SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated February 9, 2016 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated February 24, 2016. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is INCONSISTENT,. The LWRP Coordinator, in his evaluation of this project, raises the following: 1. Avoid development with other than water dependent uses in costal hazard areas. Locate new development which is not water-dependent as far away from costal hazard areas as practical. 2. Chapter 275 of the wetlands and shorelines for the Southold Town Code requires that a pool be setback 50 feet from the top of the bluff line. 3. The Coastal Erosion Hazard Area Line is located 25.9 feet from the proposed pool. 4. Aerial analysis shows the bluff surface to be stable and is heavily vegetated, however, storm events have caused the Town's shoreline to experience severe erosion(even when hardened) It is recommended that the pool be relocated to maximize the distance from the Coastal Erosion Hazard Area. The inconsistency is mitigated by the relied as amended. The applicant relocated the proposed in-ground swimming pool and adjusted the width and length to increase the in-ground swimming pool setback to 48 feet and is therefore determined to be CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: Parcel is 23,708 square feet with a buildable area of 11,215 sq. ft. located in the R40 zone district, it is improved with a two story framed dwelling. The survey shows 100.00 feet on Sound Avenue, to the south, 249.94 feet on the west, 241.49 feet on the east, and with 96.40 feet on the L.I. Sound,to the north, survey produced by Nathan T. Corwin Surveyor dated 11/16/2012, last revised February 20,2013.. Page 2-May 19,2016 ZBA File#6927—Alexandrou SCTM# 1000-33-1-11 BASIS OF APPLICATION: Request for Variance(s)from Sections 280-116A(1)and the Building Inspector's January 25, 2016 Notice of Disapproval Based upon an application for a building permit for an accessory in-ground swimming pool, at; 1)proposed location to locate an in-ground swimming pool less than 100 feet from the top of the bluff. RELIEF REQUESTED: The applicant is requesting to construct an accessory in-ground swimming at 34.11' from the top of bluff where the code requires a minimum setback of 100 feet. AMENDED APPLICATION: During the hearing, the applicant was asked to bring the plan into more conformity with the code. The agent for the applicant was asked to place the proposed swimming pool in the westerly side yard which will create a much larger setback from the bluff. The applicant, on April 18, 2016, submitted a plan increasing the setback to 48 feet from the top of the bluff, in the westerly side yard,therefore bringing the plan into more conformity with the code. Although accessory structures are not permitted in the side yard,the environmental impact of increasing the setback from the bluff is far more important. ADDITIONAL INFORMATION: This property was subject to three prior variance hearings. The first under file#3386 in 1985 denied without prejudice the location of a new dwelling at 35 feet from the edge of bank. The next was file #3471 in 1986 which approved the placement of a new dwelling no closer than 50 feet from the nearest point from the top of bank. And the last was file#3863 in 1989 granting a 35 foot front yard setback from sound Drive. The new placement of the pool adjacent to the home on the west side of the dwelling creates a much lesser impact to the top of the bluff. Three letters with concerns were received from neighbors. The ZBA requested comments from the Town Trustees and in a memo dated March 7, 2016 the Trustees stated; the wetland code setback for swimming pools under Chapter 275 is 50' from a bluff, additionally they would request a modification to place the pool closer to the home either by minimizing the pool deck or the pool itself. On February 26, 2016 the ZBA received comments from Suffolk County Soil and Water; they suggested several mitigating measures to reduce erosion to the bluff which will be added as conditions. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held public hearings on this application on March 3, 2016 and April 7,2016 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law $267-b(3)(b)(1). Grant of the relief as amended will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. In-ground swimming pools are common accessories in this neighborhood. Several homes have in-ground swimming pools close to their home in the rear yard and side yard. The Zoning Board has granted variances to homes along this bluff at the farthest distance practicable. The relief as amended is in keeping with prior bluff setbacks granted in this neighborhood. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant could construct the pool in the westerly side yard, which would require an additional side yard variance. However, the placement of the swimming pool would require a variance in almost any location proposed on this property due mostly to the proximity of the house to the top of bluff. 