Patricia C. Moore, Esq. on behalf of PETER & DIANA O'NEILL request a Wetland Permit for the
existing 4'x135' wood walk with steps from top of bank to an existing wood deck that is 58' in total
length consisting of a section which is 29' long by 8'wide, and a section that is 29' long by16' wide
along the landward edge of the bulkhead; existing 16.2'x30.4' boat house; two existing 15' bulkhead
returns; and 15' of existing dilapidated bulkhead with a 5' return. Located: 5875 Vanston Road,
Cutchogue. SCTM# 1000-118-1-1.3
The proposed actions have been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the proposed actions are INCONSISTENT with LWRP Policy 6, specifically 6.3 (below) and
therefore, INCONSISTENT with the LWRP.
6.3. Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees
laws and regulations for all Andros Patent and other lands under their jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions.
The structures were built without the benefit of Board of Trustee review and permits.
Policy 4.1. Minimize losses of human life and structures from flooding and erosion hazards.
The following management measures to minimize losses of human life and structures from
flooding and erosion hazards are recommended:specifically
A. Minimize potential loss and damage by locating development and structures
away from flooding and erosion hazards.
3. Move existing development and structures as far away from flooding and
erosion hazards as practical. Maintaining existing development and structures in
hazard areas may be warranted for:
a. Structures that functionally require a location on a coast or in coastal
waters.
The accessory structure does not functionally require a location on the
coast and is not water dependent.
5. Manage development in floodplains outside of coastal hazard areas so as to
reduce adverse environmental effects, minimize the need for future structural
flood protection measures, or expansion of existing protection measures and to
meet federal flood insurance program standards.
The boat house is located in the AE FEMA Flood Zone— El 6'. AE flood
zones are defined as areas with special flood hazards associated with structure
loss from flooding during storm events. These areas are subject to inundation by
the 1-percent-annual-chance flood event.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

LWRP CONSISTENCY ASSESSMENT FORM Southold Town
Planning Board
A. INSTRUCTIONS
1. All applicants for permits* including Town of Southold agencies, shall
complete this CCAF for proposed actions that are subject to the Town of
Southold Waterfront Consistency Review Law. This assessment is intended to
supplement other information used by a Town of Southold agency in making a
determination of consistency. *Except minor exempt actions including
Building Permits and other ministerial permits not located within the
Coastal Erosion Hazard Area.
2. Before answering the questions in Section C,the preparer of this form
should review the exempt minor action list,policies and explanations of
each policy contained in the Town of Southold Local Waterfront 1
Revitalization Program. A proposed action will be evaluated as to its
significant beneficial and adverse effects upon the coastal area(which (-2

3. If any question in Section C on this form is answered "yes",then the _
proposed action may affect the achievement of the LWRP policy standards and
conditions contained in the consistency review law. Thus,the action should
be analyzed in more detail and, if necessary,modified prior tamaking a
determination that it is consistent to the maximum extent practicable with
the LWRP policy standards and conditions. If an action cannot be certified
as consistent with the LWRP policy standards and conditions, it shall not be
undertaken.
