Application of TIMOTHY COFFEY and THE COVE AT SOUTHOLD,
INC. for a Special Exception to the Zoning Ordinance, Article
III, Section 100-30C for permission to erect off-premises
directional sign. Location of Property: South Side of the Main
Road (S.R. 25), Southold, NY; County Tax Map Parcel No.
1000-75-06-7.3.
WHEREAS, a public hearing was held and concluded on
August 18, 1988 in the Matter of the Application of THE COVE AT
SOUTHOLD (TIMOTHY COFFEY) under Appeal No. 3755; and
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded; and
WHEREAS, the Board has carefully considered all testimony
and documentation submitted concerning this application; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the Board made the following findings of fact:
1. This is an application for a Special Exception from the
Provisions of Article III, Section 100-30, Subsection C to erect
a 3' x 5' directional ground sign upon premises located in the
"A" Residential and Agricultural Zoning District located along
the south side of the Main Road (State Route 25), Southold, with
setbacks proposed at approximately 35 feet from the northerly
(front) property line and 35 feet from the easterly side yard as
more particularly depicted on sketched map submitted for
consideration.

2. The premises in question is identified on the Suffolk
County Tax Maps as District 1000, Section 75, Block 6, Lot 7.3,
containing a total acreage of 19+- acres, having frontage along
the south side of the Main Road of approximately 350 feet.
3. The subject premises is located in the A-Residential and
Agricultural Zoning District and is presently used
agriculturally. It is noted for the record that the subject
premises presently contains one ground sign for the Timothy
Coffey operations.
4. The only provisions of the Zoning Code permitting signs
in this zone district are under Section 100-30C, with conditions
for accessory home occupancy uses and others by Special Exception
approval.
5. On May 5, 1966, and again on March 22, 1979, the Board
of Appeals established guidelines and principles governing signs
not specifically covered in the Zoning Ordinance; and in order to
assist the travelling public and in the interest of traffic
safety, the Board established the following types of activities
for which a reasonable number of off-premises signs, directional
only, may be conditionally granted for a limited time period:
a. Motels, hotels, tourist houses
b. Restaurants and eating places
c. Churches
d. Ferries, transportation
e. Subdivision/development signs
f. Shopping centers or business districts
g. Amusement areas
h. Civic activities
i. Federal, State, County, Town owned signs.

It is the position of this Board that the sign as
does not meet the requirements established above and as
by law for Special Exception approval.
7. Also in considering this application, the Board finds
and determines: (a) the use of this sign is not within the
bests interests of the general public or residents; (b) this
proposal could in effect alter the essential character of the
property or neighborhood in this zoning district; (c) the grant
of this special exception as applied will not be in harmony with
or promote the general purposes and intent of zoning.
8. The Board has also considered subsections (a) through
(1) of Article XII, Section 100-121C(2) of the Zoning Code in
making this determination.
9. It is also noted for the record that under a separate
application under Appeal No. 3756 rendered same date hereof,
relief was granted for a similar sign for the same purposes at a
different site located in the Business District, as conditionally

RESOLVED, to DENY a Special Exception as applied in the

and Doyen. (Member Sawicki was absent due to serious family

RESOLUTION PASSED BY THE SOUTHOLD TOWN BOARD OF APPEALS ON
MAY 5, 1966:
As a guide to all concerned about signs on or near public
highways and elsewhere, and in view of letters of notification
of sign violations now in preparation, the Board of Appeals
hereby summarizes the guiding principles governing the granting
and denial of SPECL~L EXCEPTIONS for signs not specifically
covered in the Zoning Ordinance, subject, to the general
provisions of the Ordinance applying to all special exceptions
and permissive uses.
1. With Federal, State and Local government agencies, the
Board recognizes that the indiscriminate, uncontrolled use of
advertising signs, and/or other similar devices located on public
or private property tends to deface the landscape, change the
character of a neighborhood, and is against the best interests of
the general public of the Town of Southold, however,
2. The Board is strongly of the opinion that directional
signs for certain activities are necessarily and demonstrably in
~]e interest of the travelling public whose goodwill and patronage
are necessary to the general interest and welfare of the Town.
3. The travelling public is concerned with obtaining instant
visual information about where to eat, sleep, and worship, as well
as routes and directions to places of amusement, shopping cen~rs,
and ferry connections; the public is normally not interested in the
ordinary business activities of towns in passing. Local residents
are well aware of local facilities and do not need signs for
identification purposes.
.4. Accordingly, to'~ssist the travelling public and in the
~nterest of traffic safet55' the Board of Appeals has established

