SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. BASIS OF APPLICATION: The applicants request a Special Exception pursuant to Article III, Section 280- 13B, Subsection 14 of the Zoning Code, to legalize an "as built" Bed and Breakfast within their existing single-family dwelling, accessory and incidental to their residential occupancy under the Building Department's Certificate of Occupancy —z-26122 & z-261233 dated 11/19/1998. The "as built" B&B contains 1 bedroom for lodging and serving of breakfast to 2 B & B casual, transient roomers located in a walk out lower level. - ADDITIONAL INFORMATION: Three letters from neighbors were received objecting to the proposed B&B based upon the establishment of a"business" in a quiet residential neighborhood. The Board,however, notes that a B&B use is considered an accessory to a residential use and is permitted in residential zones upon review and approval by the ZBA. Additionally, at the hearing and in written correspondence, one of the applicant's neighbor objected to the proposed B&B based upon problems with street parking and the fact that the applicant also has a home office for her professional practice in the subject dwelling. The applicant subsequently discussed the two uses with the Building Department and submitted a letter dated May 11, 2016, with a copy of the relevant code for permitted uses in the zone district, confirming that both uses are permitted as accessories to a principal use (dwelling) and that the code does not limit the number of accessory uses. AMENDED APPLICATION: The applicant originally requested a special exception for an "as built" two (2)bedroom Bed &Breakfast in application received April 1, 2016, and then revised the request reducing Page 2-May 19,2016 _ ZBA File#6950—Fleischman • ' " ' SCTM#1000-110-5-21.2 the number of bedrooms to one(1)bedroom by letter dated May 11, 2016, based upon the code required number of on-site parking spaces,which, given the topography of the subject property was problematic. FINDINGS OF FACT, The Zoning Board of Appeals held a public hearing on this application on May 5, 2016 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection'of the property and surrounding neighborhood, and other evidence, and upon review of the code requirements set forth pursuant to Article III, Section 280-13B(14) to establish an Accessory Bed and Breakfast, the Board finds that the applicant complies with the requirements for the reasons noted below: 1. Mary Ann Fleischman the applicant(s) herein, is the owner of the property, 560 Holden Avenue, Cutchogue; NY. It is improved with a 1 '/2 story frame house with wood deck as shown on the survey by John T Metzger dated July 13, 1998. The owner/applicant will continue to occupy same as their principal residence while the Accessory Bed and Breakfast facility is managed and operated. The applicant submitted a driver's license, electrical bill, property card and other documentation to verify that the subject dwelling is her principal residence. 2. The applicants plans comply with the on-site parking requirements and provide for 3 parking spaces, two for the principal single-family use and one (1) for each of the Accessory Bed and Breakfast bedroom(s) 3. The applicants complies with the requirements of a dwelling unit as defined in Section 280-4 of the Zoning Code 4. The Accessory Bed and Breakfast, as applied for, is reasonable in relation to the District in which it is located, adjacent use districts, and nearby and adjacent residential uses. 5. The Special Exception is accessory to the principal use and will not prevent the orderly and reasonable use of adjacent properties because all parking will be on site and will not interfere with street traffic. 6. This accessory will not prevent the orderly and reasonable uses proposed or existing in adjacent use districts. 7. No evidence has been submitted to show that the safety, health, welfare, comfort, convenience or the order of the town will not be adversely affected. 8. This zoning use is authorized by the Zoning Code through the Zoning Board of Appeals as noted herein, and issuance of a Certificate of Occupancy from the Building Inspector is required by code before an Accessory use may be occupied. 9. No adverse conditions were found after considering items listed under Section 280-142 and 280-143 of the Zoning Code. 10. Submission of a Certificate of Compliance or similar document will be necessary for issuance by the Building Inspector certifying that the premises conforms to Chapter 280 of the Zoning Code for an Accessory Bed and Breakfast . RESOLUTION OF THE BOARD: In considering all of the above factors,motion was offered by Member Dantes seconded by Member Goehringer, and duly carried to GRANT the Special Exception permit for an Accessory Bed and Breakfast, to be used only in conjunction with the applicants-owners residence, as applied for and shown on the survey by John T Metzger dated July 13, 1998 and floor plans by Mary Ann Fleischmann. This Special Exception Permit requires an operating permit and inspection by a Code Enforcement Officer from the Building Department that must be renewed annually. It is the applicant's responsibility to contact the Building Department on an annual basis to schedule the required inspection. Failure to do so may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception Permit granted herein. 