Adoption of the Riverside Brownfield Opportunity Areas
(BOA) Step II Nomination Plan as an Amendment to the
Southampton Town Comprehensive Plan
WHEREAS, the Town Board of the Town of Southampton, in accordance with §272-a, Town
Law, is authorized to prepare and adopt a comprehensive plan and amendments thereto;
and
WHEREAS, S272-a (2)(a), of Town Law enables a comprehensive plan and subsequent
amendments to be prepared in the form of written and/or graphic materials that identify
goals, policies, guidelines and other means for the immediate and long range protection,
enhancement, growth and development of the Town; and
WHEREAS, by resolution No. 328, dated March 12, 1999, the Town Board adopted the 1999
Comprehensive Plan Update as an update to the 1970 Master Plan, which sets forth
recommendations concerning the development strategy for the hamlets of Flanders,
Riverside and Northampton; and
WHEREAS, by Resolution No. 2013-1149 dated November 26, 2013, the Town Board of the
Town of Southampton authorized entering into a contract and Master Developer Agreement
with Renaissance Downtowns, to prepare a Riverside Revitalization Action Plan (RRAP) with
Proposed Zoning Overlay Districts and to work with the Town in close partnership to develop
plans, test market assumptions, obtain regulatory approvals, secure financing and
successfully implement a multi-stage redevelopment program for Riverside; and
WHEREAS, on January 22, 2014 the Town of Southampton was awarded a grant through
the New York State Department of State for the preparation of a Brownfield Opportunity
Area (BOA) Step II Nomination Study for the revitalization of the Riverside hamlet; and
WHEREAS, the Master Developer and the Town worked closely with the community to
develop the RRAP and the Riverside Overlay Zoning District that facilitates implementation
of the many past planning efforts that have been initiated by the Town for the Riverside
community and that provides a comprehensive planning framework for redevelopment of
the Hamlet; and
WHEREAS, by Resolution No. 2015-599, on June 9, 2015 the Town Board contracted with
Nelson, Pope & Voorhis, LLC, to prepare a BOA Step II Nomination Study with the
incorporation of the RRAP and Proposed Zoning Overlays and to prepare a corresponding
Draft Generic Environmental Impact Statement in order to review proposed zoning
amendments, analyze potential environmental impacts of development envisioned by the
RRAP and propose measures to mitigate any potential adverse impacts of the plan and
zoning overlays; and
WHEREAS the adoption of the Riverside BOA Study and Revitalization Action Plan (RRAP)
with Proposed Zoning Overlays is an action that was subject to environmental review
pursuant to 6 NYCRR 617 (State Environmental Quality Review Act - SEQRA) of the New
York State Environmental Conservation Law and Chapter 157 (Environmental Quality
Review) of the Code of the Town of Southampton; and

