WHEREAS, a public hearing was held and concluded on November 8, 1989 in the matter of the Application of RICHARD AND JOAN GIBBS under Appeal No. 3871; and WHEREAS, at said hearing all those who desired to be heard were heard and their testimony recorded; and WHEREAS, the Board Members have personally viewed and 'are familiar with the premises in question, its present zoning, and the surrounding areas; and WHEREAS, the Board made the following findings of fact: 1. The premises in question is located along the south of Deep Hole Drive, Town of Mattituck, and is identified on the Suffolk County Tax Maps as District 1000, Section 15, Block 1. Lot 3. ~~. This is an application for Variances from the Zoning Code Article III A, Section 100-30 A.4, (Article III, Section 100-33), for permission to construct an accessory shed in front yard area. Article III A, Section 100-30 A.4, Accessory buildings shall be subject to the same requirements as 100-33 of the Agricultural-Conservation District. Article III, Section 100-33, In the Agricultural-Conservation District and Low Density Residential R-80, R-120, R-200 and R-400 Districts, accessory buildings and structures or other accessory uses may be located in the required rear yard, subject to the following requirements: 4. In considering this application, the Board finds and determines: (a) that the circumstances of this application are uniquely related to the premises and its established nonconformities; (b) that there is no other method for appellants to pursue; and placing the proposed accessory shed in any other location on the premises will require other variance relief; c) that the area chosen for the accessory shed is not unreasonably located; (d) that the variance will not in turn cause a substantial effect on the safety, health, welfare, comfort, convenience and/or order of the Town; le) that in carefully considering the record and all the above factors, the interests of justice will be served by granting the variance, as applied conditionally noted below. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sory HARDSHIP because over the years, this property has experienced theft and vandalism when attende, d~. There. is no "back" yard in the conventional sense, and we have no storage area on the property. The house is water-front and would create a hardship if the accessory building were permitted to be built in the "back" yard, which would be the waterfront side. (Size: 16' x 20') 2. The hardship created is UNIQUE and is not shared by all prope~ies alike in the immediate vicinity of this property and in this use district because there is no "back" yard in the conventional sense. On this waterfront property, the backyard appears to be the front yard and the front yard is shielded completely from the road by a dense growth of evergreens. The accessory building would be placed to the side of the house, and will not be seen from theroad. The building is needed for storage to prevent vandalism and theft of small boat, windsurfer, sails, a sunfish, lawn and garden furniture and tools, fishing equipment, etc. (Size: 16' x 20', to be landscaped.) 3. The nature of this application is a 20 by 40 foot swimming pool in the front yard area and in front of that, still in the front yard area, a proposed garage in the front yard area of 24 by 45. Box 1179 Southold, New York 11971 Re: Application No. 3871 - Richard & Joan Gibbs (Variance) Dear Mr. Goehringer: We received our confirmation of the time, date and place of the public hearing concerning our application for a variance. It is impossible for us to appear at the time specified. My husband is in California on business the week commencing November 6 until November 10. I cannot appear due to the fact that I have a retarded daughter who cannot withstand the car ride from Connecticut to Southold and back again the same night. I will tell you everything I can about the accessory building we would like to have constructed on our property. Therefore, bur hearing should not be postponed. The building will be 16 x 20 feet. The 16 feet will be length- wise, and the 20 feet will be the depth. The entrance will be facing the water. It will have two doors, side-by-side, so we can store our boat (which is now right-side down under the trees f~cing the water). We will be storing lawn furniture, the two sails from our Sunfish and Windsurfer, the Windsurfer, the Sunfish, (which is right- side down on two horses, on the side of our hous£ facing our neighbor, Mrs. Villano), lawn mower, edger, wheelbarrow, various tools, hoses (when not in use), sprinklers, window flower boxes (wintertime), various planters (wintertime), and other assorted items. It will have two windows: one on each side. They will be double hung, with six lights up and six lights down, and they will have screens in the summertime. The roof will be gabled, and the roof shingles will be the same color as our home in Mattituck. The siding of the accessory building will be the same as the house, painted the same color. The "front" of the building (roadside), will have hemlocks with assorted purple irises and Montauk daisies bordering the hemlocks. The irises and daisies will be carried around the two sides of the building, and azaleas will be placed at each side of the entranceway. We would like to have electricity in this accessory building. There will be no running