3. Town Law $267-b(3)(b)(3). The variance(s) granted herein is mathematically substantial, representing 52% relief from the code. However, the board finds that placing the swimming pool in the side yard reduces impact on the bluff and the applicant has no room for the swimming pool in the front yard. The bluff setback of 48 feet is substantial, representing 100% relief for the side yard location. However, the entire house is within the 100 foot setback and any addition to the rear or side of the dwelling will require a variance. Page 3-May 19,2016 ZBA File#6927—Alexandrou SCTM#1000-33-1-11 4. Town Law &267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and both agencies have indicated that the bluff is stable; however the recommendations by these agencies must be followed. The mitigation factors imposed by the conditions herein have reduced the environmental impact. The side yard location of the swimming pool is more environmentally sound then placing the pool in the rear yard, which is closer to the top of the bluff 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law $267-b. Grant of the relief as amended is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a in-ground cement swimming pool at 48 feet from the top of the bluff while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Chairperson Weisman, seconded by Member Goehringer, and duly carried,to DENY, the variance as applied for, and to GRANT,the relief as amended, subject to receipt of a professionally stamped survey showing a 48 foot minimum setback from the top of the bluff for the proposed in-ground pool, located in the westerly side yard with a minimum side yard setback of 10 feet. Subject to the following conditions; CONDITIONS; 1. A silt fence shall be installed during construction just landward of the non-turf buffer area. 2. All equipment to be use in constructing the pool shall be small rubber tired equipment, 3. A dry well shall be established in the western side yard, large enough to accommodate the majority of the pool water. At no time will water be pumped over the bluff. 4. Pool mechanicals shall be placed in a sound deadening enclosure 5. The water hose at the top of the bluff mentioned by Soil and Water Tec. shall be removed and no fresh water shall be permitted over the bluff. 6. All soil created by pool excavation shall be removed from the property, no excess material shall be used between the home and the bluff. 7. The applicant and his agent must adopt all recommendations by both the LWRP Coordinator,the Evaluation by S.C. Soil and Water Tec. as well as specific recommendations from the Southold Town Trustees. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. Bredemeyer, III, President Board of Trustees RE: Wetland Application of Alexandrou—SCTM#: 33-1-1 The Trustees performed a field inspection of the above referenced property for a proposed in- ground swimming pool with retaining wall on January 14, 2016. The wetlands code setback for swimming pools under Chapter 275 is 50'; a bluff being a natural resource feature for which the setback is required. The Board has been reluctant to grant a waiver for this degree of setback unless site specific or environmental conditions warrant issuance. In this instance noting the apparently stable vegetated bluff, the Board could contemplate a waiver with engineering and soils information that would support such a siting. Typically, however, the trustees might request a plan modification to place the pool closer to the home either by minimizing the pool deck or pool itself. This evaluation of the property located at 2700 Sound Drive in Greenport was conducted on February 11, 2016. At the time of the visit, the ground was covered with snow and a complete assessment of the ground for erosion concerns could not be determined. The following are the observations and recommendations respective of the findings of this inspection. Observations: The pool will be sited on the north side of the property requiring the excavation of lawn grasses and a significant amount of soil.This area slopes towards the south away from the bluff, is well vegetated, and in a stable condition. It appears from the site inspection and the survey provided that there are no drywells to manage roof runoff and the stormwater is discharged directly to the ground surface. The vegetation on the bluff is a mix of mature, invasive species and shrubbery. The slope and toe however remain in stable condition with no severe signs of erosion. Slight erosion is occurring under the stairway, which is also in stable condition and bare spots of vegetation occur just adjacent to each side of the stairway. An irrigation system or some sort of water conveyance (blue hose) is installed along the top of the bluff. Along this line there is no vegetation and can be or become an erosion hazard. There should be NO irrigation or water discharge over the top of the bluff. This curious hose should be removed in order to maintain the integrity of the bluff top. Recommendations: At this location, maintaining bluff stability and protecting Long Island Sound from sediment pollution are the primary considerations associated with the installation and maintenance of the pool at this location. In order to install this pool, a high degree of soil excavation will be necessary. Such soil disturbance leads to a high erosion potential. The close proximity to the bluff similarly lends to a high potential for sediment loading into Long Island Sound. Therefore, it is critically necessary that silt fencing is erected prior to soil disturbance to capture any sediment traveling downslope. These will help increase the life and function of the retaining wall especially in association with pool activities. All exposed soils should be seeded with turf grass and covered with jute erosion control fabric as soon as possible after soil disturbance. This will help stabilize the soils on the slope and aid in seed germination. Care should be taken with any irrigation activities meant to aid in seed germination as over irrigation poses an erosion hazard to the bluff face. Soil which