ACTION OF THE BOARD OF APPEALS
Upon application of GEORGE R. FURSE for Variances to the
Zoning Ordinance, Article III, Section 100-31, Bulk Schedule,
for: (a) approval of insufficient area of proposed Lots 92;
(b) approval of insufficient lot depth of proposed Lot #2;
(c) approval of yard setbacks as apply from the new division line
to the existing dwellings. Location of Property: Right-of-Way
off Bell Hill Avenue, Fishers Island, NY; County Tax Map Parcel
No. 1000-009-03-002, containing 3.64+- acres.
WHEREAS, a public hearing was held and concluded on June
1988 in the Matter of the Application of GEORGE R. FURSE
under Appeal No. 3729; and

WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded; and
WHEREAS, the Board bbs carefully considered all testimony
and documentation submitted concerning this application; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the Board made the following findings of fact:
1. The premises in question is located in the "A"
Residential and Agricultural Zoning District along a private
right-of-way extending off the west side of Bell Hill Avenue in
the Hamlet of Fishers Island, Town of Southold, containing a
total area of 3.64+- acres.
2. The subject premises is improved with two single-family
dwellings and three accessory buildings, all as shown on the map
amended April 12, 1988 prepared by Chandler, Palmer & King,
Surveyors, and is identified on the Suffolk County Tax Maps as
District 1000, Section 009, Block 003, Lot 002.

3. The subject premises was conveyed to Mr. and Mrs. George
Furse January 20, 1961, by Deed at Liber 4940 cp 216, and no
conveyances have been found of record since that date.
4. By this application, appellant requests approval of the
insufficient lot area of proposed Lot 92 of not less than .94
acre(s), insufficient average lot depth of 106+- feet, and
insufficient setbacks of the existing buildings to the proposed
division line as shown on the Map amended April 12, 1988,
prepared by Chandler, Palmer & King.
5. Article III, Section 100-31, Bulk. Schedule, of the
Zoning Code requires a minimum lot area of 80,000 sq. ft.,
minimum lot depth of 250 feet, and minimum frontyard setback at
60 feet and rearyard setback at 75 feet. The percentage of
relief requested in relation to these requirements is
substantial, approximately 50%.
6. Article III, Section 100-31 excepted those lots having a
lot area of less than 80,000 sq. ft. that were "held in single
and separate ownership prior to November 1971, and there-
after," or were approved by the Planning Board prior to May 20,
1983. The record shows that these parcels were not held in
single and separate ownership, although the two single-family
dwellings were in existence and occupied prior to the May 20,
1983 increase in lot area requirement. Certificates #Z4877 dated
October 26, 1972, #Z16380 dated November 9, 1987, and #Z16948
dated June 2, 1988 have been submitted and made a part of the
record.
7. No prior appeals have been found of record concerning
these premises.
8. In considering this appeal, the Board also finds and
determines: (a) the practical difficulties claimed are
sufficient to warrant a grant of this variance; (b) that the
circumstances are unique to the property and are not shared by
other properties in the neighborhood; (c) there will be no
substantial change in the character of the neighborhood or
detriment to adjoining properties; (d) that there will not be
any increase in dwelling density since each lot will contain a
single-family dwelling and no additional dwelling(s) will be
constructed; (e) the relief requested is substantial in
relation to the current lot size requirement; (f) that the
difficulties cannot be obviated by some method feasible for
appellants to pursue, other than a variance; (g) that the

relief requested is the minimal necessary under the
circumstances; (h) that in view of the manner in which the
difficulties arose and in considering all the above factors, the
interests of justice will be served by the grant of this
variance, as further noted below.
Accordingly, on motion by Mr. Sawicki, seconded by Mr.
Grigonis, it was
RESOLVED, to GRANT the Variances requested under Appeal No.
3729 in the Matter of the Application of GEORGE R. FURSE as to
the insufficient lot area, depth, and setbacks of existing
buildings from the proposed division line as shown on the Map
amended April 12, 1988, prepared by Chandler, Palmer & King,
provided that proposed Lot #2 contains a lot area of not less
than 40,000 sq. ft. and subject to approval by the Southold Town
Planning Board as required by the Subdivision Regulations
(Chapter Al06) of the Code of the Town of Southold.
Vote of the Board: Ayes: Messrs. Goehringer, Grigonis,
Douglass and Sawicki. (Member Doyen of Fishers Island was absent
due to poor weather conditions.) This resolution was duly
adopted.

is requested for the reason that the current o~ner desires to transfer one of the
two single-family dwellings on the subject premises to his children
while retaining ownership of the others, but the total lot area is
insufficient for two conforming lots under existing zoning. Also,
existing topography is such that creation of one .94+ acre lot and
one 2.70~ acre lot is desirable.

