ACTION OF THE BOARD OF APPEALS
Appl. NO. 3775 - THE COVE AT SOUTHOLD, INC.
WHEREAS, on August 30, 1988, an application was filed under
Appl. No. 3775 in the Matter of The Cove at Southold, Inc. based
upon Article III, Section 100-32 and Article IX, Section
100-119.1 of the Zoning Code in effect at that time, in the
proposed construction and location of accessory swimmingpool and
tennis court structures as shown on the April 25, 1988 Area
(Site Plan) Map prepared by Henderson and Bodwell; and
WHEREAS, reviews have been made and input received from two
other town agencies for this proposal, to wit: the Southold
Town Planning Board and the Southold Town Trustees (see letters
lastly dated January 12, 1989 and November 1, 1988,
respectively); and
WHEREAS, by letter dated March 14, 1988, the N.Y.S.
Department of Environmental Conservation confirms the inclusion
of these accessory structures under Wetland Permit No.
10-84-0118; and
WHEREAS, by resolution adopted January 10, 1989, Local Law
No. 1 - 1989 was adopted by the Southold Town Board concerning
approval of the Master Plan Zoning Updates and new Zoning Maps;
and
WHEREAS, on or about February 2, 1989, the Department of
the Board of Appeals commenced its review of pending appli-
cations for updates under the new Master Plan Zoning Update; and
WHEREAS, under this Department's review, it is noted that
the premises which is the subject of this application has been
re-designated on the new Zoning Maps from the "A" Residential
and Agricultural Zone District to "RR" Resort-Residential; and

Decision Rendered February 9, 1989
WHEREAS, Article VI, Section 100-61C of the new Zoning
Updates permits the subject accessory uses, provided they are
incidental to the residential use of the premises and not
operated for gain; and
WHEREAS, Article III, Section 100-32 under the previous
Zoning Code, applicable to the previous "A" Zone District
designation of this property, was amended to Article III,
Section 100-33 under the new Zoning Update and is applicable to
the following Zone Districts:
"...Agricultural-Conservation District and Low Density
Residential R-80, R-120, R-200 and R-400 Districts...";
and
WHEREAS, Article IX, Section 100-119.2 under the previous
Zoning Code has not been made a part of the new Zoning Code; and
WHEREAS, it has been held by the Courts that the law that
exists at the time of a decision will apply {Alscot Investing
Corp. v. Rockville Centre, 99 AD 2d 754, 471 NYS2d 669 (1984, 2d
Dept.}; (Aversano v. Two Family Use Board, 117 AD2d 665, 498 NYS
NOW, THEREFORE, on motion by Mr. Dinizio, seconded by
Mr. Goehringer, it was
RESOLVED, that for the above reasons, this Board is without
authority to consider a Variance in the Matter of the Appli-
cation of THE COVE AT SOUTHOLD, INC. as applied under Appl.
No. 3775 (filed August 30, 1988).
Vote of the Board: Ayes: Messrs. Goehringer, Grigonis and
Dinizio. (Absent were: Member Serge J. Doyen and Member Joseph
H. Sawicki.) This resolution was duly adopted.

1. STRICT APPLICATIOn. F, :T~E3 ~,I~DINANCE would produce practical difficulties or unneces-
sary HARDSHIP because ,.~ ,
The Town Tr~e~s h~ve..~ged that the pool be located away
from the creek and that there be no significant additional
structures forward of the present building line; the 1-1/2
acre parcel which fronts on Main Bayview Road is the sole
location available for the applicant's swimming pool and
tennis court.
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because
the configuration of the applicant's parcel and restrictions
on location of structures near Corey Creek dictates placing
accessory structures in the front yard of the applicant's
parcel.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because
the accessory structures in the form of a pool and tennis
court are found frequently in residential areas and do not
alter the residential character of the neighborhood.

Pool Location
In consideration of locating the pool adjacent to the entry
road, several mitigation measures must be taken:
1. The sideyard impacts to the adjacent residential lots
must be minimized. The revised grades must be such that
they take into consideration the existing adjacent
properties.
2. An acoustic screen fence or wall must be used to
mitigate noise from the pool area. Additional landscaping
should also be provided as additional screening.
3. No lights, other than those for security reasons, -
should be located in this area.
The Planning Board also requests that all the signs
advertising the project be removed from around the Town.
Please contact this office if you have any questions
concerning the above.

