Russell SUPERVISOR RUSSELL: Please rise and join in the Pledge of Allegiance. Thank you. Is there anybody that would like to address any of the items on the agenda? Go ahead, Robert. Robert Dunn, Peconic Southold Town Board Regular Meeting May 17, 2016 page 4 ROBERT DUNN: Robert Dunn, Peconic. I am just curious about some of these police cars. $5.99, $7.98. Are they cannibalized? No, I mean, you get$6 a ton at the scrap yard. SUPERVISOR RUSSELL: We talked about that, we had actually created a policy a few years ago to set a minimum bid, basically on a per ton cost, what we would get from the market for what they call a long ton, 2240 pounds. Some of the vehicles, they are so cannibalized and so much of the stuff has been removed... MR. DUNN: They will strip the price down. SUPERVISOR RUSSELL: Yes, but we don't know what the weight is, so we can't set a minimum. Also... MR. DUNN: They will weigh it for you but the bottom line is they won't give you anything. SUPERVISOR RUSSELL: Well, that's another thing. MR. DUNN: For $5 or $6, you take the radiator, they know a half a buck off, you take the catalytic convertor they knock a buck off, then you get a dollar a hundred. It's not worth the work to take it there. SUPERVISOR RUSSELL: At least $10 or $20 a piece for the tires. MR. DUNN: Yeah. I was just, they want cars intact. They want the lead battery, they want the copper. Okay, I was just curious. SUPERVISOR RUSSELL: Okay. Would anyone else like to address the Town Board? Sure. Kevin McCallister KEVIN MCALLISTER: Good evening, Kevin McAllister of Defend H20. I would like to address the CPF water referendum that's forthcoming. SUPERVISOR RUSSELL: Okay, I am just going to ask if we can get the agenda items done and then we will go to the regular discussion right after that. What we generally do is we take comments on the agenda items and then right after we are done with that, then we will take comments on all the other issues. MR. MCALLISTER: Okay. Do you roughly know how much time that will be? SUPERVISOR RUSSELL: Oh, we probably have 8 to 10 minutes of stuff. MR. MCALLISTER: Okay, great. Thank you. Kevin? Sorry to make you wait. Kevin McCallister MR. MCALLISTER: Oh, that's okay, I was just hoping it wasn't hours. Thank you very much, good to see everyone again. Kevin McAllister, Defend H2O. As you know, that referendum is forthcoming in November. I have looked at the law, I guess a few things, I would strongly encourage the Board and I know you will do this, but it does require a planning process to this. I think really strong structure to the program is extremely important, you know, this is a different animal than C P F land, you know, buying,purchasing ag lands and open space or even historical buildings, now we are talking about nuances with water quality issues and I think it's extremely important that the application of these funds have results, so you have extremely good staff and I am telling you that as a professional, as a scientist, I am very impressed with your staff, I know they will do good work. But you know, from the outset, have that important framework. You know, as the law speaks the advisory committee, I am not sure how that is structured but you know ultimately, I would submit that it probably needs to be different than the existing or the standing advisory committee for the land purchases. I think it has to be technically based you know, and the vetting process has to be very thorough here. I mean, there's a suite of applications for water quality improvements that I am already seeing out there, you know, there seems to be interest, oh, there's CPF money coming, let's do this or that and without you know, full validation of the forthcoming projects. Water quality monitoring and I strongly encourage and I know this goes back to some of your creeks that you know, begs the question with the presumptive closure from DEC, you know, are they ripe with bacterial contamination or are they not? And you know, the only way that we are going to determine, establish baseline is with the effectiveness of these prescriptions that we put forth, is with to have a strong monitoring program. I believe that with aquatic habitat restoration, that would allow you to spend those dollars on a program. Again, I, try to move forward with that at the onset so we get it in place and so from here on out I mean, it's in everybody's interests to know how the waters are faring as opposed to a lot of guess work and presumptive closures as I am describing. Suffolk County, Southold Town Board Regular Meeting May 17, 2016 page 44 I attended the program yesterday as with some of your staff was there, a couple of things that hit me, I guess a couple of impressions, you have heard me speak of this, I have been before you over the years, encouraging local laws for advance treatment. I know it's a bit of a draft document as provided but ultimately it's absence of any standards, there's two references in the document, they are worded slightly different but with the same meaning, the IA systems, innovative advance systems, have to be better, denitrify better than conventional and, like, what is that? There's no metrics, there's no measurable's, there's no accountability on either performance so certainly the county, and I have been encouraging them, to set the bar high as I say with very rigorous standards meaning, performance that reduces nitrogen to the greatest possible levels, you know, the technology is out there, they are pretty basic