AND RIVER CIRCLE CORP. for Variances to the Zoning Ordinance, Article III, Section 100-31, Bulk Schedule, for approval of insufficient lot area, depth and width of two parcels in this pending division of land, fronting along Linnett Street and Flint Street, Greenport Driving Park Lots 68 and 76, Greenport, NY; County Tax Map District 1000, Section 48, Block 2, Lot 32 and 28. WHEREAS, a public hearing was held and concluded on April 2, 1987 in the Matter of the Application of FLINT ST. CORP. AND RIVER CIRCLE CORP. under Application No. 3616; and WHEREAS, at said hearing all those who desired to be heard were heard and their testimony recorded; and WHEREAS, the board has carefully considered all testimony and documentation submitted concerning this application; and WHEREAS, the board members have personally viewed and are familiar with the premises in question, its present zoning, and the surrounding areas; and WHEREAS, the board made the following findings of fact: 1. The premises in question is referred to as Lots 68 and 76 as shown on "Map of Property of Greenport Driving Park," filed December 1, 1909 as Map No. 369, and is more particularly shown on the Suffolk County Tax Maps as District lO00, Section 48, Block 2, Lot Nos. 32 and 28. 2. The entire premises as exists contains a total area of 11,256 sq. ft., average lot depth of 225.13 feet, and 50 ft. lot width. The premises is presently improved with a single- family dwelling with setbacks of 1½ feet from the west side property line, 75 feet from the front property line along Flint Street, 26± feet from the easterly property line, 116+ feet from the front property line along Linnett Street. .(CONTINUED ON PAGE TWO) DATED: April 30, 1987. By this application, appellants request area variances for approval of (a) insufficient lot area of 5,628 sq. ft., lot depth of 112.57 feet, and lot width of 50 feet, of the southerly proposed lot; (b) insufficient lot area of 5,628 sq. ft., lot depth of 112.57 feet, and lot width of 50 feet, of the proposed northerly lot, as more particularly shown by survey prepared November 5, 1986 by Roderick VanTuyl, P.C. 4. Submitted for the record is a copy of the January 30, 1987 approval from the Suffolk County Department of Health Services (#87-32) concerning this preexisting subdivision "Map of Greenport Driving Park," Lot No. 76 and 68. 5. It is the understanding of the Board that the existing dwelling is serviced by Village water. Information concerning the existing cesspools was not furnished for the record. The proposed southerly parcel is to be serviced by both Village water and sewer utilities. 6. For the record it is noted that an application is pending at this time before the Southold Town Planning Board for subdivision set-off approval. 7. Article III, Section lO0-31, Bulk Schedule of the Zon- ing Code requires a minimum lot area of 80,000 sq. ft., minimum lot width of 175 feet, and minimum lot depth of 250 feet. 8. The amount of relief requested from the lot area requirements is 74,372 sq. ft., or a percentage of 92.5%. 9. Upon information and belief, the subject premises was not held in single and separate ownership, although the lots are shown as Lots 76 and 68 on the 1909 Subdivision Map of "Greenport Driving Park." It is also the understanding of this Board that to date, no subdivision or set-off approvals have been rendered by the T'own concerning this property. 10. In viewing the immediate area, the Board finds that the following Lots as shown on the "Map of Greenport Driving Park" in the immediate vicinity of the subject premises do not appear to have been "held in single and separate owner- ship prior to November 23, 1971 and thereafter" as required by Article III, Section lO0-31(A) of the Zoning Code: (a) Lots 7 and 8; (b) Lots 9 and 10; (c) Lots 71 and 72; (d) Lots 73 and 74; (e) Lots 87 and 89; (f) Lots 54 and 55; (g) Lots 48, 49 and 50; (h) 51 and 52; (i) Lots 67 and 66; (j) Lots 64, 63, 62, 61 and 18; (k) 60, 59, 26 and 28. ll. It has been held by the Courts (VanDusen v. Jackson, 35 AD2d 58) that a Board of Appeals cannot under the semblance of a variance exercise legislative powers. It is apparent that the variances requested are substantial with respect to lot area, lot width, and lot depth, and would in effect establish a zone district completely at odds with all other zone districts provided for in the zoning code and zoning map. This board does not believe that it has the authority to create new zoning districts under the guise of a variance. It is the consensus of the Board that this and other similar subdivisions created prior to the enactment of zoning in 1957 could be included in the "Exceptions" List of the Zoning Code alternatively. NOW, THEREFORE, on motion by Mr. Grigonis, seconded by Mr. Sawicki, it was RESOLVED, that it is the determination of this Board that for the reasons set forth above it is without jurisdiction to grant the relief as requested, and the appeal is therefore DENIED. