FOHRKOLB, Defendant. INFORMATION Docket No. ACCUSATION BE IT KNOWN THAT by this Information, CURTIS W. HORTON, a Building Inspector of the Town of Southold as Complainant herein, accuses ANDREW C. FOHRKOLB, the above named defendant residing at 670 Holden Avenue, Cutchogue, New York, with violations of: Count #1: Count #2: Count #3: Section 100-30A(1) of the Code of the Town of Southold (Maintaining two (2) one-family detached dwellings on a single lot). Section 100-141 of the Code of the Town of Southold (Reconstructing a building without a Building Permit). Section 100-145 of the Code of the Town of Southold (Failure to Comply with Order to Remedy Violation dated December 10, 1984). FACTS On or Inspector Andrew C. Mattituck, Town of Southold, New York about December 10, 1984, Curtis W. Horton, as Building of the Town of Southold inspected the premises owned by Fohrkolb on the northwesterly corner of Lipco Road, (Suffolk County Tax Map Designation: District 1000, Section 141.00, Block 03.00, Lot 017.00) and found defendant had: reconstructed and structurally altered a building located on the northerly portion of the premi- ses into a one-family dwelling by installing a new roof, plumbing and electrical service as well as erecting an addition on the rear of the existing building all without obtaining a Building Permit from the Building Department of the Town of Southold contrary to the provisions of the Code of the Town of Southold in such case made and provided. On or about December 10, 1984, Inspector of the Town of Southold Curtis W. Horton, as Building issued an Order to Remedy Violation notifying the defendant to comply with the Southold Town Code and to remedy the above conditions contained in the Order to Remedy Violation on or before the 24th day of December, 1984. On January 30, 1985, Curtis W. Horton, as Building Inspec- tor inspected the premises and found defendant was still main- taining two, one-family dwellings on his property; the defendant had not obtained a Building Permit for the reconstruction and structural alteration of the building located on the northerly portion of his property contrary to the provisions of the Order to Remedy Violation and the provisions of the Code of the Town of Southold in such case made and provided. The above allegations of fact are made by the Complainant herein on direct knowledge and upon information and belief with the sources of the Complainant's information and the grounds for his Inspector of the Town of Southold. While I have only lived in this apartment since June or July of 1980, I have known the property since 1969 or 1970 when I first met my husband who lived two houses away. The small cottage in the rear of the premises has had someone living in it for as far baek as I can remember. I know that for about a year back around 1974, 1975, or 1976 the cottage was being lived in by a minister, his wife, and their two sons. There were a number of other people who lived there both before and after the minister, but [ do not know their names. When I moved into my present apartment in 1980, a friend of my mother's by the name of Joseph Hamilton was living in this cottage. In the summer of 1982 he went down south to go to his mother's funeral, but then he died before he ever got back to New Yorl(. Shortly after that his sisters came and took all of his belongings. Later that year some seasonal workers from Agway lived there. when the cold weather came. They lefl The only person to live there after that was Andrew Fohrkolb's son who lived there for several months last summer. I also know that Dolly Lawson, who is a little older than I am, was born that cottage and lived there as a small child. Iler maiden name was Doily Funn. The longest time that i have ever known that cottage to be vacant was since Andrew Fohrkolb's son moved out last year and Andrew Fohrkolb began to fix it up.