This memo is to inform you of the consensus of the Board of
Trustees in regards to the pool location at The Cove at
Southold. It is our opinion that the pool may be located behind
the bulkhead unless it is necessary to construct it elevated to a
height above sea level where it may be aesthetically offensive.
In this case, the pool should be located to the north by the
tennis courts.

determination of the Board of Appeals which is based upon the
new regulations under the Master Plan Zoning Update adopted by
the Southold Town Board under Local Law No. 1 - 1989. The
property was redesignated Resort-Residential "RR" as of last
week.
Please be sure to return to the Planning Board to continue
finalization of the site-plan process and to the Building
Department for issuance of appropriate permits, prior to
commencing construction activities.
Copies of this determination are simultaneously being

Spoke with Valerie today concerning status of Site Plan
application of The Cove at Southold, Bayview premises.
Valerie confirmed that she previously spoke with
Mr. Forchelli and he is aware that an amended certification and
amended site plan approval is necessary since the original plan
as approved by the Planning Board did not include the tennis
court, etc.
A letter is simultaneously herewith being forwarded to the
Planning Board for their input on the amended site plan (response
to be submitted to our office prior to advertising this matter
for a public hearing. It is understood that the amended site
plan was filed with their office on or about April 22, 1988 and
informal reviews are pending.
If changes by the Planning Board are to be submitted, they should
be referred to us prior to the advertising date in order to give
all interested parties an opportunity to take a position on the
Planning Board's recommendations.

The following action was taken by the Board of Town Trustees
during their regular meeting held on August 25, 1988 regarding

WHEREAS, Wilbur Klatsky, on behalf of the Cove at Southold,
applied for a Waiver to construct a promenade, walkway and gazebo
behind an existing bulkhead, and
WHEREAS, the Town Trustees conducted an on site inspection
of the subject property, and
WHEREAS, the project will not adversely affect the health,
safety and general welfare of the people of the Town, NOW, THEREFORE BE IT
RESOLVED that the Town Trustees approve the Waiver as
requested by Wilbur Klatsky, on behalf of the Cove at Southold,
to construct a promenade, walkway and gazebo behind an existing
bulkhead on property located'on the North side of Main Bayview
Road, Southold subject to the following:
1. This approval is subject to any other agency or
department approval which may be applicable to this project.
2. The deck area is to be protected as to prevent any
despoliation or destruction to the waterway.

existing bulkhead on property known as, The Cove At Southold.
You will recall at our field meeting a waiver was requested in light of
recent town ordinance changes. Further, there was agreement that the
construction of a promenade and gazebo would be confined to an area defined
by the existing bulkhead and a line drawn at a 90 degree angle drawn from
the westerly terminus of the existing bulkhead.

Dear Mrs. Skopaz:
I wish to thank you and the Planning Board for your response to our
application on the above referenced matter and the Planning Boards
action at its meeting of June 6, 1988 at which time a Negative
Declaration was issued concerning the SEQRA status. Concerning our
application for an approval of the Modification of Site Plan we have
had an opportunity to review the comment prepared by the Town of
Southold consulting engineer, Sidney Baum and Associates.
Accordingly, the comments have been reviewed and incorporated on the
enclosed five copies of the pool and tennis court plan prepared by
Henderson and Bodwell dated May 25, 1988. The subject referenced
enclosure contains two sheets. The attached maps have the following
changes consistent with the Baum comments;
The fence along the northwest side of the entry road, adjacent to
the tennis court and pool area has been changed to a gUard rail.
The pool backwash basin has been relocated approximately ten (10)
feet in a generally northerly direction.
Existing vegetation is shown on the North and East side of the
tennis court and pool area. A supplementual planting program is
now outlined between the tennis court and Main Bayview Road.
Please note that we have reviewed the above changes with Sidney Baum
Associates and have taken the liberty to send copies of the above
referenced map to them. We would now appreciate being put on the next
available Planning Board meeting agenda for an action on this subject.

PursUant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review Act and 6NYCRR part 617,
Section 617, Section 617.10 and chapter 44 of the Code of the
Town of Southold, notice is hereby given that Southold Town
Planning Board, as lead agency for°'the action described below
has determined that the project, an Unlisted Action, will not
have a significant effect on the environment.
DESCRIPTION OF ACTION
The Site Plan of The Cove at Southold located on Bayview
Road at Southold.
The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur should the project be
implemented as planned.
The proposed action is an amendment of a previously
approved site plan. Some of the amendment (relocation of
the swimming pool) some of .the shifting of the buildings
relative to the wetland's line have been recommended by the
Board of Town Trustees.
The project will meet all the requirements of the Code of
the Town of Southold Subdivision of Land Regulations.

