Below is a brief explanation of the site's permitting history and circumstances surrounding our request. This property was previously the subject of Wetlands Permit #5279 and Coastal Erosion Management Permit#5279C (copies enclosed), which were issued in February 2001 to the prior owners, William and Louise Segallis, for the resheathing and toe armoring of an existing bulkhead. In June-2013,Mr.-and Mrs. Segallis secured an amendment to Wetlands Permit#5279 (copy enclosed) to permit a cantilevered platform and beach access steps located on the seaward side of the bulkhead. Both permits were subsequently transferred to the Keisermans in October 2015 (copy enclosed). There also exists on the property an inground swimming pool and surrounding deck, which are located partially within the Coastal Erosion Hazard Area but were constructed prior to the adoption of the Town of Southold Coastal Erosion Hazard Area Law in 1991. Historical documentation of the structures is provided by Certificate of Occupancy #Z15201, which was issued for the swimming pool on January 14, 1987 (copy enclosed); and the enclosed aerial photograph, which depicts the swimming pool and deck in their present location and configuration on February 25, 1988. However, after executing due diligence through their attorney and purchasing the property with the understanding that these structures therefore pre-dated the Trustees' permitting jurisdiction and that the decking was an"on grade" structure not requiring a Building Permit or inclusion on the Certificate of Occupancy, the Keisermans were advised by the Building Inspector that the 128 sf seaward protrusion of the pool deck (labeled on the survey as "deck overhang") is in fact situated above grade and that the entire pool deck is therefore considered to be a "raised deck addition" requiring legalization through a Building Permit. However, we plan to pursue the further modification of Wetlands Permit #5279 to include the pool deck as well as the lower deck (and associated stairs) located behind the bulkhead so that all structures not already authorized by a Town of Southold Wetlands and/or Building Permit can be permitted as needed.