has been excavated should be immediately removed from the site and not stockpiled due to the potential for erosion and sedimentation. Excavation and construction equipment should not be stored or left running on the proposed construction area due to the heavy weight and vibrations of these machines may cause instability atop the bluff. Water running over the bluff face is a catalyst of erosion. Therefore, the pool must be fitted with a dry well that would facilitate the draining of the pool water directly into the ground. At no time should the pool be drained by discharging the water directly onto the ground surface. This volume of water combined with the slope is guaranteed to cause severe and possibly irreparable bluff erosion either on this or adjacent neighboring property. Accordingly,all the structures should be fitted with downspouts that lead into drywells in order to reduce surface water flow to the bluff face. -To help ensure the continued stability of the bluff slope reflective of the current conditions, the irrigation system or water conveyance (blue hose) atop the bluff should be disconnected to reduce sheet and concentrated water flow down the bluff face. All exposed (unshaded) bare soils around the stairway should be seeded. Finally, the bluff should be regularly inspected and immediately repaired especially after storm events. The toe is currently in stable condition but if erosion at the toe, face or top of the bluff develops, the structures atop the bluff will be compromised if bluff stabilization is not maintained. SCTM#1000-33-1-11 - The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the Policy Standards and therefore is INCONSISTENT provided that: 4.1 Minimize losses of human life and structures from flooding and erosion hazards. A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. 1. Avoid development other than water-dependent uses in coastal hazard areas. Locate new development which is not water-dependent as far away from coastal hazard areas as practical. b. Avoid hazards by siting structures to maximize the distance from Coastal Erosion Hazard Areas. Chapter 275 Wetlands and Shorelines for the Southold Town Code requires that a pool be setback 100' from the top of bluff line. Additionally Chapter 280 requires that a pool be setback 100' from the top of bluff. A past Wetland Permit 0835C required that a 15' wide, non-turf buffer be installed. Aerial analysis shows that the bluff surface is heavily vegetated and relatively stable at this time, however,with consideration of the storm events that have caused the Town's shoreline to experience severe erosion (even when hardened). The Coastal Erosion Hazard Area/Line is located 25'.9" from the pool. It is recommended that the pool be relocated to maximize the distance from the Coastal Erosion Hazard Area. PROPERTY FACTS/DESCRIPTION: The property is a non-conforming 27,926 square foot waterfront parcel located-in an R-40 zone. The property has 19,306 square feet of buildable area. The property has 101.16 feet bordering the Long Island Sound. The property runs 283.68 feet on the East side, 100.00 feet along Sound Drive, and 273.95'feet on the West side. 'The parcel is developed with a 2 story frame dwelling and an accessory shed. There is a set of wood stairs going from the top of the bluff down to the bottom of the bluff. The highest natural 'point-of the property is on the top' of the bluff. From the top of the bluff the property elevation decreases as the' property gets closer to the house and street. All is shown on a survey by Kenneth M. Woychuk L.L:S. dated July 15,2011,last revised 9-13-14. Code requires all structures to be set back at least 100 feet from the top of the bluff. Following construction the applicant requests a variance to build a deck and accessory shed at 5 feet from the property line where code requires 15. The applicant also requests a variance for lot coverage of 22.7 percent where code permits a maximum of 20 percent. Finally,the applicant requests a variance to put an accessory shed in a side yard when code requires accessory sheds to be in a rear yard or front yard for water front properties. AMENDED APPLICATION: During the hearing, the applicant was asked to bring the plan into more conformity with the code. The applicant on September 15, 2014 submitted a plan replacing the raised wooden deck with a brick patio,and increasing the proposed set back from the bluff to 48 feet. The proposed side yard setback for the pool is increased to a code conforming15 feet, and the proposed lot coverage was reduced to a code conforming 17.9 percent. This eliminates the need for two variances and increases the applicant's proposed set back from the bluff thereby bringing the plan into more conformity with the codes. ADDITIONAL INFORMATION: Site inspection showed that there is a large hill on top of the bluff. Therefore storm water run off from the pool will slope away from the top of the bluff towards Sound Drive and the proposed pool will not affect the stability of the bluff. There was a prior variance on this property under ZBA file#3502 in 1986. The Board granted a variance to locate a new single family dwelling, attached decks, pool areas, etc. no closer than 65 feet from the top of the bluff, and no disturbance of the land area within 50 feet of the top of bluff and no fill or materials deposited over the bluff. In August 1986, under appeal 43546,the applicant aske'M- ivf lief to re-grade the area within 50 feet of the bluff,this application was denied. JAN 2 5 Z016 FINDINGS OF FACT/REASONS FOR BOARD ACTION: ZONING BOARD OF APPEALS The Zoning Board of Appeals held a public hearing on this application on September 4,2014 at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law X267-b(3)(b)(1). Grant of the variance for the proposed setback from the bluff for a swimming pool and for the as built accessory shed's side yard location will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of water front homes many of which have swimming pools on the seaward side of the homes and with non-conforming bluff setbacks. The accessory shed is located behind a fence and is not visible from the street. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant for the set back from the bluff cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Due to the location of the house the applicant would need a variance to build a pool anywhere in the rear yard. Further, the house's location makes it difficult to build the swimming pool in the front yard without the benefit of an area variance. The benefit sought by the applicant for the as built accessory shed in the side yard can be achieved by some method feasible for the applicant to pursue. The shed can be moved to a conforming location. The benefit sought by the applicant for the accessory shed's side yard setback can be achieved by moving the shed to a conforming side yard setback. 3. Town Law 4267-b(3)(b)(3). The variance granted herein for the bluff set back is mathematically substantial, representing 52% relief from the code. However, a swimming pool on the bluff side of the house is typical in this neighborhood and the location of this house makes it difficult to have a swimming pool in a conforming location. However,the accessory shed is set back more than 100 feet from the bluff and its location behind the fence is not visible from the street. 4. Town Law &267-bQ)(h)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact.on the physical or env_ ironmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and install,leaders and gutters and a drywell for pool dewatering. Moreover,the natural grade of the subject property on the seaward side includes a large stone hill located at the top of the bluff. The•hill's elevation is higher than the proposed pool's elevation: Therefore any water over flow"from the pool will not run toward the bluff and will,not affect the bluff's ' stability. 5. Town Law$267-b(3)(b)(Q. The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it,is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel.under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of relief as amended is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a swimming pool while preserving ,and protecting the character of the neighborhood and the health,safety and welfare of the community. On July 6,2011,the applicant submitted a revised survey by John Ehlers dated June 16,2011 Page 2—July 21,2611 ZBA File46461-Henson CTM 1000-33-1-6 increasing the proposed bluff setback to 55 feet, eliminating the single side yard setback variance, and increasing the total side yards to 28 feet,thereby bringing the plan into more conformity with the codes. ADDITIONAL INFORMATION: The applicant has obtained a wetland permit and coastal erosion hazard permit #7414 from the Southold Town Board of Trustees dated October 10, 2010. On November 4, 2010 the NYSDEC issued a letter of no jurisdiction for this proposal. The Board requested comments from County of Suffolk Soil and Water, in a letter dated May 4, 2011, it states they find the bluff to be in stable condition, they suggested a rain garden for storm water runoff and the applicant should allow the pool water to sit in sunshine for two days without adding any chemicals or to use an additive to de-chlorinate the water before draining. They further stated in summary that there are no natural resource concerns. As requested by this Board the applicant submitted a prior decision 45523 dated June 3, 2004, in which the Board granted a 5 foot side yard setback for a swim"tfiilirgy'0o1 in�g the side yard of neighboring home. IAN 216 o/ 7� FINDINGS OF FACT/REASONS FOR BOARD ACTION: G� ZONING BOARD OF APPEALS The Zoning Board of Appeals held public hearings on this application on May 5,2011 and July 7,2011, at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law$267-b(3)(b)(1). Grant of alternative relief will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The house has existed in its current location since 1970; the applicant reduced the amount of relief requested. Similar variances have been granted by this board within this neighborhood. 2. Town Law 6267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than the area variances as applied for. The board proposed reducing the need for a side yard setback on the proposed porch and the applicant has agreed to eliminate the need for any variance on this portion of their project. The Board also requested that the existing deck on the rear (waterside) of the house be reduced or eliminated and the applicant has responded by eliminating the existing deck in favor of a masonry patio on grade which resulted in an increase in the existing bluff setback from 39 feet to 55 feet. The placement of the swimming pool would require a variance in almost any location proposed on this property due mostly to the proximity of the house to the top of bluff 3. Town Law 6267-b(3)(b)(3). The variance granted herein for the proposed swimming pool is substantial and represents a 100% variance from the code requirement that prohibits accessoy structures in the side yard. However, the board finds that placing the swimming pool in the side yard reduces impact on the bluff and the applicant has no room for the swimming pool in the front yard. The bluff setback of 55 feet is substantial, representing 45% relief, however, the entire house is within the 100 foot setback and any addition to the rear or side of the dwelling will require a variance. .The proposed combined side yard setback of 28 ft,as amended,where the code requires 35 ft is deficient by 7 feet and is not substantial since the proposed westerly single side yard setback in the area of new construction has been changed to be conforming, and the existing house has a non- conforming easterly single side yard that cannot be altered without demolition. 