Gentlemen:
We have reviewed the revised Site Plan dated March 10, 1988, and
the pool and tennis court area plan dated April 25, 1988, of the
aforementioned project.
The proposed drainage, timber retaining wall and revised driveway
grade are acceptable and in accordence with Town standards.
Several large trees will have to be removed at this new location
thus magnifying the visual impact of the recreational facility on
adjoining lands. The plan does not indicate existing vegetation to
remain on the Notherly and Easterly sides of the facility, although the
developer has conveyed to us his intention to save as much as possible
and supplement it with more planting. Eight (8) large trees will
remain between the facility and the driveway as shown. A tree clearing
and Preservation Plan coupled with all proposed landscaping should be
submitted. The Tree Clearing Plan should overlap onto the adjoining
parcel to the East and show any significant vegetation.

Pursuant to a recent request from your office, please find
enclosed a Short Environmental Assessment form dated May 31, 1988.
For your information, the subject site plan was previously
approved by the Planning Board and the subject changes were
requested by the Southold Board of Trustees. Said revised
plans, which have already been submitted to the Southold Planning
Board has been reviewed and approved for the Town of Southold
Board of Trustees and the New York State Department of
Environmental Conservation (NYSDEC). It should be noted that the
charges are minor in natfre and are generally as follows:
Slight orientation of buildings 9 - 12 and 13 - 16. Please
note the Planning Board has already approved a modification
of this site plan concerning the location of building 17-20.
The relocation of the pool and existing tennis court per
request of the Board of Trustees.
3. Relocation of water lines removing same from wetlands area.
Change of construction specifications for roads and driveways
pursuant to request from NYSDEC.
Please note consistent with discussions with your staff as well as
the town attorney, that since the Planning Board has already been
declared the Lead Aqency in this matter consistent with its
previous Negative Declaration, no coordinated review is
applicable. This being the case and after the town consulting
engineer has reviewed this plan, we would appreciate an
expeditious approval as well as a second Negative Declaration.

Part I
#5. Project contains 8.75 acres with 33 townhomes previously
approved by the Town of Southold Planning Board. Project is in an
"M" zone. Modification of previously approved site plan is due
to request of the Town of Southold Board of Trustees. Changes
include minor adjustments of location of buildings 9-12 and 13-
16 inclusive. Please note that building 17-20 has already
received approval from the Planning Board. In addition, at the
request of the Board of Trustees, the swimming pool has been
relocated to the northeast sector of the site and the existing
tennis court has been relocated in the same area. Other minor

The following is a synopsis of our meeting of May 17, 1988.
Adams Associates- Proposed minor subdivision on the N/S of
CR 48, 176.46' E/O Cox Neck Lane, Mattituck SCTM #1000-113-12-10.
After a review of the facts and the correspondence from the
applicant's attorney, it was determined that:
1. The Planning Board could require the applicant to upgrade
.the right-of-way in accordance with Town specifications,
even though the applicant does not own the right-of-way
p~oper, but merely has right of access over it.
2. The applicant's attorney concedes that her client can be
required to upgrade the right-of-way.
3. The applicant's attorney is incorrect in asking the
Planning Board to require other parties to the right-of-way
to share the cost of upgrading same. The requirement to
upgrade the road is a direct result of her client's wish to
subdivide his land in the manner proposed.
The Cove - Proposed amendment to site plan on S/S Main
Bayview Road (Corey Creek) Southold. SCTM #1000-87-5-20.
The recommended procedure to be followed so as to comply
with SEQRA requirements is to have applicant complete Part I
of the Long Envionmental Assessment Form. The proposed
amendment involves the addition of a tennis court and
swimming pool adjacent to Bayview Road.
PERFORMANCE BONDS
Developer has the option of either building the road and
completing it to the Plannning Board's satisfaction within one
year of conditional final approval or posting a performance bond
for a period of time not to exceed an initial period of three
years. Under NY State Town Law, the Town cannot require a
developer to substitute a letter of credit or a passbook for a
performance bond where road construction is concerned.
However, where sidewalks, drainage and sanitary systems are
concerned, letters of credit, cash and passbooks can be required.
But if a developer asks to use a letter of credit or passbook for
the road portion of the bond estimate, we can accept it.
The Town has a problem with developers who have proven less
than cooperative in extending bonds. No conclusion was reached on
how to deal with this situation. My suggestion at this point is
that the Planning Board shou~put the developer on notice at the
time it grants final approval (signs the Map) that if the road is
not completed prior to the expiration date of the bond and if he
does not request an extension of said bond in a timely fashion
(three months prior to its expiration), that the Town will find
him to be in default and will prosecute. If phrased as stated
above, the onus of notification will be placed on the developer.
If any of the foregoing is incorrect, please notify me.

