WHEREAS, a public hearin 1987 in the Matter of the Appl Appeal No. 3655; and g was held and concluded on August 20, ication of ELLEN HOPE DeMARIA under WHEREAS, at said hearing all those who desired to be heard were heard and their testimony recorded; and WHEREAS, the Board has carefully considered all testimony and documentation submitted concerning this application; and WHEREAS, the Board Members have personally viewed and familiar with the premises in question, its present zoning, and the surrounding areas; and are WHEREAS, the Board made the following findings of fact: 1. By this application, appellant requests a Variance from the Provisions of Article III, Section 100-32, and Article XIV, Section lO0-141(C) for approval of the construction of an accessory storage shed of a size 20' by 12' and as more parti- cularly shown on survey prepared by Roderick VanTuyl, P.C. dated April 9, 1984. 2. The premises in question is a described parcel of land containing a total area of one acre with frontage of 155.52 feet along the west side of "Private Road" located off the westerly end of South View Drive, Orient. 3. The subject premises is improved with one single-family dwelling house with a setback of 94± feet from the front property (CONTINUED ON PAGE TWO) DATED: September 10, Foz~n ZB4 (rev. 12/81) 1987. The subject premises is located in the "A-40" Residential and Agricultural Zoning District. 5. For the record it is noted that under Appeal No. 785 rendered July 8, 1965, a conditional variance was rendered for the placement of the subject accessory building in the frontyard area as applied therein with a setback of 30 feet from the front property line. 6. Certificate of Occupancy #Z4778 was issued August 30, 1972 for a "private one-family dwelling" without reference to the subject accessory building. 7. By building-permit application of recent date, it was noted that the accessory building was located was a setback of less than that required by the 1965 variance, requiring this additional variance application. 8. The accessory building as exists is used and will continue to be used for residential storage purposes incidental to the existing residence and not to be operated for gain, and shall not exceed the present height of 11 feet (which exists at the present time). 9. It is the opinion of this Board that: (a) appellant's request is not unreasonable and circumstances of the past history in this matter lends to difficulties; (b) the variance will not in turn be adverse to the safety, health, welfare, comfort, convenience, or order of the town; the the (c) the relief requested is not substantial in relation to the requirements; (d) there is no other method feasible for appellant to pursue other than a variance; (e) there will be no detriment to adjoining properties; (f) in view of all the above factors, the interests of justice will be served by granting the variance as applied. Accordingly, on motion by Mr. Goehringer, seconded by Mr. Sawicki, it was RESOLVED, to GRANT the relief requested under Appeal No. 3655 in the Matter of the Application of ELLEN HOPE DeMARIA for the placement of an accessory storage building with a setback of 20± feet from the front property line, as exists and more particularly shown on survey prepared by Roderick VanTuyl, P.C. dated April 9, 1984, and SUBJECT TO THE FOLLOWING CONDITIONS: 1. No expansion or increase Z.B.A. approvals; 2. Accessory building to the existing dwelling only; 3. Accessory building facilities; 4. Accessory building applied with limitations on the Vote of the Board: Ayes: Douglass and Sawicki. The Chairman opened the hearing at 8:22 o'clock p.m. and read the notice of hearing and application for the record. CHAIRMAN GOEHRINGER: I have a copy of survey produced by Roderick VayTuyl, P.C.; the most recent date is mentioned in the application as April 19, 1984, indicating the approximate placement of a storage shed at 20 feet from the private road as indicated in the application. And I have copy of the Suffolk County Tax Map indicating this and sur- rounding properties in the area. Is there somebody who would like to be heard? Mr. DeMaria, is there anything you'd like to say sir? MR. DEMARIA: No. I think you said it all. I think the original ap- plication for a variance was in error as far as the measurement was concerned because the shed was already on the land. It came from Bob's farm I think in 1965 and it was set down there and then we were told we needed a variance. So we were only~asking for a variance to approve it where it already was and we tried to measure the distance to the .... There was no marker. I used a telephone pole, as you can see right there, instead of that marker. I mis-measured. So I asked for 30 feet and I should have asked for 20. If I had gotten VanTuyl up there in '65, instead, he came up and did another survey ih '66 the following year. It turned out that there was a ten foot difference. CHAIRMAN GOEHRINGER: Mr. DeMaria, is this property used for anything other than a storage shed? ~ MR. DEMARIA: No. CHAIRMAN GOEHRINGER: This building I should say. And you have no ob- jection to the re-enhancement if the. Board so desires to grant this in the area of where it's granted or where it's placed right now? That the building not be used for anything but a storage shed. You have no objection? MR. DEM-ARIA: NO.
