SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated February 9, 2016 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated February 11, 2016. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRP in regard to the survey/site plan not showing the Flood zones and the as-built additions and accessory structures being built without the benefit of a Board review. The survey/site plan has been revised and submitted to show the Flood Zones (Zone X and Zone VE) and the subject as-built structures between the top-of-bluff and bulk head will be reviewed by the Southold Town Trustees, all of which will then be CONSISTENT with LWRP policy standards and therefore CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: The subject parcel is a 33,673 square foot waterfront parcel in an R-40 district. The parcel fronts Nassau Point Road for 101.18 feet, it adjoins a parcel to the north for 329.81 feet and a parcel to the south for 343.66 feet and is waterfront to Little Peconic Bay along the apparent high water mark for 100.01 feet. The parcel is improved with a one and two story frame and stone house and garage with an attached as-built deck. The parcel has a bulkhead at the bottom of the slope and has multiple retaining walls, decks and stairs between the top-of-bluff and bottom of slope, all as shown on the survey prepared by Nathan Corwin Taft III, L.S., dated November. 19,2007 and last revised March 4, 2016(Add Flood Zone). BASIS OF APPLICATION: Request for Variances from Article XXII Section 280-116A and Article XXIII Section 280-124 and the Building Inspector's December 22, 2015, Amended January 14, 2016 Notice of Disapproval based on an application for building permit to legalize 'as built' additions/alterations and accessory structures and construct additions/alterations to the existing 'as built' accessory structures, at; 1) the proposed and Page 2-May 19,2016 ZBA File#6929—Stronski SCTM#1000-111-15-11 'as built' accessory construction is less than code required setback of 100 feet from the top of the bluff, 2) 'as built' deck addition is less than the code required setback of 100 feet from the top of the bluff, 3) 'as built' deck addition located at less than the code required minimum side yard setback of 15 feet, located at: 7125 Nassau Point Road (adj.to Little Peconic Bay)Cutchogue,NY. SCTM#1000-111-15-11 RELIEF REQUESTED: The applicant requests variances to maintain an as-built wood deck addition having: 1.) a top of bluff setback of+/- 20 feet, where the code requires a minimum of 100 feet and 2.) a single side yard setback of 12.8 feet,where the code requires a minimum of 15 feet, all as shown on the survey prepared by Nathan Corwin Taft III,L.S., dated November 19, 2007 and last revised March 4,2016(Add Flood Zone). ADDITIONAL INFORMATION: This application only addresses the as-built deck addition that is attached to the rear of the dwelling and landward of the top-of-bluff, ZBA jurisdiction. The area between the existing top-of-bluff and existing bulkhead at the bottom of the slope (bluff face) has multiple retaining walls, decking, landings and stairs of which some are being removed and/or repaired or rebuilt. This area is under the jurisdiction of the Town Trustees. The Board of Appeals requested and received comments on the subject application from the Board of Town Trustees in a Memorandum dated March 9, 2016, which included the proposed removal of an existing dilapidated "boathouse/gazebo" which the applicant intends to do. The Board also required that the applicant contact Jay Tanski, Senior Coastal Processes and Facilities Specialist, at Sea Grant to determine the impact of removal of retaining walls and other structures on bluff stability. A letter from Tanski, dated April 22, 2016, was received at the public hearing on May 5, 2016. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on March 3, 2016 and May 5, 2016, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law $267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Rear yard attached decks are characteristic of residential properties in this neighborhood and the subject as-built deck cannot be seen from the street. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant could have constructed a patio at grade in lieu of the raised as-built deck. 3. Town Law §267-b(3)(b)(3). The variance granted herein for a top-of-bluff setback is mathematically substantial, representing 80% relief from the code. However, is has been professionally determined by a Senior Coastal Processes and Facilities Specialist that "The bluff face was steep but well-vegetated, indicating it was relatively stable". Therefore, since the deck is as-built from at least 2001 (from viewing Suffolk County GIS data), it shows that its existence, over time, has not been detrimental to the stability of this bluff, which mitigates the substantiality. The variance granted herein for a side yard setback is mathematically substantial, representing 13% relief from the code. However, the applicant's representative stated that there is an error in the submitted survey showing the subject existing side yard setback. Upon site inspection, it was discovered that the as-built deck addition is aligned with the dwelling in the side yard. The as-built deck addition is in alignment with the dwelling and has the same existing side yard setback as that of the dwelling, of 14 feet, which represents a 7% relief from the code, which is not substantial. • Page 3-May 19,2016 , ZBA File#6929—Stronski • SCTM#1000-111-15-11 4. Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the-neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in, effect and it,is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6.,Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an attached rear yard deck, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. _ RESOLUTION OF THE BOARD: In considering all of the'above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Schneider, seconded by Member Goehringer, and duly carried,to . Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. UI >.;•:'�.te Y S"Ilt New York April 22, 2016 Dear Mr. Kimack: I am writing to briefly summarize my observations made during the site visit yesterday at the Stromski/Perez property at 7125 Nassau Point Road. There were a unusually large number of structures on the bluff face that included stairs, decks, landings and retaining walls. The structures appeared to be built at different times and were in various states of repair. The bluff face was steep but well-vegetated, indicating it was relatively stable. The plans you provided call for rebuilding, modifying, repairing and adding structures. In terms of maintaining bluff stability, the most critical action is removing the two uppermost retaining walls and replacing them with a single retaining wall placed slightly down slope with a top elevation matching the existing top of the bluff. The existing top retaining wall was comprised of horizontal members that were essentially resting on the slope. This wall has no foundation and appeared unstable as indicated by its leaning downslope. Removal of this wall will not affect bluff stability as long as the associated fill is excavated and removed from the edge. I should note that this is assuming that all work on the bluff face is to be done by hand as indicated by your builder. The second existing retaining wall downslope is also constructed of horizontal members but it was not possible to judge how deep they penetrated the bluff surface. To avoid destabilization of the bluff face care must be taken if this wall is to be removed. The backfill will first have to be removed carefully and measures taken to stabilize the slope while the work was done. Your builder indicated that he would be using coir logs and geotextile erosion control fabric to accomplish this. A major concern is that the amount of wood needed for the crib retaining wall and the associated backfill will be adding additional weight to the top of the bluff and could cause an unstable condition. The bulkhead at the toe of the bluff and the existing vertical sheetpile retaining wall are primarily responsible for the present bluff stability. The integrity and strength of the retaining wall are critical in terms of supporting the added weight of the new retaining wall and backfill. Visual inspection indicated the existing wall was well-built and in good repair. However, it was not possible for me to assess the wall's foundation, depth of penetration of the sheetpile and piling or potential resistance to overturning. Again, your builder indicated he was present when the existing wall was built and was confident that it could handle any potential increased load due to the new retaining wall. Another potential problem is the fact that the existing vertical sheetpile retaining wall does not extend across the entire bluff face while the plans call for the new retaining wall to extend all the way to the southern property line. This will result in a significant stretch of bluff where extra weight will be added to the top of the bluff without the benefit of the foundational stability provided by the vertical sheetpile retaining wall. As we discussed, this will create a very unstable condition. The plans should be modified to address this situation. However, if the structures are removed by hand this impact should be minimal and would most likely be outweighed by the benefits associated with re-vegetating the bluff. As we discussed, before completely dismantling the middle landing you should assess the role the structural elements play in maintaining the integrity of the attached retaining walls. You may want to remove the decking but keep the structural components or add deadmen and tiebacks to realign and strengthen walls. I would also suggest you consult with SCWS regarding what to do with the tree on the bluff face on the northern end of the property. They can cause an unstable condition by adding weight to the bluff face. Removal of the dirt-filled, elevated square wood structure will result in a steep slope (similar to the natural slope to the north)that may require terracing to establish vegetation. The