The following 1966 Sign Resolution was Reaffirmed and Restated with
em 4, Section "h" modified as follows:
On motion by Mr. Douglass, seconded by Mr. Grigonis, it :vas
RESOLVED, as a guide to all concerned about signs on or near public
highways and elsewhere, and in view of letters of notification of sign
violations now in preparation, the Board of Appeals hereby summarizes
the guiaing principles governing the granting or denial of SPECIAL
EXCEPTIONS for signs not specifically covered in the Zoning Ordinance,
subject to the general provisions of the Ordinance applying to all
special exceptions and permissive uses.
1. With Federal, State and local government agencies, the Board
recognizes that the indiscriminate, uncontrolled use of the advertising
signs, and/or other similar devices located on public or private property
tends to deface the landscape, change the character of the neighborhood,
and is against the best interests of the general public of the Town of
$outhold, however,
2. The Board is strongly of the opinion 'that directional signs for
certain activities are necessarily and demonstrably in the interest of
the travelling public whose goodwill and patronage are necessary to the

3. The travelling public is concerned with obtaining instant
visual information about where to eat, sleep, and worship, as well
as routes and directions to places of amusement, shopping centers,
a nd ferry connections; the public is not normally interested in
the ordinary business activities of towns in passing. Local residents
are well aware of local facilities and do not need signs for identi--
fication purposes.
4. Accordingly, to assist the travelling public and in the interest
of traffic safety, the Board of Appeals has established the following
types of activities for which a reasonable number of off-premises
signs, directional only, may be granted:
a. Motels, hotels, tourist houses.
b. Restaurants and eating places.
c. Churches
d. Ferries, transportation.
e. Residential development signs listing residents.
f. Shopping centers, or business districts.
Amusement areas, including marinas, theatres.
Temporary signs advertising local civic, charitable
and public activities.
i. Federal, state, county, town owned signs.
~igns for the above may be granted s~ubject to the following condi-
tions:
1. Written permission of property owner for sign erection~
2. Ail Sign perralts are terminable at once at the direction of the
Board of Appeals. This condition is essential in the event the Town
finds a legislative solution to the problem.
3. Purpose of sign must be directional in the public interest
as distinguished from advertising of products or services. Content
of si~n must be approved. Size of sign may not exceed four ~t
by six (6) feet. A reasonably accurate sketch of proposed sign must
accompany application.

tioners" as well as home occupations, and sign uses customarily
associated with the ownership of property.

The Chairman opened the hearing at 9:21 p.m. and read the
notice ofhearing as published in the official newspapers of
the town.
CHAIRMAN GOEHRINGER: I have a copy of a tax map indicating a di-
rectional sign of where this is going to be placed. And I have a
copy of the Suffolk County Tax Map indicating this and surrounding
properties in the area. And I have a letter from the most immedi-
ate neighbor to the east, Mr. and Mrs. Terry that they could not
be here to comment on the sign and they would like us to postpone
the hearing until the next regularly scheduled meeting. So the
Board usually does grant one recess. But I do know that there is
at least one person who would like to comment tonight, Would you
like to say anything Mr. Klatsky?
MR. KLATSKY: Vice President of the Cove. We would desire an ac-
tion this evening. We adhered to the requirements of the Board
and we'd really like to put that sign up during the season. Thank
you.
CHAIRMAN GOEHRINGER: Is there anybody else who would]~ike to speak

MR. STANKOWICZ: I live on the east of this property. I'm against
it. The first thing, the zoning ordinance should speak for itself
on signs. I'm also against that
If ~. Coffey, who owns property next door, wanted a.sign for~im-
self, is one thing. But if he's going to rent out to all the peo-
ple that want directional signs throughout the town, there's got to
be hundreds of them. When this gentleman, when they put this place
up, they spent millions of dollars. They should have realized that
they can't commercialize with this sign next door to us or any
place else. I can't see any justification ok.any reason this Board
should approve of this sign. They tried to put it up on the east
of it, the stockwood. And Mr. Terry questioned him on it and they