Following up on our recent discussion, this letter will serve as
our application for SITE PLAN MODIFICATION. The changes in the
SITE PLAN include:
Minor relocation of three (3) buildings, 5 thorugh 8,
9 through 12, and 13 through 16, at the request of the
Southold Board of Trustees.
Relocation of proposed pool at the request of the
Southold Board of Trustees.
Relocation of the existing tennis court at the
request of the Suffolk County Health Department.
Please note that the subject SITE PLAN MODIFICATION was in part
due to the Cove at Southold, Inc. application to the Southold
Board of Trustees which requested certain changes and the
adoption of a rather extensive mitigation plan. The applicants
request for a work permit was granted by the Southold Board of
Trustees along with a CONDITIONAL NEGATIVE DECLARATION.

York State Department of Environmental Control the subject
revised Site Plan and received approval of same. For your

their regular meeting held on January 21, 1988 regarding the above matter.
Moved by Trustee Bednoski seconded by Trustee Smith
WHEREAS, Wilbur Klatsky on behalf of the Cove at Southold applied to the
Southold Town Trustees for a permit
under the provisions of the Wetland Ordinance of the Town of
Southold, application dated December 4, 1987, and
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a public hearing was held by the Town Trustees with
respect to said application on January 21, 1988 at which time all interested
persons were given an opportunity to be heard, and
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area, and
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE, BE IT
RESOLVED that Wilbur Klatsky on behalf of the Cove at Southold BE AND-HEREBY
IS GRANTED PERMISSION UNDER THE
PROVISIONS OF THE WETLAND ORDINANCE OF THE TOWN OF SOUTHOLD TO:
Construct certain housing units within 75' buffer. Property is located on Main
Bayview Road, Southold. Approval is granted as submitted, the covenants and
restrictions will have to be reviewed by the Town Attorney to insure that they are
truly acceptable in the form of what the Trustees requested for the Town. These
will have to be acceptable to the Town Attorney.

This permit will expire on January 21, 1990 if work has
not commenced by said date. There are two inspections required and
the Trustees are to be notified upon the completion of the work.
Prior to the issuance of said permit by the Clerk, the applicant
shall file with the Clerk a certificate that he has public liability
insurance policies insuring against any liability which may arise
in the performance of the operations pursuant to such permit in such
amount as shall be fixed by the Trustees, which said policies shall
name the Town as a name insured. Please take further notice that
this declaration should not be considered a determination made for
any other department or agency which may also have an application
pending for the same or similar project.
Please remit $10.00 for wetland inspection fees.
PLEASE RETURN TO THE BUILDING DEPARTMENT FOR A DETERMINATION ON

Dear Mr. Goehringer:
Recently several situations have arisen where the Trustees
have made different [t'ypically more stringent]wetland line
determinations than other involved agencies in writing Wetland
Permits.
After thorough discussion at two work sessions, the Trustees
consensus is as follows:
1. Strict observance of our permit restrictions and
mitigation measures is far more important than the
academic question of whose line is "better."
2. Please strictly observe our line for all Town setbacks
where a project was fully coordinated and had the opportunity of
a pre-submission conference with the Trustees/Conservation
Advisory Council.
3. In the case where a pre-submission conference was not
possible, we have no objection of your agency using a wetland
line other than ours provided all Trustee Permit conditions are
adhered to and the reasons for using another agencies line are
chiefly non-wetland in nature.
In closing, the Trustees would like to encourage the use of
joint pre-submission conferences with the personnel of the New
York State D.E.C. for all commercial, subdivisions and
potentially controversial projects so as to avoid any confusion
in the future. Thank you for your cooperation in this matter.

