That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees,the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar days of issuance of this permit. 9. That the said Board will be notified by the Permittee of the completion of the work authorized. 10. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit,which may be subject to revoke upon failure to obtain same. 11. No right to trespass or interfere with riparian rights. This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights, title, or interest in real or personal property held or vested in a person not a party to the permit. Box 2003 Bridgehampton, NY 11932-2003 RE: 470 LLOYDS LANE, LLC c/o ANDREW DRAZIC 470 LLOYDS LANE, MATTITUCK SCTM# 1000-99-3-4.3 Dear Mr. Anderson: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, May 18, 2016 regarding the above matter: WHEREAS, Suffolk Environmental on behalf of 470 LLOYDS LANE, LLC c/o ANDREW DRAZIC applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated April 15, 2016, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on May 18, 2016, at which time all interested persons were given an opportunity to be heard, and, 2 WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees have found the application to be Consistent with the Local Waterfront Revitalization Program, and, RESOLVED, that the Board of Trustees approve the application of 470 LLOYDS LANE, LLC c/o ANDREW DRAZIC to construct a 71.4'x99.6' (3,143sq.ft.) two-story dwelling with a 51'x42' (1,746sq.ft.) attached deck; a 12'x38' (456sq.ft.) swimming pool; install a sanitary system landward of proposed dwelling; install a 2,880sq.ft. driveway; connect to public water; install gutters to leaders to drywells to contain roof runoff; and to clear a 25,630sq.ft. area up to 50 feet from the top of bluff; with the condition to establish and perpetually maintain a 25' non-disturbance buffer from the top of the bluff, with an additional 25' non-turf buffer landward of the aforementioned buffer; with a split rail fence to delineate the border of the non-turf buffer; and as depicted on the survey prepared by Nathan Taft Corwin III, Land Surveyor last dated on May 20, 2016, and stamped approved on May 27, 2016. However, that line as depicted on the survey places the proposed home within 100 feet of the jurisdictional boundary of the bluff as it is defined in both Chapter 275 and 111 of the Town Code, wherein the landward limit of a bluff is defined as: "25 feet landward of the receding edge/point of inflection on the top of the bluff'. Accordingly, the project will require a Town Wetland Permit. The status of the bluff in this location commands the highest degree of protection that is best handled by permitting and the current C& R protections and practices. A non jurisdiction letter, if applicable, could only send the wrong message that it is "OK" to match the neighbors land use practices where an alleged wetland violation of a prior Trustee permit, viewed by the Board during field inspections, is currently pending action in Town Court. It is my further understanding that the Trustees had concern as to the correct location of the top of the bluff because Trustee jurisdiction extends 100 feet from that point. I also understand that this matter was referred to Michael Verity for his opinion as to the location of the bluff fronting the 470 Lloyds Ln., LLC property.The purpose of this correspondence is to provide additional information in support of our underlying request for a Letter of Non-Jurisdiction based upon the project location beyond 100 feet from the top of the bluff. Our request for a Letter of Non-jurisdiction from your Board was made on January 13, 2016. Accompanying our request was a survey prepared by Nathan Taft Corwin, III last dated October 20, 2015 ("Survey"). The Survey submitted with our request depicts the mean high water line at the Long Island Sound, a wood bulkhead constructed at or near the bottom of the bluff, the top of the bluff, the Coastal Erosion Hazard Line, the Building Envelope as authorized on the underlying subdivision map,and a 100 foot setback from the top of the bluff. The purpose of the Coastal Erosion Hazard Area regulations is to protect property from areas of active erosion. In order to do so, the regulation identifies natural protective features (i.e. the bluff)the preservation of which accomplishes protection of private property.§11-6 defines bluff as follows:Any bank or cliff with a precipitous or steeply sloped face adjoining a beach or a body of water. The waterward limit of a bluff is the landward limit of its waterward natural protective feature. Where no beach is present, the waterward limit of a bluff is mean low water. The landward limit is 25 feet landward of the receding edge or, in those cases where there is no discernible line of active erosion, 25 feet landward of the point of inflection on the top of the bluff. The "point of inflection"is that point along the top of the bluff where the trend of the land slope changes to begin its descent to the shoreline.Application of the town's definition of bluff leads to the conclusion that the bluff is correctly identified on the Survey. The Survey also depicts property elevations reference to NGVD 1929 data and from these property elevations, topographical contour lines at 1 foot intervals are depicted throughout the site. The area r ' between the toe of the bluff and the top of the bluff are characterized by a steep a precipitous slope. The overall morphology of the bluff was more fully analyzed, By Joseph Fischetti, P. E. who concluded that the bluff as characterized on the Survey submitted with our underlying request accurately depicts its full extent. (See technical statement prepared by Joseph A. Fischetti. P. E.dated February 26,2016 attached herewith at Exhibit A.) The following analysis and information is provided in further support of our request for a letter of non-jurisdiction: 1. Attached herewith at Exhibit B is a copy of the filed subdivision map of Honeysuckle Hills at Mattituck filed on October 16, 1981 as file no. 7019 and abs no. 9049. The subdivision map depicts the mean high water and the average line of the top of the bluff.The subdivision map also depicts a building setback line extending from the top of the bluff. The subdivision map depicts six lots that front the Long Island Sound. Of the six lots fronting the Long Island Sound, four are developed. Each of the developed lots comply with the setback in the underlying subdivision and the top of the bluff as depicted on the subdivision map was recognized and accepted for purposes of the development of said lots. Likewise, this application complies with the same bluff setbacks applied to the adjacent improved