WHEREAS, by Resolution No. 2015-866, on August 25, 2015 the Town Board accepted the
Draft RRAP as complete for public review and coordinated with other identified Involved
Agencies for Lead Agency designation; and
WHEREAS, by Resolution No 2015-946, on September 24, 2015 the Town Board assumed
Lead Agency status in connection with the State Environmental Quality Review of the
Riverside BOA Step II Nomination Study and the RRAP and issued a Positive Declaration,
requiring the submission of a Draft Generic Environmental Impact Statement (DGEIS); and
WHEREAS, on October 5, 2015, the Town Clerk received a Draft BOA Step II Nomination
Study and Draft GEIS from Nelson, Pope &Voorhis, LLC; and
WHEREAS, by Resolution No. 2015-1001, on October 13, 2015 the Town Board deemed the
DGEIS adequate for public review; and
WHEREAS, on October 29, 2015, the Town Board held a combined public hearing on the
Riverside Brownfield Opportunity Area (BOA) Step II Nomination Study and Riverside
Revitalization Action Plan (RRAP), which will become elements of the Southampton Town
Comprehensive Plan; and on the Zoning Code Zoning Code and Map amendments; and the
accompanying Draft Generic Environmental Impact Statement (DGEIS); and
WHEREAS, Nelson, Pope & Voorhis, LLC prepared a Final GEIS in accordance with §617.10
of 6 NYCRR (SEQR), which provided responses to substantive comments compiled by the
Southampton Town Board as Lead Agency during the SEQR public review, including verbal
comments presented at the public hearings and written comments submitted by the public
and involved/interested agencies up to the period of 14 days after the close of the final
public hearing on October 29, 2015; and
WHEREAS, upon review of the Final GEIS the Town Board as Lead Agency found that it
adequately responded to comments and facilitated the preparation of findings and
legislative decision related to the adoption of the Riverside Brownfield Opportunity Area
(BOA) Step II Nomination Study, Riverside Revitalization Action Plan (RRAP), Zoning Map
and Code Amendments, and the accompanying Draft Generic Environmental Impact
Statement (DGEIS), which will become elements of the Southampton Town Comprehensive
Plan and Zoning Code.
WHEREAS, by resolution 2015-1227, on December 8, 2015, the Town Board as Lead Agency
found that the Final GEIS for the "Riverside Brownfield Opportunity Area (BOA) Step II
Nomination Study, Riverside Revitalization Action Plan (RRAP) and Zoning Code and Map
amendment" to be complete and a Notice of Completion of Final GEIS was filed for
publication in the Environmental Notice Bulletin (ENB) as prescribed by SEQRA (6 NYCRR)
§617.12; and
WHEREAS, the Town Board as lead agency afforded the public and involved/interested
agencies 10 days in which to consider the Final GEIS and provide any additional input that
was necessary to incorporate into the SEQRA Findings Statement; and
WHEREAS, after the requisite public consideration period, the Town Board requested that a
SEQRA Findings Statement be prepared by Nelson, Pope & Voorhis, LLC, which summarized
the facts and conclusions of the Draft GEIS and Final GEIS, considered public and agency
responses, weighed and balanced the relevant environmental impacts with social, economic
and other considerations, and provided a rationale for the Town Board's decision;

WHEREAS, on December 22, 2015, the Town Board accepted and adopted the SEQRA
Findings Statement prepared on its behalf by Nelson, Pope & Voorhis, LLC, dated December
22, 2015, pursuant to the State Environmental Quality Review Act and Chapter 157 of the
Town Code, and adopted amendments to Chapter 330 (Zoning) of the Town Code that
incorporated the Riverside Overlay District as a means for implanting the RRAP and BOA;
and
WHEREAS, the Draft BOA Plan was included as Appendix B in the Generic Environmental
Impact Statement and the Final BOA Plan has incorporated the comments that were
received from the NYS Department of State (DOS) on the draft plan and the Final BOA Plan
is complete;
NOW, THEREFORE BE IT RESOLVED, that the Riverside Brownfield Opportunity Areas Step II
Nomination Plan that was assessed in the Draft GEIS and Final GEIS is hereby adopted as
an amendment to the Southampton Town Comprehensive Plan.

BE IT HEREBY RESOLVED, that the Town Board hereby directs that a public hearing shall be
held on August 9, 2016, at 1:00 p.m., at the Southampton Town Hall, 116 Hampton Road,
Southampton, New York, to hear any and all persons either for or against a proposed local
law entitled: "A LOCAL LAW amending provisions of the Town Code to promote solar energy
systems as an accessory use in all zoning districts" which provides as follows:

BE IT ENACTED by the Town Board of the Town of Southampton as follows:
Section 1. Legislative Intent
Solar energy is a renewable and non-polluting energy resource that does not produce fossil
fuel emissions and will reduce a municipality's energy load. Energy generated from solar
energy can be used to offset energy demand on the grid. The Town of Southampton is
committed to such goals, and has articulated such in its Comprehensive Plan and
Southampton 400+ Sustainability Plan, which states "because climate change poses a direct
threat to the New York shoreline, any effort to reduce carbon footprint is a benefit to a
waterfront community like Southampton" and recommends that the Town "Support the
construction and expansion of, and improvements to all forms of energy supply
infrastructure as a means to provide enhanced environmental benefits, greater fuel diversity
and consumer choice to all Southampton Town residents". These amendments therefore
seek to increase the prevalence of solar by promoting the accommodation of solar energy
systems as an accessory use in all zoning districts.
Section 2. Amendment
Town Code §330-5 (Zoning, Definitions), of the Code of the Town of Southampton is hereby
amended by adding the underlined words alphabetically as follows:
§330-5. Definitions.
GROUND-MOUNTED SOLAR ENERGY SYSTEM: A Solar Energy System that is anchored to
the ground and attached to a pole or other mounting system, detached from any other
structure.
ROOF-MOUNTED SOLAR ENERGY SYSTEM: A solar panel system located on the roof of any
legally permitted building or structure.
SOLAR ENERGY EQUIPMENT: Electrical energy storage devices, material, hardware,
inverters, or other electrical equipment and conduit of photovoltaic devices associated with
the production of electrical energy.

