March 20, 2024: William Goggins, attorney for the applicant, submitted the following request: "In connection with the above referenced matter, please be advised that we represent the Estate of Roman Watroba and his last surviving child, Tisha Watroba. Today, we learned that there was an amended site plan approval issued on January 8, 2019 (2018*), but the inspection condition prior to the issuance of a certificate of occupancy was never accomplished. A copy of the approval is attached. After struggling with a heart condition and anemia, Mr. Watroba died on February 24, 2020. Tisha Watroba believed that her father received all approvals and was issued a certificate of occupancy. We received a title report which alerted us to the fact that it was not issued. We respectfully request that an inspection of the premises be scheduled to meet with the condition for approval so she can obtain a certificate of occupancy, and sell the property." - William C. Goggins Staff analysis: approved amended site plan remains consistent with all pertinent rules and regulations. Site Inspection (see photos): - Striped parking and queuing lane exist - Employee parking in approved location but not striped - Storm water controls: verification is necessary from the Town Engineer. 4" inlet grates were observed on the ground under the gutters but no leader pipes installed V. Items to consider: 1. Consider a 1-year approval extension (April 2025); 2. Support the issuance of a CO after receiving certification from the Town Engineer that all storm water controls were constructed on site as approved. 3 WTV ILLIAM C. Please consider the following: 1. Anew 8'diameter x 4'deep leaching pool has been proposed to contain runoff from the new roof structure. This proposed drainage will be considered compliant with chapter 236. 2. There is also a proposed trench drain indicated at the existing entrance. What Drainage system will this trench drain be connected to? The Planning Board should consider that the new roof structure has been proposed over the existing impervious surfaces located at this site. All of these existing surfaces generally drain to the existing curb cut entrance where a trench drain has been proposed. It is my recommendation that the proposed drain be re-located to the area adjacent to the existing curb cut. Once re-located to this location the trench drain could be connected to the new leaching pool. The Mark-outs division should be contacted to verify existing underground utilities before any excavation.
