GELHAUS, his wife, roslding at Teati- tuek, Southold Town, Suffolk County, New York, parties of the second part; WHEREAS, Old 14111 Haven Company,Ine, by decd dated January 31, 1928, recorded in Suffolk County Clerk's office at Riverhoad.New York, on February 6, 1928 in Liber 1330 of Deeds, at Page 390,con- veyed to one Christine Anna Cromer a parcel of land at Yattituck Inlet, Southold Town, Suffolk County, New York, adjacent to I:arbor- view Avenue and South Lagoon Lane, so called; and said Christine Anna Cromer conveyed the said premises so acquired by her to the parties of the second part by dead dated June 2, 1939, recorded in said office on June 5, 1939 in Liber 2043 of Deeds, at Page 266,and WHEREAS, through mistake and inadvertence the starting point in the description of said premises as set forth in said deeds was erroneously stated to be at a monument on the southerly side of Harborview Avenue at the point of intersection of the southerly side of Harborview Avenue and the easterly point of lot No.l as shown on the map hereinafter mentioned,.but was intended to be shown as at a monument set on the southerly line of Harborview Avenue North 78 deg. 181 40" East 92.65 feet as measured along the southerly side of Harborview Avenue from the monument set at the intersection of the southerly side of Harborview Avenue and the easterly line of said Lot No. 1, and WHEREAS, Old Mill Haven Company,Inc. subsequently conveyed to Marine Associates,Inc. the lands remaining to it at that location by a deed dated July 13, 1931, recorded in said office on July 16, 1931 in Liber 1590 of Deeds, at Page 364, which deed included the iretr.3056 PAGE371 Dnterest,if any, of Old Mill Haven Company,lne• in the lands intended to be conveyed by the deeds to Cramer and Gelhaus above mentioned,and WNIMEAS, this is s correction deed whereby it is intended to correct said mistake and error to conform to the original intention Of the parties, and }WIEREAS, said Christine A. Cramer conveyed to Marine Associates, Ltd. by a deed dated April 8, 1932 and recorded in said office on May 22, 1932 in Liber 1651 of Deeds, at Page 30, a certain right to use a road or driveway generally along Herborview Avenue and South Lagoon Lane and through the said property of Christine A. Cramer for a width of 50 feet, and it is the desire that the party of the first part release end extinguish the easement and right of way as created by said deed and doeument only, Now,therefore, WITNESSETH, that the party of the first part in consideration of One Dollar, lawful money of the United States, paid by the parties of the second part, end other valuable consideration, the receipt of which is hereby aeknowledged, does hereby grant and release unto the parties of the second part, their heirs and assigns forever, ALL that parcel of land situate at Mattltuck Inlets Southold Town, Suffolk County, New York, bounded and described as follows; PARCEL l: BEGINNING at a concrete monument set on the southerly ch boundary line of property shown on a map entitled "Subdivision J of Properties of the Old Mill Haven Company, East of Mattituck Creek, Mattituck, N.Y." end filed in the office of the Suffolk County Clerk; said monument being S.7CP Ill 20" W. 442.68 feet; thence E. 710 41100" W. 116.94 feet; thence S. 810 251 50" W. 123.10 feet; thence S. 780 18, 40" W. 114.29 feet along said boundary line from a concrete monument set at the southeasterly corner of said propertys as shown on said maps at the inter- section of said southerly boundary line with the westerly line of Reeve Avenue; from said point of beginning running along land of Doris M. Reeves and passing through a concrete monument set 235.25 feet along this course from the initial pont of said course S. 500 531 50" W. 366.26 feet; thence along lend now or i '�3056 X3726p ue„ N. 490 49, 40^ W. 128.48 formerly of Old Mill Haves feet to the southwesterly corner of lot 1 as shown on said map; thence along said lot 1, as abown on said map, 5 courses as follow.: (1) on a curve to the right, having a radius of 135.0 feet, a distance along said curve of 123.70 feet; thence (2) on a curve to the right, having a radius of 74.0 feet, a dis- tance along said carve of 92.02 feet; thence (5) on a curve to the right, having a radius of 224.0 feet, a distance along said curve of 62.55 feet; thence (4) on a curve to the ri&%t, having a radius of 900.0 feet, a distance along said curve of 66.75 feet; thence (5) on a curve to the left, having a radius of 564.0 feet, a distance along said curve of 67.89 feet;thence along other land of the party of the first part, S. 85000, E. 160.0 feet to the point of beginning. PARCEL 2; ALL of the right,title and interest of the party of the first part in and to the use of a road or driveway through Harborview Avemre,Scuth Lagoon Lane, East Side Avenue and lands of the parties Of the second part which mere acquired by the first party by deed from Christine A.Craz r dated April 6,1932, and recorded in said office May 21,1932 in Liber 1651 of Deeds, at page 30,affecting premises near Mattituck Iniet,Southold Town, Suffolk County,New York,it being the intention of the party of the first part to release and grant any interest it so acquired by said deed so as to extinguish the same as if said deed had not been given.
