SAWlCKI ACTION OF THE BOARD OF APPEALS Application of OLIVER CAMPBELL for a Special Exception to the Zoning Ordinance, Article IX, Section 100-90A for permission to construct principal building for storage purposes in this C-1 Industrial Zone District in conjunction with sand and stockpile yard, at premises located along the west side of Cox Lane, Cutchogue, NY; County Tax Map Parcel No. 1000-84-03-005. WHEREAS, a public hearing was held and concluded on Thursday, July 14, 1988, in the Matter of the Application No. 3742; and WHEREAS, at said hearing all those who desired to be heard were heard and their testimony recorded; and WHEREAS, the Board has carefully considered all testimony and documentation submitted concerning this application; and WHEREAS, the Board Members have personally viewed and are familiar with the premises in question, its present zoning, and the surrounding areas; and WHEREAS, the Board made the following findings of fact: P~ge ~ - Appl. No. 3742 Matter of OLIVER CAMPBELL Decision Rendered July 14, 1988 1. This is an application pursuant to the requirements of Article IX, Section 100-90A for a Special Exception to construct principal storage building of a size 61+- feet x 37+- feet x 17+- feet high. 2. The subject premises consists of a total area of 2.4+- acres, is presently vacant land, and is identified on the Suffolk county Tax Maps as District 1000, Section 84, Block 3, Lot 5. 3. The subject premises is located in the C-1 General Industrial Zone District and is located along the west side of Cox's Lane in the Hamlet of Cutchoque, Town of Southold. 4. Submitted for consideration is the Preliminary Site Plan prepared by Peconic Associates, Inc. dated May 1988 (lastly revised June 23, 1988) which depicts the proposed building set back 150 feet from the front property line, 70+- feet from the northerly side property line, 50 feet from the southerly property line, and the proposed parking area 120 feet or more distant from the front (easterly) property line. 5. It is noted for the record that letters have been received from the Office of the Planning Board indicating their acquiescence with the site-plan layout. 6. In considering this application, the Board finds and determines that: (a) the use requested will not prevent the orderly and reasonable use of adjacent properties or of properties in adjacent-use districts; (b) the use will not adversely affect the safety, health, welfare, comfort, con- venience or order of the Town; (c) the use is in harmony with and will promote the general purposes and intent of zoning. 7. The Board has also considered subsections (a) through (1) of Article XII, Section 100-121C(2) of the Zoning Code in making this determination. Accordingly, on motion by Mr. Grigonis, seconded by Mr. Sawicki, it was RESOLVED, to GRANT a S~ecial Exception as applied in the Matter of Application No. 3~42 - OLIVER CAMPBELL for permission to construct principal storage building as shown on the May 1988 Site Plan prepared by Peconic Associates, revised June 23, 1988, SUBJECT TO THE FOLLOWING CONDITIONS: 1. WIGGINS: Merl Wiggins for the petition of OliVer Campbell to construct a storage bdilding on an industrially zoned site. Mr. Campbell is one of the group that has of operating a business in a residential area. And he is involved in the construction Of' septic tanks, cesspools, excavation and that type of work. And he's trying to purchase a two-acre wooded site and proposing to put approximately a 2,000 square foot building 125 feet back from Cox Lane and we made the entrance so its!curbs will shield it from the public. And this is in compliance with the use of the property. All he'needs is a special exception. We have sent plans to the Planning Board which they now have under consideration. It's hoped that a speedy grant of this variance can be done.as Mr. Oliver is under the gun so to speak because he needs to move his operation away from the residential that's coupling to his commer- cial industrial property. CHAIRMAN GOEHRINGER: The only objection that I would place on be- half of the Board is the existing screening that is showing on the site plan map along the road be continuously maintained.
