permission to use existing storage building for warehousing and storage
of lumber and building materials and supplies, in conjunction with the
existing lumberyard opposite Sound Avenue. Zone District: "C-Light
Industrial." Location of Property: South Side of Sound Avenue (or
North Road), Mattituck, NY; County Tax Map Parcel No. 1000-141-3-41.
WHEREAS, a public hearing was held and concluded on November 10,
1987 in the Matter of the Application of GEORGE L. PENNY, INC./JERRY
SHULMAN under Appl. No. 3682; and
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded; and
WHEREAS, the Board has carefully considered all testimony
and documentation submitted concerning this application; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the Board made the following findings of fact:
1. The property in question is identified on the Suffolk
County Tax Maps as District 1000, Section 141, Block 03, Lot 41,
consists of a total area of 10,688± sq. ft. with approximately
200 ft. frontage along the south side of Sound Avenue (a/k/a
Old North Road), Mattituck, and is located in the "C-Light
Industrial" Zoning District.
2. This is an application for a Special Exception to the
Zoning Ordinance, Article VIII, Section lO0-80(B) for permission
to establish and use a majority of the existing storage building
for warehousing, storage, loading and unloading of lumber and
building materials and supplies, in conjunction with the lumber
yard operated by Penny Lumber directly across Sound Avenue (a/k/a

3. The subject premises is presently improved with the
following structures, as shown by survey amended May 23, 1964
submitted with this application: (a) substantial frame storage
building, partly encroaching along the front property line at
its northeasterly corner, and (b) frame building situate at
the northwesterly corner set back 3.5 feet at its nearest point
from the front property line along the south side of Sound
Avenue.
4. For the record, it is noted that there are prior
actions of record: (a) under Appl. No. 3482 for a Special
Exception rendered April 16, 1986 permitting the warehousing
of building materials and office area (for use by the insulation
company presently occupying the premises) at the west end of
the premises, and (b) under Appl. No. 813 rendered November 10,
1965 to erect an addition to a nonconforming building to house
trucks and loading and unloading of potatoes.
5. For the record, it is also noted that the following
permits have been issued to date concerning these premises:
(a) Certificate of Occupancy #Z-16390 dated November 13, 1987,
(b) Certificate of Occupancy #Z-16385 dated November 10, 1987;
(c) Certificate of Occupancy #Z-14445 dated May 30, 1986;
(d) Certificate of Occupancy #Z6774 dated November 10, 1975,
(e) Building Permit #14874Z dated May 12, 1986; (f) Building
Permit #8119Z dated August 1, 1975; (g) Building Permit
#2931Z dated November 16, 1965, (h) Town Planning Board
Site-Plan Approval rendered May 5, 1986; (i) Town Planning
Board waiver of October 9, 1987; (j) Town Board resolution
adopted March 11, 1986 determining the uses to be consistent
with those in the proposed "B-l" General Business Zoning
District prepared by Raymond, Parish, Pine & Weiner.
6. In considering this application, the Board has deter-
mined: (a) the uses proposed will not prevent the orderly
and reasonable use of adjacent properties or of properties in
adjacent use districts; (b) the uses will not prevent the
orderly and reasonable use of permitted or legally established
uses in adjacent use districts; (c) the safety, health, wel-
fare, comfort, convenience or order of the Town will not be
adversely affected by the proposed use and its location; (d)
the use will be in harmony with and promote the general
purposes and intent of the zoning ordinance. The Board has
also considered items (a) through (1) of Article XII, Section
lO0-121(C)[2] of the Zoning Code.
Accordingly, on motion by Mr. Sawicki, seconded by
Mr. Douglass, it was
RESOLVED, that the Application in the Matter of GEORGE
L. PENNY, INC./JERRY SHULMAN, for a Special Exception as
applied under File No. 3682 for permission to establish and
use existing building for warehousing, storage, loading and
unloading of lumber, building materials and supplies in
conjunction with the lumber yard opposite Sound Avenue (a/k/a
Old North Road) and in conjunction with those uses established
and approved under Special Exception No. 3482 rendered

April 16, 1986, BE AND HEREBY IS GRANTED, SUBJECT TO THE
FOLLOWING CONDITIONS:
1. No obstructions into the public street areas by
vehicles loading, unloading, parking, etc. which may block
access (along Sound Avenue)~
2. No storage of materials outside of building (all
materials must be contained inside of the existing building)~
3. Any change of use (to other than that applied and
granted hereunder) will require further application for
consideration.
Vote of the Board: Ayes: Messrs. Goehringer, Grigonis,
Douglass and Sawicki. (Member Doyen of Fishers Island was
absent.) This resolution was duly adopted.