2. The applicant must upgrade the current driveway to provide three parking spaces to conform to B & B parking regulations, with adequate turn around space to insure that cars will not need to back down the existing driveway to access Holden Avenue. 3. Prior to receiving a permit to operate the B&B, the applicant must submit to the ZBA office, a new site plan showing the parking configuration described in 2 above. 4. The applicant shall call the ZBA office when the driveway parking is completed so that Board Members may conduct a site inspection to verify compliance. 5. The applicant must submit an updated floor plan showing one(1) single B &B bedroom. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. NOTE: This Special Exception permit cannot be transferred to new owners Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any violations of the conditions, occupancy or other requirements described herein, may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception permit as granted herein. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. MAY .j 1 2016 PO Box 1179 4694/NG SOARD of APPEALS Southold, NY 11971 Re: MaryAnn Fleischman # 6950 May 11, 2016 Dear Ms. Kanes Weisman,and Members of the Zoning Board: Thank you for your thorough investigation of details pertaining to my pursuit of approval to operate a (now revised one bedroom) B&B from my home in Cutchogue, 560 Holden Avenue. There are three issues I present in this letter: Issue 1: B&B and Home Office. My Zoning Board Hearing (5/5/16) was postponed when Mr. Schultheis presented information that my home therapy business and a B&B is not legally allowed to operate together in a single dwelling such as my house. His presentation seemed valid as if he were outlining the codes of use in the Town of Southold. He missed one key component. He did not talk to the experts in the building department. If he did, he would have learned what I learned from a very simple discussion with the building department workers. I left the Zoning Hearing and headed to the Building Department and spoke with Damon Rallis. He explained operating a B&B and a home office is basically like taking about apples and oranges. He also gave me copies of the code (attached)., The brief overview is as follows:• - A B&B needs approval from the Zoning Board in order to operate. An accessory does not need approval, though is required to bide by outlined guidelines in the code . Multiple accessories are allowed on a single dwelling. A B&B is allowed to operate, if approved by the Zoning Board, with accessories, in this case a home office. I:06N° The office room I operate is on the main level of my house. The B&B operates in the - lower level of my house. ,There are no connections between the B&B and my therapy office, they are separate and always have been. At one point, as I explained in the Zoning Hearing, I initially thought to provide intensive weekend couple therapy retreats having the couple stay downstairs in,the B&B area. It never happened and it is not something I have ever done, it was just an idea, that has been defunct almost as soon as it was a conceived idea. Couples are not interested in a retreat in my house, they just come for individual therapy session, in my office. So in conclusion, a B&B and a home occupation office are allowed to operate concurrently in a single dwelling house. Also, Damon Rallis spoke with Mr. Michael Verity, the Supervisor, at my request and called me after the Supervisor returned to the Building Dept. office where they had the discussion of usage. Mr. Verity concurred with Mr. Rallis that a homeowner can have multiple accessories like a home office and with special approval, can also operate a B&B in the same dwelling. Mr. Schultheis research was not as comprehensive as it was presented, but now we all know the differences involved! Zoning Board Members are also welcome to visit my house and the separate home office area should they need clarification. Issue 2: Concerned Neighbors Against my B&B pursuit. Regarding the people/letters against my request for the B&B operation approval, there are a total of 5 letters. Here is information I would like the Zoning Board to know, whether it is pertinent or not, is your decision/choice. 