REASON FOR APPEAL
Continued
1. STRICT APPL CAT ON ~F THE,O~DI~blANCE would produce practical difficulties or unneces-
sary HARDSHIP because there is now insufficient total area for two lots,
yet the dwellings already exist. One dwelling was built prior to
zoning; the other was built subsequent to zoning when the minimum
area requirement was 40,000 square feet.
2 The hardship created is UNIQUE and is not shored by ail properties alike in the immediate
vicinity of this property and in this use district because this property already contains
two single-family dwellings.
3 The Vanance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because, with two existing single-family dwellings
already on the property, the density will not be increased. There will
be no change whatsoever to the neighborhood as no new structures are
proposed.

The Chairman opened the hearing 8:15 o'clock p.m. and
read the legal notice for the record.
Motion was granted to waive the reading of the application.
CHAIRMAN GOEHRINGER:
And I have a copy of the Suffolk County Tax Map indicating this
and surrounding properties in the area. Would you like to be
heard sir?
MR. [~AM: My name is Steven Ham of Matthews and Ham, 45 Hampton
Road, Southampton. I had prepared a statement to read into the
record but I think it might move things along if I just answer
your questions. As noted on the application, the purpose of the
application is to enable the owner to give one of these houses to
his children.
CHAIRMAN GOEHRINGER: That's lot #2 right?
MR. HAM: It's 2.7 acres.
CHAIRMAN GOEHRINGER: The 2.7 acres he's giving to his children.

That's the main house, yes. And I have a copy of a pre-
certificate of occupancy. It covers the second dwelling.
GOEHRINGER: Let me just understand something here. We
year around houses. Is that correct?
MR. HAM: Yes.
CHAIRMAN GOEHRINGER: What is the cottage? What is that? That is
a pre-existing sleeping area or what?
MR. HAM: It's a maid and domestic quarters. It has no kitchen fa-
cilities. It has a bedroom and a bathroom and it's not covered by
the c.o. as issued today. This is my affidavit and the cottage is
mentioned in number four.
CHAIRMAN GOEHRINGER: Go ahead. You want to continue?

MR. HAM: If you have any further questions. The fact is that
these structures are already there. So there will be no impact
at all on the neighborhood if the variance is granted.
CHAIRMAN GOEHRINGER: My only question is; why did the applicant
so choose to make one lot 2.70 acres and the other lot .94?
MR. HAM: It has to do with the lay of the land. Apparently there
is a small ridge that provides a natural boundary. I think Mr.
Doyen...
MR. DOYEN: That's not quite the case but anyway, I know why they
want to do it. It's the same situation that we had in another
hearing here. The reason why they want to divide it in this man-
ner is because; see over here or anywhere along the shore, people
want the greatest view they have. The view from this house is
this way. The view from this one is like this. If you divide it
any other way, your family starts fighting. And if you want to
get even with them and put trees in there, you don't have a view
any more from this house. So they want~to divide it up so this
house is always assured of a view and that house is assured of a
view and that's the only way they can do it.
MR. HAM: George didn't inform me of that reason. Apparently there
is not a natural ridge there.
MR. DOYEN: No. The ridge is on the other side of this house. There
is a ridge that goes down but it is over here. This is all relatively
flat across here. He didn't explain it to you. That's a good prac-
tical reason. If you or I owned it, that's what anybody would want.
CHAIRMAN GOEHRINGER: But don't you do that with covenants and re-
strictions?
MR. HAM: I guess you don't know the law very well. Covenants and
restrictions don't ....
CHAIRMAN GOEHRINGER: Well, we thank you Mr. Doyen for your words
wisdom. Thank you Mr. Ham. Alright. Is there anybody else that
would like to speak in favor of this?