water. Mr. Gerard P. Goehringer November 6, 1989 Page -2- Presently, we store our Windsurfer and Windsurfer sail at home in Connecticut in our garage. The Sunfish is facing our neighbor, Mrs. Villano, in Mattituck, which I am sure is an eyesore for her each winter. The lawn furniture is stacked in our living room and porch and the existing shed is crammed with everything else, including our garbage cans. (Included in the existing shed is the hot water heater, cold-water storage tank and pump.) Naturally, these are not movable and will remain in the existing shed. The proposed accessory building will be located to the right of our driveway as one would enter the driveway. Our entire front of the house is blocked off by huge evergreens, which are planted close to the road, making it impossible to see our house or property from the road. It is impossible for us to appear at the time specified. My husband is in California on business the week commencing November 6 until November 10. I cannot appear due to the fact that I have a retarded daughter who cannot withstand the car ride from Connecticut to Southold and back again the same night. · I will tell you everything I can about the accessory building we would like to have constructed on our property. Therefore, our hearing should not be postponed. The building will be 16 x 20 feet. The 16 feet will be length- wise, and the 20 feet will be the depth. The entrance will be facing the water. It will have two doors, side-by-side, so we can store our boat (which is now right-side down under the trees fecing the water). We will be storing lawn furniture, the two sails from our Sunfish and Windsurfer, the Windsurfer, the Sunfish, (which is right- side down on two horses, on the side of our house facing our neighbor, Mrs. Villano), lawn mower, edger, wheelbarrow, various tools, hoses (when not in use), sprinklers, window flower boxes (wintertime), various planters (wintertime), and other assorted items. It will have two windows: one on each side. They will be double hung, with six lights up and six lights down, and they will have screens in the summertime. The roof will be gabled, and the r. oof shingles will be the same color as our home in Mattituck. The siding of the accessory building will be the same as the house, painted the same color. The "front" of the building roadside), will have hemlocks with assorted purple irises and Montauk daisies bordering the hemlocks. The irises and daisies will be carried around the two sides of the building, and azaleas will be placed at each side of the entranceway. We would like to have electricity in this accessory building. The Sunfish is facing our neighbor, Mrs. Villano, in Mattituck, which I am sure is an eyesore for her each winter. (Included in the existing shed is the hot water heater, cold-water storage tank and pump.) Naturally, these are not movable and will remain in the existing shed. The proposed accessory building will be located to the right of our driveway as one would enter the driveway. Our entire front of the house is blocked off by huge evergreens, which are planted close to the road, making it impossible to see our house or property from the road. I am sorry that I was not able to take your call, and I will be unable to call you next Saturday, the 26th because I will be out of town. The purpose of my wanting to speak with you is because we have requested a variance on our property in Mattituck, and I was told last Friday that we aren't going to be scheduled for a hearing until mid-October. Mr. Goehringer, please listen to my plight: (1) Our primary residence is in Westport, Connecticut. We come to Mattituck every weekend, from early May to mid-September. In September, we close up our home in Mattituck. We close it be- cause of necessity. Not because we want to. We close the house because we have no heat. Our home is strictly a "summer" home. We would love to stay in Mattituck until October or even November when all the crowds have left, and we could watch the wildlife in our creek...and watch the beautiful autumn sunsets...and watch the spectacular sunrises. But we can't do that because it gets too cold. We have no fireplace to ward off the chill brought on by the crisp autumn evenings. For us to come to Southold in the middle of October would be a hardship. (2) ! amnQt astranger t~your part of Long Island. My great- uncle settled in Mattituck in 1927 and my parents raised my sister, brother, and me in ~:attituck every summer .from 1932 until 1940. We were down at Shore Acres during those years. In 1958 my parents purchased a home on Deep Hole Creek. And in 1975 the house next to theirs was for sale, and my husband and I purchased it. And then, as history will repeat itself, we have raised our three children in Mattituck, every summer. (3) My husband, with the help of our neighbor, want to erect this accessory building which we need so badly, before we close the house in mid-September. He estimates it would take him approximately four to five days to erect it. My husband plans to take his vacation to do this. (4) We submitted our application last July 26th. Our check was submitted and deposited at that time, too. (5) I understand that everything is backed up because the secretary for the Zoning Board of Appeals has resigned. If this is the reason for the back-up, I am truly sorry. But Mr. Goehringer, Mr. Gerard P.