k'~The Chairman opened the hearing at 8:10 o'clock p.m. and
read the notice of hearing and application for the record.
CHAIRMAN GOEHRINGERz I have a copy of a survey prepared by Young
and Young. -The most recent date is April 17, 1986 indicating a
framed building with several small additions and a small framed
building toward the road side which does not appear to be connected
to the garage/potato house building. And I have a copy of the
Suffolk County Tax Map indicating this and surrounding properties
in the area. Would you again, like to be heard Mr. Cuddy?
MR. CUDDY: This is property that's directly across from the
existing George L. Penny Lumber Yard in Mattituck. The property
is approximately 10,000 square feet. It contains a building that
has been used in the past, for the storage and warehousing of po-
tatos and other crops. The building that is the most westerly
unit of this complex is now used by an ~nsu]ati0n company. This
whole complex has a history before the Zoning Board starting in
1965. The Board approved the use of the property at that time
and extended the complex that was there from small buildings and
really the large buildings that now exist. In 1986, this par-
ticular parcel was also before this Board as well as the Planning
Board, and granted an approval for the westerly building to be
used as an office and InSulation now in operation. The Planning
Board at the present time, has granted us an exemption, a waiver
as far as our application. Our application is simply to convert
the use of the building from potato storage into the warehousing
of lumber and equipment that's pertinent to the lumber operation
which is currently conducted by Penny Lumber across the street.
So we'd like to store our lumber and building materials in this
particular building. There have been C.Oo'S issued for the par-
ticular property in question in 1975. There was a c.o. issued
for the potato storage and the grading operation that was conducted
there. The property is owned by Mr. ~and Mrs. $ hulman. There's

a consent in your particular file from Mr. and Mrs. $ hulman. Mr.
Penny, who is here tonight on behalf of George L. Penny, Inc~, is
in the process of purchasing that property. The purchase, as I in-
dicated in the application, is subject to your approval for the
special exception use. In going through the ordinance, I don't
believe that the special exception use will have any adverse ef-
fect or any different impact on the neighborhood or the area with-
in the operation that was presently conducted there a long time
which is potato storage. Certainly, the operation that's proposed,
will be in conjunction with the existing lumber yard. Essentially,
what he wants to do is bring trucks in, store lumber there. The
employees would essentially be employees that would be employed for
the most part, 6n the other side of the road. I don't believe there
will be a parking problem because the parkings%is ample, aqain with
the existing lumber yard which is across the~street. Mr. Ren~y is
here to answer any questions. I'm here to answer questions.
CHAIRMAN GOEHRINGER: The only question was that; the thought of
the Board was that when the specific building was used for potato
storage, large 40 foot trailers were used and they were backed in
to the east side of the building which then obstructed (to some de-
gree) the ingress and egress down Sound Avenue. My question basical-
ly is, would a situation like that reoccur?
MR. CUDDY: There will be trucks that will go there. I mean that
is part of the operation. I don't think that it's intended that
truck after truck go there. I don't think that it's intended that
trucks go out at Sound Avenue. There are two possibilities as far
as unloading at that spot. One is; at the end of the triangle, the
easterly end, there are two garage type doors which will allow access
to the building. If those doors are used, We're~not sure exactly
how good they are at this point. But if they're used, the trucks
will essentially be off the road. If the middle door is used and
there is a door about half way down~this~ntire comple~goi~ down
North Road, the truck will probably stick somewhat out into the
road. That happens presently when the insulation people are load-
ing and unloading. This would be simply a temporary thing. It
would not be a permanent regular 0ccurrence~ It would be maybe once
or twice during the course of the day. I don't anticipate it being
more than that.
CHAIRMAN GOEHRINGER: And will you be keeping the insulation compa-
ny on the west side of building?
MR. CUDDY: Yes. I also have the cards to hand up, receipts.
CHAIRMAN GOEHRINGER: Is there anybody else who would like to speak
in favor of this application? Yes.
MR. PENNY: I just wanted to clarify the delivery and the type of
trucking that we deal with on a r~gular basis. And I'm fully aware
because when Jerry $ hulman was there, he blocked it. You would
have to pull half way into our yard to back his tractor trailers.
And I have pictures here if you want to see exactly what we're
talking about here because people haven't seen it. But the nature

of the trucking that we deal with nowadays is a lot shorter. We
are dealing more with the van type trucking. When a tractor trail-
er does come in, that would probably be on a very occasional basis.
Maybe once or twice a month. The trucks that Mr. Cuddy has mentioned
earlier, aur trucks have 16 foot bodies and are probably 26 or may-
be 30 feet long and the van type trucks that are normal for the de-
livery routes in our area to our industry, are not the tractor
trailer type. So we're going to be using a lot shorter trucks.
CHAIRMAN GOEHRINGER: I think by nature of the operation that existed
prior, for some strange reason, that's where the potato trucks al-
ways ended up. Always at that end of the building and that's the
reason why most people recall that fact because the tractor trailers
were out there all the time.
MR. PENNY: Would you like these pictures? Would they be helpful?
CHAIRMAN GOEHRINGER: Thank you. Is there anybody else who would
like to speak in favor of this application? Anybody like to speak
against the application? Any questions from Board members. Hearing
no further questions, I'll make a motion closing the hearing, reserv-
ing the decision until later.

The building is located on the south side of North Road adjoining
the Long Island Railroad and is identified on the tax map as
Section No. 141, Block 03 and Lot 041. It is our understanding
that you may review the application as part of the site plan
review process. You will note that the building, in an industrial
use district, has been in existence for many years, has previously
been used for the warehousing, storage, grading and shipping
(loading and unloading) of potatoes and, in part, is now being
used to store insulation materials.
