WHEREAS, a public hearing was held and concluded on April
1987 in the Matter of the Application of GULL POND DAWN CORP.,
File No. 3609; and
WHEREAS, at said hearing all those who desired to be heard were
heard and their testimony recorded; and
WHEREAS, the board has carefully considered all testimony and
documentation submitted concerning this application; and
WHEREAS, the board members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the board made the following findings of fact:
1. By this application, appellant requests a Variance from
the Provisions of Article XI, Section lO0-119.2(B) to construct
a new dwelling structure with an insufficient setback at its
closest point at not less than 42 feet from the nearest waters
edge, or bulkhead, as more particularly depicted by survey prepared
December 25, 1987 (sic) by Peconic Surveyors & Engineers, P.C.
2. The premises in question is located along the east side
of Dawn Drive, Greenport, and is located in the "A" Residential
and Agricultural Zoning District.
3. The subject premises is

4. Artic!le XI, Section 100-119.2, subparagraph (B) requires
all buildings ~nd structures located on lots adjacent to tidal
water bodies o~her than the Long Island Sound to be set back not
less than seventy-five (75) feet from the ordinary hi§hwater mark
of'such tidal Water body, or not less than seventy-five (75) from
the landward edge of the tidal wetland, whichever is the greater
distance.
5. The Courts have held that the area setback variance must
meet the "practical difficulties" standard, considering as
follows: (a) the relief requested is not substantial in rela-
tion to the requirement; (b) the project as proposed is not
out of character with the neighborhood; (c) the circumstances
of the property are unique and are not personal in nature;
(d) the variance will not in turn be adverse to the safety,
health, comfort, convenience or order of the town; (e) the
variance requested is the minimal necessary; (f) there is
no other method feasible for appellants to pursue other than
a variance.
6. It islthe opinion of this board that: (a) the relief
requested is the minimal necessary under the circumstances;
(b) the project as pro.posed is not out of character with the
neighborhood; (c) the circumstances of the property are
unique and are not personal in nature; (d) the variance-
will not in turn be adverse to the safety, health, comfort,
convenience or, order of the town; (e) there is no other
method feasible for appellants to pursue other than a variance;
(f) the percentage of relief requested is substantial in
relation to the zoning requirement; however, there are estab-
lished setbacks existing in the area similar to that proposed
herein.
7. It is noted for the record that: (a) a waiver under
File #10-87-0242 was issued by the N.Y.S. Department of
Environmental Conservation dated March 5, 1987; (b) a
conditional permit was granted by the Southold Town Trustees
March 26, 1987.
NOW, THEREFORE, on motion by Mr. Goehringer, seconded by
Mr. Douglass, it was
RESOLVED,ito GRANT a Variance as applied u~d~r Appeal
No. 3609 in the Matter of GULL POND DAWN CORP. l~ permission
to construct new dwelling wit'h a~ insufficient setback of
not less than 42 feet from the nearest waters edge or bulkhead,
whichever is closer, SUBJECT TO THE FOLLOWING CONDITIONS:
1. New d~elling to be construc'ted as shown on survey
prepared by PecQ~ic Surveyors & Engineers, P.C. dated
December 25,. 1987 (sic); any proposed exPansion of the
dwelling or deck areas within the 75-ft. setback area will
require application for consideration.
2. Entire deck remain open and unroofed.
3. Entire deck area to remain un~n~Dit~ble.
4. Setback of nearest construction to waters edge, or
bulkhead, whichever is closer, shall be not less than 42 feet.
Vote of the Board: Ayes: Messrs. Goehringer, Grigonis,
Douglass and Sawicki. This resolution was duly adopted.

cant adverse effect on the environment for the reasons indicated

(1) An Environmental Assessment in the short form has been
submitted which indicates that no significant adverse effects to
the environment are likely to occur should this project be imple-
mented as planned;
(2) Separating the project in question from the waterfront or tidal
area is other construction and/or bulkhead in good condition..
(3) The relief requested is a setback variance as regulated by

Dear Mr. Prime:
The following action was taken by the Board of Trustees during
their regular meeting held on March 26, 1987 regarding your wetland
application.
WHEREAS, T. Ford Prime, President Gull Pond Dawn Corp. applied to the Southold
Town Trustees for a permit under the provisions of the Wetland Ordinance of the
Town of Southold, application dated January 12, 1987, and
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a public hearing was held by the Town Trustees with
respect to said application on March 26, 1987 at which time all interested
persons were given an opportunity to be heard, and
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area, and
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE, BE IT
RESOLVED that T. Ford Prime, President, Gull Pond Dawn Corp. BE AND HEREBY IS
GRANTED PERMISSION UNDER THE PROVISIONS OF THE WETLAND ORDINANCE OF THE TOWN OF
SOUTHOLD TO: Construct a single family dwelling, deck, sanitary and well with
minimal landscaping. Property is located on the East side of Dawn Drive,
Greenport.

This permit will expire on March 26, 1988 if work has
not commenced by said date. There are two inspections required and
the Trustees are to be notified upon the completion of the work.
Prior to the issuance of said permit by the Clerk, the applicant
shall file with the Clerk a certificate that he has public liability
insurance policies insuring against any liability which may arise
in the performance of the operations pursuant to such permit in such
amount as shall be fixed by the Trustees, which said policies shall

Landward of the topographic crest of a bluff, Cliff or dune which is greater
than 10' in elevation above mean sea level.
__ Listed in Part 661.5 of 6NYCRR (Tidal Wetlands Land Use Regulations) as a use
not requiring a permit or notification letter approval.
Therefore, no permit is required under the Tidal Wetlands Act (Article 25 of the
Environmental Conservation Law). Please be advised, however, that no construction,
sedimentation or disturbance of any kind may take place seaward of the 10' contour or
topographic crest without a permit. It is your responsibility to ensure that all
necessary precautions are taken to prevent any sedimentation or other a]teYation or
disturbance to the ground surface or vegetation in this area as a result of your pro-
ject. Such precautions may include providing adequate work area between the 10' con-
tour or topographic crest and the project (i.e. a 15' to 20' wide construction area)
or erection of a temporary fence, barrier, or hay bale berm.
Please note that any additional work, or modification to the project as described,
may require authorization by this Department. Please contact this office if such