SOLAR ENERGY SYSTEM: A system that transforms solar energy into another form of
energy or transfers heat from a collector to another medium using mechanical, electrical, or
other means.
SOLAR PANEL: A device capable of collecting and converting solar energy into electrical or
thermal energy.
Section 3. Amendment.
Town Code §330-67 is hereby amended by adding the underlined words as follows:
§330-67. Protection of natural vegetation.
A. To ensure maximum water recharge and to minimize the potential for fertilized
vegetation, natural vegetation located on a tract or lot shall be preserved to the
maximum extent possible, consistent with the following parameters:
(4) Residential lots and tracts:
(a) For residential lots, the amount of disturbance of natural vegetation shall not
exceed the following percentages, except on flagpolc lots, whcrc thc or a of thc
perm ittcd:
(1) the pole portion of a flagpole lot shall be exempt for the total lot area and
the total amount of clearing permitted; and.
(2) Ground-Mounted Solar Energy Systems having a minimum output of 5,000
kw and a maximum of 4,500 square feet shall be exempt from the total
amount of clearing permitted; provided that no more than 20% of this
exempt area shall contain impervious surfaces. If such system is removed
or becomes inoperable, the subject lot shall be revegetated so as to comply
with the clearing restriction of this section, per a site disturbance plan
approved by the Planning Board pursuant to §330-67A(1).
Section 4. Amendment.
Town Code §330-76 is hereby amended by adding the underlined words as follows:
§ 330-76. Placement of accessory buildings, structures, and uses in all districts.
L. Solar Energy Systems.
All such systems are permitted as an accessory use in all zoning districts when the primary
purpose is for producing electricity or thermal energy for onsite consumption.
(1) Roof-Mounted Solar Energy Systems.
(a) All such systems are subject to the requirements of §123-39.1.
(b) Height. Shall not exceed the maximum height restrictions of the zoning
district within which they are located.
(c) Aesthetics. Roof-Mounted Solar Energy System installations shall incorporate
the following design requirements:
a. Solar Energy Equipment shall be installed inside walls and attic
spaces to reduce their visual impact.
b. Panels facing the front yard must be mounted at the same angle as
the roof's surface with a maximum distance of 6 inches between the
roof and highest edge of the system.

(2) Ground-Mounted Solar Energy Systems.
(a) Maximum Height shall not exceed 10 feet.
(b) Shall adhere to the setback requirements pursuant to §330-77G, as well as
transition yard requirements pursuant to §330-83, as may be applicable, but
in no case shall it be located closer than 10 feet from any property line.
(c) All such systems shall be installed in the side or rear yards.
Section 5 Amendment.
Town Code §330-77D is hereby amended by adding the underlined words as follows:
330-77. Placement of accessory buildings, structures, and uses in residence districts.
D. Accessory building and/or structures to be located or constructed in any
residential zone in the required rear yard for a main or principal building shall not
occupy more than 20% of such required rear yard, except for the area of the
footprint associated with a Ground-Mount Energy System having a minimum
output of 5,000 kw, and decks and patios within 12 inches of grade. The total lot
coverage shall not exceed the maximum lot coverage provided in §330-11.
SECTION 6. Authority.
The proposed local law is enacted pursuant to Town Law Article 16 and Municipal Home Rule
Law §10(1)(ii)(a)(11) and §10(1)(ii)(d)(3).
SECTION 7. Severability.
If any section or subdivision, paragraph, clause, phrase of this law shall be adjudged invalid
or held unconstitutional by any court of competent jurisdiction, any judgment made thereby
shall not affect the validity of this law as a whole or any part thereof other than the part or
provision so adjudged to be invalid or unconstitutional.
SECTION 8. Effective Date.
This local law shall take effect upon filing with the Secretary of State pursuant to the
Municipal Home Rule Law.

