Historic Preservation Commission Minutes
3:00 p.m., March 15, 2016
Town Hall Annex Executive Board Room

Call to Order:
The meeting was called to order at 3:08 p.m. by Chairman Garretson.
Approval of Minutes:
The minutes of January 19, 2016 were approved unanimously on
a motion by Commissioner Webb and a second by Commissioner Parker.
Resolution #3.15.16.1 – Passed, Unanimously
Resolution #3.15.16.1, recommending that the Town Board of the Town of Southold
reappoint Commissioners Surchin, Grathwohl and Feiler, as their term expires in March,
2016, was approved unanimously on a motion by Commissioner Webb and a second by
Commissioner Harper. (A full copy of the resolution is on file in the Southold Town
Building department.)
Chairman’s Comments
Chairman Garretson shared and discussed a letter he had sent, on behalf of the
commission, to Kari Christ, owner of a landmarked property at 2275 Main Road in
Orient.
The letter was written at the request of the property owner who wanted an explanation of
why proposed additions and alterations to a structure on the property, presented on
September 15, 2015 during a pre-submission conference, were deemed “inappropriate”
by the commission. (A copy of the letter is on file in the Southold Town Building
department.)
Chairman Garretson had announced that despite assurances from the town attorney’s
office, a response to the HPC’s memo, dated December 2, 2015, requesting an
interpretation of the town code’s definition of façade, was not delivered ahead of the
meeting.
Administrative Assistant Damon Rallis said that he had been informed just before the
meeting that the response was not complete because the town attorney wanted to review
the memo with Chief Building Inspector Michael Verity.
The commission discussed the urgency of the issue as the memo had been written in
response to a building permit being issued for a landmarked property at 430 Orchard
Street in Orient, without prior approval from the HPC.
A motion was made by Commissioner Harper to pass a resolution from the floor, which
was read into the record as follows: “Be it resolved, effective immediately, that any
application made to the Southold Town Building Department involving a landmarked
property, including those properties within a historic district, shall be sent to the Historic
Preservation Commission for review, prior to any action by the building department.”
The resolution was seconded by Commissioner Webb and was approved unanimously.
Resolution #3.15.16.3 (Application Policy Change) – Passed, Unanimously

A second motion was made by Commissioner Webb to pass a resolution from the floor,
which was read into the record as follows: “Whereas a building permit was issued for
work at 430 Orchard Street, Orient and whereas the property is a landmark within a
historic district, and therefore under the prevue of the Historic Preservation Commission,
and whereas the Historic Preservation Commission, in reviewing the permit and the
ongoing construction, has determined that the additions and alterations to the existing
structure are visible from a public street, and whereas Chapter 170 of the Southold Town
Code requires approval from the Historic Preservation Commission and is therefore in
violation of the Southold Town Code. Therefore be it resolved that the Historic
Preservation Commissioner hereby authorizes and directs the Southold Town Building
Department to immediately issue a stop work order and direct the applicant to come
before the Historic Preservation Commission. The resolution was seconded by
Commissioner Harper and was approved unanimously.

Unanimously

Public Hearing
525 New Suffolk Road, Cutchogue
(SCTM# 1000-102.-6-10.1). Proposed additions and
alterations to an existing single family dwelling on a landmarked property.
The property owner, John Feldmann opened the discussion by noting the changes
o
that had been made to the architectural drawings since his pre-submission
conference on January 19. 2016.
Mr. Feldman noted that he had done his best to ensure that the “street facing
o
windows” on the new addition closely matched the street facing windows on the
existing façade.
Mr. Feldman said that although window changes were made on the plan to match
o
the existing, he said there was a possibility that the final windows could be an
“inch” off because of egress requirements.
He noted that the new chimney was now duplicating the “look” and “detail” of the
o
existing chimney on the structure, as requested by the commission.
Mr. Feldman also pointed out that the attic vents had been altered to a more
o
triangular shape as requested by the commissioners.
Between the pre-submission conference and the public hearing, based on site
o
inspections by commission members and photographic evidence, it was
determined that original storm shutters that were once on the house had been
removed.
Mr. Feldman explained that most of the shutters were beyond repair and he did
o
not have everyone in his possession. He brought one of the shutters to the
meeting.
Commissioner Harper reminded Mr. Feldman that the removal of the existing
o
shutters would have required approval from the Historic Preservation
Commission and that the commission reserved the right to compel Mr. Feldman
to put the shutters (or similar ones) back on the house as part of their approval.
Commissioner Webb made a motion to issue a certificate of appropriateness for
o
the project, based on the plans presented at the public hearing (plans dated
January 16, 2016 – NO#1157 by Charles Di Giovanna, architect), subject to the
replacement of the street-facing shutters and provided that the applicant submit a
window cut sheet (front windows) for review by the commission. The motion was
seconded by Gary Parker and passed unanimously.
Resolution #3.15.16.2 (Certificate of Appropriateness – Feldmann) – Passed,
Unanimously

Appointments
Administrative PermitSusan Looze, 1100 Youngs
(Conference): owner of property at
Avenue, Southold
(SCTM# 1000-60.-2-7.1). Proposal to replace a front door with a
window, bringing the façade back to its original look (two windows, one door).
Mrs. Looze explained that it was her intention to open a bed and breakfast at 1100
o
Youngs Avenue. The historic structure was previously a multiple use building
with a hair salon downstairs and a dwelling unit upstairs. As a result, Mrs. Looze
explained that, at some point, an existing window on the front of the house was
replaced by an entry door.
It was her proposal to replace that door with a window, matching the existing
o
window that exists between the two doors, bringing the façade of the home more
closely to its original look.
A motion was made by Commissioner Webb and seconded by Commissioner
o
Harper, to approved an administrative permit for the proposed work.
Resolution #3.15.16.5 (Administrative Permit - Looze) – Passed, Unanimously

Mark Kaffaga John Currin,
(Conference)(contractor) on behalf ofowner of property
745 King Street, Orient
at(SCTM# 1000-26.-1-32.1). Continued discussion - “as built”
alterations to the façade of an existing single family dwelling on a landmarked property
in the Orient Historic District.
Mr. Kaffaga confirmed that he had put back the clapboard on the front of the
o
building, eliminating that portion of the “as built” project from the HPC’s review.
Commission members thanked him for “doing the right thing” with respect to the
o
siding.
Commissioners continued to question the Yankee gutters that had been installed.
o
Mr. Kaffaga said that there were a number of houses in the village of Orient with
Yankee gutters.
Commissioner Surchin noted that, while this may be true, the gutter system
o
installed on the above referenced structure seemed disproportionately large.
Mr. Kafaga agreed and said it would be possible to cut them back.
o
They further discussed the change in the window and a possible change in the
o
roof line, which was again confirmed by Mr. Kafaga.
It was agreed that a public hearing would be scheduled for the April HPC
o
meeting.
Mr. Kafaga was informed that he would need to submit architectural drawings at
o
the meeting reflecting all changes that were made.
New Business
As/Built and Proposed Construction at 335 Village Lane
Administrative Assistant Damon Rallis announced that it had come to the
o
Building Department’s attention that a door had been replaced on the façade of
the above referenced home without a building permit or HPC approval.
The applicant currently has an open permit for interior alterations to the dwelling
o
and would now like to replace all of the windows on the façade of the home.
Rallis told commissioners that he would schedule a pre-submission conference for
o
the April meeting.

The meeting was adjourned unanimously on a motion by Chairman Garretson and a
second by Commissioner Parker.