MR. DOYEN: You should note for the record there that the Planning
Director recommended to the Planning Board that this be divided more
equally.
CHAIRMAN GOEHRINGER: Well, that was the reason why I asked the
question. Let me just ask this question. Assuming that the Board
is not happy with the way this property is divided, what would we
do? Would we deny it and then have you come back with a more fa-
vorable equitable division?
MR. HAM: If you substandard in your determination that you would
consider another division, I would take it back to my client. I'm
sure he does want to give the benefit of this to his children.

MR. DOYEN : Looking at this, there's no way that you can
gain and meaningful hit or add to it and still have two lots with
the view objective that I stated before.
MR. HAM: I haven't been to the property.
MR. DOYEN: No, you don't have to. There's nothing you can do.
You can't gain anything and achieve what they want. There's no
significant increase in the land area.
CHAIRMAN GOEHRINGER: Alright. Well, we'll thrash that around and
we appreciate that and we'll see what developes here. Is there any-
body else who would like to speak against the application? There
is no one here from Fisher's Island? Hearing no further comment,
I'll make a motion closing the hearing reserving decision until
later.

Re: Application of Georqe R. Furse
Dear Board Members:
I have enclosed a copy of the State Department of
Environmental Conservation Permit for the proposed subdivision of
George R. Furse. You will note that the DEC has approved the
division of the property into the same two lots for which I
requested variances on Mr. Furse's behalf at the hearing on June 2.
I understand that the Town Planner and perhaps one
Planning Board member have suggested that there be a more equal
division of the property than the one we have proposed. In making
your determination in light of these remarks, I ask you to consider
the following factors.
First, as was pointed out at the meeting, there are valid
practical reasons for dividing the property in the proposed manner.
While the Planner's recommendation might make some sense in a
situation where both parcels were unimproved, this is a case where
there can be no adverse impact on the neighborhood because the
structures are already in place and will continue to stand in their
present locations. Indeed, if Lot 2 is expanded, the waterfront of
Lot 1 would have to be reduced or eliminated, thereby diminishing the
value of Lot 1 and conceivably other property values in the area.
Second, the Town Planner apparently did not set forth a
specific division line so what she recommends continues to be
unclear. Moreover, Lot 2 contains .94 acres, a sufficient area
under the Zoning Code at the time the dwelling was first completed.

Finally, now that the DEC has issued its Permit for the
proposed division (and an application for the same is pending before
the Health Department), re-drawing the line could result in
substantial additional delay.

GENERAL CONDITIONS

c) newly discovered information or significant physical changes are discovered since the permit was issued.
The permittee is responsible for keeping the permit active by submitting a renewal application, including any forms, fees or supplemental information which may be required
by the Department. no later than 30 days (180 days for SPDES or Solid or Hazarduous Waste Management permits) prior to the expiration date·
This permit shall not be construed as conveying to the applicant any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the
permitted work or as authorizing the impairment of any rights, title or interest in real or personal property held or vested in a person not a party to the permit

10. That if future operations by the State of New York require an al-
teration in the position of the structure or work herein authorized, or
if, in the opinion of the Department of Environmental Conservation
it shall cause unreasonable obstruction to the free navigation of said
waters or flood flows or endanger the health, safety or welfare of
the people of the State, or cause loss or destruction of the natural
resources of the State, the owner may be ordered by the Department to
remove or alter the structural work, obstructions, or hazards caused
thereby without expense to the State, and if, upon the expiration or
revocation of this permit, the structure, fill, excavation, or other
modification of the watercourse hereby authorized shall not be com-
pleted, the owners, shall, without expense to the State, and to such
extent and in such time and manner as the Department of EnvironmentaJ
Conservation may require, remove all or any portion of the uncompleted
structure or fill and restore to its former condition the navigable
and flood capacity of the watercourse. No c~aim shall be made against
the State of New York on account of any such removal or alteration.
11: That the State of New York shall in no case be liable for any damage
or iniury to the structure or work herein authorized which may be caused
by or result from future operations undertaken by the State for the
conservation or improvement of navigation, or for other purposes, and
no claim or right to compensation shall accrue from any such damage.
1:2. Granting of this permit does not reheve the applicant of the responsi-
bility of obtaining any other permission, consent or approval from
the U.S. Army Cor~s of Engineers, U.S. Coast Guard, New York State
Office of General Services or local government which may he required.
13. All necessary precautions shall be taken to preclude contamination
of any wetland or waterway by suspended solids, sediments, fuels.
solvents, lubricants, epoxy coatings, paints, concrete, leachate or any

