SCTM#1000-116-5-11 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated March 14, 2016, stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated April 6, 2016. The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The applicant's property is a non-conforming 13,662 sq. ft. waterfront parcel in the R-40 zone, with a 9,316 sq. ft. buildable area. The northerly lot line measures 40.00 feet along Dean Drive. The easterly lot line measures 347.54 feet along an adjacent residential parcel, and the southerly lot line measures 45.59 feet along Peconic Bay. The westerly lot line measures 341.91 feet along another residential parcel. The property is improved with a one story single-family dwelling and an accessory garage, as shown, on the survey drawn by John Metzger, Licensed Surveyor, dated May 26, 2015, latest revision dated Jan. 15, 2016, showing the proposed new building construction and new septic system. BASIS OF APPLICATION:_Request for Variances from Article XXIII Section 280-124 and the Building Inspector's February 11, 2016 Notice of Disapproval based on an application for building permit to demolish existing dwelling with deck and construct new single family dwelling with deck additions, at; 1) less than the code required minimum side yard setback of 10 feet,2) less than the code required combined side yard of 25 feet. RELIEF REQUESTED: The applicant requests two variances in order to demolish and reconstruct a one story, single family dwelling with single side yard setback of 4.3 feet where 10 feet is required by Code, and a combined side yard setback of 8.6 feet where 25 feet is required. , ` ADDITIONAL INFORMATION: The applicant's file includes a copy of a Pre-existing CO #26873, dated Jan. 06, 2000, issued for the existing single family dwelling, with deck, and a one car accessory garage, built prior to April Page 2-May 19,2016 ZBA File#6944—Taylor SCTM#1000-116-5-11 9, 1957. The file also contains a copy ofNYSDEC Tidal Wetlands Permit #1-4738-04433/00001, dated Feb. 1, 2016. Several neighbors submitted letters in support of the applicant's proposed construction. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on May 5, 2016, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law X267-b(3)(b)(I). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The long-established neighborhood contains numerous non- conforming, similar sized parcels with dwellings that have non-conforming side yard setbacks. The applicant will increase by 3-4 feet the existing setback from Peconic Bay, and increase both side yard setbacks by approximately 1 foot. 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The narrow, 40 feet width of the property makes construction of an average sized dwelling not possible without the grant of the variances. 3. Town Law §267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 57% relief from the code for the single side yard setback, and 66% relief for the combined side yard setback. However, the neighborhood consists of several other parcels with variances granted for non-conforming side yards. 4. Town Law &267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. The applicant will construct a new county certified on-site septic system. 5. Town Law M7-b(300). The difficulty has not been self-created, because the property has been owned by this family since before zoning,the dwelling has pre-existing status, and the lot is only 40 feet wide. 6. Town Law &267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new single family dwelling with non-conforming side yard setbacks, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Horning, seconded by Member Goehringer, and duly carried,to GRANT the variances as applied for, and shown on the drawn by John Metzger, Licensed Surveyor, dated May 26, 2015, latest revision dated Jan. 15,2016, showing the proposed new building construction and new septic system. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. Establish Vegetated Buffer To protect the values of the tidal wetlands, a permanent vegetated buffer zone shall be established. There shall be no disturbance to the natural vegetation br topography within the area labeled as "BEACH GRASS" on the approved survey. 8. Straw Bales or Other at Tidal Wetland A row of staked straw bales or approvable erosion control devices shall be placed a minimum of 100linear feet from the tidal wetland boundary, prior to commencement of any regulated activities and remain in place and in good, functional condition until the project is completed and all disturbed areas are stabilized with vegetation. 9. Area of Disturbance for Structures Disturbance to the natural vegetation or topography greater than 20 feet seaward of the approved structure is prohibited. 10. Storage of Equipment, Materials The storage of construction equipment and materials shall be confined within the project work area and/or upland areas greater than 100 linear feet from the tidal wetland boundary. 11. Concrete Leachate During construction, no wet or fresh concrete or leachate shall be allowed to escape into any wetlands or waters of New York State, nor shall washings from ready-mixed concrete trucks, mixers, or other devices be allowed to enter any wetland or waters. Only watertight or waterproof forms shall be used. Wet concrete shall not be poured to displace water within the forms. 12. Sanitary Systems above Groundwater Sanitary system (bottom of tank and leaching pools) shall be located a minimum of 2 feet above seasonal high groundwater. 13. Runoff Directed to Upland Drywells Roof runoff shall be directed to drywells a minimum of 100 linear feet landward of the tidal wetland boundary for immediate on-site recharge. 14. Tarps are authorized to supplement these approved methods. 16. Driveway/Parking Area of Pervious Material Driveway and parking areas shall be constructed of NYSDEC-approved pervious materials. 17. No Disturbance to Vegetated Tidal Wetlands There shall be no disturbance to vegetated tidal wetlands or protected buffer areas as a result of the permitted activities. 18. No Construction Debris in Wetland or Adjacent Area Any debris or excess material from construction of this project shall be completely removed from the adjacent area(upland) and removed to an approved upland area for disposal. No debris is permitted in wetlands and/or protected buffer areas. 