4. Town Law &267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The mitigation factors imposed by the Town Trustees have reduced the environmental impact. The side yard location of the swimming pool is more environmentally sound then placing the pool in the rear yard, which is closer to the top of the bluff. 5. Town Law 267-b 3 b 5 . The property is presently-vacant, since removal recently,of the applicants' two-story, single-family dwelling that existed (former dwelling shown on the 1-15-2002 survey prepared by John C. Ehlers. The property has 100 feet along Sound Drive, a lot depth of 275.87 feet along the westerly side lot line, and 110.06 feet along the high water line of the Long Island Sound. BASIS-OF APPLICATION: Building Inspector Notices of Disapproval dated March,28, 2006, April 11, 2006 and May 22, 2006'under Section 100-239.4(1). Zoning Code Section 100-239.4(1) is cited by the Building Inspector in the denial of a building permit application for the reason that a new single-family dwelling and new swimming pool are proposed less than 100 feet from the top of the bluff. FINDINGS OF FACT . The Zoning Board of Appeals held a public hearing on this application on May 25, 2006 and June 22, 2006, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicants request variances to locate: (a) a new single- family dwelling, after recent demolition of the existing two-story dwelling, and (b) a new swimming pool on the bluff side of the dwelling, both with nonconforming setbacks from the top of the bluff. The'applicants submitted three different plans for consideration. The first plan requested a dwelling and • swimming pool, proposed partly in,the location of the former porch and partly in a•new nonconforming area at less than 100 feet from the top of the bluff. Also on June 13, 2006, an additional plan (amended Plan B shown on survey dated 06-12-2006) was submitted, providing an increased setback of only three feet (from 62 feet to 65 feet from the top of the bluff for a swimming pool), instead of the code-required 100 feet, as well as a new dwelling proposed at 92 feet from the top of the bluff(modified from the 88 feet requested in Amended Plan A).- LWRP DETERMINATION: ' The applicants request a new dwelling and accessory swimming pool construction in a new location with a setback at less than the code-required 100 feet minimum from the top of the bluff. A Determination of Inconsistency was issued under Chapter 95, Waterfront Consistency Review of the Town of Southold Code and Local Waterfront Revitalization Program (LWRP) standards. Grant of alternative relief in this variance application will substantially increase the setback measured between the new construction and the top of the bluff to a minimum of 80 feet for-new construction, and denies the applicants requests for substantial variance relief. The alternative relief granted herein will meet at least 80% of the requirement of Section 100-239.4A of the zoning.code, and provides a location for new construction substantially landward of the former dwelling's location. All other setback and lot coverage limitations and requirements of the Zoning Code are proposed to conform to the minimum standards that apply for this parcel containing 28,884 square feet of vacant land area. REASONS FOR BOARD ACTION, DESCRIBED BELOW: Based on the testimony presented, materials- submitted and personal inspection, the Board makes the following findings: 1. Grant of alternative relief will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Zoning code Section 100-239.4A became effective in 1985. The property is currently vacant, although it is noted that there'was a large home on the property that existed for many years, before the applicants voluntarily demolished and removed the home. The requested nonconforming setback at 65 feet or closer for a swimming pool in this application is not the minimum necessary, because there Is approximately 184 linear feet of land available, measured north to south at the street. The increased setback for a new dwelling and related construction by alternative relief will provide more conformity to the code requirement of-100 ft. minimum setback, requiring a.minimum of 80 feet from the top of the bluff. '2. The benefit sought by the applicants cannot be achieved by some method,feasible for the applicants to pursue, other than an area variance. 3. The alternative variance relief granted herein is substantial and constitutes a 20 ft. reduction from the code requirement of 100 feet, or 20%'relief. 4. There is no evidence that grant of alternative relief(increasing the setback from the top of the bluff for all' construction) will have an adverse effect or impact on physical or environmental conditions. This setback is appropriate in light.of other bluff setbacks in the area. As you move from the west of applicant's property toward the east along the L.I.