the proposed law to the Southampton Town Planning Board as well as the Suffolk County
Planning Commission for their review and recommendations; and be it

County Grant for the Purposes of Creating the Tiana Bayside
Marine Education and Outreach Center and Authorize the

WHEREAS, in 2012, the Town of Southampton applied for an Incentive Based Septic
Inspection grant from the Department of Economic Development and Planning, this grant
was for $120,000 with a $60,000 match from each entity; and
WHEREAS, the Town never went further than the application process and the County of
Suffolk has agreed to allow the Town to re-purpose this grant and apply for a new grant for
the creation of the Tiana Bayside Marine Education and Outreach Center, provided that the
following conditions are met:
-the Town of Southampton agrees to be the "lead agency" in any SEQRA determinations
and that compliance will be met with all applicable SEQRA regulations; and
-the Town of Southampton agrees to provide a 50% match to the County's match or
($60,000) which the Town will provide in like kind funds by its Parks and Recreation
Department; and
-the Town of Southampton agrees to enter into an Inter-Municipal Agreement with the
County of Suffolk for the funding of this project; and
WHEREAS, this grant funding will then be re-purposed to create the Tiana Bayside Marine
and Education and Outreach Center in cooperation with Cornell Cooperative Extension at the
Town's Tiana Bayside Recreational Facility; and
WHEREAS, the intent of this center is to engage and educate the residents of Southampton
about Marine and Coastal issues which will include classroom space, small scale shellfish
production nursery, eel & beach grass restoration and improvements to the outdoor space;
and
WHEREAS, the Town and Cornell are hoping to have this center be a place where field trips
can be organized and local school children can learn about the ecological importance of the
reserve; now therefore, be it
RESOLVED, that the Town Board of the Town of Southampton hereby agrees to re-purpose
the 2012 Septic Inspection grant from the Department of Economic Development and
Planning into a grant to create the Tiana Bayside Marine and Education and Outreach Center
and the Town Board of the Town of Southampton also authorizes the Supervisor to execute
any and all documents pertaining to this grant including but not limited to an Inter-

WHEREAS, the New York State Brownfield Opportunity Area (BOA) program was established
to provide assistance to municipalities and/or community-based organizations to revitalize
neighborhoods affected by the presence of abandoned, vacant, and blighted properties; and
WHEREAS, the Town of Southampton was awarded funding through the New York State
Department of State BOA Program to complete a BOA Step II Nomination Study for the
Hamlet of Riverside; and
WHEREAS, the Draft Nomination Study, Generic Environmental Impact Statement and the
Findings Statement pursuant to the New York State Environmental Quality Review Act were
completed and accepted by the Town of Southampton in December 2015; and
WHEREAS, the recommended zoning for the Riverside Overlay District for which a
theoretical development scenario was analyzed in the Generic Environmental Impact
Statement and a Form Based Zoning Code were adopted into law by the Town of
Southampton on December 22, 2015; and
WHEREAS, this newly adopted Riverside Overlay District sets the stage for the
redevelopment and revitalization of the Riverside community, for which there is enthusiastic
community support; and
WHEREAS, the Final BOA Nomination Study was modified by the Town's consultant, Nelson,
Pope &Voorhis, to reflect input from the Town of Southampton and New York State
Department of State and said study was adopted by the Town Board on June 28, 2016; and
WHEREAS, the planning and implementation strategies developed by communities
participating in the BOA program lay the framework to spur revitalization of distressed areas
by establishing clear priorities for redevelopment and other actions for community renewal
and improved quality of life; and
WHEREAS, communities with a BOA Nomination that appropriately reflects community
priorities, presents an attainable and realistic plan to promote redevelopment, and is
consistent with the applicable provisions of the General Municipal Law, Article 18 - C,
Section 970-r, may request designation of that BOA by the Secretary of State; now
therefore be it
RESOLVED that, pursuant to the process for requesting BOA designation, the Town Board of
the Town of Southampton hereby authorizes and directs the Town Clerk to publish the
