Located: 41270 Main Road, Orient. SCTM# 1000-15-9-16 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP provided that the Board requires the following: 1. Clarify the need to fill in 600 square feet of public waters. In the event that the action is approved the following BMP is required pursuant to: § 275-11. Construction and operation standards. A. General. The following standards are required for all operations within the jurisdiction of the Trustees: (2) Erosion control. Installation of an erosion control structure is necessary during any building, grading, landscaping or site work activity within Trustee jurisdiction. This structure may include, but is not limited to, installation of a silt fence, hay bales, wood chip berm and silt booms. The placement of the erosion control structure(s) shall be determined by the Trustees or their designee. All intertidal construction and excavation requires the installation of a silt boom that will retain all suspended sediments within the immediate project area. Require the installation of a silt boom. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Cross Sound Ferry Terminal Rehabilitation Project Town of Southold—Wetland-Coastal Erosion Application Project Narrative ' Part I. Project Description: This shovel-ready'rehabilitation project will revitalize key components of the Cross Sound Ferry Service's terminal at Orient Point, New York. The rehabilitation project includes installing temporary berthing dolphins,construction of a new bulkhead,as well as removal and rehabilitation of the existing vehicle access ramps and replacement of the support structures. The rebuilt ramps will remain the same size as the existing ramps. The existing bulkhead is estimated to have been installed approximately 70 years ago and has undergone a number of maintenance events,in the past although it has never been wholly rehabilitated. The current condition of the bulkhead requires rehabilitation as it has begun to exhibit signs of degradation. The existing bulkhead is approximately 270 feet in length. The entire dock area is approximately 20,000 square feet. The bulkhead will be renewed by installing approximately 270 feet of new bulkhead along the shoreline in front of the existing degrading bulkhead that is currently used for ship docking. The proposed work will permanently fill approximately 600 square feet of water area. To accommodate continued operations without interruption during the construction,the temporary docking dolphins will be installed. In coordination with the bulkhead work,the vehicle access ramps and stanchions will be removed and rehabilitated and support structures will be replaced. The rehabilitated terminal will have a life expectancy of 50 years with normal maintenance. To accomplish this project,Suffolk County(the County),an eligible 5,307 recipient, is sponsoring this application on behalf of Cross Sound FerryServices, Inc. (CSFS),with offices at 2 Ferry Street, P.O. Box 33, New London,Connecticut 06320,a private entity,and the owner and operator of the ferry services. Upon award from FTA,the County will enter into an agreement with CSFS,whereby CSFS will commit to executing the project under the administrative oversight of the County. This project is shovel-ready and can be completed within 12-18 months from award. Cross Sound Ferry has already applied for and received a permit from New York State Department of Environmental Conservation (NYS DEC)for this work. Having the permit in place at the time of this application is estimated to allow for the project to begin 6-12 months in advance of not having the permit in hand. At the time of this application, Cross Sound Ferry has designed and completed the bulkhead rehabilitation plan. These improvements will help preserve and enhance an existing ferry terminal allowing continued operations,which will provide a vital service to the residents of Long Island and New England. Cross ,. Sound Ferry operates daily year-round passenger and vehicular ferry service between Orient Point, New ( York and New London,Connecticut with over 14,000 annual one-way trips. As one of the largest vehicle and passenger ferry operators in the United States,Cross Sound Ferry transported just over 1.1 million passengers and 430,000 vehicles in 2012. L Hazardous Materials: An environmental record database search was reviewed for the Cross Sound , Ferry property located at 41270 Main Road in Orient, New York. The state environmental database contained records of two environmental releases at the site: a. April 8, 2005—The saddle tank of a tractor trailer truck was damaged as the truck was being unloaded from the ferry. An estimated 50 gallons of diesel fuel'was released from the tank to the pavement and was contained by CSF personnel using absorbent materials. b. August 9, 1993=A 275-gallon aboveground tank located next to a small building was- accidentally filled beyond capacity resulting in a release of No.2 fuel oil to the ground. Neither environmental release is believed to have an effect,or to be affected by,the proposed project. The magnitude of the releases were relatively minor,were contained,and corrective actions were undertaken at the time of the releases. J. Navigable Waterways: The Cross Sound Ferry is an approved facility that operates daily between ' Orient Point, New York and New London,Connecticut. The proposed bulkhead repair and dolphin installation is scheduled to be completed during the winter months(November through March)when the species listed above are not -actively foraging and are using the waters immediately adjacent to the existing bulkhead and/or dolphins. In addition the project does not propose any impacts to the sandy shoreline areas located to the west and east of the ferry terminal. These sandy shoreline areas would have the potential to support piping plover, least tern, and red knot foraging habitat between April and October and not during the anticipated construction schedule. The ground surface behind the existing bulkhead will be disturbed when installing the proposed bulkhead, pile and anchor rod tie back system.The bulkhead and anchor piles will be installed by crane from land. Best management practices per the New York State Standards and Specifications for Erosion and Sediment Control will be used around these areas,and use straw bale dikes or silt fence. , In addition, Gardiners Bay water quality will be protected throughout construction using best management practices including the use of turbidity curtains,silt booms, and oil booms. For the reasons presented above the project will have no adverse effect on endangered and/or threatened species. , M. Water Quality: The proposed project does have the potential to impact water quality during construction. Temporary impacts to nearby residents and businesses will be a moderate increase in noise during the driving of the proposed sheet piling,which will likely be done with a vibratory hammer.