other environmentally deleterious materials associated with the
project.
'[4 Any material dredged in the prosecution of the work herein permitted
shall be removed evenly, without leaving large refuse piles, ridges across
the bed of a water~ay or floodplain or deep holes that may have a
tendency to cause damage to navigable channels or to the banks of
a waterway.
15 There shall be no unreasonab(e interference with navigation by the work
herein authorized.
16. If upon the expiration or revocation of this permit, the project bereby
authorized has not been completed, the applicant shall, without expense
to the State, and to such extent and in such time and manner as the
Department of Environmental Conservation may require, remove all or
any portion of the uncompleted structure or fill and restore the site
to its former condition. No claim shall be made against the State of
New York on account of any such removal or alteration.
17 if granted under Article 36, this permit does not signify in any way '
that the project will be free from flooding.
18. If granted under 6 NYCRR Part 608, the NYS Department of Environ-
mental Conservation hereby certifies that the subject project will not
contravene effluent limitations or other limitations or standards under
Sections 301,302, 303, 306 and 307 of the C~ean Water Act of 1977
(PE 95-217) provided that all of the conditions listed herein are met.

following conditions apply to all permits:
If any of the permit conditions are unclear,the permittee shall con-
tact the Division of Regulatory Affairs at the address and telephone
noted below.
A copy of this permit or approval and supplementary conditions shall
be available at the project site whenever authorized work is in
progress.
The permit sign enclosed with the permit or a copy of letter of
approval shall be protected from the weather and posted in a con-
spicuous location at the work site until completion of authorized work.
At least 48 hours prior to commencement of the project, the permittee
shall complete and return the top portion of the enclosed receipt form
certifying that he is fully aware of and understands all provisions and
conditions of this permit. Within one week of completion of the
permitted work, the bottom portion of that form shall also be com-
pleted and returned.
For projects involving activities to be accomplished over a period of
more than one year, the permittee shall notify the Regional Permit
Administrator in writing at least 48 hours prior to the commencement
of resumption of work each year.
If project design modifications take place after permit issuance, the
permittee shall submit the appropriate plan changes for approval by
the Regional Permit Administrator prior to undertaking any such modi-
fications. The permittee is advised that substantial modification
may require submission of a new application for permit.
Ail necessary precautions shall be taken to preclude contamination of
any wetlands or waterway by suspended solids, sediment, fuels,
solvents, lubricants, epoxy coatings, paints, concrete, leachate or
any other environmentally deleterious materials associated with the
project work.
Any failure to comply precisely with all of the terms and conditions
of this permit, unless authorized in writing, shall be treated as a
violation of the Environmental Conservation Law.
The permittee is advised to obtain any permits or approvals that may
be required from the U.S. Department of Army Corps of Engineers, NY
District, 26 Federal Plaza, New York, NY 10278, (Attention: Regulatory
Functions'Branch), prior to commencement of work authorized herein.
The granting of this permit does not relieve the permittee of the
responsibility of obtaining a grant, easement, or other necessary
approval from the Division of Land Utilization, Office of General
Services, Tower Building, Empire State Plaza, Albany, N~ 12242, which
may be required for any encroachment upon State-owned lands underwater.

2. I represent George R. Furse, the owner of the real
property shown on the survey annexed hereto.
3. Upon information and belief, the dwelling, "cottage"
and garage shown on the 2.70± acre parcel were constructed prior
to 1957 and have remained in their current locations without
change or modification since 1957. The "playhouse" shown on such
parcel was purchased from F.A.O. Schwartz and put up in or about
1960. The dwelling shown on the .94± acre parcel was built in
1972 and added to in 1987. It is the subject of Certificates of
Occupancy No. Z4877 and Z16380, dated October 26, 1972 and
November 9, 1987, respectively.
4. Upon information and belief, the "cottage" is not a
separate dwelling but merely quarters for domestics and guests; it
consists of a bedroom, living room and bathroom and has no kitchen
or cooking facilities.
5. I make this affidavit in order to induce the Building
Inspector of the Town of Southold to issue a pre-existing
Certificate of Occupancy for the structures requiring the same on
