PROPERTY LOCATION: 2300 and 2200 Rocky Point Road,East Marion,NY SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk - County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated April 13, 2016 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: Subject parcels consist of three lots. Subject lot 1000-31-2-6.2 is vacant and is being eliminated, Subject lot 1000 31-2-7, (Lot 2) is being increased in size by 6,862 sq. ft. making the total lot size 23,387 sq. ft. and is improved with a one and a half story single family dwelling. Lot 2 remains non- conforming in R40 Zone District. It has 155.91 feet of frontage on Rocky Point Road, proposed 152.48 feet along the northern property line, 155.91 feet along the eastern property line, and 152.48 feet along the southern property line as shown on survey dated September 10, 2015, last revised Feb 4, 2016, prepared by John T. Metzger, LLS. BASIS OF APPLICATION: Request for Variance(s)from Article IV, Sections 280-18 and the Bulk Schedule,The building inspector's March 2, 2016 notice of disapproval based on an application for building permit for a lot line change, at less than the code required minimum lot size of 40,000 sq. ft. in this R-40 Zone District. RELIEF REQUESTED: Applicant is requesting a lot line change to eliminate a vacant nonconforming lot located between two improved lots which would create one improved conforming lot and reduce the nonconformance of the other improved non-conforming lot ADDITIONAL INFORMATION: The applicant will be required to apply to the Planning Board for a lot line change. Comments where requested from the Planning Dept., and on April 8, 2016, ZBA received a memo with comments stating that the Planning Board supports the variance as requested. Subject parcel 31-2-6 received a prior ZBA grant in 1977 under file No.2334 to divide property with insufficient width and area. FINDINGS OF FACT/REASONS FOR BOARD ACTION: Page 2-May 19,2016 ZBA File#6947—Philippou SCTM# 1000-31-2-7&6 2 The Zoning Board of Appeals held a public hearing on this application on May 5,2016 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties. The proposed lot line changes will eliminate a vacant non- conforming parcel, thereby reducing potential additional residential development, create one conforming parcel, and reduce the non-conformity of an improved parcel, all of which will benefit the character of the neighborhood. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some other method, feasible for the applicant to pursue, because the proposed lot line change, although eliminating a vacant lot, will still result in an improved lot that will remain non-conforming. 3. Town Law §267-b(3)(b)(3). The variance granted herein for the proposed non-conforming 23,387 sq. ft.( 0.537 acres) parcel (lot 1) in the R40 zone district is mathematically substantial representing 42% relief from the code. However, the lot line change will result in one conforming lot, eliminate one possible building lot, and decrease the degree of non-conformance of another lot. 4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The lot line change will have a positive impact by eliminating one density unit and creating more conformity to the code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the unimproved lot which,when annexed to the two adjacent improved lots, is not sufficiently large to create two confirming improved lots. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a lot line change while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Member Weisman (Chairperson), and duly carried,to GRANT, the variance as applied for, and as shown on survey dated September 10, 2015, last revised February 4, 2016, prepared by John T. Metzger, LLS. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. The proposal is for the 0.3 acre Vallas parcel (SCTM#1 000-31-2-6.1) to be merged with the 2.1 acre Vallas parcel (SCTM#1000-31-2-9) to create a single lot, shown as Lot 1 on the plan. In addition, the action before you seeks a Variance for a proposed Re-subdivision (Lot Line Change) that essentially splits the Tsakos parcel (SCTM#1000-31-2-6.2) where 9,664 sq. ft. would be transferred to SCTM#1000-31-2-6.1(Lot 1) and 6,862 sq. ft. would be transferred to SCTM#1000-31-2-7. The resulting Lot 1 would equal 2.67acres and conform to the R-40 Zoning District. Lot 2 would equal 0.5 acres and would not conform to the R-40 Zoning District. The Planning Board supports the Variances as requested based on the following: 1. Our records indicate that the involved parcels are not subject to Planning Board restrictions. 2. The action would make one existing non-conforming lot (SCTM#1000-31-2-6.1) conforming, and make the other (SCTM#1000-31-2-7) less non-conforming in the R- 40 Zoning District. ZONING BOARD OF APPEALS (1) An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if granted, because: The subject parcel owned by Harry and Irene Philippou and the neighbor Theodore Vallas purchased together the Paul Tsakos parcel in order to split the parcel and complete a lot line change. The Philippou parcel is an improved pre-existing nonconforming parcel with regard to area,the parcel will be made larger by the purchase of the adjacent parcel. The size of this and neighboring Rocky Point Road parcels were established prior to up-zoning, the merging of the extra land will not change the character of the area. (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because:Because the Philippou parcel is less than one acre, and will remain less than one acre after the lot line change, the benefit of the extra land merged to make the Philipou parcel larger can not be achieved without the "technical" variance. The lot is being made "more conforming" however the lot remains undersized. (3) The amount of relief requested is not substantial because: The area variance is to make the existing improved parcel larger. (4) The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: No adverse environmental impacts. Two buildable lots are being extinguished by the proposed lot line change. The Vallas family is merging their"conforming" two acre parcel with the Rocky Point Road parcel. No variance is required because their parcel is being made larger through the combining of two buildable lots and the jointly purchased portion of the Rocky Point Road parcel.
