES IN THE DISTRICT
The variance will not affect traffic safety in the area.
Corner lots are deemed to have two front yards from a concern
that traffic safety will be jeopardized if motorists are unable
to see around buildings not set back from the corner. Traffic
safety will not be affected if the variance is granted because
Hobart Avenue is a one-way street with no traffic northbound
toward Main Road. All traffic travelling from Main Road goes
south on Hobart Avenue and the presence of the building would not
impact the ability of traffic to safely negotiate this
intersection.
VARIANCE WILL ENABLE APPLICANTS TO IMPROVE
THE PROPERTY INTO A VIABLE BUSINESS
Applicants want to alter the character of the existing
business. Drinking establishments that do not or are unable to
offer food in addition to alcoholic beverages are becoming
extinct. Liability insurance for such places has increased in
price dramatically and increased public awareness over the
dangers of drinking and driving has altered the public's social
habits. In addition, organizations of bar owners have encouraged
and attempted to teach and persuade members to incorporate food
availability into their operations as part of good and safe
business practice.
The existing kitchen facility in the Quiet Man Inn lacks any
fire safety system and unusable as a commercial establishment in
its condition. (See attached letter from Henry M. Haan Brokerage)

are ready and willing to condition the variance on a covenant
that would limit seating capacity to its present 38 seats. In
other words there would be no additional seating capacity
provided by the proposed addition. The existing seats would
simply be spread out to relieve congestion. It is important to
note that the proposed addition does not reduce the number of
parking spaces already provided on the property.
CONCLUSION
Petitioners respectfully request that the Board grant the
front yard variance. At present, additional off-street parking
is being discussed with the Planning Board and the applicants
would ask that the Zoning Board's decision be made conditional

ing the parking and site plan dated March ll, 1987 and the
March ll, 1987 correspondence from Kenneth Ramsaer concerning
the availability of additional parkin9 on the abutting premises.
'Also received is a photocopy of a revised site plan dated
March ll, 1987 which shows four p~rking spaces on Hobart
Avenue rather than within the perimeter of the site.
Please furnish the following to complete our file:
(1) four certified prints of the entire site and abutting
parcel which would depict the additional parking, egress and
ingress, etc.;