following are the observations and recommendations of this site investigation as follows: Observations: The existing house is sited atop a vegetated bluff with less than 50 feet of lawn and deck occurring between the house and bluff. The top of the bulkhead to the top of the bluff is vegetated with a diversity of native and non-native species. However, the existing deck, stairs, and landings appear to be in poor condition. Recommendations: The foremost objective with the proposed application is maintaining the present level of bluff stability. Currently the stability has been achieved through toe protection via the bulkhead and stability of the top of the bluff by limiting disturbance and surface water from traveling onto'the bluff. The vegetation occurring on the bluff face is critically important to maintaining the stability. While information gathering-is the prime objective of the pre-submission process, it provides some indication as to what the'Board might contemplate upon submission of an application for a wetland permit. 1) Noted was a gap in the bulkhead beneath an overhanging deck. The Board believes a contiguous bulkhead would best serve bluff stabilization and erosion protection for this site. 2) The Board believes the enclosed structure resembling.a boathouse is beyond repair and should be removed. Should engineering/other justification point to it being saved, the Board would limit use to no plumbing/water/sewage. 3) The Board would like to limit deck area consistent with good soil and water conservation practices. A 200 square foot limitation for decks in erosion prone areas as a guideline as well as the Wetland Code limitation of decks no larger than 100 square feet associated with stairs would be benchmarks the Board might consider in reviewing.the wetland application. 4) Water and electric should be limited to incidental waterfront uses, i.e. no showers and only permit irrigation of vegetation as part of a planting plan. i 5) In reviewing the Trustee's pre-submission inspection report and recalling the site it comes to mind that there is extensive tree shading of the bluff which should be accounted for in any revegetation plan. Policy 4.1. "Minimize losses of human life and structures from flooding and erosion hazards." The following management measures to minimize losses of human life and structures from flooding and erosion hazards are recommended. specifically A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. 3. Move existing development and structures as far away from flooding and erosion hazards as practical. Maintaining existing development and structures in hazard areas may be warranted for a. structures which functionally require a location on the coast or in coastal waters. The accessory structures do not functionally require a location on the coast and are not water dependent. 5. Manage development in floodplains outside of coastal hazard areas so as to reduce adverse environmental effects, minimize the need for future structural flood protection measures, or expansion of existing protection measures and to meet federal flood insurance program standards. Flood zones are not shown on the submitted documents and must be added. Portions of the deck appear to be located in the VE (velocity hazard) Flood Zone - El 9'. VE zones are defined as areas with special flood hazards associated with high-velocity waters generated by tidal surges and hurricane wave wash. Accessory structures located within these areas have the potential to suffer high rate of loss and pose hazards to life and property during storm surge events. The 65 degree angled new bulkhead and retaining wall, along with the upper and lower planting levels, formed by stepped RR ties,do not exist in the form presented on the attached site plan. However, a retaining wall does exist in its place, which includes the underground storage facility, as well as 65 degree angled four sided retaining wall near the northerly property line. Also shown on the site plan, is the deck off the bulkhead, albeit to be stone or brick, the landing and staircase to the lower deck aforementioned, the line of an existing bulkhead and retaining wall, which is in existence landward of the aforesaid retaining wall, and the existing bluff stairs. The waiver grants permission to construct a secondary retaining wall , presumably the next one landward was the first. It can be said that the two lower retaining walls, the deck off the bulkhead, the stairs and landing leading to said deck and the bluff steps along with a portion of the northerly steps, were in existence, or to be constructed, at the time this waiver was given, with no other concerns raised by the Trustees. It can be said that the existing steps, decks and retaining walls were generally a known quantity to the Trustees who granted a waiver,that, if completed as designed, would make what now exists,pale in comparison. I respectfully request the Board consider that a good portion of what now exists on the slope was either granted a waiver by the Trustees, or they did not feel the need to include in the waiver.
