The family obtained a wetland permit#5491 in 2002 when the bulkhead had experienced storm damage. The existing dock is shown on the survey. The family is in contract to sell the property. The existing house was constructed in 1905 and the applicant's grandfather purchased this property in the 1930's. The property has 210 linear feet along Peconic Bay and title to the property extends 38' beyond the bulkhead. The dock was constructed in the 1930's and pre-dates the Trustee's jurisdiction. The purchaser has made the contract conditioned on the owners-sellers obtaining two documents from the Southold Town Trustees: 1. A certificate of compliance for the bulkhead under permit#5491 (enclosed for your convenience). Please inspect the bulkhead for compliance. 2. A wetland permit for the existing dock. The existing dock is only 3' in width for the first 48.7 feet into the water, the code allows 4', and 4' x 38.5' into Peconic Bay, Cutchogue. Therefore, the dock extends, in total, only 77.2 feet from the tie line (owner's property) into the Peconic Bay. 1 Board of Trustees re: 1165 West Road Cutchogue May 23, 2016 Page 2 From the owner's bulkhead to the tie line (owners title) the dock consisting of 8' x 8' pier, 8'x16' pier and 3'x 5.5' stairs. The piers from the bulkhead to the stairs is on the owner's property. Attached is the survey presented and accepted by the Trustees for the bulkhead permit. (Exhibit A) It is my understanding that during a pre-submission field inspection with Mr. McLaughlin Esq. the Board was insisting on the removal of the last 15 feet of the dock. First, this preexisting dock has been on this property since the 1930's and is a legal pre- existing structure. Second, the dock extends only 77.2 feet into the water. The adjacent dock was issued a Trustees permit#4573 in 1996 for a 4' x 100' dock. Third, there is a sand bar directly seaward of this and the Ivarone dock which impedes navigation. These docks provide a visible obstacle before unknowing boaters hit the sand bar. Finally, the contract for the sale of this parcel is conditioned on receipt of a wetland permit for this existing structure. The existing dock conforms to the wetland code. The purchaser will terminate the contract if the permit is not issued for the existing dock. Denial or failure to issue a wetland permit for the pre-existing dock will cause irreparable financial harm to the owners. We understand that a wetland permit merely permits the owner to maintain the existing structure, which it has done for the last 75 years, however, the dock can not be reconstructed without a wetland permit application for a new dock.