1. Mr. Schulteis, 45 Holden Ave Extension, not on Holden Ave proper, rather down the two hills of Holden Ave., is on the other side of the crossroad Midwood Rd. Mr. Schultheis submitted a seeming thorough letter of violations I operate under my house. His letter and his appearance at the Zoning Hearing have been proved to be less than credible. Upon review of his letter, most is written from his belief', not from a stance of fact. - We've never met or spoke before the hearing. In the beginning of their move into their house years-ago, I spent two years waving at them as I drove past when they were outside, and they snubbed me and never reciprocated with waves. I gave up trying to be neighborly. OS° Also, oddly, his wife recently (4/30/16) came out of her property disturbingly waving her arms at my daughter driving past onto Holden Ave. Extension. My daughter didn't stop because the woman was acting erratic, running toward her in her moving vehicle. The police showed up on my door step within the hour because that woman called the Police Department to accuse my daughter of blowing a stop sign, driving away from her and almost running two people off the road...although there was no one else on the road except her acting crazy. My daughter was not going to stop with a seemingly crazy lady flinging her arms erratically trying to flag her down, as someone she doesn't know. No charges were filed obviously. The police officer was puzzled as well. I'm also not sure the Schultheis are full time residents of Fleets Neck. The house is vacant alot of the time, I drive past generally at least twice a day. 2. John and Diane Boone, 1925 West Creek Road, submitted a letter, are backyard neighbors to the Schultheis' and do not live near Holden Ave either, rather they live on West Creek Road. We have-never met. They do not appear to be full time residents of Fleets Neck. 3. & 4.Richard and Josephine Zanoni, 345 Holden Ave, live across the street on the other side of Dick's Point. They each submitted their own separate letters. In the 6- isn years (?) (could be more) that they have lived in their house, I have had one conversation with Mrs. Zanoni and little more than a wave from the Mr. Zanoni, not real community neighborly oriented. They are not full time residents of Fleets Neck. 5. Roy and Eileen Schumacher, 980 Southern Cross, are also not full time residents of Fleets Neck . They also have an ax to grind with me as they let their dogs roam free and I 'call'them on it, especially when I have walked my dogs on a leash and their dogs come after mine! It has been scary not knowing how the dogs would react, with them saying the dogs are friendly', so everything is supposed to be fine. Up until the submission of their letter here, I didn't even know their names, we only have had the interactions twice regarding their free roaming dogs. In my opinion, part time residents of Fleets Neck don't seem to be as vested into the community as the writing of their opinions may suggest, but yet they hold onto the higher standards for the neighborhood regardless of the limited time they spend living here. Most are what we always referred to since I was young, as they are 'summer folk', less than vested into a community connection with the 'locals'. When they are out in the summer, they tend to stay with their own families and guests that they bring out for their visits.- I admit I am a North Fork snob! because I am a born and raised North Forker, born in Greenport hospital and raised in Fleets Neck on Eastwood Drive two blocks away from Holden Ave. My Stepfather is finally selling the house that I grew up in. My Mom died 10 years ago and he is moving down south now where he can afford his later years more fully. I moved to Holden Ave full-time nearly 17 years ago. I have respect for the area and am loyal to my roots here. The changes to Fleets Neck have been immense since I was a young girl growing up here, but I still love this area, wanting only the best. Of my immediate neighbors, Tom and Jane Glover who live in New Jersey and across the street from me on Holden Ave have expressed support for my pursuit of a B&B, even last year when I was offering the short term AirBNB rentals. And Ted Boutzalis is a next door neighbor on Holden Ave., he made a special trip out from his home in Manhasset, specifically to ask me about my pursuit of this B&B after getting the Zoning Board notification. He expressed concerns regarding his past experience as a landlord with tenants subletting etc. (in Nassau County) He understood that I was always going to be present when guests attended the B&B. His concerns were valid, and he left the conversation satisfied with my intentions. He was ok with the B&B after our conversation. Regarding all the concerns of the neighbors presented, please know that last year when I operated the short term rental, there were no complaints from any of