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary HARDSHIP because applicant wishes to resparate two existing lots which show as separate lots on both the Suffolk County Tax Map (I.D. # 1000-48-2-28 & 32) and the original fi]ed map #369 enititled the Greenport Driving Park. The lots which will result from reseparation wilI be similar in size to the majority of lots in the area. Both lots have frontage on separate streets. Strict application of the ordinance will deny applicant full enjoyment and value of their property in spite of the general conformity of the pro- posed use with the character of the area. 2. The hardship created is UNIQUE and is not shared by all prope~ies alike in the immediate vicinity of this property and in this use district because most lots in the area are smaller than the applicant's merged lot; most lots tn the area are identical to the applicant's pro- posed lots; very few lots in the area run from street through to the next street as does the applicant's. 3. CORP. AND RIVER CIRCLE CORP. Variances for approval of insufficient lot area, depth and width of two parcels in this pending division of land. Linnett and Flint Streets, Greenport Driving Park Lots 68 and 76, Greenport. The Chairman read the legal notice and application for the record. CHAIRMAN GOEHRINGER: I have a copy of a survey indicating lot ~76 at 5,628 square feet with a 1½ story framed house three feet from the rear property line. Parcel #2, 5,628 square feet also, lot #69 which is vacant. And I have a copy of the Suffolk County Tax Map indicating this and surrounding properties in the area. And an analysis summary indicating what lots'are built on and what are not provided to us from the applicant or the agent of the application; to be incorporated in the file. Would you like to be heard Mr. Kapell? MR. KAPELL: Mr. Chairman, members of the Board. The application is pretty self explanatory. If I can emphasize a couple of points. These are two existing merged lots which still show on the Suffolk County Tax Map as separate lots. They are unusual in that they do run .... It's narrow in its merged form, it's a narrow deep lot which would have minimal use as one lot and it fronts on two sepa- rate streets. In addition, the lots in the neighborhood for the most part, are identical if not very similiar to the proposed lots that would result in approval by this Board. I~oth lots... Excuse me. The existing house is already served with village water and the proposed lot will be served with village water and sewer. And it's another opportunity for the Zoning Board to give an approval which would result in the addition to the inventory of smaller lots which would be affordable in lower prices to people of lesser means and who are out of the market for large one acre or two acre lots. CHAIRMAN GOEHRINGER: Can you just tell me if the existing cess- pools on lot #76 are on lot #68? MR. KAPELL: I don't know. I honestly don't know. It's a ques- tion that we have thrown around. Yesterday as a matter of fact. I don't know° I can't say that if they're located on lot #68, that we will relocate them or tie into the sewer. Because ob- viously, they pose a problem to the use of the proposed lot. CHAIRMAN GOEHRINGER: The other question that I had was, you have no indication or intention of repositioning that house on lot #76? MR. KAPELL: No I don't. That house, by the way, predates, as far as I can tell, the subdivision in the area. That's an old house. It's been there for a long time. Page 2 - April, 1987 Public Hearin~ Flint Sto Corp. CHAIRMAN GOEHRINGER: There is no sewer system on the unpaved part of Flint Street° Is that correct? MR. KAPELL: There is no sewer system on this part of Flint Street. That's right. I think there is sewer now at the other end. There is sewer to Brown Street. CHAIRMAN GOEHRINGER: On Leonard Street and Brown Street or just Leonard Street? MR. KAPELL: No. Just on Leonard Street. CHAIRMAN GOEHRINGER: Was that recently put in? MR. KAPELL: No. It's been there for quite some time. CHAIRMAN GOEHRINGER: It has. And that runs off of 6th Street and comes in through the back? MR. KAPELL: It runs off of 6th Street and then it loops around on 9th Street and runs down to Driftwood Cove. CHAIRb~N GOEHRINGER: So this is actually the sewer line that runs down Driftwood Cove. MR. KAPELL: To the best of my knowledge. Whether there was another connection to the Front Street, there may be. There may also be a connection to the sewer on Front Street. I'm just not familar with it. But I know that it makes the turn from Leonard Street and runs down Leonard Street toward Front Street. CHAIRMAN GOEHRINGER: Ok. Let's see what develops. I thank you very much Mr. Kapell. MR.