Requests to erect off-premise signs
August 18, 1988
for The
Cove subdivision.
In your review of these applications, keep in mind that
there are a large number of subdivisions that have been approved,and
are under construction, or that are on the drawing boards. Not
all of these subdivisions enjoy prominent road frontage on or near
the major traffic arteries. If these applications are granted,
your Board will have to grant similiar requests to any other subdivi-
der whose development is a little off tke beaten track. The end
result over a period of time is a roadside crowded with directional
and advertising signs. ~
If you find it absolutely necessary to grant these appli-
cations, I strongly recommend that the permission be valid for a
very limited period of time, for example: six months to a year.
However, even this concession leaves the Zoning Board open to re-
peat applications to extend the permission for an additional six
months, etc. .~
The traditional methods of advertising, via newspaper
advertisements and through real estate brochures, give potential
purchasers sufficient information to find the properties, hence
my recommendation to deny the above named applications.

The Chairman read the Legal Notice for this hearing, as published
in the suffolk Times and L.I. Traveler-Watchman, Inc.
CN~IRMAN GOEHRINGER: We'll go on with the Cove hearing which was
a hearing that was rescheduled from August 18th. And I'll open
that up. Is there anybody here that would like to either speak
pro or con on the Cove hearing at Timothy Coffey's property in
Peconic? How are you doing Mrs. Terry?
MRS. TERRY: My property is east of where this sign is supposed to
go up. I feel that if it was Mr. Coffey's property, I would say
by all means put the sign there. But the Cove has nothing to do
with Mr. Coffey's nursery. All it is is commercialization, adver-
tising his Cove on Bayview and I don't feel that that sign should
be there. It's commercialization along Route 25. Route 48 looks
bad enough without 25 looking like 48. Also, I thought there was
a zoning ordinance or a town ordinance against signs going up along
the highways. And as I say, if it was Mr. Coffey's business, I'd
say by all means, I wouldn't argue it. But where it's the Cove,
every where yo~.ride you see these little signs. We're getting
swamped with them and I don't think it's necessary.
CHAIRMAN GOEHRINGER: Thank you. Is there anybody else who would

Absent was: Member Doyen of Fishers Island (due to family
illness).
Also present was the Assistant to the Board, Linda Kowalski,
the Applicants and approximately 80 persons in the audience.
The Chairman opened the hearing at 9:21 p.m. and read the
notice ofhearing as published in the official newspapers of
the town.
CHAIRMAN GOEHRINGER: I have a copy of a tax map indicating a di-
rectional sign of where this is going to be placed. And I have a
copy of the Suffolk County Tax Map indicating this and surrounding
properties in the area. And I have a letter from the most immedi-
ate neighbor to the east, Mr. and Mrs. Terry that they could not
be here to comment on the sign and they would like us to postpone
the hearing until the next regularly scheduled meeting. So the
Board usually does grant one recess. But I do know that there is
at least one person who would like to comment tonight. Would you
like to say anything Mr. Klatsky?
MR. KLATSKY: Vice President of the Cove. We would desire an ac-
tion this evening. We adhered to the requirements of the Board
and we'd really like to put that sign up during the season. Thank
you.

MR. STANKOWICZ: I live on the east of this property. I'm against
it. The first thing, the zoning ordinance should speak for itself
on signs. I'm also against that
If Mr.~Coffey, who owns property next door, wanted a sign for him-
self, is one thing. But if he's going to rent out to all the peo-
ple that want directional signs throughout the town, there's got to
be hundreds of them. W~en this gentleman, when they put this place
up, they spent millions of dollars. They should have realized that
they can't commercialize with this sign next door to us or any
place else. I can't see any justification of any reason this Board
should approve of this sign. They tried to put it up on the east
of it, the stockwood. And Mr. Terry questioned him on it and they

put it down and he wasn't even notified like you have a letter
from him. Unless I told him about it when we had a letter. But
I think we have an ordinance on this and if they want to start
putting directional signs up every place, then I'll get a piece
of the action too. I'll start renting my property. But I'm
completely against it.