the neighbors near or far. There were no complaints from anyone, to me directly or to the police department or Town Hall. It was so low key, no one knew I was having AirBNB guests stay for the weekend...they thought (if it was even a consideration) they were all my friends staying over! Issue 3: Parking and Traffic The traffic on Holden Ave is really near non existent in the Winter, and Spring. Seriously, I have no neighbors! Tom and Jane Glover (across the street ) live in New Jersey and come out with increase attendance in the Summer and Fall, but are not full-timers. The other parcel across the street is a double plot owned by Filipkowski is a wooded plot, their home is built on the other side on Pinewood Rd, they don't use Holden Ave for any access to their property, on occasion they use Dicks Point. Next door to my right (on Holden Ave) is Anna and Ted Boutzalis, they live in Manhasset and are out rarely in the summer, mostly only on holiday weekends. Next door to my left (on Dicks Point) are people that I have never met because they have only been out to stay here a handful of times in any given Summer. Behind me down the hill are two neighbors, Kucher and Loutit who live on West Creek Road...I don't know who they are and they don't use Holden Ave. One is a part-time resident, one is a full time resident and their dog wakes me up with excessive barking almost every morning for years between 5:30 am and 7am! 61,6i-cP In the Winter months it is not uncommon for no vehicles to pass in front of my house on Holden Ave, or the side roads to me. All other times, including Summer, the flow of traffic increases maybe to 5 to10 vehicles passing thru, spread over the course of any given day. Last year when I opened the short term rental on the weekends, my guests parked their vehicles on the road and there were no complaints to me or the police....because hardly anyone is on the road passing by, it was never a problem. But now that I am aware that parking on the roadside is not acceptable on Holden Ave, I am making plans to be within code regulations. I have listened to the concerns of the Zoning Board and will add the car stalls near where the swings are , as initially the idea was presented by the Zoning Board Chairperson during the site visit. My application for the B&B is revised to be a one bedroom B&B. The two bedroom designation;is not appropriate as it currently is set up in the great room... If my home occupation office requires a parking slot, I will install two. The application brings up several issues which need to be addressed. The issues include the utilization of a B&B in the neighborhood, traffic issues, zoning regulations regarding residential areas, and the existing CO and Building Permit for the basement level. The idea of the proposed Bed and Breakfast in the the subject neighborhood presents quality of life issues for the residents of the neighborhood. A B&B is more suited to a commercial environment. There will be increased traffic in the area and the street is too narrow to allow offsite parking. In the past cones placed at the end of the driveway to identify the site to short term renters will continue to confuse thru traffic. A review of the Town of Southold Zoning Code supports the issue that the proposed Bed & Breakfast will not conform to the code. The first issue is that the residence in question is already being used as a Home Professional Office. A review of the professional website for the owner Mary Ann Fleischman LCSW-R who is a Clinical Social Workfrherapist will show by the photos of the office space that she uses her residence as her office. Pictures on the web site will show that she intends to establish the B&B in the same rooms presently utilized by her office thereby establishing two different uses in addition to a residence. A review of the pictures will show that the office includes the entire lower level floor as well as the rooms labeled Bedroom/Study and Bath on the First Floor Plan of the plans for the house submitted for the Building Permit.Article 218-13 (C) (2) (c) states that the office space shall not exceed 25% of the area of the entire area of all floors and in no event occupy more than 500 square feet of floor area.The floor area represented as her office in the pictures on the web site comprises 927 square feet or 427 more square feet than allowed. Article 218-13 (C) (2) (g) states that home professional offices shall in no event be deemed to include tourist homes, rooming houses, or boardinghouses. A B&B is definitely a tourist destination. Article 218-13 (C) (6) states that not more than four off-street parking spaces shall be permitted in the minimum front yard. Considenng there is no garage this could present a problem because of the existence of a B&B, home office and residence on the same site. Unfortunately the area available