That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will,at his or her own expense, defend any and all such suits initiated by third parties,and the said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months,which is considered to be the estimated time required to complete the work involved,but should circumstances warrant,request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved,to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized,or if,in the opinion of the Board of Trustees,the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar days of issuance of this permit. 9. That the said Board will be notified by the Permittee of the completion of the work authorized. 10. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit, which may be subject to revoke upon failure to obtain same. 11. No right to trespass or interfere with riparian rights. This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights, title, or interest in real or personal property held or vested in a person not a party to the permit. Box 488 Hampton Bays, NY 11946 RE: SAMUEL SINGER 44030 ROUTE 25, PECONIC SCTM# 1000-75-6-6.1 Dear Ms. Rigdon: . ,. • The Board of Town Trustees took the following action during its regular meeting held on Wednesday, April 20, 2016 regarding the above matter: WHEREAS, DKR Shores, Inc. on behalf of SAMUEL SINGER applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated January 21, 2016, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on March 23, 2016 and April 20, 2016, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, 2 WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees have found the application to be Consistent with the Local Waterfront Revitalization Program, and, RESOLVED, that the Board of Trustees approve the application of SAMUEL SINGER to install a pervious gravel driveway; construct a ±43.7'x83' two-story dwelling with attached 1,175 sq.ft. seaward stone patio; install sanitary system landward of dwelling; install a 22'x62' in-ground swimming pool with surrounding 1,836 sq.ft. stone patio; install pool enclosure fencing; with the condition to establish and subsequently maintain a 75' wide naturally vegetated non-disturbance buffer area along landward edge of tidal wetlands; and as depicted on the site plan prepared by Nathan Taft Corwin, Ill Land Surveyor, last dated April 14, 2016, and stamped approved on May 10, 2016. It is my understanding that the owner would like to build a house on a 5 acre wooded area that is part of a larger 26+ acre parcel,the bulk of which is cleared. It is also my understanding that the 5 acre area is separated from the rest of the parcel by wetlands and the applicant is seeking access over the wetlands to reach the wooded portion,which is habitat to many species,including many bird species.(Please see Dr. Nancy Pearson's comments submitted on this application.) I would hope the Trustees would deny this permit and encourage the landowner to build his house on the portion of the already cleared portion of the property that is not home to a decades old woodland, is not subject to flooding and would not need a wetlands permit. We are the owners of Bayside Farm, as well as the end of Indian Neck,the former Lappe farm, and Onabay Vineyards, Almost 200 acres in total. Although we do not abut the parcel under review, we have an interest in preserving the beauty and uniqueness of the area that encompasses the Eastern shore of Richmond Creek. Over the last 20 years, we have seen the continual degradation of the Creek. Acres of marshland and eel grass have disappeared. The Eastern headwaters of the Creek have served as a critical nursery for aquatic life including turtles. The Eastern shore of Richmond Creek is the last of the undeveloped shoreline for this large estuary. It is very unfortunate that the Town did not pursue protecting this important watershed parcel. While we understand Mr. Silver's desire to make full use of his purchased property, the plans for development on the parcel are overscaled and will overwhelm the fragile wetlands and uplands along the Creek. This is such an important site, that a thorough enviromental evaluation and your scrupulous oversite are warranted. Our old woods downshore along the creekbank and the wooded area on the proposed building site are important wildlife areas, and one of the few wooded areas left for miles....A bald eagle was sighted during a couple weeks in the fall. The back fields of Bayside Farm and the adjoining open space have been used for the prestigious Audubon Christmas Bird Count for decades with very impressive species counts. This area is one of the jewels of Southold. Our family and Nancy Conradi have done our best to be good stewards of it. Please keep us apprised of the development of this proposal. It was scheduled for a public hearing for tomorrow night but I heard it was postponed until March 23. I hope that gives you time to address some of my concerns. 1. This is a large piece of land with plenty of cleared land to build on. The proposal clears trees which are rare wooded habitat buffering Richmond Creek,where birds nest and the upland is protected from flood waters; The area of the proposed house was flooded during Hurricane Sandy. 2. The size of the proposed dock will impact salt marsh and creek bottom in a very shallow part of the creek. 3. There are wetlands in the areas of proposed access to this area; Can you properly assess this while its covered in snow? There are very few areas of woodland left in Southold, especially adjacent to the creeks; Please have the applicant locate the house in the cleared area and preserve the woods. Although they may not have so stated, in order to create an access driveway to the approx. 