RESOLVED that the Southold Town Trustees DENY the request made by
Wilbur Klatsky on behalf of the Cove at Southold, Inc. for a Waiver of the
Wetland Ordinance for the construction of certain housing units within a 75'
buffer because of the scope of the project, the long environmental assessment
form, and additional items that should be discussed through the application
process and review. The property is located on Main Bayview Road, Southold.
RESOLVED that the Southold Town Trustees declare itself lead agency in
regard to the State Environmental Quality Review Act in the matter of the application
of Wilbur Klatsky on behalf of the Cove at Southold, Inc. for a Wetland Permit on
certain property located on Main Bayview Road, Southold.

Cove" of Southold has requested a varience for their
property. This time for the relocation of the Tennis
Court and Swimming Pool. My Mother (Mrs. Mildred
Dickinson-87 years old) and lives almost across the
street from this proposed 1°cation was not given the

Dear Mr. Murphy,
Several months ago the residents of Southold, and particularly in
Bayview, lost in their efforts to prevent the COVE developers from
building 12 three sto~y towr~house units on designated wetlands.
We lost because the town agencies, by sleight of hand, (changing
ZBA/Board of Trustee jurisdiction to apply retroactively) circum-
vented responsibility in making this important decision.
Now there is a variance proposed to allow construction of tennis
courts and swimming pool in the "front yard" of the COVE condominiums
right across from our restored 1726 home...
The same minds that deemed it an "improvement" and favored 33 three
story luxury homes on 8.4 acres, simply because there existed a cluster
of small, seasonal motel units (obscured from the road by several acres
of locust grove) will be making the determination on this variance.
Have we any reason to doubt that all concessions will be granted to
the developer- bringing the additional noise, night lights and general
intrusion of these privileged people entertaining their friends in their
luxury condos to our door and further ereding our quality of life?
The simple pleasure of walking in Bayview is now prohibitive and a
dangerous pastime. The constant traffic flow is horrendous and the
35mph speed limit is ignored. What will happen when the 33 new
families occupy the COVE condos, and the proposed ANGEL SHORES
development just down the road brings another 50-80 families? In
addition,new single homes are proliferating at an alarming rate in
Bayview.
Take a ride down Bayview Road and see if you think the
"Commack development type" entrance is an "improvement" over the
former view of the locust grove, in what was our residential, agricult-
ural neighborhood.
How mam..y "Town Officials turned development consultants" can Southold
suffer? Why should we have any'confidence that your judgements will
reflect our concerns? When will our town officials have the integrity
to say "NOI! ENOUGHI!" to the developers?
The last Southold town election was a powerful statement in favor
of controlled, sane development. It is up to you to honor that trust.

Pool Location
In consideration of locating the pool adjacent to the entry
road, several mitigation measures must be taken:
1. The sideyard impacts to the adjacent residential lots
must be minimized. The revised grades must be such that
they take into consideration the existing adjacent
properties.
2. An acoustic screen fence or wall must be used to
mitigate noise from the pool area. Additional landscaping
should also be provided as additional screening.
3. No lights, other than those for security reasons, -
should be located in this area.
The Planning Board also requests that all the signs
advertising the project be removed from around the Town.

Appl. NO. 3775 - THE COVE AT SOUTHOLD, INC.
WHEREAS, on August 30, 1988, an application was filed under
Appl. No. 3775 in the Matter of The Cove at Southold, Inc. based
upon Article III, Section 100-32 and Article IX, Section
100-119.1 of the Zoning Code in effect at that time, in the
proposed construction and location of accessory swimmingpool and
tennis court structures as shown on the April 25, 1988 Area
(Site Plan) Map prepared by Henderson and Bodwell; and
WHEREAS, reviews have been made and input received from two
other town agencies for this proposal, to wit: the Southold
Town Planning Board and the Southold Town Trustees (see letters
lastly dated January 12, 1989 and November 1, 1988,
respectively); and
WHEREAS, by letter dated March 14, 1988, the N.Y.S.
Department of Environmental Conservation confirms~ the inclusion
of these accessory structures under Wetland Permit No.
10-84-0118; and
WHEREAS, by resolution adopted January 10, 1989, Local Law
No. 1 - 1989 was adopted by the Southold Town Board concerning
approval of the Master Plan Zoning Updates and new Zoning Maps;
and
WHEREAS, on or about February 2, 1989, the Department of
the Board of Appeals commenced its review of pending appli-
cations for updates under the new Master Plan Zoning Update; and
WHEREAS, under this Department's review, it is noted that
the premises which is the subject of this application has been
re-designated on the new Zoning Maps from the "A" Residential
and Agricultural Zone District to "RR" Resort-Residential; and