lots. 2. The File subdivision Map is accompanied by a road and drainage plan which also depicts the topographical conditions throughout the subdivision. A copy of the road and drainage plans prepared by Young and Young,Surveyors is attached hereto at Exhibit C. Review of the road and drainage plan map reveals that the bottom of the bluff is found at elevation 10 whereas the top of the bluff is found at approximately elevation 60 feet above mean sea level. The average line of top of bluff is depicted on the road and drainage plan and is consistent with the average line of top of bluff as depicted on the file subdivision map and the survey. Slopes extending landward of the top of the bluff are less severe than the slopes seaward of the top of the bluff, also consistent with the Survey submitted in connection with our request for letter of non jurisdiction. Accordingly,there have been no perceptible changes to the topographical conditions of the site since the filing of the subdivision map. 3. The Survey provided with our initial request for letter of non-jurisdiction depicts a Coastal Erosion Hazard Line as scaled from the Coastal Erosion Hazard Area Map. The Coastal Erosion Hazard Area Line is drawn at a location 25 feet landward of the top of the bluff pursuant to the New York State Coastal Erosion Management Regulations found at 6NYCRR Part 505 of Environmental Conservation Law. Such designation is recognized and accepted by the Town of Southold and the Southold Town Trustees pursuant to their local implementation of the state Coastal Erosion Management Regulations now found at Chapter 111 of the Town Code. Therefore, the Town has adopted the State's determination that the top of the bluff which is 25 feet seaward of the coastal erosion hazard line. Therefore,the Survey submitted in connection with our request for Letter of Non jurisdiction correctly depicts the top of the bluff. i 4. The prior Town regulation of all adjacent lots correctly rely on the location of the top of the bluff as depicted on the filed subdivision map or as recognized in the Coastal Erosion Hazard Area Maps adopted by both the State of New York and Town of Southold. a. SCTM# 1000-99-3-4.1 is a developed lot that received a Letter of Non- Jurisdiction from the NYSDEC as well as the Southold Town Trustees. The NYSDEC letter of Non-Jurisdiction dated November 16, 1999 is based upon the development landward of the top of the bluff. The Southold Town Trustees Letter of Non-Jurisdiction dated October 4, 1999 is based upon the development being more than 100-feet landward of the top of the bluff. The survey prepared by Young and Young, Surveyors dated May 21, 1999 depict the top of the bluff, Coastal Erosion Line and Building Setback Line consistent with the filed map. A copy of the NYSDEC and Southold Town Letter of Non-Jurisdiction(s), and the survey are attached herewith at Exhibit D. b. SCTM# 1000-99-3-4.2 review a building permit records for this lot revealed memorandum from Board of Trustees to Robert Fox dated November 21, 2002 accompanied by a survey. The survey depicts a proposed pool that would be cited 100 feet landward of the top of the bluff.Survey also depicts the Coastal Erosion Hazard Line as scaled from the Coastal Erosion Hazard Area Map. Both the top of the bluff and the location of the Coastal Erosion Hazard Line are consistent with the top of the bluff as depicted on the subdivision map and the Survey prepared with this application. Likewise, the Coastal Erosion Hazard Area line is consistent with the Subdivision Map and the Survey submitted with this application.A copy of the November 21, 2002 memorandum from the Trustees and accompanying survey is attached-here with at-Exhibit E. c. SCTM# 1000-99-3-4.3 is subject parcel with the survey depicting the top of the bluff consistent with the filed map, the existing slopes and the Coastal Erosion Hazard Area Maps adopted by both the NYSDEC and Town of Southold. d. SUM#1000-99-3-4.4 is a vacant lot. e. SUM # 1000-99-3-4.5 is a fully developed parcel with Certificate of Occupancy. Although, a Letter of Non-Jurisdiction from the NYSDEC and Town Trustees could not be located through Town archival search, the survey depicts a single family dwelling constructed landward of the building setback line. Thus, the Town relied upon the filed map and Coastal Erosion Hazard Area designations relating to the top of the bluff in the development of the parcel (See Exhibit F). f. SUM # 1000-99-3-4 .6 is a fully developed lot which received a Letter of Non-Jurisdiction from the NYSDEC and Southold Town Trustees dated November 26, 2004 and December 8, 2004, respectively. Both regulatory instruments certify the top of the bluff at a location consistent with the filed subdivision map and the Coastal Erosion Hazard Area Map. Attached here with at Exhibit G are the NYSDEC Letter of Non-Jurisdiction. Southold Town Trustees Letter of Non-Jurisdiction, and survey. It is noted that subsequent to the construction of single family dwelling, the applicant applied for a swimming pool and deck on the seaward side of the house necessitating a variance. However, the location of the top of the bluff as depicted on the filed map was recognized by the Town in connection with the development of this lot including the subsequent variance proceeding. g. SCTM# 1000-99-3-2 is a developed lot adjacent to and west of Honeysuckle Hills Subdivision. Subject parcel is fully developed and the survey for the lot depicts the top of bluff consistent with the top of bluff as depicted on the subdivision map. A copy of the May 2, 1996 survey prepared by Joseph A. Ingeno is attached herewith at Exhibit H. As a final matter, attached herewith at Exhibit I is an aerial photograph prepared by this firm that depicts the existing development within the map of Honeysuckle Hills and including the adjacent parcel immediately to the west.The aerial photograph confirms consistent application of the top of the bluff in connection with the development of all improved parcels. In every case, the top of the bluff was established in a manner consistent with the top of the bluff as depicted on the subdivision map recognized in the Coastal Erosion Hazard Area Maps adopted by NYSDEC and the Town of Southold.Thus, any finding that the location of the top of the bluff landward of its location as depicted on the underlying subdivision map and on the Coastal Erosion Hazard Area Maps would be inconsistent and at variance to the prior regulation of all developed parcels along this coastal area. All properties in the immediate area have been regulated pursuant to a finding relating to the top of the bluff as determined by the Coastal Erosion Hazard Area Map or subdivision map.
