SUFFOLK COUNTY ADMINISTRATIVE CODE: Pursuant to the Suffolk County Administrative Code Sections A 14-14 to 23, referral of this application to the Suffolk County Department of Planning is not required. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property conforms to the R-40 Zoning District having a total area of 69,313 square feet. The northerly property line along Nassau Point Road measures 149.89 feet; the southerly property line along Wunneweta Road measures 151.60 feet. The easterly lot line measures 475 feet and the westerly lot line measures 449.79 feet, both along adjacent residential parcels. The property is improved with a two story single-family dwelling, with an attached screened porch and a wood deck, as shown, on the survey drawn by John C. Ehlers, Licensed Surveyor, last revised May 18, 2015, showing the proposed in-ground swimming pool surrounded by a wood deck in the yard fronting Wunneweta Road. BASIS OF APPLICATION: Request for Variance from Article III Section 280-15 and the Building Inspector's March 25, 2016 Notice of Disapproval based on an application for building permit to construct/replace existing accessory in-ground swimming pool, at; 1) proposed in location other than the code required rear yard. RELIEF REQUESTED: The applicant requests a variance for an accessory in ground swimming pool in a front yard where the code requires a rear yard location. The applicant has two front yards on public roads. ADDITIONAL INFORMATION: The applicants parcel is unique in that it runs street to street, both of which are public roads in the Town of Southold. The proposed pool will lie 80 feet to the east of the westerly public road. The survey indicates that the required fencing is indicated, along with a wood deck around the pool. The applicant received a prior variance from the Board of Appeals(#4960,July 12,2001)for a tennis court in a front yard, Page 2,June 16,2016 #6955,Brice SCTM No.1000-111-12-2.1 FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on June 2,2016, at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law$267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties.The proposed pool lies 80 feet from the nearest road and 50 feet from the property line to the north. The proposed location cannot be seen from Wunneweta Road because of an existing heavy buffer of trees and other vegetation, and the existing dwelling and tennis court block the visibility of the proposed pool from Nassau Point Road . 2. Town Law§267-b(3)(b)(2).The benefit sought by the applicant, cannot be achieved by some method, feasible for the applicant to pursue,other than an area variance. The applicant has two front yards and no rear yard,thereby requiring a variance since there is no conforming location on the subject property in which to locate he proposed swimming pool. 3. Town Law$267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 100% relief from the code. However,the proposed placement of the in-ground pool has substantial setbacks and natural vegetative buffers that will protect the privacy of surrounding neighbors.. 4. Town Law 0,67-b(3)(b)(4)No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code, as well as a dry well large enough to accommodate the discharging pool water. 5. Town Law§267-b(31(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law$267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new in-ground swimming pool in the second rear yard while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer , seconded by Member Weisman (Chairperson), and duly carried,to GRANT the variance as applied for, and shown on the survey prepared by John C. Ehlers, land surveyor, dated May 14, 2015, and last revised May 18, 2015 showing the proposed in-ground swimming pool surrounded by a wood deck. SUBJECT TO THE FOLLOWING CONDITIONS: 1. Installation of a de watering dry well large enough to accommodate the discharge of pool water. 2. All pool equipment must be placed in a sound proof structure. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1)year terms. According to the Building Department inspection report, the Town's Building Inspector conducted an inspection on July 28, 2021, and advised the applicant that the ZBA approvals had expired in 2021, and to contact the ZBA in order to make current his ZBA variance approval, and also informed him of a number of other requirements to be met prior to the issuance of a Certificate of Occupancy. While the Board understands that you are attempting to assist the owner/applicant, the applicant received the ZBA's decision which stated in bold capital letters under TIME LIMITS ON THIS APPROVAL: ....IT IS THE PROPERTY OWNER'S RESPONSIBILITY TO ENSURE COMPLIANCE WITH THE CODE REQUIRED TIME FRAME DESCRIBED HEREIN. In order to finalize the