for parking was not delineated on the application q • Page 2 May 4,2016 A review of the records in the Building Department raises issues regarding whether the proper CO's exist for the existing building. The home was built in 1978. On June 3, 1998 Building Permit#24911 was issued for the lower level and stated it was for construction completed in 1978. The Permit shows the scope to include finishing the north side of the basement and a storage area on the south side. CO # Z-26123 was issued on 11/19/98 and indicated it was for "ALTERATION TO EXISTING ONE FAMILY DWELLING AS APPLIED FOR "AS BUILT" ". Inspection of the photo from the website will show that the south portion was also finished at some time and included new windows on the south and west sides as well as a completely finished interior. This wort is not addressed in any Building Permits or CO's in the Building Department. Also a B&B will require an egress window in proposed Bedroom#2. It is my belief that the Zoning Code does not allow a B&B in addition to the home office in the subject residence and also since proper Building Permits and CO's do not exist for alterations to the house the application must be denied. I have attached pictures of the office space identified on the web site with their location noted on the floor plan submitted with the application. (7) Beach clubs, tennis clubs, country clubs,golf clubs and annual membership clubs and accessory playgrounds, beaches,swimming-pools,tennis courts, recreational buildings and maintenance-buildings-catering-exclusively-to members and their guests, subject to the following requirements: (a) No building or part thereof or any parking or loading area shall be located within ioo feet of any street line or within 5o feet of any lot line. (b) The total area covered by principal and accessory buildings shall not exceed 20%of the area of the lot. (c) No such use shall occupy a lot with an area of less than three acres. (8) Children's recreation camps organized primarily for seasonal use and subject to the following requirements: (a) No building,tent, activity area or recreation facility shall be less than 20o feet from any lot line, and any such building,tent,activity area or recreation facility shall be effectively screened therefrom as required by the Planning Board. Buildings intended for use as_sleeping.quartersshall.besot.less.than 3o feet from each_other_, except ._ tents,which shall be not less than io feet apart (b) The minimum lot area shall be not less than io,000 square feet for.each cottage,tent or other principal-building and-not less-tharr3;000square feet of land area shall be provided for each person accommodated in the buildings or tents on the premises. (9) Farm labor camps, subject to the following requirements: (a) All farm labor camps on farms shall be construed in conformance with applicable laws and shall not be located nearer to any other residence than the residence of the employer, except by specific review and approval of the Planning Board. (io) Veterinarian's offices and animal hospitals, subject to the following requirements: (a) The housing of all animals shall be in a fully enclosed structure, if nearer than 15o feet to any lot line. (ii) Cemeteries_ . " (i2) Stables and riding academies_ (13) One accessory apartment in a lawfully existing detached accessory garage, barn or storage building, subject to the following requirements: (a) The accessory apartment shall contain no less than 450 square feet and shall not exceed 750 square feet of livable floor area and shall have no more than one bathroom. (b) A minimum of three off-street parking spaces shall be provided on premises (c) Not more than one accessory apartment shall he permitted on a lot. (4) Garden house,toolhouse,storage building, playhouse,wading pool, swimming pool or tennis court incidental to the residential use of the premises and not operated for gain, subject to the following requirements: (a) Any swimming pool shall be completely enclosed with a permanent chain link (or similar type) fence of not more than two-inch mesh, not less than four feet in height, erected, maintained and provided with a self-closing,self-latching gate to prevent unauthorized use of the pool4nd to prevent accidents. Ms. Fleishman's home is situated in a precarious location on a hill and her AirBNB guests are told to park, per her instructions, in the street between red cones in front of her home and not in her driveway. This parking situation and increase in traffic is a notable risk to our children and neighbors as it has unclear views for pedestrians and drivers. Our neighborhood is not a commercial business district. it is where we bought our homes to live in a tranquil and safe area to raise our children, go for a walk,jog, ride our bikes, skate, walk our dogs, enjoy our quality of life and retire.
