Zoning District: 35350 County Road 48, Peconic, NY; County Tax Map Parcel No. 1000-69-04-2.1. WHEREAS, a public hearing was held and concluded on January 8, 1987 in the Matter of the Application of HELMUT HASS under Appeal No. 3461; and WHEREAS, at said hearing all those who desired to be heard were heard and their testimony recorded; and WHEREAS, the board has carefully considered all testimony and documentation submitted concerning this application; and WHEREAS, the board members have personally viewed and are familiar with the premises in question, its present zoning, and the surrounding areas; and WHEREAS, the board made the following findings of fact: 1. The premises in question is located along the south side Middle Road (a/k/a C.R. 48), Peconic, NY, having a total area of 49,709 sq. ft. and 100 ft. lot width. of 2. The subject premises is identified on the Suffolk County Tax Maps as District 1000, Section 69, Block 4, Lot 2.1, and is located in the "B-I" General Business Zoning District. 3. By this application, appellant requests variances from the Provisions of Article VII, Section: (a) 100-71, Bulk Schedule, for insufficient lot area of proposed Parcel #1 of 20,774 sq. ft. and Parcel #2 of 28,935 sq. ft., and insufficient lot width of 100 feet; (b) lO0-70(A) continuing established residential use as principal use [in the existing two-story building] southerly Parcel (#1); (c) lO0-70(A) and lO0-71 continuing established residential use in existing (CONTINUED ON PAGE TWO) DATED: February 5, 1987. [northerly Parcel (#2)]. 4. Article VII, Sections 100-71 and 100-70 of the Zoning Code require a minimum of 30,000 sq. ft of lot area and 150 ft. lot width, per parcel, in this "B-l" General Business Zoning District. The lowest allowable livable floor area in the "A" District is 850 sq. ft. The percentages of relief requested are: (a) 1,065 sq. ft. and 9,226 sq. ft., or .035% and 31% as to lot area; (b) the lot width is preexisting; (c) the insufficient livable floor area is preexisting. 5. It is noted for the record that: (a) by letter dated November 24, 1986, the Suffolk County Department of Health Services waived Article 6 Review; (b) the Planning Board by letter dated March 26, 1986 recommended approval. 6. It is the opinion of this Board that there will be no increase in density since the property is developed, and the variances requested are the minimal necessary under the cir- cumstances. In considering this appeal, the board also finds and determines: (a) that the percentages of relief requested are not substantial; (b) the circumstances are unique since the premises is developed; (c) there will not be a substantial change in the character of the neighborhood since the variance will not create any increase in density; (d) there is no other method feasible for appellant to pursue other than a variance; (e) that in view of the manner in which the difficulties arose and in considering all the above factors, the interests of justice will be served by allowing the variance, as conditionally noted below. Accordingly, on motion by Mr. Grigonis, seconded by Mr. Sawicki, it was RESOLVED, to approve the variances requested and as more particularly shown by survey map amended December 29, 1986, prepared by Roderick VanTuyl, P.C., SUBJECT TO THE FOLLOWING CONDITIONS: 1. (B) It is proposed to subdivide the parcel North/South. ~orm ZB! (Continue on other side) REASON FOR APPEAL Continued 1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary HARDSHIP because the parcel has for upwards of 20 years been utilized as a family "cc~pound" with a residence on the southerly lot, and a residence and business establishment on the northerly lot. The residence on the northerly lot contains approx. 686 sq. fet. (min. 850' required). That residence building and the structure used for business (fronting C.R. 48) were moved back (southerly) to there present location when C.R. 48 (then NYS 27A) was widened to the present dual highway. In not creating two distinct parcels, the southerly of which is reached by a right of way over the northerly parcel to C.R. 48, an econc~ic hardship is perpetuated. 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because of the depth of the pareet; utitized as above. Two distinct parcels created (north/south) would confirm the use,i.e., principally residential in a B-1 General Business use area. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because the present lay out and buildings are the same as they have been for upwards of 20 years. SOUTHOLD TOWN BOARD OF APPEALS MATTER OF HELMUT HASS THURSDAY, JANUARY 8, 1987, PUBLIC HEARING 8:42 p.m. Appeal No. 3461 - Public Hearing commenced in the Matter of HELMUT HASS. (1) Insufficient lot area and lot width, (2) establishing existing residential use as principal use of proposed southerly parcel; (3) for approval of insuf- ficient livable floor area in existing dwelling of proposed northerly parcel. "B-i" Zone. 35350 C.R. 48 (s/s) Peconic. The Chairman read the legal notice and application for the record.~ CHAIRMAN GOEHRINGER: I have a copy of a survey produced by Roderick VanTuyl P.C. January 22, 1970 indicating the front parcel of the parcel closest to the railroad. It would be the rear parcel in this particular case of 20,774 square feet which houses a two-story framed house or comprises a two-story framed house. The front parcel which is 28,935 square feet which is a one-story framed shop and a one=story framed house. And I have a copy of the Suffolk County Tax Map indicating this and surrounding properties in the area. Sir, how are you tonight? Would you state your name. MR. GLICKMAN: I'm an attorney at law, 114 Main Street, Green- port. If the Chairman would kindly the two-story as lot number one and the parcel on 48 parcel number two. Those maps were just handed to me. I don't have very much to say. I believe that from the Suffolk County Board of Health I have a letter here dated November 24th where they have no objection unless the Board does. At the Planning Board, have granted it con- ditions therein which I have complied with for the 25 foot right-of-way as you can see in the survey. We have c.o.s running back from 1963 I think it is and they've been there. There's no other land to build on. You can not improve it any more. What is there is what you see and that's what you are going to get. We're asking to cut them in half. Not in half but undersized lots. Not 40,000 square feet. There's a question. The reason being is that according to this man's will and testament, we want to leave something for the wife and something for the children and there's no way that you can leave it all. The only way to satisfy everybody is to cut it in half and say one is yours and one is theirs. You can't build any longer in there. So there's no really other method. We've.complied with the Planning Board, the Health Department and I'm here ~today to ask the Board to grant the petition. CHAIRMAN GOEHRINGER: Is it the house on number two lot that is the undersized house? MR. GLICKNAN: It's the one nearest the 48. That's right. It is the 20,000. No I'm sorry. I'm wrong. It's the one that's right along on the railroad, 20,774 and the other one running from Middle Road up is 28, 000 almost 29,000 square feet. This g~es back to 1963.