Certificate of Occupany for this residence in compliance with Southold town building department this is a request for a ZBA permit extension. The original permit was applied for by William Birkmier of North Fork Pool Care. North Fork Pool Care, Inc was contracted to install an 20'X46' inground gunite swimming pool. Other parties were contracted for masonry work, landscaping and tree work as well as fencing. As part of the final Certificare of Occupancy North Fork Pool Care, Inc was asked for rebar certification as well as drywell locations. These requests were completed.After completing the pool construction other companies added and outdoor kitchen which required an updated survey.The survey was never completed therefor the Certificate of Occupany was never completed. Additional items that were not in my scope of work were placed upon my company to address. Masonry, fencing issues as well as the need for an updated and corrected site plan and survey. These open items were placed on my company even though they were not by contract my responsibility. As a local company who does not walk away from any project I have been asked to correct these issues and finalize the Certificate of Occupancy. At this time, all necessary documents_ and inspections have been completed. If the requested extension of the ZBA permit is granted, final Certificate of Occupancy will be issued and closed out. The findings of the Board are that the lot to be created would be undersized in a recommended low density area. Two water studies, a general sutdy by Malcolm Pirnie of the Town of Southold in June, 1967, and the Suffolk County Board of Health 1971 survey of Nassau Point in particular, updated to 1975, emphasize the finite nature of the available water supply which is replenished solely by rainfall. In 1975, 80% of the wells showed evidence of salt water intrusion according to the Board of Health letter of March 4, 1977, which indicates that there is no change in the 1975 test results. The creation of such a lot would set a precedent for the division of many lots which are somewhat over 40,000 sq. ft. in Nassau Point but not large enough for two lots. Many single and separate un- developed lots on Nassau Point, some undersized, remain to be de- veloped and should have prior rights to the available water. The Board finds that strict application of the Ordinance , would not produce practical difficulties or unnecessary hardship; the hardship created is not unique and would be- shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will change the char- acter of the neighborhood, and will not observe the spirit of the Ordinance. FINDINGS OF FACT PROPERTY FACTS/DESCRIPTION: Applicant's property is located on the east side of Wunneweta Road and west side of Nassau Point Road in Cutchogue. The April 8, 2000 survey map prepared by John C. Ehlers, L.S., amended May 15, 2000 shows the lot at 69,313 sq. ft. in area, and approximately 150 on both streets. The depth of the property is 449.79 feet along the northerly side line and 475.09 feet along the south line. The property is improved with a single- family dwelling, an accessory frame garage, and swimming pool, and the lot is shown on the Map of Nassau Point Club Properties Amended Map A as#141 and part of 142. BASIS OF APPEAL: Building Inspector's June 14, 2001 Disapproval which reads that the building permit for an accessory tennis court is not permitted in a front yard location under Article III, Section 100-33. Section 100-33 states that"accessory buildings and structures or other accessory uses shall be located in the required rear yard." AREA VARIANCE RELIEF REQUESTED: Variance to locate a 55' x 105' tennis court in a front yard location. The applicant's original plan showed a proposed location 52 feet from the front property line facing Nassau Point Road, but by letter dated June 19, 2001 to the Board of Appeals, the location was amended by application to be a minimum of 60 feet from the Nassau Point Road and at least 17 feet from the north side property line. Applicant indicates proposed landscaping as shown on the 4-22-00 plan prepared by Briarcliff Landscape, and no outdoor lighting is proposed. A variance regarding fence height is not requested in this application. REASONS FOR BOARD ACTION. DESCRIBED BELOW: Based on the testimony presented, materials submitted and personal inspection, the Board makes the following findings: 1. Grant of the area variance will not produce an undesirable change in character of neighborhood or a detriment to nearby properties. The property is a large (69,313 sq.ft.)lot with two front yards on Nassau Point Road and Wunneweta Road. The proposed 55'x 105'tennis court is proposed at a setback greater than that required for the dwelling (55 ft. code requirement). 2.