stuff and you are probably hearing this. Cape Cod, we need to start introducing them locally to get nitrogen removal down to single digit levels and we can do so. The 50 percent removal as the county suggests, you know, 19 milligrams, parts per million that you may be hearing, I just think that's just really average and you know, we have got to do better and by requiring highest achievable standards, we can't go wrong with that because we know with our creeks and particularly our backwaters, you know, are overburdened and over the top with the influence of both wastewater and bacterial as well as nitrogen. Lastly, I strongly encourage, well, let me inject this. They are suggesting a very fast timeline on rolling this out, I think they brought in a very competent consulting firm, CVM something, I have seen their work in the past, they do good modeling work, they are going to do, embark on watershed assessments, you know, it's all good stuff but ultimately that process particularly with an impact study, it's likely to take a couple years out and the notion that these regulations and now I am describing to you, out of the box, they are deficient. You know, on the standards for nitrogen removal, they are absent. They are not in the draft document and you know, other than what I am describing, the, 19 milligrams, that's verbally suggested what our target is. That's not good enough, particularly when we know what's out there in the world, right here in Massachusetts this layered approach that we are hearing with carbon base, this is pretty basic chemistry. You know, Michael Collins, you know, great stuff with using wetlands. This is innovative, progress thinking that you have, that you are bringing forward yourselves. So, ultimately, this process is going to take longer than represented by the county yesterday and I will go right back to local authority, I think you are going to have to really start to enact some local laws require more stringent standards when it comes to discharges and you cannot go wrong and there cannot be conflict when you are requiring performance down to levels that are county approved systems and particularly in the realm of new development and you know, I am very candid with you. I was always direct but you know, I watch around my area of work, you know, both forks and the projects including in your township that were dropped, you know, these new proposals are coming forward. It's a fact of life for us. And to be stuck, deferring to Suffolk County to tell us what's best, you know, I think we are missing it and we have to start requiring better systems for wastewater treatment. So, again, the major points: really good framework to the plan, having thorough vetting by professionals that can guide you on this and you know, ultimately some local laws and raise the bar high so we realize some real benefits to water quality and again, that will be determined and defined by a good water quality monitoring program. Thank you once again for your attention to my comments and I have been at this a long time and granted, Kevin may have his, of course, opinion but I would like to suggest to you that it is scientifically based and well-informed because, you know, I am in it. Southold Town Board Regular Meeting May 17, 2016 page 45 SUPERVISOR RUSSELL: Let me just say, first of all, I can speak for myself saying I agree with just about everything that you just said. Because the worst thing we can do is start getting this money in and not have a very thoughtful, specific and deliberate way of spending it because there are so many worthwhile projects that we really need to evaluate everything and establish priorities. But I do have to say, the Board discussed today similar to what you had just recommend which is establishing standards that are more stringent than the county on wastewater systems and I think the board is willing to do that, we were just going to, hopefully by July the county is going to roll out their approvals for these systems and we didn't want to adopt legislation that simply wasn't addressable or actionable because it is currently not permitted but I do think that there's an interest on the Board to establish standards that are more stringent than the county's standards. But I would agree with you that yes, they didn't have very good (inaudible), look, I was there all day for the whole thing... MR. MCALLISTER: Oh, you were. SUPERVISOR RUSSELL: And that, the study is a great framework, their task assignments are very good, there's a couple of things that they didn't mention which are the standards. They used the word assumptions a lot. I would rather they used the word monitoring rather than just assumptions, I think they will get a better product if they spend more time on monitoring but you are right, I think they talked about a 12 or 18 month time frame for getting it done. Something along those lines. MR. MCALLISTER: Yeah. I thought it was closer to the year that they were representing but just understanding and recognizing the amount of work that needs to go into to this as they framed it, you know, I think we are looking a couple to several years out, I hope it's sooner but it's all good. I am very pleased and I don't mean to dismiss the county, as I have but it's a new day and I am very optimistic that finally, them stepping up and acknowledging that wastewater is problematic to our waterbodies and setting in motion at least some structure for corrective actions but you know, as I put in a