WEILE REVOCABLE TRUST, c/o V. REGI WEILE SCTM# 1000-21-1-11 V.R. WEILE REVOCABLE TRUST, c/o V. REGI WEILE requests a Wetland Permit for the existing 3' wide bluff stairs with associated 12.5'x4' top landing, an 11.7'x3' upper landing, a 18.2'x3' middle landing, a 4'x3' lower landing, and 8.2'x12' deck with T wide steps to beach at bottom of bluff stairs; and for the existing 9.4'x14.4' shed on beach. Located: 905 Aquaview Avenue, East Marion. SCTM# 1000-21-1-11 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my determination that the proposed actions are INCONSISTENT with the following Policy Standards and therefore is INCONSISTENT with the LWRP. 4.9 Minimize losses of human life and structures from flooding and erosion hazards. The cottage is located seaward of the Coastal Erosion Hazard Area (CEHA). The unpermitted shed is not permitted in the CEHA. Figure 1. Subject parcel. A. Minimize potential loss and damage by locating -development and structures away from flooding and erosion hazards. Avoid development other than water -dependent uses in coastal hazard areas_ b. Avoid hazards by siting structures to maximize the distance from Coastal Erosion Hazard Areas. The shed does not require a location on the coast, is not water dependent or a public facility. It is recommended that the cottage be re -located off the beach and out of the CERA. 3. Move existing development and structures as far away from flooding and erosion hazards as practical. Maintaining existing development and structures in hazard areas may be warranted for. a. structures which functionally require a location on the coast or in coastal waters. b. water -dependent uses which cannot avoid exposure to hazards. C. sites in areas with extensive public investment, public infrastructure, or major public facilities. The shed is located with the FEMA flood zone VE (Velocity Hazard). It is recommended that the shed be relocated outside of the VE flood zone. 6.3 - Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The structures were constructed without the proper permits. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
