Main Rd. &Youngs Ave.) Southold, NY 11971 _�ly Pp'��� Telephone: 631 765-1938 err - -... /0' • LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To: John Bredemeyer, President Town of Southold Board of Trustees From: Mark Terry, Principal Planner LWRP Coordinator Date: October 19, 2015 Re: LWRP.Coastal Consistency Review for LOIS ANDERSON SCTM# 1000-70-4-45.5 Suffolk Environmental Consulting on behalf of LOIS ANDERSON requests a Wetland Permit for a Ten Year Maintenance Permit to maintenance dredge an area along the south-westerly bulkheading to a depth of-3.0' during average low water; the area of proposed maintenance dredging measures ±3,500sq.ft. and will result in approximately 200 cubic yards of dredge spoil to be kept on site and deposited along the southeasterly shoreline, landward of the apparent high water mark to dewater, then grade/groom and plant with native vegetation (i.e. Cape American Beach grass (Ammophila breviligulata @ 1.0' o/c); siltation fencing will be installed along the seaward side of the deposited dredge spoil; and the proposed dredged area will include 1:3 slopes along the edges for stability. Located: 2515 Calves Neck Road, Southold. SCTM# 1000-70-4-45.5 The proposed actions have been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed actions are INCONSISTENT with LWRP Policy 6, specifically 6.3 (below) and therefore, INCONSISTENT with the LWRP. 6.3 Protect and restore tidal and freshwater wetlands. F. Restore tidal wetlands and freshwater wetlands, wherever practical, to foster their continued existence as natural systems by: 4. protecting lands adjacent to wetlands from alterations so as to maximize natural buffers to wetlands. The buffers are necessary to ensure the long term viability of the Town's wetlands. The proposal to place the dredge spoil on beneficial wetland/transitional vegetation which serves as a vegetated buffer that protects water quality is inconsistent with this policy. It is recommended that the dredge spoil be located off-site to an approved disposal location. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C,the preparer of this form should review the exempt minor action list,policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area(which includes all of Southold Town). 3. If any question in Section C on this form is answered"yes",then the proposed action may affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus,the action should be analyzed in more detail and, if necessary,modified prior to making a determination that it is consistent to the maximum extent practicable with the LWRP policy standards and conditions. If an action cannot be certified as consistent with the LWRP policy standards and conditions, it shall not be undertaken.