19. Seeding Disturbed Areas All areas of soil disturbance resulting from the approved project shall be stabilized with appropriate vegetation(grasses, etc.) immediately following project completion or prior to permit expiration, whichever comes first. If the project site remains inactive for more than 48 hours or planting is impractical due to the season,then the area shall be stabilized with straw or hay mulch or jute matting until weather conditions favor germination. 20. Precautions Against Contamination of Waters All necessary precautions shall be taken to preclude contamination of any wetland or waterway by suspended solids, sediments, fuels, solvents, lubricants, epoxy coatings, paints, concrete, leachate or any other environmentally deleterious materials associated with the project. 21. State May Require Site Restoration If upon the expiration or revocation of this permit, the project hereby authorized has not been completed, the applicant shall, without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservation may lawfully require, remove all or any portion of the uncompleted structure or fill and restore the site to its former condition. No claim shall be made against the State of New York on account of any such removal or alteration. 22. PROPERTY FACTS/DESCRIPTION: The applicant's 18,883 sq. ft. lot has frontage along the south side and east side' by Dean Drive, and 259.85 ft. along the westerly property line. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on March 18, 2004, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other,evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicants wish to construct additions with alterations to the existing dwelling at 29.9 feet from the easterly (front) lot line and from the westerly (side) lot line with variable setbacks between 5.1 ft. and 12 ft., and to rotate the existing detached garage (265 sq. ft. and proposed 128 sq. ft, addition)to a minimum setback at 23 feet from the front lot line. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated September 11, 2013 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated September 23, 2013. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP. PROPERTY FACTSIDESCRIPTION: The property is a non-conforming 22,201 square feet and has 12,083 square feet of buildable area, it is located in the R40 zone district. On the property is an existing Garage which has a lot area of 331 square feet. There is an additional structure on the existing property which has been severely damaged by fire. It has 50.00 feet of frontage on Dean Drive, 293.21 feet on the eastern property line, 116.70 feet on the Great Peconic Bay and 342.62 feet on the west property line. All is shown on a survey prepared by John T. Metzger L.L.S. dated April 24, 2013 and last revised August 27, 2013. BASIS OF APPLICATION: Request for Variances from Article XXIII Section 280-124 and the building inspector's August 20, 2013 Notice of Disapproval based on an application for building permit for demolition and reconstruction of a new single family dwelling at; 1) less than the code required minimum side yard setback of 15 feet, 2) less than the total combined side yards of 35 feet, 3) more than the maximum code permitted lot coverage of 20%. ADDITIONAL INFORMATION: During the hearing a photograph of an old survey of the applicant's property dated August 30, 1971 was presented. The old survey showed that the lot area of the property back in 1971 was 17,800 square feet. 'The most recent survey of the property shows that the lot area of the property is 22,201 square feet. Testimony was taken that the size of the property increased between 1971 and 2013 because Suffolk County dredged Down Creek twice and both times dumped the spoils from the dredging in front of the applicant's as well as the applicant's neighbors' properties. On January 2, 1969, this property was granted a variance under file #1228 to reduce frontage and area. The agent submitted a copy of the NYSDEC approval and similar variances granted in the area. Additionally,five letters of support where received from neighbors. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on October 3,2013 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law&267-b(30)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood around the subject property contains many similarly sized houses, some significantly larger than the proposed structure which are placed on parcels similar in size to the applicant's property. The Zoning Board has approved similar variances four times (ZBA file No's 5489; 5711; 5984; and 6585). 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance because the over coverage of the lot is a direct result of the significant restrictions placed on the property by the definition of"buildable land." While the property is roughly 22,201 square feet, only 12,083 square feet of that is "buildable land", thereby significantly restricting the size of the house on the lot below what the actual size of the lot would allow. The side yard setback variances are needed because the lot narrows precipitously upon reaching the"buildable land"section of the property. 3. Town Law §267-b(3)(b)(3). The variances granted for the excess lot coverage herein is not mathematically substantial, representing 12% relief from the code. The variance granted for,the minimum side yard setback is not substantial and represents a 14% relief from the code. The variance granted for the total side yard setback is substantial and represents a 26% relief from the code. However, the lot is an odd shape and its location bordering the Great Peconic Bay limits the buildable lot area as well as the location where a structure may be built. 4. Town Law &267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law &267-b(3)(b)(5). The difficulty for the relief of the lot coverage limitation has been self-created. However, the difficulty of the relief requested from minimum side yard setback and total side yard setback has not been self-created. The applicant purchased the parcel in 1973 after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. However, dredging by Suffolk County increased the size of the parcel, after the applicant purchased it,therefore increasing the side yard setbacks required by code. 6. Town Law &267-b. Grant of requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new waterfront home while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