5-6acre woodland which is isolated by wetland from the remainder of the mostly cleared 26.6 acre parcel, it will be necessary to dump in and fill at least about 5000 sq ft of wetland. Tim Coffey has already, unbeknownst to the previous absentee owner, illegally dumped fill into part of it but they would surely need to add much more. At least a third of this wooded area was submerged under Sandy. When the next storm comes along the pool would be submerged and the house largely surrounded with baywater. It seems highly imprudent in these times of trying to adapt to sea level rise to allow new construction in such a low area. The 240ft dock proposal into the upper reaches of shallow Richmond Creek and on the side more removed from any conceivably navigable channel seems to be stretching the limits of reality and environmental sense. The nearest dock on that side is almost a quarter mile closer to the mouth of the creek and that allows prudent use best,around high tide. The neighbor to the N has told me that he stirs up the bottom of the creek when he brings a boat up there at this point. My last concern is for this5-7acre parcel of dominant oak-hickory woodland probably at least a hundred years untouched and even with steady deer pressure containing a good understory of shadbush and catbrier. All lying alongside Rchmond Creek a saltwater esturary and marsh degnated :Of Special Concern" by New York State. _— ----— -_--�s This is not merely a POTENTIAL habitat, a now very rare example of a previously common habitat of old growth deciduous forest of mixed oak and hickory with many trees greater than 2-3 ft. diameter lying next to a brackish tidal marsh, but is AT PRESENT the home and territory of numerous species including many,of especial concern. All of the following species which I will enumerate have been observed by eitperieh(;U North Fork Audubon Society members. ' This large property of which at least 25 acres is already cleared adjacent to the Creek offers plenty of areas for several homes without destroying any of the woods, if you as a board would take that stand. No. 23-20071 The area is shallow and increased turbidity and/or bottom scarring may occur form vessel operations. As indicated above, the proposed action is located within a New York State Department of State Significant Fish and Wildlife Habitat Area, a New York State Critical Environmental Area and a Peconic Estuary Critical Natural Resource Area. [6] Whether the dock will cause habitat fragmentation and loss of significant coastal fish and wildlife habitats; The proposed action is located within a New(York State Critical Environmental Area. At the discretion of the Board of Trustees, any operations proposed in critical environmental areas (§ 275-2) may be subject to more stringent requirements than detailed in this section. Such requirements may include, but are not limited to, denial of certain operations, shortening or reducing the size of structures, and increasing the width of non-disturbance buffers. Diamondback terrapin are vulnerable to disturbance by humans from April 1 through August 15. Nesting shorebirds inhabiting Richmond Creek and Beach are highly vulnerable to disturbance by humans, especially during the nesting and fledging period (March 15 through August 15). Significant pedestrian traffic or recreational vehicle use of the beach could easily eliminate the use of this site as a breeding area and should be minimized during this period. Recreational activities (e.g., boat and personal watercraft landing, off-road vehicle use, picnicking) in the vicinity of bird nesting areas should be minimized during this period. Predation of chicks and destruction of eggs or nests by unleashed pets (e.g., dogs, cats) and natural predators may also occur, and predator control should be implemented where feasible. Fencing and/or continued annual posting of shorebird nesting areas should be provided to help protect these species (NYSDOS). Alterations of tidal patterns in the marsh (e.g., by modifying the inlet) could have major impacts on the fish and wildlife species present. Construction of bulkheads, breakwaters, revetments, and other"hard" shoreline structures negatively impact tidal wetland habitats. Alternative strategies for the protection of shoreline property should be examined, including innovative, vegetation-based approaches. Control of invasive nuisance plant species, through a variety of means, may improve fish and wildlife species use of the area and enhance overall wetland values. Any activity that would substantially degrade the water quality of Richmond Creek would adversely affect the biological productivity of this area. All species of fish and wildlife are affected by water pollution, such as chemical contamination (including food chain effects as a result of bioaccumulation), oil spills, sedimentation, excessive turbidity, stormwater runoff, and waste disposal (including boat wastes). Impacts to water quality in the creek should be minimized or eliminated to enhance locally important shellfish and crustacean populations. Barriers to fish migration, whether physical or chemical would have a maior impact on the fisheries in Richmond Creek. (NYSDOS) Unrestricted use of motorized vessels including personal watercraft in the protected, shallow waters of bays, harbors, and tidal creeks can have adverse effects on aquatic vegetation and fish and wildlife populations. (NYSDOS) [7] Whether the dock will result in the destruction of or prevent the growth of vegetated wetlands, seagrasses including eelgrass (Zostera marina) and widgeon grass (Ruppia maritima) or shellfish; There is a high probability that commercially valuable shellfish species occur in the proposed location of the dock structure. Bottom scarring is would be expected due to low water depths in the creek. [11] Whether the cumulative impacts of a residential and commercial dock will change the waterway or the environment and whether alternate design, construction, and location of the dock will minimize cumulative impacts; and The construction method has not been identified. § 275-11 Construction and operation standards requires that all intertidal construction and excavation employ the installation of a silt boom that will retain all suspended sediments within the immediate project area. [12] Whether adequate facilities are available to boat owners and/or operators for fueling, discharge of waste and rubbish, electrical service and water service. The answer to this question has not been provided. 9.3 Preserve the public interest in and use of lands and waters held in public trust by the state and the Town of Southold. A. Limit grants, leases, easements, permits or lesser interest in lands underwater in accordance with an assessment of potential adverse impacts of the proposed use, structure, or facility on public interest in public lands under water. The placement of a private, residential 223' dock structure in public trust lands and/or waters results in a net loss of public use of such lands and water. Due to the high ecological value of Richmond Creek, a seasonal mooring is a better option in this instance. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