Newsday letter a week ago, the half measures are just, they are not going to get it done and we are not going to get a second attempt at this, I don't see any recalibration and so why not strive for the highest achievable levels of treatment and start to get them in the ground as soon as we can, even if they are on single commercial scale or multi- family that we are seeing, you know, basically being proposed everywhere. So, thank you so much for the opportunity to address you. SUPERVISOR RUSSELL: Would anybody else like to address the Town Board? Kevin Mitchell KEVIN MITCHELL: I come before the Town Board because I care about our town, I care about the calm and beauty of Southold and I am coming before you because we have a major problem with trees in Southold, we have a lot of people coming to Southold and they are just clearing property left and right. I live over by McCabe's beach, my father lives over on Town Harbor Lane and in the last year, everybody buying houses, they are literally taking everything down. And I spoke to the supervisor, Scott, about it. We had a house, must have been 125 year old trees. No reason to take them down, he takes them all down. Even close to the road which I Southold Town Board Regular Meeting May 17, 2016 page 46 think was part of the road he took down. Junie Albertsons' house, right across from Joe Conway's house. That house was absolutely beautiful before. Cleared every single tree off that property, too. There's houses on Soundview Avenue, talking over 100 year old trees, they are taking them down because they don't like the trees. I had a house in the Village of Lattington, the Board made a tree proposal, that they have to come before the town before they can cut a tree down. Now Southold, there is no ordinance. They just come and take down whatever they want. Before you know it, Southold is going to be like Levittown. You look around but lately in the last year, it's just been, it's like an epidemic here. I see, and I see other people, they are waiting to come before the Board. They want to see how the board approached me coming to you. But it's like an epidemic in this town. Everywhere you turn, people are buying houses, they are all from the city and they just basically clear the property. I have from the Village of Lattington that any tree, they have to get a permit for a tree and the tree, you know, certain circumference and it really deters people from just going about clearing out their property. If they know that they have to have a permit, they would think twice about it. And you figure for a 100 year old tree, that's generations it takes to grow that tree and its like, if we don't do something now, before you know it and the way that Southold has been changing lately, it's going to be gone. The charm and beauty of Southold won't be here that long. Because, like I spoke Supervisor Scott about it and he had the same issue in some areas by him, so it's, I come before you because I care about Southold and if something is not done, I mean, Southold, we have a lot of properties being changed and it seems like everybody that has been buying these properties, I have pictures that I have taken, we have somebody just bought a house on Soundview Avenue, he has every single tree on the property tagged to be taken down. And there is a woman that lives across, she works for the Town of Southold and she says, I can't say much because I work here and she has an arborist that trims her trees. Now, here is somebody that just bought the house, in an all wooded area and he has all the trees bar none, going to be taken down. So, I don't know what else to say, you know,people keep saying the next guy. Well, you know what? The next guy is not going to be here, before you know it, there won't be very much left because I have seen it happen in Nassau County. You know, it's just one area after another. And like I said, the Village of Lattington, other areas like Matinecock, other areas, you can't even take a tree down. So, like I said, if you want to look at some pictures that I have, I have taken pictures recently and I just think that Southold should have some kind of ordinance to preserve what we have. SUPERVISOR RUSSELL: We actually talked about it, I assured you we would talk about it at work session and we did today. We certainly recognize it as a problem. Obviously the Board struggles with the private property rights component but we did talk about the impacts it has on a community wide basis particularly with stormwater runoff, road runoff. All those things, as people are clearing those lots and they are re-grading their yards, they are pumping a lot of water and silt into the public right of way and it's a community interest because the community has to pay to mitigate that rainwater. To catch it, put it in a basin. So, I don't think it's unreasonable for the Town to say, look, you need to reevaluate what you are doing on the site here. So we actually talked about starting, moving it over to discussion within the context of the drainage code. To expand the drainage code some to say, look, you can't just do whatever you want and have and put the impacts and costs onto your neighbors. MITCHELL: And also, too, there was a thing about the air quality in Suffolk County is one of the lowest in the State now and trees, they suck up all the pollution and everything else, so from the loss of trees on Long Island, its only adding to the poorer air quality. You know, there's health issues here, too.