Decision Rendered February 9, 1989
WHEREAS, Article VI, Section 100-61C of the new Zoning
Updates permits the subject accessory uses, provided they are
incidental to the residential use of the premises and not
operated for gain; and
WHEREAS, Article III, Section 100-32 under the previous
Zoning Code, applicable to the previous "A" Zone District
designation of this property, was amended to Article III,
Section 100-33 under the new Zoning Update and is applicable to
the following Zone Districts:
"...Agricultural-Conservation District and Low Density
Residential R-80, R-120, R-200 and R-400 Districts..."; and
WHEREAS, Article IX, Section 100-119.2 under the previous
Zoning Code has not been made a part of the new Zoning Code; and
WHEREAS, it has been held by the Courts that the law that
exists at the time of a decision will apply {Alscot Investing
Corp. v. Rockville Centre, 99 AD 2d 754, 471 NYS2d 669 (1984, 2d
Dept.}; (Aversano v. Two Family Use Board, 117 AD2d 665, 498 NYS
NOW, THEREFORE, on motion by Mr. Dinizio, seconded by
Mr. Goehringer, it was
RESOLVED, that for the above reasons, this Board. is without
authority to consider a Variance in the Matter of the Appli-
cation of THE COVE AT SOUTHOLD, INC. as applied under Appl.
No. 3775 (filed August 30, 1988).
Vote of the Board: Ayes: Messrs. Goehringer, Grigonis and
Dinizio. (Absent were: Member Serge J. Doyen and Member Joseph

Once again I Qrevail upon you to deny "The
Cove" of Southold their current request this t~me
a Zoning change to build a swimming pool. To ~ ~
date it would seem our many pleas to you to deny
variances have fallen on deaf ears. The many letters
certainly should indicate the feelings of a great
number of ccncerned people. As a property owner
almost directly across from TKe Cove I can honestly
verify the increase in traffic to this location.
The addition of lights-noise will certainly be a
detriment to this entire neighborhood.
S~ould this request be granted it will definately
affect the chance to rent my house. Will you
please consider my plight. 5'ly livelyhood will be
great~,~menardized should this premit be granted.

Gentlemen:
On October 27, 1988 I attended the Board of Trustees meeting and listened
to the discussion about a location for a swimming pool at the Cove at Southold.
The Trustees were just about equally divided, half made a compelling case
for not locating the pool on the wetlands. The other half made an equally
compelling for not permitting a zoning change to place the pool on the Bayview
Road side of the development.
No one suggested a good location for the pool, for obvious reasons---there
is no good location. Mrs. Scopaz was called into the meeting to present her
views. She felt that a change of zone in this development is not the right thing
to do.
Wouldn't you be fulfilling your job by saying "NO" to this application?

Requests to erect off-premise signs for The Cove subdivision.

In your review of these~applications, keep in mind that
there are a large number of subdivisions that have been approved,and
are under construction, or that are on the drawing boards. Not
all of these subdivisions enjoy prominent road frontage on or near
the major traffic arteries. If these applications are granted,
your Board will have to grant similiar requests to any other subdivi-
der whose development is a little off the beaten track. The end
result over.a period of time is a roadside crowded with directional
and advertising signs. ~ ~ ~
If you find it absolutely necessary to grant these appli-
cations, I strongly recommend that the permission be valid for a
very limited period of time, for example: six months.to a year.
However, even this concession leaves the Zoning Board open to re-
peat applications to extend the permission for an additional six
months, etc.
The traditional methods of advertising, via newspaper ~
advertisements and through real estate brochures, give potential
purchasers sufficient information"to find the properties, hence
my recommendation to deny the above named applications.
REASON FOR APPEAL Continued
1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary HARDSHIP because
The Town Trustees have urged that the pool be located away
from the creek and that there be no significant additional
structures forward of the present building line; the 1-1/2
acre parcel which fronts on Main Bayview Road is the sole
location available for the applicant's swimming pool and
tennis court.
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because
the configuration of the applicant's parcel and restrictions
on location of structures near Corey Creek dictates placing
accessory structures in the front yard of the applicant's
parcel.
3, The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because
the accessory structures in the form of a pool and tennis
court are found frequently in residential areas and do not
alter the residential character of the neighborhood.

1. Reinforcing steel shall be deformed rebate as noted.
