WHEREAS, a public hearing was held and conclUded
1987 in the Matter of the Application of CHRISTIAN B.
Appl. No. 3622; and
on September lO,

WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded~ and
WHEREAS, the Board has carefully considered all testimony
and documentation submitted concerning this application; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the Board made the following findings of fact:
I. By this application, appellant requests a Variance from
the Provisions of Article XI, Section 100-119.2 to locate a
proposed one-story, open surface deck construction of a size
16' by 20' by 12' by 20' at the rear of existing dwelling and
accessory stairs 30 ft. long Jet back 6.5± ft. from the west
side property line and 8 ft. from the shoreline along Marion
Lake.
2. The premises in question contains a total lot area of
5,000+ sq. ft. and frontage along a private right-of-way of 40
feet, and is improved with a single-family dwelling set back
42 or more feet from the lake shere!in~ ~nd 5N~2feet from the

3. The subject premises is located in the "A" Residential
and Agricultural Zoning District and is more particularly iden-
tified on the Suffolk County Tax Maps as District lO00, Section
31, Block 9, Lot 15.
4. Article XI, Section 100-119.2 requires all buildings and
structures to be set back not less than seventy-five (75) feet
from a tidal water body, tidal wetland edge, or freshwater wetland.
5. The Courts have held that the area setback variances
must meet the "practical difficulties" standard, considering at
least the following: (a) that the relief requested is not sub-
stantial in relation to the requirement; (b) that the project
as proposed is not out of character with the neighborhood; (c)
the circumstances of the property are unique and are not personal
in nature; (d) that the variance will not in turn be adverse to
the safety, health, welfare, comfort, convenience, or order of
the town; (e) that the variance requested is the minimal neces-
sary; (f) that there is no other method feasible for appellant
to pursue other than a variance.
6. It is the position of this Board as follows:
(a) that the relief requested is not subs{a~tial in
relation to those established in the area;
(b) that the project as proposed is not out of
character with the neighborhood;
(c) the circumstances of the property are unique and
not personal in nature, particularly due to the nonconforming
lot size, width, setbacks of existing building, etc.;

7. In view of all the above factors, the Board finds that
the interests of justice will be served by granting the
variances applied for the construction of the accessory steps
and open-deck construction attached to dwelling as shown on
sketch received August 10, 1987.
Accordingly, on motion by Mr. Goehringer, seconded by
Mr. Douglass, it was
RESOLVED, to GRANT the Variances requested under Appl.
No. 3622 for the construction of the 30' long accessory
stairs (to be set back 8 feet from the shoreline of Marion
Lake) and open-deck construction (12" above ground, more
or less) attached to existing dwelling with a setback at
not closer than 29± feet to the shoreline (as proposed)
in the Matter of CHRISTIAN B. SALMINEN, SUBJECT TO THE
FOLLOWING CONDITIONS:
1. The deck construction must remain open and unroofed
[as proposed herein];
2. Precauti6nary measures must be taken by the applicant
and builder When constructing as to prevent erosion problems.
Vote of the Board: Ayes: Messrs. Goehringer, Grigonis,
Doyen and Douglass. (Member Sawicki was absent.) This
resolution was duly adopted.

Absent was: Member Charles Grigonis, Jr.
The Chairman opened the hearing at 8:10 o'clock p.m. and
read the notice.of hearing and application for the record.
CHAIRMAN GOEHRINGER: I have a sketch of the survey. The last date
was September 29, 1986 by Roderick VanTuyl, P.C. indicating a pro-
posed deck to be added to the existing one-story framed bungalow
and steps within the natural bluff or contour areas down to the lake.
And I have a copy of the Suffolk County Tax map indicating this and
surrounding properties in the area. Is there somebody who would like
to be heard?
MR. SALMINEN: I would answer any questions that you have at al'l.
CHAIRMAN: How big is the deck in reference to size?
MR. SALMINEN: 16 by 2'0. Twenty foot is the width of the house and
it's longest point it's about 16 feet.' The westerly side and the
easterly side would come out approximately 12 feet.
CHAIRMAN: What about distance to the actual shoreline? What would
that put you from the shoreline? Have you ever measured it~
MR. SALMINEN: It would be difficult to measure.

CHAIRMAN: And the deck itself would be a raised deck or it would come
out?
MR. SALMINEN: It would be the same. About 12 inches above.
CHAIRMAN: Twelve inches above and it shall remain open and unroofed.
I think the only question the Board (sir) is that we were concerned
with the step area and the ability to get around them in case you
have to get in with some heavy equipment to the rearyard of your house
and possibly the steps could be moved over a little bit closer to the

to get in there. I guess you could take them down (so to speak) if
you had to.
MR. SALMINEN: On the site plan, shows a horizontal view of the steps.
It shows the steps will actually start at the edge of the bluff.

MR. SALMINEN: I can't foresee any problem with bringing any equip-
ment in the back of the house. We still have the original distance
from the house to the steps and the steps would actuall~ then go down
the bank down to the lake.
CHAIRMAN: And how long are these steps? How long do you think the
actual stairs will be? Do you have any idea?
MR. SALMINEN: Well, in distance, I would estimate probably 30 feet
on a horizontal plane.
CHAIRMAN: Are you planning on putting any dock or asking for any dock
from the Trustees or anything of that nature?
MR. SALMINEN~ No.
CHAIRMAN: You just want to be able to get down to the water area.
MR. SALMINEN: Yes. When I was a kid, I grew up two houses away from
that.as a youngster. I should provide access for my children to the
lake for boating and fishing.
CHAIRMAN: Would there be any lighting on either the deck or the steps
that would be offensive to either neighbor on either side?
MR. SALMINEN: No there's none currently planned.
CHAIRMAN: Alright. I know this application has been before us and
we'll do the best we can to expedite it for you. We thank you very

structure or fill and restore to its former condition the navigable

If any of the permit conditions are unclear, the permittee shall contact
the Division of Regulatory Affairs at the address and telephone noted below.
A copy of thio permit or approval and supplementary conditions shall be
available at the project site whenever authorized work is in progress.
The permit sign enclosed with the permit or a copy of letter of approval
shall be protected from the weather and posted in a conspicinus location
at the work site until completion of authorized work.
At least &8 hours prior to commencement of the project, the perr..ittee shall
complete and return the top portion of the enclosed receipt form certif}'in~
that he is full? aware of and understands all provisions and conditions of
this permit, l.~ithin one week of completion of the permitted work, the
bottom portion of that form shall also be completed and returned.
For projects involvin~ activities to be accomplished over a period ,r more
than one year, the pe.-~nittee shall notify the Regional Permit Administrator
in %~itin~ at least kB hours to the commencement of resumption of work each
year.
If project design modifications take place after per,,it issuance, the
permittee shall submit the appropriate plan chan~es for approval by the

regular meeting held on May 28, 1987 regarding your application referenced

WHEREAS, Christian B. Salminen applied to the Southold Town Trustees for a permit
under the provisions of the Wetland Ordinance of the Town of
Southold, application dated March 12, 1987, and
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and

WHEREAS, a public hearing was held by the Town Trustees with
respect to said application on May 28, 1987 at which time all interested
persons were given an opportunity to be heard, and no objections were raised, and
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area, and
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and

As per your request~ an assessment of the project for C~RISTIAN SAI~INEN .
Appeal No. 3622 (variance) has been conducted.
During a site inspection on April 1, 1987 it was noted that the proposed deck would
terminate at the top edge of a steep bank above East Marion Lake. This bank has a
fair amount of indigenous woody vegetation growing on it. However~ a large amount
of debris consisting mostly of branches and leaves has been disposed of on the face
of the bank. The lower portion or toe of the bank is much flatter and has cattails
(Phragmites communis) growing on it. Soils at the site are mapped as Carver and
Plymouth Sands with 15-35 percent slopes.
Construction of the deck will slightly increase surface water runoff; however~ due
to the sandy soils this should not create any problems. Placement of 4 x 4 posts
and possible concrete around them~ could create problems if they are located too
close to the top edge of the bank. I recommend a minimum 4 (four) foot setback
from the top edge of the bank for the posts.
Construction of the stairs leading down to the lake will create problems with soil
erosion by removal of existing vegetation and impeding establishment of new vege-
tation due to shade. Terracing under the stairs would alleviate the soil erosion.
A planting plan regarding the selection of vegetation for the bank could be provided
by this office upon the landowner~s request.
Existing debris on the bank should be removed. This material will destroy any
existing vegetation below it and also adds excessive weight onto the bank.
In reference to an unrelated matter~ the deck plan does not show a railing around
the deck. Due to the steepness of the bank, a railing along the outer edge of the
deck should be constructed.
